S No. CBC’s Questions DHA Replies

1

Does any proposed plan approval / permission has been issued by DHA regarding construction of subject bungalow as this office has not issued any such permission.

This is an old case of 1966. No record is with CBC/DHA. The building has been constructed almost 46 years back as per old byelaws / regulations and same verified from that period building plans of various other plots.

2

First floor has been marked as revised component which is required to be constructed however same is constructed at site & occupied. Please elucidate.

After construction of ground floor the owner constructed the first floor in the same manner as mentioned in para-1 above, no such record is available in this office.

3

If said construction is un-authorized why the composition fee has not been forwarded to CBC.

Said construction is not un-authorized as it was constructed years back. All documents lost / not traceable with the owner. To regularize such old construction, the case is precessed through revied building plans. It is requested to process the case for approval please.

Now the applicant / owner submitted Form-7 alongwith application

dated 27-011-2012 with the request that he is willing to pay the reasonable penalty

be imposed by the Board so that completion plan may be issued.

In the circumstances stated above, this office left with no option except

to calculate composition fee on entire covered area of the subject bungalow as per

Para 6(ii) of Ministry of Defence letter no. 75/853/Lands/92/4970/D-12/ML&C/94

dated 06-11-1994 @25% & moreover the lessee has submitted Form-7 that he is

willing to pay the penalty. The detail of calculation of composition fee is as under:-

Recommendations of the Building Committee held on 21-12-2012:- After thorough deliberation, the Committee is of the unanimous view that in the year 1966 neither CBC nor DHA was existed and thus to penalize the construction @ 25% of the computed value shall not be justified at all. It is therefore recommended to compound the construction @ 10% of the cost of construction.

RESOLUTION: The Board considered proposal along with

recommendations of Building Committee and resolved to

compound the construction @ 10% of the cost of

construction as an exceptional case due to peculiarity of the

case and also subject to concurrence of Competent

Authority and fulfillment of all necessary formalities

including payment of all related dues .

S/No Details Remarks of the staff Recommendations

i.

To consider the request for amendment of

Hoarding Policy in respect of Pole Sign size

the most of the Advertisers are giving

preference to that size and it will generate extra

Revenue.

ii.

To consider the request of M/s Look Outdoor

regarding the levy of annual rent of Hoarding

charges on Gantry single sided measuring

110x10 instead of measuring 115x10 double

sided and to remove the site of 15x45 Hoarding

allotted to M/s Prime Services, which is

blocking the view of their gantry sign from the

road sea view towards Hyper Star.

In this regard it is apprised that the

measurement of Gantry is 115x10

(instead of 110x10) as per survey of the

outdoor staff, it is added that since the

installation of site one side is not used

so far, hence, may please be

recommended for cancellation of single

side instead of double side and the

permission for installation of Hoarding

15x45 to M/s Prime Services was

granted prior to this permission.

Considered at the length and resolved to approve the single side of Gantry from the date of approval / installation instead

of double.

iii. To consider the amendment of re-size of Gantry

of M/s Gizelle located at Kh-e-Jami, measuring
