Trying to save a few hundred dollars on a ‘do it yourself’ will kit from the newsagent is often a false economy, as one recent case we know of shows.

A client had recently lost his father and presented a DIY will kit that his father had purchased from the post office for less than $30. It was clear that the father wanted to provide a gift to his two sons but the way in which he had drafted the will (without legal advice) meant that his entire estate went to one son and the second son got absolutely nothing.

To make matters worse, the father subsequently discovered his error but instead of having a replacement Will professionally prepared, he relied on another DIY kit. This time the gift clause was drafted in a way that includedboth sons, but unfortunately the father failed to execute the second Will properly, and the Will was consequently invalid.

The first Will (which left everything to one son and nothing to the other) remained the only valid Will at the time of the father’s death. Needless to say, the Will was challenged.
