Qualified Person’s Statements and CertificationsAs the qualified person, I certify that:

A phase one environmental site assessment of the RSC property, which includes the evaluation of the information gathered from a records review, site reconnaissance, interviews, a report and any updates required, has been conducted in accordance with the regulation by or under the supervision of a qualified person as required by the regulation.

A phase two environmental site assessment of the RSC property, which includes the evaluation of the information gathered from planning and conducting a site investigation, a report, and any updates required, has been conducted in accordance with the regulation by or under the supervision of a qualified person as required by the regulation.

The information represents the site conditions at the sampling points at the time of sampling only and the conditions between and beyond the sampling points may vary.

As of 2014/06/19, in my opinion, based on the phase one environmental site assessment and the phase two environmental site assessment, and any confirmatory sampling, there is no evidence of any contaminants in the soil, ground water or sediment on, in or under the RSC property that would interfere with the type of property use to which the RSC property will be put, as specified in the RSC.

Ground water sampling has been conducted in accordance with the regulation by or under the supervision of a qualified person as required by the regulation.

I have, within the six months immediately before the submission of this record of site condition, given written notice of intention to apply non-potable ground water site condition standards to the clerk of the local municipality in which the property is located and the clerk of any upper-tier municipality in which the property is located.

As of 2014/06/19, in my opinion, based on the phase one and phase two environmental site assessments and any confirmatory sampling, the RSC property meets the applicable full depth generic site condition standards prescribed by section 37 of the regulation for all contaminants prescribed by the regulation in relation to the type of property use for which this RSC is filed, except for those contaminants (if any) specified in this RSC at Table 2, Maximum Contaminant Concentrations Compared to Standards Specified in a Risk Assessment.

As of 2014/06/19, the maximum known concentration of each contaminant in soil, sediment and ground water at the RSC property for which sampling and analysis has been performed is specified in this RSC at Table 1, Maximum Contaminant Concentrations Compared to Applicable Site Condition Standards.

I am a qualified person and have the qualifications required by section 5 of the regulation.

I have in place an insurance policy that satisfies the requirements of section 7 of the regulation.

This is in response to your July 31, 2014 notification of the intent to apply non-potable (Table 9) site condition standards in this project (Phase Two Environmental Site Assessment). Please note that there are two criteria upon which the Region can offer input regarding the use of non-potable standards as per O.Reg. 153/04 Sec 35(3) a, b:

(a) the property, and all other properties located, in whole or in part, within 250 metres of the boundaries of the property, are supplied by a municipal drinking water system, as defined in the Safe Drinking Water Act, 2002, and have no wells installed for the extraction of ground water;

(b) the property is either,

(i) not located in an area designated in a municipal official plan as a well-head protection area or other designation identified by the municipality for the protection of ground water, or

(ii) if it is located in such a designated area, the municipality has consented in writing

to the application of the non-potable ground water site condition standards in preparing a record of site condition for the property.

With regard to item (a), Development Services staff notes that municipal water services are available for the subject property and other properties within 250 metres of the subject site. Also, information provided with your request, which was obtained from the Ministry of the Environment’s well records map, indicates that wells in the vicinity of the subject property are monitoring wells installed in December 2013 by Amec and that there are no domestic water wells. With regard to item (b), the Region has not designated well-head protection areas or areas for the protection of ground water in its official plan. We note for your information, however, that

the subject property is located within an area identified by the Niagara Peninsula Conservation Authority (NPCA) through mapping prepared for the Drinking Water Source Protection Plan as a Highly Vulnerable Aquifer. We also note that the property site is adjacent to Foran’s Marine and is located near the lake and Forty Mile Creek, which are identified as Fish Habitat (Critical Type 1 and Fish Spawning Area) on the Regional Official Plan’s Core Natural Heritage Map. As a result, the use of non-potable (ground water) MOE Table 9 SCS is used for the purposes of Section 41 of O.Reg. 153/04 as amended. Accordingly, based on the above, the Region confirms that it does not object to the proposal to use Non-Potable Site Condition Standards for the subject property. The Phase Two CSM for 15 Lake Street, Grimsby is provided below:

Regulatory Requirement Phase Two Property Information

i. Areas where potentiallycontaminating activity hasoccurred, areas of potentialenvironmental concern andsubsurface structures andutilities that may affectcontaminant distribution andtransport.

The location of the Phase One and Two Property is shown in Figure 1. Based onthe findings of the Phase One ESA, APECs and PCAs are associated with thePhase Two Property (Figure 8) due to historical infilling across the entire PhaseTwo Property and the maintenance and repair facility with associated UST to thesouth of the Site (approximately 210 m south and associated with Foran’s Marine).

As discussed above, based on the findings of the Phase One ESA, PCAs andAPECs associated with the property are as follows (Figure 8):

- APEC/PCA #1 – Historic infilling;

- APEC/PCA #2 – Boat Maintenance and Repair; and

- APEC/PCA #3 – Current UST.

Subsurface features that may affect contaminant distribution at the Phase TwoProperty include inactive storm and sanitary sewers and an inactive water main atthe southwest end of the Phase Two Property as depicted on Figure 2. The relativewater level elevation ranged from 99.42 (BH/MW2) to 98.55 (BH/MW3) mAAD. Theinferred ground water flow within the native silty clay/clayey silt/sandy silt till isinferred to be to southeasterly (Figure 5).

No previous RSCs have been filed on this Phase Two Property. The RSC #s 45918and 45498 are registered on adjacent properties to the current Phase Two Property.

ii. Description and figuresillustrating the physicalsetting of the propertyincluding, stratigraphy,hydrogeologicalcharacteristics, depth tobedrock, depth to watertable, aspect related toSection 41 or 43.1 that applyto the property, areas wheresoil has been brought ontothe property, location of anyproposed buildings.

The stratigraphy at the Phase Two Property is depicted on the cross sections(Figures 3 and 4) and in general, the subsurface conditions consisted of fill materialconsisting of sand and gravel (BH/MW1) to depths of 0.7 mbgs or granular fill(TP100) to depths of 1.2 mbgs over sandy silt/silty sand with clay or silty clay/clayeysilt fill to depths ranging from 3.7 to 5.8 mbgs overlying native silty clay/clayeysilt/sandy silt till to depth. No deleterious materials were noted in the testpits orboreholes.

Visual or olfactory evidence of environmental impacts were not observed by AMECduring the testpitting and drilling programs.

COV and TOV concentration headspace measurements recorded in the soilsamples collected from the boreholes and testpits ranged from non-detectable to 50ppm.

A small building was present at the northwest end of the Phase Two Propertyoccupied by the Grimsby Auxiliary Marine Rescue Unit as a radio monitoring station.According to the Phase One ESA, no former buildings were present on-site. Theowner will construct residential condominiums but the plan of subdivision is notfinalized. This small rescue building which is not used and is not in the areas withCOCs and therefore, on-Site vapour intrusion is not considered a concern at thePhase Two Property.

The overburden in the vicinity of the Phase Two Property is interpreted to be HaltonTill of the Ontario-Erie Lobe, consisting of predominantly silt to silty clay matrix, highin matrix carbonate content and clast poor. Bedrock in the area is anticipated to beof the Upper Ordovician age, consisting of shale, limestone, dolostone and siltstone

of the Queenston Formation. Bedrock in the vicinity of the Phase Two Property isanticipated to be approximately 1 to 7 mbgs inferring bedrock is anticipated to beencountered at approximately 68 to 74 mASL.

The regional ground water flow direction, based on topographic features andknowledge gained from other sites in the area, is expected to be to the north,towards Lake Ontario. Locally, however, the shallow ground water flow may beinfluenced by underground utility trenches, conduits, and structures, variations insoil type, and minor fluctuations in topography. As shown in Figure 5, theinterpreted ground water flow is southeasterly based on hydrogeological testing.

There are areas of natural significance located in the area of the Phase TwoProperty. The land surrounding Forty Mile Creek adjacent to the west of the PhaseTwo Property, as well as the south shoreline of Lake Ontario, are listed in the Townof Grimsby’s Official Plan as Environmental Conservation Area. However, thePhase Two Property is not considered to be an area of natural significance. Thereare no conditions that would apply to the Phase Two Property under Section 41(Environmentally Sensitive Areas).

The water level measurements undertaken in BH/MW1, BH/MW2, and BH/MW3 onFebruary 6, 2014 ranged from 1.82 to 2.21 mbgs. The relative water level elevationranged from 98.42 (BH/MW2) to 98.55 (BH/MW3) mAAD. The inferred groundwater flow within the native silty clay/clayey silt/sandy silt till is inferred to besoutheasterly (Figure 5).

AMEC completed falling head slug tests to assess the hydraulic conductivity of thescreened substrata in BH/MW1, BH/MW2 and BH/MW3. The estimated hydraulicconductivities of BH/MW1, BH/MW2 and BH/MW3 were 2.7x10-6 m/s, 1.3x10-7 m/sand 7.9x10-6 m/s, respectively. The horizontal gradient is 0.024 m/m and the verticalhydraulic gradient was not determined as only one geologic unit was investigated.

The standards used for the identification of COCs were Table 9 SCS for use within30 m of a water body, non potable ground water condition,residential/parkland/institutional and medium and fine textured soils.

iii. Contaminants on the Site The contaminants located on the Phase Two Property and their origin are as follows: Metals (cadmium, lead and/or zinc) and available boron in BH/MW1,

TP109 and TP110 associated with the historical infilling of the Phase TwoProperty.

Metals (antimony, cadmium lead and/or zinc) and EC in BH/MW2, TP105and TP108 associated with the historical infilling of the Phase TwoProperty.

PHC F3 and F4 in BH/MW1 and TP100 associated the historical infilling ofthe Phase Two Property.

The Acid, Base, Neutral parameters group was not considered a COC and thereforewas not analyzed. No exceedances of the Table 9 SCS for metals, VOCs and PHCswere noted in ground water in the Phase Two ESA.

Contaminants that exceeded the Table 9 SCS on the Site in soil are depicted onFigures 3, 4 and 6. The COCs in soil are likely attributed to the former infilling of

the Phase Two property. The estimated and actual horizontal and verticaldistribution of the contaminants in each area is indicated on Figures 2, 3 and 4.Based on the soil analytical results from the Phase Two ESA, a SRP was completedat the Site. The horizontal and vertical delineation of COCs and the distribution ofmetals, EC, available boron and PHC F3 and F4 exceeding Table 9 SCS on-Site(Figures 3, 4 and 6) correspond to the locations of the historical infilling on-Site.

Based on the delineation testpitting program completed as part of the Phase TwoESA, the separation distance between boreholes/testpits with no Table 9 SCSexceedances and boreholes/testpits with Table 9 SCS exceedances, AMECestimated the amount of PHC, EC, available boron and metals-impacted soilrequired to be removed for off-Site disposal to be 831 tonnes. Based on actual fieldobservations and lab results, a SRP was completed at the Site and included theremoval of approximately 1,056 tonnes of PHC, EC, available boron and metals-impacted soil to a Ministry of the Environment and Climate Change (MOECC)licensed landfill (Niagara Waste Systems Limited – Atlas landfill in Welland, ON).Confirmatory soil sampling and soil vapour readings at the limits of the soilremediation excavations were below the Table 9 SCS for the COCs (metals, EC,PHCs and available boron). The location of the confirmatory sampling and soilvapour readings are indicated on Figures 11 and 12. The remedial excavation wasbackfilled with granular material from a local quarry.

The transport of these COCs in the surface would be influenced by seasonalfluctuations in ground water elevation as well as the underground utilities and arenot expected to have had a significant effect on the horizontal and verticaldistribution of contaminants.

iv. Cross-Sections anddistribution of contaminants,depth to water, stratigraphy,subsurface structures orutilities affecting distribution.

For areas of contamination,release mechanisms,transport pathways,receptors, exposure pointsand routes of exposure.

The cross-sections provided on Figures 3 and 4 identify the depth to water (rangedfrom 1.82 to 2.21 mbgs), stratigraphy (fill over native silty clay/clayey silt/sandy silttill) and that there are no significant subsurface features that affect distribution ofcontaminants. The horizontal and vertical distribution of contaminants is indicatedin Figures 3, 4 and 6.

Figures 9 and 10 illustrate the Human Health and Ecological Exposure ConceptualModels. The models are described as follows:

Ingestion by Plants and Prey

Human and Ecological Receptors:Potential human receptors include future residents and visitors and constructionworkers and potential ecological receptors include terrestrial plants, invertebrates,mammals and birds.

Receptor Exposure Points:Human exposure (resident, visitor) to COCs in soil via dermal contact, ingestion,inhalation of indoor and outdoor air. No contaminants were found in ground waterand no complete exposure pathway is present.

Ecological exposure (terrestrial plants) anticipated through root update, inhalationvia wind erosion and volatilization in ambient air. The exposure to COCs byterrestrial invertebrates is expected through soil ingestion, dermal contact andinhalation of volatiles in ambient air. The exposure to COCs of terrestrial mammalsand birds is expected through soil ingestion, dermal contact, ingestion of plans andprey, inhalation via wind erosion, inhalation of volatiles in ambient air. Nocontaminants were found in ground water and no complete exposure pathway ispresent.
