ITEM C – 2 QUARTLERLY BUDGET REVIEW STATEMENT File number: 085 Reporting Officer: Director of Corporate & Community Development Operational Plan Objective: Pillar 6: Our Leadership 6.3.2 – Provide good governance, prudent financial management and effective support services for all its activities.
Officer Recommendation: That Council note the quarterly budget review.
Purpose of Report The purpose of this report is twofold: 1. To review actual performance against budget for the nine months of
the 2014/15 financial year up to 31 March 2015. 2. To adjust the budget in response to changes in the financial landscape and changes to Council’s corporate goals. Report The Projected Year End Result has been adjusted to allow for carry forward items, first quarter adjustments and second quarter adjustments. These changes have been shown in the Recommended Changes Column. The items to be carried forward and the first & second quarter changes have already been approved by Council at previous meetings. The third quarter changes are shown in a separate column and discussed below and need to be approved at this meeting. The figures in the Projected Year End Result Column are the estimate of income/spending at the end of the financial year. It is the sum of the originally adopted budget for 14/15, plus items carried forward from 13/14, plus or minus adjustments made at the first, second and third quarterly reviews. Refer to the detailed statement provided under separate cover.

It is my opinion that the Quarterly Budget Review Statement for Balranald Shire Council for the quarter ended 31/03/15 indicates that Council’s projected financial position at 30/6/15 will be satisfactory at year end, having regard to the projected estimates of income and expenditure and the original budgeted income and expenditure. C – 3 INTEGRATED PLANNING & REPORTING (IPR) ADOPTION OF DRAFT OPERATIONAL PLAN 2015/2016

Officer Recommendation:
That Councils DRAFT Operational Plan is placed on public exhibition for a period of 28 days commencing 21st May 2015 in accordance with Section 405 (1) - (6 of the NSW Local Government Act 1993.
Purpose of Report To present Councils 2015/2016 Draft Operational Plan. Report The Operational Plan, including the draft budget and Revenue Policy is an annual plan that must be adopted by Council before the beginning of each financial year. The plan outlines the activities to be undertaken in that year as part of the Delivery Program (4 year plan). The Draft Operational Plan must be placed on public exhibition for a minimum of 28 days to invite public comment. Any submissions received must be considered by Council before the final program is adopted. Councillors will have further opportunity to comment on the Draft documents during the public exhibition period up to the 17th June, although, Councillors are encouraged to put forward their comments well prior to this deadline. A copy of the Draft Operational Plan is provided under separate cover.

Purpose of Report To provide Council with a progress report on Tourism. Report Attached to this report is the Tourism Monthly Reporting Dashboard for the month of April 2015. The following is a summary of the Statistics provided in this report;
Walk-In increased by 141.8% compared to April 2014 and increased by 27.4% compared to last month. As per last month’s figures, the largest percentage of visitors is coming from within NSW. The largest percentage of interstate visitors was from Tasmania, followed by Western. International visitors made up 6% of visitors, with highest numbers coming from Netherlands, followed by the New Zealand, Canada, USA and Germany. Income increased by 147.65% compared to March 2014 and increased by 47% compared to last month. Most popular merchandise – Frog Figurines was the largest seller, followed by Oils & Dressings, Balranald Post Cards, Construction Post Cards and Pistachios. Social Media continues to be a popular and valuable marketing medium with both the Council Facebook page and the Balranald Discovery Centre Facebook pages topping the 1127 LIKES mark over the month of April.

Item I - 1 MAINTENANCE AND CONSTRUCTION PROGRAM

Purpose of Report To provide Council with a progress report on works, since the March meeting. Report
1. Road Maintenance During recent wet weather both construction crews carried out maintenance grading on local and regional roads in the vicinity of their construction works. Ivanhoe Rd and Benanee Rd both received targeted maintenance grading. 2. Roads to Recovery Program Euston – Prungle Road The project involves formation earthworks, gravel construction, new drains and a bitumen seal, 9.62km to 11.62km from the Sturt Highway. This project is now completed with the spray seal being applied in the first week of May. The construction crew from this project are now moving over to Marma Box Creek Road.
Marma Box Creek Road Construction works have now commenced for a 1.5km extension of the road westerly from the end of the existing bitumen. A triple cell culvert has been extended and a new headwall installed prior to earthworks. Earth works are scheduled to commence third week of May. Completion is anticipated prior to the end of June.

3. Repair Program Balranald Ivanhoe Road Construction works are advancing on a 2km extension of the sealed road southerly from the end of the existing bitumen seal at the northern border. Preliminary earthworks and new culvert installs have been completed. Gravel delivery is nearing completion. Laying and compacting of gravel is well underway. Completion is anticipated by the end of June. 4. Reseal Program Council’s 2014/15 Reseal program commenced in late April and was completed in early May. $1.06 Million in road reseals were carried out on a combination of urban, local and regional roads. Approximately 38km of roads were resealed in this year’s program. The primer seals on Marma Box Creek Rd and Ivanhoe Rd are the only outstanding seal items and they are anticipated to be completed at the end of June. 5. Miscellaneous Works
Malcolm Street Filtered water main has now been completed. It was commissioned in early May and at least one resident is already connected.
Military trail plaques installed prior to ANZAC day. Clean up of Greenham Park entrance area in preparation for new garden by the Balranald Beautification Committee. Cactus and bamboo eradication at various locations. Main street tree trimming.
Theatre Royal garden bollards reinstated. Footpath and Kerb & Gutter revaluation inspections. Repair of pavers at IGA Remove underground disused fuel tanks at depot commenced.

ITEM I – 3 RMS FUNDING INITIATIVES File number: 713 Reporting Officer: John Stevenson, Director Infrastructure & Development Operational Plan Objective: Pillar 5 – “Our Infrastructure”
Officer Recommendation: Council participate in the RMS Active Transport – Safer Roads program grant opportunity.
Purpose of Report To advise Council of Safer Roads grant application program. Report I attended the above RMS forum on behalf of Council on 28th April 2015. Regional Director Lindsay Tanner, together with senior support staff Johnathon Tasker and Mitchell Judd, delivered a series of discussions relating to:
Revised approaches to condition assessments
Likely usage patterns becoming a determining factor in funding priorities towards pavement rehabilitation projects
A 10 year forward program for rehabilitation projects
A current review on resealing cycles (reseals being pushed out to 12+ years) with greater emphasis on the considered aging, and stripping and cracking of seals
RMS Road Safety Officer for the Riverina region, Karen Summerfield, gave an address on a strategy to reduce fatalities on Riverina roads by 30% by 2020. To this end a partnership with Councils to enter into funding programs of work under “NSW Safer Roads” commencing in the 2016/17 year, will be soon announced, with a number of aspects including intersection safety and pedestrian safety included in any consideration. It is considered prudent to include Morris, Bertram, Taylor and Brett Roads intersections with the Sturt Highway as appropriate submissions. (Council will recall the above works failed to gain funding under NSW Transport Fixing Country Roads).

ITEM I - 4 EUSTON WASTE DEPOT MANAGEMENT File number: 431 Reporting Officer: John Stevenson, Director Infrastructure & Development Operational Plan Objective: Pillar 5 – “Our Infrastructure”
Officer Recommendation: Council appoint MJ & EA Leslie Pty Ltd as the contract Euston Waste Depot Managers following their purchase of the Robinvale Waste business.
Purpose of Report To advise Council of the pending sale of Robinvale Waste by Mr Tim Williams to MJ & EA Leslie Pty Ltd and his wish to also transfer the Waste Depot Management to this party in the next financial year.. Report Mr Tim Williams has held several discussions with Council staff on this pending sale of his business, Robinvale waste, and the exit from his contract with Council to manage the Euston Waste Depot. Discussion with the purchaser indicate that they are quite happy with Councils present agreement for the Euston Waste Depot Management providing a 5 year with minimum two (2) five (5) year roll over periods are included to provide security of the tenure. It is highly desirable that Council retain the present management structure for Euston Waste Depot i.e. the contractor retains all income derived from his business and has no charge for all operations to Council for management of the waste depot. Secondly, Council retain the incomes derived from sale of tokens, which from time to time in the past have been returned to improvements at the Depot (perimeter security fencing). Indications from Mr Williams are that the present site will accommodate waste deposits for a minimum of 15 years given the deep cell in clay method of landfill. As Council is in the process of renewing Mr William’s contract at this time, it is recommended that provision be made to transfer to the new business name when this sale is completed. A copy of this agreement covering the waste depot management will be tabled at the meeting rather than included in this report.

Consent be refused to Raymond McGill for the subdivision of Lot 2 DP 1123428, off O’Connor Street, Balranald on the grounds that it:
Creates an abnormally small allotment in a rural zone, contrary to the LEP.
Land locks the rear parent lot
Purpose of Report To seek Council’s consent to the subdivision of the above lot, off O’Connor Street Balranald.
Report An application has been lodged by Mr Raymond G. McGill to subdivide the above land into two (2) lots in accordance with the attached sketch. The subject land and the adjoining lots were originally created over or adjacent to the original waste depot for the purpose of light industrial / agricultural activities, prior to Councils 2010 LEP. When adopted, the LEP zones this area off O’Connor St as rural (RU1). Part 4 of Council’s LEP states that rural zone subdivisions must ensure that development is undertaken on appropriately sized parcels of land. The principal minimum lot size is 40ha, however, Council is aware that many lots may be less than this size if justified by an intensive agricultural activity. This proposal seeks to create a very small approx. 2ha lot of which 1.5ha is presently devoted to access road. In addition, the proposal seeks to enable the rear parent portion access over this land (via a registered right of carriageway or the like).

Part 4.1 (b) of the LEP requires Council to ensure that new subdivisions in rural zones reflect lot sizes and patterns characteristic of the surrounding locality. It is highly likely that such a proposal would be rejected from title registration by the LPI. The proposed lot shapes and access are not considered acceptable and resultant areas well below that required by Council’s LEP. The adjoining property landholders have been notified in accordance with Sect 88 of the Environmental Planning and Assessment Regulation 2000, and the submissions received are attached.

Item G – 1 EARLY LEARNING CENTRE REQUEST FOR DONATION

Officer Recommendation: That Council provide a donation of $5,100 to Balranald Early Learning Centre for the replacement of the front fence subject to the provision of two quotes. Purpose of Report To advise Council of a request from the Balranald Early Learning Centre Inc for a donation of $5,100. Report The Balranald Early Learning Centre has submitted a donations application form requesting $5,100 towards replacing the front fence. The General Manager and Health & Development Officer inspected the existing fence and agree that it is at the end of its useful life. The proposal is to replace the existing 1.2m high fence with a 1.8m high fence which will provide additional security. Council owns the land and the last time Council provided a donation to the Early Learning Centre was in October 2010 for $,5,500 and September 2009 for $13,750. There are currently sufficient funds in the donation budget to adhere to the request.

Purpose of Report To advise Council of a request from the Balranald CWA for a donation of $800. Report The Balranald CWA has submitted a donations application form requesting $800 towards updating their honour board and contribution towards their electricity account. Council has traditionally provided the CWA with a donation of $500 per year with the exceptions being $700 in 2012/2013 and no funds in 2014/2015. There are currently sufficient funds in the donation budget to adhere to the request.

Officer Recommendation: That Council;
1. Allow self-contained camping at Greenham Park for up to 100 people within the sites specified on the map (presented to Council) for the duration of the Balranald Central School 150th Anniversary Celebrations.
2. Request the Balranald Caravan Park to administer the bookings.
3. Set the fees at $15/day for powered sites and $10/day for unpowered sites.
4. Not accede to the request for the Balranald Central School to have use of the round tables due to the tables not being suitable for relocation.
Purpose of Report To advise Council of a request from Balranald Central School requesting Council to allow camping at Greenham Park and to use the RV Park for their 150th Anniversary. Report A report was provided to the April Council meeting regarding Balranald Central School’s request that camping be permitted at Greenham Park during their 150th Anniversary Celebrations. Council requested that further investigation be undertaken and a plan presented to the next Council meeting. It is likely that both the 150th Anniversary Celebrations will occur the same time as the 5 Rivers Festival which will provide issues for accommodation. It is assumed that camping or parking of motor homes/caravans not occurs at Greenham Park until all accommodation facilities within Balranald are booked for that period. There are twelve powered sites around the football oval which could be utilised and there are amenities to sufficiently accommodate up to 100 people at Greenham Park. The attached plan shows where people would be allowed to camp and park their motorhomes/caravans.

To ensure that accommodation providers within in Balranald are fully booked prior to allowing people to stay at Greenham Park it is suggested that the Balranald Caravan Park administer the bookings. This will ensure that all powered or unpowered camping sites at the Caravan Park are booked prior to Greenham Park. The Caravan Park Manager is happy to take the bookings. It is suggested that the fees for camping at Greenham Park be as follows: $15/day per powered site and $10/day for an unpowered site (this will ensure that the administration, electricity and cleaning costs are covered). The Balranald Central School has requested if they could hire the round tables from the Theatre Royal for their evening dinner. As per discussions at the April Council meeting the tables are not suitable for being relocated to another facility (due to the age and construction of the tables).

Purpose of Report To advise Council of a summary of meetings held. Report The Mayor and General Manager attended the Euston/Robinvale Historical Society Open Day at the Euston Courthouse on Saturday April 18 April. The day was organised to commemorate the Centenary year of ANZAC and featured photos of local men who enlisted and went off to war, as well as new items and other information from that era. The General Manager attended the Robinvale Euston Community Alliance (RECA) meeting on Tuesday 21 April at Robinvale District Health Services. Representatives from the Hospital, School, Indigenous group, Mallee Family Care and both Councils attended the meeting. The meeting focussed on formalising the Alliance by reviewing the RECA objectives, determining who would be on the board, formation of partner network, length of the Interim Board before elections and the election process. The Mayor, Councillor O’Halloran, Councillor Jolliffe, General Manager and Director of Corporate & Community Development met with the Chairman and CEO of the Murray Darling Basin Commission on Wednesday 22 April. Matters discussed included: Nimmie Ciara project, River Flows, Balranald Weir, Balranald Weir Fish Ladder and the Yanga Lake Weir. Rhonda Dickson (CEO MDBA) invited the Mayor and Councillors when in Canberra in June to visit the MDBA offices for further discussions. The General Manager, Director of Corporate & Community Development and Council’s Building Inspector met with three representatives from Cristal Mining on 24 April. Discussion focussed on: Project update, Project Schedule and key dates, MR67 upgrade works, Development Consent Conditions, Haul Road Construction and Approvals, Transport Management Plan, Employment and Sponsorship opportunities and Council Rates.

The Acting General Manager (Director of Corporate & Community Development) had a Video Conference with all of the Far West Council General Managers on Monday 27 April. Items discussed include: Development of Local Government Model for Western Division Councils, Formation of a Western Division Joint Organisation, “Fit for the Future” Assessment Panel and application for funding from “Fit for the Future” Innovation Fund. The Mayor attended the RAMROC Mayors and GMs meeting held at Jerilderie on Wednesday 6 May. Jason Collins from NSW Department of Premier and Cabinet (DPC) provided an update on DPC and RAMROC matters. Officers from NSW Department of Environment and Heritage provided an update on the Murrumbidgee and Murray Lower Darling River systems. The Director of Infrastructure and Development attended the Rural Fire Service District Meeting at the Balranald Rural Fire Service on Thursday 7 May. Matters discussed included: increased actions on illegal burning, Fire Hazard Reduction programs, Atlas Campaspe Mine land clearing, Fire Trail funding bids and communication blackspots. Councillors and the Executive Team attended a Budget Workshop on Monday 11 May to review and make changes to the Draft 2015/2016 Operational Plan.
