INSTRUCTIONS
1. INSTRUCTIONS1. Due to the extensive volume and nature of information included in this Contractor
Assessment Questionnaire and the Invitation to Tender (“ITT”) documents, respondent is advised that EMIL currently plans to only issue an English language version of the Contractor Assessment Questionnaire and ITT documents.
2. Failure to complete this questionnaire in full may limit the scope of work a respondent will be considered qualified to perform. Please complete the survey within this document by inserting responses in the designated fields. The request to 'describe' an item in regards to a specific question is intended to obtain a brief, concise statement. Questions that do not apply to respondent shall be clearly marked as “Not Applicable”.
3. Where additional information is required in order to complete a response to the questionnaire, please answer each question or item on a separate sheet. For example, Section 1.3 of the questionnaire requires respondent to attach copies of required certificates/registrations/permits to work legally in Iraq. The response should restate the specific question or item at the top of the page, including the number of such question or item, followed by the response. Responses should be in sequential order, consistent with the questionnaire format.
4. Please only submit supporting documents that are required as specified within this document. Extra attachments not requested within the questionnaire will not be reviewed.
5. Upon completion, please submit two (2) electronic versions (CD-ROM or flash drive) of your entire response to the mailing address listed below. Do not email your response. This questionnaire shall be returned as a “native file” (e.g. this Microsoft Excel format). All supporting documents (as requested / specified within this questionnaire) shall also be sent electronically (e.g. in Microsoft Word, PowerPoint, Excel, or PDF format). Please do not send any hard copies of this questionnaire file or supporting documents.

2. MISCELLANEOUS 1. EMIL considers information in this questionnaire provided to respondent to be
proprietary and should be treated as confidential by respondent. The respondent may release information related to the proposed ExxonMobil project to third parties whom the respondent intends to include in the performance of any work related to this project provided that the respondent conveys such confidentiality obligations to said third parties prior to disclosure.
2. All Contractor Entities submitting responses to this questionnaire do so with the understanding that EMIL accepts no obligation of confidentiality with respect to any information disclosed to EMIL in respondent's submittal, unless specifically covered by a separate written confidentiality agreement. By submitting responses, all respondents agree that they will place no restrictive notices on any document (including drawings) provided as part of this questionnaire. The respondents further agree that if they do place such notices on documents, EMIL is authorized to remove and/or disregard any such restrictive clauses and shall be free to use and disclose to third parties any or all information contained therein without accounting to the respondent.
3. The respondents' submittals and any participation therein, including any statements whether oral or written between EMIL and any respondent shall not create or be deemed or construed in any way so as to create any binding legal relationship or contract between either or both jointly of EMIL and any respondent. Furthermore, submittals will not guarantee placement on a bid list or the award of any contract or work. THIS CONTRACTOR ASSESSMENT IS FOR EMIL INFORMATIONAL PURPOSES ONLY.
4. EMIL reserves the right to reject any and all submittals at its sole discretion.
5. All costs and expenses incurred by respondent, or any other party participating in this assessment with respondent, shall not be reimbursed by EMIL and are solely for the respondent's / party's account.
6. EMIL reserves the right to contact all references proved by respondent, visit any respondent work locations and interview any respondent personnel in the performance of this assessment.
