INCOME TAX
1. TAX RATES:
1.1. There has been no change in the slab rates of taxes. The new tax slabs
and the applicable tax rates are asunder:

1.2. TAX RATES IN CASE OF CAPITAL GAINS
• For General Capital Assets Long Term Capital Gain Tax is maintained at 20% and Short Term Capital Gain is taxed at applicable slab rate.
• Section 112 Long Term Capital Gains on Sale of Listed Equity Shares and Equity based Mutual Funds in excess of Rs. 1 lakhs, will now be taxed @ 10% (Plus applicable cess and surcharge). Appreciation up to 31st January 2018 will not be taxed. For example if the purchase price is Rs. 100 whereas value on 31..01.2018 is Rs. 140 and the equity shares are eventually sold at Rs. 200, then tax will have to be paid on Rs. 60 only (Sale value minus value on 31.01.2018). However, if the purchase cost is greater than value on 31.01.2018 then purchase cost will be deducted to work out the capital gains.

Indexation benefit will not be allowed in this working. Long Term Capital Gains on sale of listed equity shares and mutual funds below Rs. 1 lakhs pa will continue to be exempted u/s. 10(38)
This is a compulsory tax and cannot be reduced by investing in 80C / 80D and other Chapter VIA benefits. However rebate u/s. 87A of Rs. 2500 will be available.
• Short Term Capital Gain for all general capital assets will continue to be taxed at normal slab rates.
• Tax on Short Term Capital Gains on Sale of Listed Equity Shares and Equity based Mutual Funds will continue to be taxed @ 15 %.( Section 111A).
• Section 115AD Long term Capital Gains on sale of listed equity shares and equity oriented mutual funds made by foreign Institutional investors will also be taxed @ 10%.
1.3. Surcharge: Individuals and HUF’s do not have to pay any surcharge if their income is below Rs. 50 lakhs, but if the total income is between Rs. 50 to 100 lakhs then surcharge @ 10% on income tax is payable and if the total income exceeds Rs. 100 lakhs than surcharge @ 15% of tax will have to be paid.
1.4. Education Tax (Primary and Secondary) is enhanced to 4% of Tax (FY 2017-18 it is 3%).
