Qualified Person’s Statements and CertificationsAs the qualified person, I certify that:

A phase one environmental site assessment of the RSC property, which includes the evaluation of the information gathered from a records review, site reconnaissance, interviews, a report and any updates required, has been conducted in accordance with the regulation by or under the supervision of a qualified person as required by the regulation.

A phase two environmental site assessment of the RSC property, which includes the evaluation of the information gathered from planning and conducting a site investigation, a report, and any updates required, has been conducted in accordance with the regulation by or under the supervision of a qualified person as required by the regulation.

The information represents the site conditions at the sampling points at the time of sampling only and the conditions between and beyond the sampling points may vary.

As of 2015/04/14, in my opinion, based on the phase one environmental site assessment and the phase two environmental site assessment, and any confirmatory sampling, there is no evidence of any contaminants in the soil, ground water or sediment on, in or under the RSC property that would interfere with the type of property use to which the RSC property will be put, as specified in the RSC.

Ground water sampling has been conducted in accordance with the regulation by or under the supervision of a qualified person as required by the regulation.

As of 2015/04/14, in my opinion, based on the phase one and phase two environmental site assessments and any confirmatory sampling, the RSC property meets the applicable full depth generic site condition standards prescribed by section 36 of the regulation for all contaminants prescribed by the regulation in relation to the type of property use for which this RSC is filed, except for those contaminants (if any) specified in this RSC at Table 2, Maximum Contaminant Concentrations Compared to Standards Specified in a Risk Assessment.

As of 2015/04/14, the maximum known concentration of each contaminant in soil, sediment and ground water at the RSC property for which sampling and analysis has been performed is specified in this RSC at Table 1, Maximum Contaminant Concentrations Compared to Applicable Site Condition Standards.

I am a qualified person and have the qualifications required by section 5 of the regulation.

I have in place an insurance policy that satisfies the requirements of section 7 of the regulation.

I acknowledge that the RSC will be submitted for filing in the Environmental Site Registry, that records of site condition that are filed in the Registry are available for examination by the public and that the Registry contains a notice advising users of the Registry who have dealings with any property to consider conducting their own due diligence with respect to the environmental condition of the property, in addition to reviewing information in the Registry.

The opinions expressed in this RSC are engineering or scientific opinions made in accordance with generally accepted principles and practices as recognized by members of the environmental engineering or science profession or discipline practising at the same time and in the same or similar location.

I do not hold and have not held and my employer CHUNG & VANDER DOELEN ENGINEERING LTD.does not hold and has not held a direct or indirect interest in the RSC property or any property which includes the RSC property and was the subject of a phase one or two environmental site assessmentor risk assessment upon which this record of site condition is based

Introduction This Phase Two Conceptual Site Model has been prepared, in accordance with Schedule E, Part V, Table 1, S6(x) of Ontario Regulation 153/04 (as amended), as part of the Phase Two Environmental Site Assessment (ESA) by Chung & Vander Doelen Engineering Ltd. (CVD) for the RSC Property located at 365 Albert Street, in Waterloo, Ontario (hereinafter referred to as the “Phase Two Property”). The Phase Two Conceptual Site Model (CSM) is based on the findings of the Phase One ESA (file no. E15041, dated April 6, 2015) and the Phase Two ESA (file no. E15041, dated April 30, 2015) conducted by CVD for the Phase Two Property. The CSM is complete with several figures to assist with organizing, presenting and understanding the potential and/or actual environmental concerns related to the soil and ground water at the Phase Two Property. Refer to Figures 1-10 and Appendix A (appended). Figure 1 - Key Plan Figure 2 - RSC Study Area Figure 3 - Borehole Location Plan Figure 4 - APEC Plan Figure 5 - Direction of Ground Water Flow Plan Figure 6 - Cross Section Plan Figure 7 - Cross Section A-A' Figure 8 - Cross Section B-B' Description and Assessment The Phase Two Property is a rectangular-shaped property, 1.06 acres in area, located on the west side of Albert Street, 50 m north of Columbia Street West in an area of residential, commercial and industrial land uses. The Phase Two Property is improved with a vacant three-storey residential apartment building and asphalt covered parking lot. A Key Plan illustrating the Phase Two Property location is enclosed as Figure 1. The legal description of the Phase Two Property is Part of Lot 29, Municipal Compiled Plan 717, City of Waterloo, Regional Municipality of Waterloo. The Phase Two Property was initially developed in 1967 with the construction of the current apartment building. Prior to residential development, the Phase Two Property was vacant and undeveloped agricultural land.

Areas Where Potentially Contaminating Activity Has Occurred The Phase One ESA evaluated the environmental conditions of the Phase Two Property and adjacent properties to identify actual or potential sources of contamination associated with the Phase Two Property and surrounding properties. Based on the result of this investigation, potentially contaminating activities (PCAs) associated with the Phase Two Property and surrounding properties were identified. The PCAs are illustrated in Figure 2 and summarized in the following table:

Fuel underground storage tanks (USTs) are located 250 m west of the Phase Two Property at a Shell service station. Fuel may have potentially been

released to the subsurface if the condition of the tank(s) deteriorated over time. The service station

was developed in the 1970’s. Gasoline contamination was noted in a Bell

manhole in July 1990 and believed to be caused from an UST leak at the 360 Phillip Street service

station. The PCAs are shown on Figure 2.

Subsurface Structures and Utilities Hydro, natural gas and communication (telephone and TV) services extend underground from Albert Street, along the south Phase Two Property boundary and into the south side of the building. Water and sanitary sewer services extend underground from Albert Street to the east side of the building. No contaminants are present at the Phase Two Property, additionally, the shallowest ground water level measured at the Phase Two Property is 5.89 mbgs, sufficiently below the vertical extent of buried infrastructure. Therefore, subsurface utilities on, in or under the Phase Two property are not anticipated to affect contaminant distribution and transport. There is no potential for off-site migration of contaminants at this time. The locations of the underground services are shown on Figure 3. Physical Setting Stratigraphy A total of three (3) boreholes (MW4 to MW6) were advanced on the Site to characterize the underlying soil and ground water conditions as part of the Phase Two ESA. All three (3) boreholes were installed with monitoring wells. Borehole locations are provided in Figure 3. The boreholes were located in the following areas with the following rationale:

• MW4 was located along the north property boundary (APEC-2). The purpose of MW4 was to assess for potential environmental impacts related to a Bell Canada property located north of the Phase Two Property.

• MW5 was located at the southwest corner of the property (APEC-3). The purpose of MW5 was to assess of potential environmental impacts related to an automotive service garage and two (2) gasoline service stations located southwest of the Phase Two Property.

• MW6 was located at the northwest corner of the property (APEC-1). The purpose of MW6 was

to assess for potential environmental impacts related to Raytheon Canada, located adjacent to the northwest of the Phase Two Property.

As determined from the Phase Two ESA borehole logs, the Phase Two Property stratigraphy generally consists of a layer of sandy silt and/or clayey silt to a maximum depth of 2.50 metres below ground surface (mbgs), beneath which is a sand some silt deposit extending to a maximum borehole termination depth of 7.62 mbgs. Bedrock was not encountered in any of the boreholes. A Cross Section Plan is included as Figure 6. Cross Section drawings of the soil stratigraphy are presented in Figures 7 and 8.

Hydrogeological Characteristics The City of Waterloo relies on ground water as a source of potable water. The William Street Pumping Station is located 3.3 km southeast of the Phase Two Property at 17 and 23 William Street East. The Regional Municipality of Waterloo William Street well system is comprised of four (4) ground water wells, located between 190 m and 220 m north of the Phase Two Property. These wells pump directly into the William Street Reservoir and Pumping Station. William Street has a total rated capacity of 193.9 L/sec and a daily maximum water taking of 16,744,960 L. The William Street Pumping Station was built in 1899. The Region of Waterloo has implemented a plan that designates Wellhead Protection Areas around each municipal drinking-water supply well. Within each Wellhead Protection Area one or more Wellhead Protection Sensitivity Area (WPSA) may be delineated. Wellhead Protection Sensitivity Areas (WPSA) are classified from 1 to 8, with WSPA-1 areas being the areas closest to municipal wells and the most vulnerable. According to Region of Waterloo, Map 6a, “Urban Area Source Water Protection Areas”, due to factors including a separation distance of over 2 km to the nearest municipal wellhead, the Phase Two Property is located outside the boundaries of the surrounding wellhead protection areas. According to The Grand River Assessment Report, the technical foundation for the Grand River Source Protection Plan, the Phase Two Property is located in a Wellhead Protection Area (WHPA). WHPAs are classified from A to D, with WHPA-A areas being the closest to municipal wells and the most vulnerable. The Phase Two Property is located in an area designated WHPA-D. WHPA-D delineates areas located within the twenty-five (25) year time of travel capture zone of a municipal well system. The Phase Two Property is assigned an intrinsic aquifer vulnerability category of low based on a calculated Surface to Aquifer Advection Time (SAAT) of greater than or equal to 25 years. Also, the Phase Two Property is located in an area designated with a vulnerability score of 2 (low) and is therefore not a Highly Vulnerable Aquifer (HVA). HVAs located within WHPAs are assigned a score of 8 to 10. The southwest portion of the Phase Two Property is located within an Issue Contributing Area (ICA), regarding issue parameter 14 – storage of snow. The Phase Two Property is not located within a Significant Groundwater Recharge Area (SGRA). Three (3) monitoring wells were installed in the Phase Two Property during the Phase Two ESA. The monitoring wells were installed within the sand some silt deposit. Based on the groundwater records, the groundwater flow direction is generally in a westerly direction, as shown on Figure 5.

The shallow ground water table was observed in a single unconfined sand aquifer. There is no perched water at the Phase Two Property and no evidence of perched water. The ‘horizontal’ groundwater flow velocity through the surficial unconfined sand aquifer can be calculated using Darcy’s Equation and estimates of the hydraulic conductivity, horizontal hydraulic gradient and porosity.

The ‘horizontal’ hydraulic gradient (or water table slope) across the Phase Two Property is estimated to be in the 0.0032 m/m range, based on the interpreted water table contours presented in Figure 5. The ‘horizontal’ hydraulic conductivity (or permeability) of the surficial aquifer is expected to be 1x10-4 m/s, given the nature of the aquifer (e.g., sand to sand some silt). Using a typical ‘effective’ porosity of 0.3, the horizontal groundwater flow velocity through the water table aquifer is estimated to be in the 100 to 200 m/yr range. Approximate Depth to Bedrock The native bedrock was not encountered at the Phase Two Property during this Phase Two investigation, however, according to Ontario Geological Survey, Preliminary Map P.168, “Bedrock Topography Series, Stratford Area”, published by the Ontario Ministry of Natural Resources, bedrock in the vicinity of the Phase Two Property is located at a geodetic elevation of approximately 290 m and the current geodetic elevation of the Phase Two Property is approximately 345 m. It is therefore determined that the depth to bedrock on the property is approximately 55 metres below ground surface. Bedrock would be expected to comprise limestone of the Guelph Formation. Approximate Depth to Water Table Based on the groundwater records for this investigation, depth to the water table at the Phase Two Property ranges between 5.89 mbgs and 6.67 mbgs, corresponding to ground surface elevations 344.79 and 345.76 m respectively. Elevations are relative to the top of a manhole cover in front of 365 Albert Street (as shown in Figure 3) with known geodetic datum elevation of 344.56 m. Section 41 or 43.1 of the Regulation The Phase Two Property is not within/adjacent/part of an area of natural significance and analytical testing indicated the pH of the tested soil samples is between 5 and 9. Therefore, Section 41 of the Regulation (Site Condition Standards, Environmental Sensitive Areas) does not apply to the Phase Two Property. The Phase Two Property is not a shallow soil property, as the bedrock was not encountered within 2 m below the ground surface. A water body is not located on or within 30 m of the Phase Two Property. Therefore, Section 43.1 of the Regulation (Site Condition Standards, Shallow Soil Property or Water Body) does not apply to the Phase Two Property. Soils Placed On, In or Under the Phase Two Property There are no areas where soil has been brought from another property and placed on or under the Phase Two Property. Proposed Building and Other Structures The proposed redevelopment of the Phase Two Property includes the demolition of the existing three-storey building and the construction of two (2) apartment buildings, with ancillary commercial uses, ranging in height from 7 to 13 storeys.

Contamination In or Under the Phase Two Property Based on the findings of the Phase One ESA, contaminants of potential concern in the soil and groundwater with respect to the identified APECs at the Phase Two Property were assessed during the Phase Two ESA. The City of Waterloo relies on ground water as a source of potable water. In accordance with Ontario Regulation 153/04 s. 43.1, the analytical soil and ground water results were compared to the Ministry of the Environment and Climate Change (MOE) Table 2, Full Depth Generic Site Condition Standards in a Potable Ground Water Condition. The proposed use of the property is mixed residential/commercial and therefore, the soil and ground water results were compared to the residential / parkland / institutional property use for a coarse textured soil (herein referred to as the “applicable regulatory standards”). Area Where Contaminants are Present A review of the analytical test results of soil and groundwater at the test locations indicates the tested parameters meet the applicable regulatory standards. Therefore, there are no contaminants identified at the Phase Two Property at a concentration above the applicable Table 2 Standards during the Phase Two ESA. Distribution of Contaminants No contaminants are identified at the Phase Two Property at a concentration above the applicable regulatory standards. Contaminant Medium No contaminants are identified at the Phase Two Property at a concentration above the applicable regulatory standards. Reasons for Discharge No contaminants are identified at the Phase Two Property at a concentration above the applicable regulatory standards. Migration of Contaminants No contaminants are identified at the Phase Two Property at a concentration above the applicable regulatory standards. Temporal, climatic and meteorological conditions do not have a major influence at the Phase Two Property. Soil vapour intrusion is also not a concern at the Phase Two property.
