Project History Application for $450,000 towards construction of approximately

10,000 feet of track.– 2,600 carloads annually– $10.4 Million in facility investment and expansion– $ 2.1 Million in on-site rail infrastructure improvements

First application rejected: Per a letter dated November 16, 2009, work was already underway. DRPT contract administration prohibits grant reimbursement of expenses incurred prior to CTB Allocation of funds and approval of a final Scope of Work by the Department.

Second application received after discussions with DRPT and Board Member, Dr. Davis. Completed application brought to Board for Special Consideration.

Special Consideration by CTB The Department evaluated the second application:

– 54 points out of 100– Anything above 50 points meets threshold for recommendation– Again, original application denied because construction was underway

before application

– DRPT contract administration does not allow for costs incurred prior to a Notice to Proceed or a Letter of No Prejudice

– Frederick County has endorsed the Application by Resolution dated February 23, 2011

– Project funding can only move forward with special exception andaction by the Board

DRPT’s contract administration does not allow for project costs incurred prior to issuance of a Notice to Proceed or issuance of a Letter of No Prejudice. As an economic incentive program, projects already underway or complete are ineligible for consideration.

At the recommendation of the Staunton District Board Member; and, with CTB passage of a special exception, DRPT will advance funding to a project that otherwise has not received DRPT staff recommendation for approval in accordance with program administration procedures.
