2. MEDICAL REIMBURSEMENT
a) To consider and approve the application dated 27.09.2012 submitted by Mr. Muhammad Farhan, Driver, CBC where in he has requested for grant of Medical reimbursement amounting to Rs.2,37,562/- incurred by him on his medical treatment through a private Hospital at Liaquat National Medical Hospital, Karachi. The said case has been recommended by Medical Reimbursement Committee vide its meeting held on 21.01.2013 at S.No.9.
The medical bills have been duly verified by Senior Medical Officer, CBC Health Centre, Phase-II, DHA, Karachi.
b) To consider and approve the application dated 22.03.2012 submitted by Mr. Jamil Ahmad, Peon, CBC wherein he has requested for grant of Medical reimbursement amounting to Rs.63,760/- incurred by him on medical treatment of his son through a private hospital at A.O Clinic, Karachi. The said case has been recommended by Medical Reimbursement Committee vide its meeting held on 21.01.2013 at S.No.15.
The medical bill has been duly verified by Senior Medical Officer, CBC Health Centre, Phase-II, DHA, Karachi.

c) To consider and approve the application dated 21.05.2012 submitted by Mr. Waqar-ul_Hassan, Asstt. Revenue Supdt. (Retd) has requested for grant of Medical reimbursement amounting to Rs.34,172/- incurred by him on medical treatment of his wife through Dow University Hospital, Karachi. The said case has been recommended by Medical Reimbursement Committee vide its meeting held on 21.01.2013 at S.No.20.
The medical bill has been duly verified by SMO CBC health centre, Phase-II, DHA, Karachi.

RESOLUTION: The Board considered the agenda and approved. The cases be sent to competent authorities for sanction.

In this connection it is brought to the notice of the Board that vide above referred CBR the period of 1 x Sanitary Vigilance Inspector and 6 x Assistant Sanitary Vigilance Inspectors was renewed for further one year in order to monitor and levy fine on contractors/residents not ensuring general cleanliness etc, within CBC limits. Their services are still required for efficient working of the IWMP / Sanitation Branch

7. PURCHASE OF SKIP BINS

To consider and approve the purchase of 200 Skip Bins from M/S. Pakistan Steel Fabricating Company Limited. It may be mentioned here that earlier 100 skip bins as per details below were approved by the Board vide CBR No.45 dated 19.07.2012 @Rs.11976/-

It is for their maintained that Cantt Board vide CBR No.8 dated 03.01.2013 approved the purchase of 200 skip bins from M/S. Pakistan Steel Fabricating Company Limited at already approved rates of Rs.11,976/- per skip bin. M/S. Pakistan Steel Fabricating Company Limited were therefore issued supply order vide this office No. CBC/Sanitation/435 dated 24.01.2013.
M/S. Pakistan Steel Fabricating Company Limited vide letter No. PSF/DGM PSFCL/2013/128 dated 04.02.2013 have showed inability to supply 200 skip bins at old rates and offered the supply of skip bins @Rs.18,000/- per skip bin. It will not be out of place to mention here that rates offered by M/S. Pakistan Steel Fabricating Company Limited @Rs.18,000/- per skip bin are still reasonable. Total expenditure involved would be Rs.36,00,000/-.
RESOLUTION: The Board considered and resolved that the rates quoted by M/S
Pakistan Steel Fabricating Company Limited be re-negotiated as
the rates received are much higher than earlier approved rates of
the Board. Also the quantity should be reduced upto 100 skip bins.
8. PURCHASE OF DELTANOR FOR FUMIGATION
To consider and approve the purchase of the following insecticide from M/s. Jaffer Brothers (Pvt.) Ltd on retail price for fumigation in DHA/CBC area. The said insecticide shall be purchased directly from M/s. Jaffar Brother (Pvt) Ltd being manufacturers.

11. GRANT OF LEASE OF PLOT NO.C-81/23, PUNJAB COLON, BAZAR AREA, CLIFTON CANTONMENT.
To consider the application submitted by the M/s. Muhammad Yaqub & Wahid Bux. M/s. Muhammad Yaqub S/o Shadi Khan & Wahid Bux S/o Allah Bux, has submitted “Sch-V” form (Application Form for Lease) duly verefied / signed by the Councilor Anwar Khan Niazi, for grant of lease of plot No.C-81/23, measuring 82.84 Sq. yards (Residential-cum-Commercial Purpose) situated at Punjab Colony, Bazar Area, Clifton Cantt.
They have also submitted KESC Bill and KESC statement dated 21-12-1983, Old NICs as a proof/evidence of his occupation prior to 23.03.1985, as a original occupier.
The case was placed before the Board. The Board vide CBR No.7 dated 30.06.2000, had pended the case till the finalization of widening of Kh-e-Jami Road. Now Kh-e-Jami has been up graded and there is as such no issue for grant of lease of subject plot.
The site has been checked by the LS/ALS and reported / certified there are no encroachment, illegal construction and violation involved at site.
A public notice was also published in “Daily Jang” dated 16-1-2013 and “Daily Express” dated 16-1-2013 for inviting objection against grant of lease in respect of plot No.C-81/23, area measuring 82.84 Sq.yards situated at Punjab Colony, Bazar Area, Clifton Cantt in favour of M/s Mr.Muhammad Yaqub S/o Shadi Khan & Mr. Wahid Bux

S/o Allah Bux, but no objection has been received from any person/authority as yet. . It is pointed out that the case was placed before the Bazar/Lease Committee for consideration. The committee after detailed scrutiny has recommended / approved the case for grant of lease in favour of applicants vide item No.01 dated 07.02.2013.

12 . APPLICATION FOR REGULARIZATION OF PROPERTY BYGRANTING OF LEASE IN SCH VIII OF CLAR 1937 IN KATCHI ABADI, LOWER GIZRI, BAZAR AREA, CLIFTON CANTT.
To consider the application dated 14.06.2010 submitted by M/s. (1) Faisal S/o Shehzada Saleem & (2) Faisal Ahmed S/o Sultan Ahmed, regarding grant of lease of plot No.G-9/5, Lower Gizri, Bazar Area, Clifton Cantt.
Plot No. G-9/5, measuring 48.00 Sq. yards (Commercial) situated at Lower Gizri, Bazar Area, Clifton Cantt was originally occupied by Mr. Muhammad Aslam S/o Haji Dost Muhammad. Who expired on 28.9.1999, as per death certificate.
The deceased left behind seven legal heirs as per heirship certificate issued by Justice of Peace dated 18.03.2009, namely 1) Mst. Rasool Be (Widow), 2) Mst. Wakif Sultana (Daughter), 3) Mst. Wajib Sultana (Daughter), 4) Mst. Rabia Sultana (Daughter), 5) Mst. Shafqat Sultana (Daughter), 6) Mst. Farah Naz (Daughter), 7) Mst. Fakhar Naz (Daughter), all legal heirs of deceased sold out the property to M/s.(1) Faisal S/o Shehzada Saleem & (2) Faisal Ahmed S/o Sultan Ahmed through sale agreement dated 30.01.2010.
Now M/s. (1) Faisal S/o Shehzada Saleem & (2) Faisal Ahmed S/o Sultan Ahmed
have applied for grant of lease for Commercial purpose in respect of property No.G-9/5,
Lower Gizri, Bazar Area, Clifton Cantt in their favour. They have submitted Sch-V form
and copy of KESC bill the meter tariff is commercial, KESC statement / record meter
installed at site dated 18.07.1983 and Old NIC of Muhammad Aslam S/o Dost Muhammad
dated 04.10.1979, as proof / evidence of his occupation prior to 23.03.1985.
A public notice was published in “Daily Jang” dated 21.05.2010 for inviting objections against grant of lease in respect of plot No.G-9/5, area measuring 48.00 Sq. yards situated at Lower Gizri, Bazar area, Clifton Cantt in favour of M/s. (1) Faisal S/o Shehzada Saleem & (2) Faisal Ahmed S/o Sultan Ahmed but no objection has been received from any person / authority as yet.
The site has been checked LS/ALS and certified that no encroachment, illegal construction, and violation are involved at site. It is pointed out that the case was placed before the Bazar/Lease Committee for consideration. The committee after detailed scrutiny has recommended / approved the case for grant of lease in favour of applicants vide item No.02 dated 07.02.2013.

13. GRANT OF LEASE OF PLOT NO.G-10/10-A, LOWER GIZRI, BAZARAREA, CLIFTON CANTONMENT.
To consider the application submitted by Syed Mehboob Shah on Schedule “V” form regarding grant of lease of plot No.G-10/10-A, Lower Gizri, Bazar Area, Clifton Cantt.
Plot No.G-10/10-A, measuring 66.18 Sq. yards (Commercial Purpose) situated at Lower Gizri, Bazar Area, Clifton Cantt was originally occupied by Syed Muhammad Kho S/o Syed Muhammad Ali.
Syed Muhammad Kho S/o Syed Muhammad Ali, Gifted the un-leased property to his real son Syed Mehboob Shah through un-registered Declaration of Gift dated 15.04.2006.
Now Syed Mehboob Shah S/o Syed Muhammad Kho, has applied for grant of lease in his favour. He has also submitted KESC Bill, PTCL Bill, Receipt of Income Tax return, Verification letter from Muntizma Committee, New CNIC and Old NIC dated 16.03.1978, as a proof/evidence of occupation of Syed Muhammad Kho, prior to 23.03.1985 as an original occupier.
A public notice was published in “Daily Express” dated 13.10.2012 for inviting objections against grant of lease in respect of plot No.G-10/10-A, situated at Lower Gizri, Bazar area, Clifton Cantt in favour of Syed Mehboob Shah S/o Syed Muhammad Kho, but no objection has been received from any person / authority as yet.
The site has been checked by the LS/ALS-I and reported / Certified that no encroachment, illegal construction and violation are involved at site. It is pointed out that the case was placed before the Bazar/Lease Committee for consideration. The committee after detailed scrutiny has recommended / approved the case for grant of lease in favour of applicants vide item No.03 dated 07.02.2013.

Reference: CBR No.11 dated 9-12-2006. To consider the revision of rates and slab for fee being charged for temporary installation of generator sets within the jurisdiction of Cantonment Board Clifton. In this regard, it is apprised that in compliance of CBR referred to above, at present the said fee is being charged as per following rates / slab:-

To consider an application dated 23-10-2012 submitted by M/s The Royal Rodale property bearing No.TC-5, 34th Street, Phase-VI, DHA, Karachi, requesting therein to waive off non connection charges against the said property as water connection does not exist in the said premises. In this connection it is apprised that, to settle the audit para, recovery notice under section 259 of the Cantonments Act 1924 was served but the occupant of the said premises stated in the court that the water connection does not exist in the premises and requested to delete the same. The committee was constituted comprising DHA and CBC senior Officials to settle the issue, after discussion the committee recommended on 16-05-2008 to issue bill of non-connection charges for Rs.5,50,000/- instead of water charges for the period from Nov-1998 to 30-06-2008 as no connection exist. To consider the proposal of revision of assessment of commercial areas within the jurisdiction of Cantonment Board Clifton on the basis of ‘fair letting value’ as required under section 64 (b) of the Cantonments Act, 1924. In this regard, it is apprised that the rental value of commercial properties have been increased manifold over the years but the assessment has not been revised at par with the said increase which is mandatory to be revised in accordance with Section 71 (I) (d) of the Cantonments Act, 1924. On the other hands, owners / occupants / tenants are reluctant to disclose their rent agreement. Now it is proposed that the revision of assessment of commercial properties falling in different zones may be made keeping in view of the market rental valve and according to the commercial potential of the area. In this regard, it is apprised that the notice required regarding vacation of property for consideration of exemption under section 76 of the Cantonments Act 1924 had been given by the owner of the said units. The concerned staff of revenue branch has also visited the site and reported that the said units are still lying vacant and recommended that the exemption as per detail mentioned below may please be considered. i. 22. SUSPENSION / CANCELLATION OF ENLISTMENT / REGISTRATION
OF ARCHITECT MR. ABDUL ALEEM FROM CBC PANEL.
Ref:- DHA letter no. DHA/TP&BC/107-Gen/Bldg dated 07-02-2013
To consider the DHA letter referred above dated 07-02-2013 regarding suspension of enlistment / registration of Mr. Abdul Aleem from panel of CBC. The contents of the letter are reproduced as under:-
“It is intimated that Mr. Abdul Aleem (Architect) has been enlisted in list of architect on panel of CBC for the year 2012 but the drawing submitted / vetted by him under his signature are not as per BC&TP regulations 2011. These drawings are repeatedly objected and returned to owner, which causes lot of inconvenience to owner besides wastage of precious time and efforts in processing of building plans by DHA. Competent Authority has observed this anomaly seriously and desird to consider Mr. Abdul Aleem and his firm for suspension / cancellation from CBCs architect panel list. ”
Note: Architect Abdul Aleem has been called in person in Building Committee for inquiry / clarification.

After hearing the point of view of the architect wherein he stressed to give a chance to him and assured the committee that the mistakes shall not be repeated again, the Committee recommends to continue his enlistment as architect with CBC for further 90 days. If the architect fails to fulfil his committent, his license will be cancelled.
RESOLUTION: The Board considered the recommendations of the Building Committee and approved the same. The Architect be informed accordingly.

24. ENHANCEMENT IN VETTING FEES / CHARGES OF CANTONMENT BOARD PROJECTS.
Reference:- (i) Application dated: 03/01/2013 submitted by Liaq-Ul-Islam on behalf of Association of Consulting Engineers (Pakistan) &
(ii) The Building Committee held on 04-01-2013 & 21-01-2013. ii. To re-consider the case regarding enhancement in vetting fees of structural Engineers. The case was already placed before the Building Committee twice times in response of application submitted by Liaq-Ul-Islam on behalf of Association of Consulting Engineers (Pakistan.) regarding enhancement in vetting charges paid to proof vetting Engineer. The contents of the application are reproduces as under please:-
� The vetting charges of Rs. 0.50 per sft was set by both Cantonment board and KBCA about 15 years back, after which the cost of all items have increased ten fold. In view of this the SBCA has increased its rate to Rs. 10/- per sft (Rs. 5/- for vetting Engineer and Rs. 5 retained by SBCA) minimum of Rs. 25,000/- about one month back, it was increased to Rs. 2/- about 5 years back from Rs. 0.50/-

� Therefore it is requested in order to get proper vetting from Senior Structural Consultants, rate of Clifton Cantonment Board should be also be increased in similar manner. Rs. 3000 to 4000/- for a B+G+4th floors building of 100 sq yds is not appropriate in our opinion.
� Soil investigation to be conducted before architectural planning. � Some law to be devised which creates fear of blacklisting. � It should be analyzed how much jobs can be handled by a Soil / Structural
consultant within a period of 01 month. If a consultant is performing more than he should be called for an explanation.
� CBC enlistment and renewal fees are too high Rs. 25,000/ compared to SBCA Rs. 2,000/- for Structural Engineers and Rs. 25,000/- compared to SBCA Rs. 15,000/- for Proof Engineers.”
iii. In this connection it is relevant to mention that the case was placed before Building Committee in its meeting held on 04-01-2013 the committee resolved as under:-
“The Engineers and builders may be called for meeting on the next Building Committee meeting. Representative of Sindh Out-door Advertising Associations should also be called for consultation on rates for vetting of Billboards”
iv. In the light of Building Committee’s Resolution this office has called the associations / Nominees of ABAD, DBA, SBCA ACEP, Vetting Engineers & officials of this office in the building committee in order to discuss the issue & all the members attend the meeting held on 21-01-2013 & after detailed discussion & deliberation it was decided to devise a fee slab for next Building Committee.
v. It is pertinent to mention that ABAD has requested vide letter no. ABAD/CBC/13-0080 dated 21-1-2013 that the vetting fees which is currently 50 paisa p.s.f and and if it has to be increased it should be up to Rs. 1.50/ per sft
vi. Now this office has worked out a very user friendly Fee Slab hereinbelow keeping in view the plot size for small projects G+4 floors & for bigger size of high-rise projects as per sft.

These drawings are repeatedly objected and returned to owner, which causes lot of inconvenience to owner besides wastage of precious time and efforts in processing of building plans by DHA. Competent Authority has observed this anomaly seriously and desires to consider Syed Tehseen Ahmed and his firm for suspension / cancellation from CBCs architect panel list. Detail of objection / observations in respect of plot no. 44-C, Kh-e-Bokhari, Ph-VI, is also attached as Annex-A to this letter.”
Note: Architect Syed Tehseen Ahmed has been called in person in Building Committee for inquiry / clarification.

Recommendations of the Building Committee held on 08-03-2013:- The architect agreed to the observations and has apologized for his negligience and as it is first mistake, has promised to be more vigilant. Architect is put on warning / observation for 6 months as of 8th March 2013. RESOLUTION: The Board considered the case alongwith recommendations of the
Building Committee and approved the same. The Architect be informed accroingly.
(j) COMPLETION PLAN FOR APPROVAL OF CANTONMENT BOARD
CLIFTON PLOT NO. A-2-A/II, SOUTH SEAVIEW AVENUE, PH-II, DHA . Reference: (i) MEO letter No. K-15/PDSO/8000/06 dated: 15-11-2012
(ii) RHQ letter no. 6/153/DKR/Clifton/39 dated 07-012013 (iii) An application dated 04-03-2013. To consider the It is reported that the lessee of the subject property has submitted an application referred above addressed to the Add. Director, TP&BC, DHA copy forwarded to this office wherein he has ventilate his concerns against the composition of un-authorized construction of the subject property. The contents of the application are reproduced as under:-
“With due respect, it is brought to your kind notice that DHA after approval of completion plan of above metioned plot forwarded it to Clifton Cantonment Board vide their letter no. DHA/TP&BC/N-1196 dt: 12-01-2012 but same was returned back by CBC vide letter dated 09-03-2012 that excess area has ben constructed by the lessee. DHA authorities informed the CBC authorities vide their letter no. DHA/TP&BC/N-1196 dt: 22-03-2012 that approval for additional area was granted to the owner vide their no. DHA/TP&BC/N-1196 dt: 16-06-2009 and approval may be accorded accordingly. CBC issued a demand notice after lapse of 08 months for recovery of composition fees Rs. 48840/- (photocopy enclosed) for the additional excessive area. The compostion fee has been imposed without any fault of the lessee / owner whereas proper approval was obtained from the Competent Authority of DHA. Yours authorities are requested to approach the CBC authority for withdrawal of demand notice for recovery of composition fees which which has been imposed illegally. Hope my request will be considered sympathetically and early action will be taken to settle down the matter.”
In this context, tt is relevant to mention that the Completion Building Plans of subject property was forwarded by DHA Karachi vide their letter dated 12-01-2012 as a “No violation case”. The technical staff of this office has checked the completion plan in accordance with the approved building plan and found the following deviations regarding covered against approved building plan.

Thereafter, the completion plan of subject property was returned to DHA vide this office letter no. CBC/BC/A-2-A/II, South Seaview Ave/1191 dated 09-03-2012 for rectification. The DHA vide their letter also referred above dated 22-03-2012 returned the same stating therein the reason that excessive covered area of first floor is already permitted vide their (DHA) letter no. DHA/TP&BC/N-1196 dt: 16-06-2009 (photocopy attached). It is relevant to mention that the case was placed before building Committee meeting held on 17-04-2012 and Committee resolved as “ The Committee may be detailed by the Board, to evaluate and suggest resolution of deviations, approved by DHA, upto / within allowable area of a plot” Consequently the case was placed before Board in its meeting held on 09-05-2012 and the Board vide CBR no. 37 (j) resolved as “ Considered and resolved that the Building Committee may re-consider the cases under provisions of the Cantonment Act, 1924 and as per Bye-laws framed under this Act, then re-submit recommendations for consideration of the Board.”
Thereafter, the case was again placed before Building Committee meeting held on 14-09-2012 & the Committee resolved as under:-
“It is recommended to take a lenient view in this regard as the DHA was on-board during course of construction. Being not in conformity with the legal requirement of CBC, least minimum Composition fee be imposed”.
Consequently the case was placed before the Board in its meeting held on 27-09-2012 & the Board vide CBR no. 36(l) dated 27-09-2012 & the Board resolved as under:-
“The Board agreed with the recommendation of the Building Committee and approved composition to be calculated on formula as decided vide CBR No. 31 of this Board meeting subject to necessary formalities and concurrence of the Competent Authority, wherever required.”
In the light of SOP approved by the Board vide CBR No. 31 dated 27-09-2012 this office calculated composition fee @10% same is mentioned below including area of stair towerr:-

RESOLUTION: The Board considered the proposal along with recommendations of

However, the Board further resolved that in order to avoid any such complications, henceforth DHA should send the revised plans at the time of submission of the same so that residents are spared from the payment of composition fee at the completion stage.
29. PROPOSED SUB-DIVISION OF DEMOLISHED OPEN PLOT NO.

To consider MEO Karachi, letters No. K-15/PDSO/6298/9 dated:
28/02/2013 regarding grant of NOC from municipal point of view to the proposed sub-division of Plot No. 63, 21st Street, Ph-V, DHA, Karachi measuring 982 Sq.Yds into two separate plots i.e . 63, 21st Street, Ph-V, DHA, Karachi measuring 491 Sq.Yds & 63/I, 21st Street, Ph-V, DHA, Karachi measuring 491 Sq.Yds. The DHA Karachi vide letter No. DHA/TP&BC/AF-3649 dated 04/03/2013 has also furnished the NOC in this regard. RESOLUTION: The Board considered the proposal on agenda side and approved
the same.
30. ENLISTMENT AS CONTRACTOR To consider the application of the contractor /firm for enlistment as contractor in CBC. The Engineering Branch has scrutinized their documents and recommended their enlistment as Cantonment Board contractor in category mentioned against the name of each firm: -

To consider an estimate amounting to Rs.11,41,951/- sent by the KESC in
response of this office letter No. CBC/29/WS/10270, dated 20.12.2012 regarding shifting of electric connection bearing No.BL.001240 from load shedding zone to Non-load shedding zone at Ghazi Pumping Station ( Chakra Goth). RESOLUTION: The Board considered and approved Rs.11, 41, 951/- for shifting of
electric connection from Load Shedding Zone to Non-Load Shedding Zone.

HORDING BRANCH 32. REVAMPING OF WATER SEWERAGE WATER TREATMENT PLANT .
To consider an estimate of Rs.24.00 (M) for revamping of sewerage water treatment plant located at Qublie Khan Phase-V, DHA, and Karachi.
In this context, it is relevant to mention that an amount of Rs.64.00 (M) was earmarked in budget estimates 2012-2013 for the construction of sewerage treatment plant at said location in the light of the directives issued by honorable Supreme Court of Pakistan in Environmental pollution case No.14 of 1992, 11 of 1994, 30 of 1994 and 3747 of 2006 for disposal of raw sewage in Sea.
Consequently, the existing abandoned treatment plant has been thoroughly studied and revamping of the existing are considered feasible and economical.
All connected papers are placed on the table. RESOLUTION: The Board discussed the point and observed that with this new
proposal the long desired revamping of the Sewerage Water Treatment Plant would be made possible in a shorter period of time, as well as the Board would be able to save Rs. 56 (M) which would be a considerable saving.
The Board, therefore approved the proposed estimate of Rs. 24.00 (M) for revamping subject to concurrence of the competent financial authority.
33. REFUND OF PAYMENT ON ACCOUNT OF HOARDING.
To consider the request of M/s Cubes for re-fund of payment, in this regard it is apprised that a hoarding measuring 60’ x 20’ was allotted to M/s Cubes Advertising at Do Talwar, Block-9 vide this office letter No. CBC/ADV/2 dated 29-03-2008 and renewed for a period of further one year from 05-05-2009 to 04-05-2010 vide this office letter No. CBC/ADV/5402 dated 06.05.2009 subject to following terms and conditions:

The said Advertiser (M/s Cubes) is requesting for re-fund of payment made for the 2nd quarter Rs. 7,68,900/- vide Cantt 4-B No. 73/4070 dated 27.04.2010 as his contention is that the Cantonment Board Clifton has removed the site in Aug-2009 due to Non-payment, whereas, as per record there is no any correspondence made regarding cancellation of said hoarding as the company can not fulfill the financial requirements. However, the case for re-fund of payment made for second quarter was placed before the Board and the Board vide CBR No. 48 dated 29-09-2011 has considered and decided to refer the case to Hoarding committee for its consideration and recommendations. An amount of Rs. 18,45,360/- is outstanding in demand and collection register 2009-10, correspondence in this regard is carried out by this office to pay the outstanding amount and case No.1250/2011 is also filed in the Court of Hon’ able Cantt. & Judicial Magistrate U/S 259 of the Cantonments Act 1924 for recovery of dues and it is pertinent to mention here that at present the said site is allotted to M/s Links Ad, vide this office letter No. CBC/ADV-9/12061 dated 31-12-2010 In this regard it is added that the matter was placed before the hoarding Committee for consideration as per CBR No. 48 dated 29-09-2011 and the Hoarding Committee/Board vide CBR No. 12 (g) dated 03-01-2013 “Considered the matter at length and decided to obtain Legal opinion from the Cantonment Legal Advisor before next meeting”. Consequently the Legal Advisor vide letter No. ALA/85/03/2013 dated 04-03-2013 opined as follows: “In my humble opinion, the M/s Cubes are not entitled for re-fund of any amount as requested by them. It is not revealed from record that the Hoarding was ever removed by the Cantonment Board Clifton. This is admitted position that no such facts was brought in the knowledge of the Clifton Cantonment by the Advisor at the relevant time”. “The case of the Advertiser also has no legs to stand as appears to be false and baseless as a man of prudent mind cannot accept that the Hoarding was ever removed in August-2009 but the company was making payment on 23-10-2009 and even another payment was also made on 27-04-2010. Thereafter the office of the Cantonment Board Clifton demanded their balance payment vide letters dated 20-05-2010 and 02-06-2010, which were not responded but later on as a counter blast on 07-07-2010, a letter was received for re-fund which doesn’t appears to be genuine.” “In view of above circumstances, claim of the company does not appear to be genuine; rather the Clifton Cantonment is entitled to recover the balance amount. Application for recovery is already pending before Judicial Magistrate. It is suggested to let the Magistrate to decide the issue and claim of the company be declined.” All connected papers are put up on table. Upon said legal Advice by the CLA this office carried out the
survey and worked to bring all un-authorized sites except 03 Nos
60x20 Hoarding which is sub-judice and according to CBR No. 12
(f) (c) (ii) dated 03-01-2013 the Deferred the request for permission
to erect a Hoarding at Kala Pul Railway Land till decision of the
Court, hence, the matter is still pending in the Court of Law.

37. WAIVER OF WATER CHARAGES Reference: Application dated 28-03-2012. The case was referred to Cantt. Engineer water supply on 27-06-2012, after verification the Cantt. To consider re-constitution of various committees in the light of general discussion
during the last Board meeting held on 12-02-2013. In the said discussion it was generally observed that there was a need to re-shuffle members in certain committees in order to re-invigorate these committees and to infuse new ideas with those changes. It may also be highlighted here that the “ABAD” has also requested vide their letter No. C-38/ABAD/ 13-0381 dated 13.03.2013 for inclusion of their nominated members in the building committee, which also needs to be considered by the Board.

g) REVISED BUILDING PLAN FOR APPROVAL OF CANTONMENT BOARD
CLIFTON, PLOT NO. 67/III, 3rd STREET, PH-V, DHA KARACHI. Ref:- DHA letter no. . DHA/TP&BC/N-400/I, dated 23-11-2012 To consider the revised building plan of subject property forwarded by DHa vide their letter referred above. Consequently the Technical staff of this office has checked the subject site & found that bungalow constiting of G + 1st Floor is constructed at site beyond the approved plan.
This office vide letter no. CBC/BC/67/III, 3rd St./2341 dated 31-12-2012 returned the case to DHA with the following questions & DHA vide their letter no. DHA/TP&BC/N-400, dated 19-02-2013, re-submit the case alongwith following replies / remarks; same are reproduced as under:-

The revised building plan of the subject property returned un-actioned herewith the observation that it revealed from the existing site that the construction is already completed no such constructional work has been left so far. 2. Kindly ask the lessee to submit the Completion Building Plan through DHA office to proceed further in the matter accordingly.

No composition fee has been received from the lessee and the permission for 1st floor beyond the approved building plan was granted to the lessee through deviation / addition / alteration by this office. 2. Furthermore, the composition fees, if any will be prcessed to CBC at the time of completion as in practice.

h) REVISED BUILDING PLAN IN RESPECT OF PLOT NO. D-62/I, BLOCK-9, KDA
SCHEME-5, CLIFTON, KARACHI. (DT 22-03-2013) Reference:- Revised Building plan application dated 06/11/2012 submitted by Mr. M. Ramzan Baluch To consider the matter of unauthorized construction of 2nd floor on subject property. It is relevant to mention that the lessee of the subject property submitted

revised building plan of subject property & requested therein for approval. In this context, it is pertinent to mention that the Proposed Building Plan of the subject property was approved by the Board vide CBR no. 36(b) dated 19-07-2012 & the approval was conveyed to the lessee vide this office letter No. CBC/BC/717 dated 27-07-2012. Consequent upon submission of Revised Building Plan the technical staff of this office has checked the site & found that only structure of B+G+1st floor was completed in that time. The revised building plan was placed before Building Committee meeting held on 21-01-2013 & the Committee vide BCR 3(2) dated 21-01-2013 recommended for approval by the Board same was approved by the Board vide CBR no. 8(c) dated 12-02-2013 & concurrently as per practice in vogue a letter was issued to the DDO, KDA Wing with the request to furnish NOC from Land and tenure point of view. In response DDO furnished NOC vide their letter no. KDA Wing/DLM/Clif/D-62(I)/9/61 dated 01-03-2013. Meanwhile, the field staff of this office has checked the site again and found that the lessee has unauthorizedly constructed 2th floor in violation of byelaws, approved building plan as well as the terms of the lease. However, the revised bilding plan approval accorded vide CBR no. 8(c) dated 12-02-2013 has not been issued to the lessee yet.

RESOLUTION: The Board considered and resolved to ask the owner to demolish the existing unathourized construction of 2nd floor, after demolition the Building Plan shall be re-considered accordingly.
