The Chairperson welcomed all in attendance to the meeting. Apologies were extended on
behalf of Mr. Davis who was in Court, Mr. Ricketts who had an emergency, Mr. Wedderburn
who was unavoidably absent and Cllr Sewell who was recuperating from an illness.

Cllr. Dixon enquired when was the notice served to Mr. Everoy Chin. Mr. Morrison in
responding stated about two (2) months ago. The Acting Director of Planning stated that
regarding the wall, Mr. Chin has submitted a plan and requested permission to pay in two (2)
parts and same was granted for him to pay 75% then the balance thereafter (before the
plan is approved and issued).
Chief Engineering Officer’s Report
Melvin Dyce Subdivision
A. At a previous meeting Cllr. Freeman enquired for an update on the Melvin Dyce
Subdivision. In responding the Acting Director of Planning stated that there are two (2)
applications being processed and that conditions were prepared and sent to the
Attorney (Robinson, Phillips & Whitehorne)and the Corporation has not received a
response from the Attorney as yet.

MATTERS ARISING FROM THE MUNICIPAL REPORT
Cllr. Hudson made an enquiry about whether or not the necessary penalties are being
administered as she observed weekend dates on the report, however there is no
penalty fee being reflected.
Cllr. Dixon enquired about summonses which were prepared. The Acting Director of
Planning stated that regarding the Notices served in May 2018, if persons have not
complied; the Officer would prepare the necessary statements and same would be
sent to the Acting Chief Executive Officer for legal actions to be taken. He further
added that the notices served in June would not yet be expired.

Matter Arising from Advertisement & Amusement Report
(1) The Chairman of Planning highlighted that items 16 and 17 contains the same
information. The Acting Director of Planning in responding stated that Items 16 and 17
is a double entry (typographical error).
(2) A discussion ensued surrounding the format being use for the Municipal Report and a
decision taken for the Municipal Department to commence using the format currently
being used by the Planning Department. ACTION: Mr. Davis (Municipal Department) to
commence using the template used by the Planning Department to do their report.
The committee enquired of the absence of the officers to the meeting to which the
Acting Director of Planning stated that he was made aware that Mr. Davis and Mrs.
Johnson will be at Court and Mr. Ricketts has an emergency. He further stated that he
was unable to indicate why there is no representative from the Municipal Department.
The Committee instructed that the Acting Director of Planning should write to the
Acting Chief Executive Officer regarding the absence of the Municipal Department.
ACTION: ADOP to write to the ACEO regarding the absence of a representative of the
Municipal Department.

(3) Cool Oasis Signs being erected
The Acting Director of Planning stated that checks were made to verify the
amount of billboards erected by Cool Oasis, which confirmed that the
amount presented at the last meeting was indeed correct (16 signs 15
approve 1 undergoing review). However there was an error where it reads
‘Grays Inn’ it should read Rio Nuevo.
MATTERS ARISING FROM THE MINUTES
1. Permanent Advertisements (Plyboard rental signs)
The Acting Director of Planning stated that a response was not received from the
applicant; as such enforcement has commenced and approximately sixty (60) signs
were removed.
The committee requested that this matter be removed from the minutes. (To be removed
from next minutes)
2. Civic Centre
The Acting Director of Planning stated that the estimate was sent to the Acting Chief
Executive Officer however same was sent back to the Chief Engineering Officer as the
estimate for the windows were not included in the estimate.
3. CEASE WORK NOTICE
a) Uliet Robinson Boscobel Housing Scheme (Building without Approval)
The Acting Director of Planning Stated that he was informed by Mr. Morrison that Miss
Robinson still cannot be located.

b) Faith Bryan- Lot #130 Mountain Drive, Spring Valley Estate (Illegal addition to
building)
The Acting Director of Planning stated that he was informed by Mr. Morrison that
Faith Bryan is still off the Island.
c) Michael Belnavis - Gibraltar, Oracabessa (Pool drawings to be submitted)
That Acting Director of Planning stated that the necessary fee was paid and the
plan is now being processed.
d) Mission’s Possible Church being built at Idle Wild, Galina
The Acting Director of Planning stated that the notice was served on Tuesday 19,
June 2018. A lengthy discussion ensued.
e) Statements for the areas of Martin and Well Road, Rosend
The Acting Director of Planning stated that as it regards Martin; he was informed by
Mrs. Johnson that this matter is in the Court. He further added that Well Road has
been abandoned and there is no one at the location to serve a notice.
f) Carmen Williams (Marlene Scott) – Illegal building at Corn Hill, Jacks River
At a previous meeting the Committee questioned whether or not Carmen Williams
and Marlene Scott is the same.
The Acting Director of Planning stated that he is still checking to verify, however, no
plan was submitted for that location as such the necessary enforcement will take
effect.
g. Allan & Elwin Irvin Illegal Construction of Commercial/Boundary Wall - Tower Isle
The Acting Director of Planning informed that the Chief Engineering Officer visited the
area and reported that he had not observed any issues at the location regarding any
development.

h. ILLEGAL BUILDING AT ENTRANCE OF ROSEMOUNT – (Basil Phillips)
The Acting Director of Planning stated that the Enforcement Team and Building Officer
will collaborate to serve a new notice.
i. ILLEGAL CONTAINERS -ESTABLISHMENT AT SAND SIDE
The Acting Director of Planning stated that the plan for the Alignment facility/
Mechanic Shop is still being processed and NWA has requested additional
information. He also stated that it was reported that the ‘others’ are in the Court.
j. Construction of Commercial Building at Rio Nuevo – Richard Brown
The Acting Director of Planning stated that the statements were prepared and are
now being reviewed by the Chief Engineering Officer.
k. Illegal Development being done below Retreat Police Station
The Acting Director of Planning stated that he was informed by Mr. Morrison that the
Municipal Team served a notice on Tuesday 19 June 2018.
l. Improper building developments in Moore Hall (Islington)
The Acting Director of planning stated the information is still being awaited from NLA.
m. WHITE HALL ESTATE
m (a) HEIGHT OF WALLS Surrounding the Development
The Acting Director of Planning stated that Mr. Chin has submitted a plan and also
requested permission to pay in two (2) parts and same was granted for him to pay 75%
then 25% thereafter (before the Application is approved and Issued).

m (b) Change of Use- White Hall Development/Comments on provisional
Development Order
The Acting Director of Planning stated that a report was submitted to the Acting Chief
Executive Officer for further review and submission to the Government Town Planner
thereafter.
m (c) Approval for Construction of Robins Bay Theme Park -Everoy Chin & Co. Ltd.
The Acting Director of Planning stated that he made checks within the Planning
Department, as well as, with NEPA which revealed that in 2007 NEPA provided
information that the application could not be processed because it was not legible as
such it was below the acceptable standard. The Acting Director of Planning stated
that a review of what was submitted will be done after which the additional
information required to complete the processing will be requested of the applicant.
The Chief Engineering Officer requested a Development Application Review
Committee along with other agencies to meet and review the application.
4. Establishment of an Exotic Night club in a residential area (Hamilton Mountain)
The Acting Director of Planning stated that the Municipal Team served a notice on
someone at the location however they were informed that the owner is overseas.
He further stated that it was an oversight that the research into the process for business
to obtain Insurance and how the Corporation can assist in the process was not done.
ACTION: ADOP to conduct research into the process for business to obtain Insurance.
5. JOINT VENTURE BETWEEN CONSORTIUM COMPANY LTD AND THE ST. MARY PARISH
COUNCIL – INDUSTRY PEN (Proposed Residential development )
At a previous meeting the Acting Director of Planning stated that he along with the
Acting Chief Executive Officer and the Chief Engineering Officer is in the process of
compiling a comprehensive report on the Industry Pen Development and at the end
of the report the findings will be submitted to the Committee.
The Acting Director of Planning stated that the report is still being complied.
6. TREMOLESWORTH – Informal Settlers on a section of the cemetery lands
At a previous meeting the Director of Planning indicated that the captioned was in
relation to informal settlers on the cemetery lands and has been on the minutes
before 2011. He further stated that a resolution was passed at Council for a waiver
of the subdivision with a view of them receiving titles but to date there was no
further development.
The Chairperson suggested that the matter remain on the minutes.
There was no further update on this matter.
7. Illegal Buildings at Light House Road Galina
Acting Director of Planning stated that he had discussion with Mr. Brown of Health and
pointed out the issues however Mr. Brown reported that the issue expands the north
coast and that the Health Department have given attention to the matter which
resulted in the correct sewage system being implemented. He added that he will have
further discussion with other key stakeholders.

The Chairman of Council enquired of the hold up to the processing of this plan.
The Acting Director of Planning reported that the Health Department did not
recommend the sewage system and same is currently at the Roads and Works
Department. Mr. Morrison reported that Mr. Wedderburn had done an inspection and
submitted same to Mr. Ricketts for signature. The Chairman of Council instructed the
Chief Engineering Officer to follow through on the progress of the application.
ACTION: CEngO to follow through on the processing of the application.
9. Three Hills
At a previous meeting (Feb 2018) the Director of Planning stated that there are still
sewage issues at Three Hills.

10. Charles Richards – Gibraltar Lot 66 & 67
The Acting Director of Planning read the correspondence below; a lengthy discussion
followed the reading / summarizing of the said correspondence. The Acting Director of
Planning stated that he is in the process of organizing a meeting with key stakeholders.
The Chairman of Council asked for a tentative date. None was given as such he
instructed that same should be done within the month of June 2018.

11. Dilapidated dwelling House close at Casa Maria Hotel
Cllr. Smiley stated that the progress is moving slowly; however the building process has
begun.
12. Modification of Covenant – Lot 150 Iteboreale - Arlene Mighty
The Acting Director of Planning stated that a new resolution was drafted and sent to
the Acting Chief Executive Officer for review.
13. Saltrum / Arcada Housing Scheme
The Acting Director of Planning informed that this matter was still being worked on.
14. Illegal Garage at Boscobel
The Acting Director of Planning stated that he was informed by Mr. Morrison that the
location was visited and no garage was observed.
15. Illegal building at Lewis Store (Rudolph Riggs)
At a previous meeting the Acting Director of Planning reported that he was informed
by Mrs. Johnson that no one was at the location.
There was no further update.
16. Building Development at Better Wheels
A lengthy discussion ensued surrounding the location of the Entrance/Exit gate. A
decision was taken for the Acting Director of Planning to draft a letter and forward
same to the ACEO indicating that the location of entrance/exit gate is unsuitable and
thus same should be moved. ACTION; ADOP to draft letter to the ACEO.
17. Land titles for Tremolesworth
The Acting DOP stated that a request was sent to the Fire Department for them to
formally indicate their willingness to remove the need for Fire Hydrant.
18. Building Application for Edwin Coleman
The Acting Director of Planning stated that the corporation received a copy of the
plans that was previously submitted from Mr. Coleman, same was forwarded to the
Chief Engineering Officer. However, recently the three (3) copies of the plans which
were submitted to the Corporation were found. He added that information on the
plans suggested that additional information was requested by Mines and Geology for
a Geotechnical Report. Mr. Morrison indicated that he found a copy of same.
A lengthy discussion ensued.
The Chairman of Council stated that the Planning Department was tardy with dealing
with Mr. Coleman’s Application and as such this matter must be treated with utmost
urgency. As such he instructed that the plan must be presented at the next Planning
meeting (July 2018). He also instructed that a letter of apology should be written to Mr.
Coleman for the length of time it took to process his application.
ACTION: ADOP to ensure the mentioned plan is presented at July 2018 meeting and an
apology letter be written to Mr. Coleman for the length of time it took to process same.

1. The Chief Engineering Officer stated that he had spoken to Mr. Davis on the matter
but he has not physically visited the location as yet. The Chairman asked the Chief
Engineering Officer to check on the locations. ACTION: CEgnO to visit the location and
take the necessary action(s).

1. Cookshop on a bus shed – Annotto Bay
The Acting Chief Executive Officer reported that she got a complaint from concerned
citizens in Annotto Bay of a cook shop which was constructed on a bus shed. Additionally,
the shop and the bus shed is impeding visibility which is very dangerous.
2. Wall being constructed at Race Course (Appears too High)
The Acting Chief Executive Officer informed that there is a wall being constructed in Race
Course which appears higher than 4 feet 6 inches.
3. Development at Oracabessa
The Chairman of Council made reference to a development in Oracabessa which appears
to be like a town house development. Mr. Morrison stated that the development should be
four (4) bungalow which was approved. The Chairman of Council enquired if they are
building according to the approval. Mr. Morrison stated that they appear to be building
according to plan.
4. Golden Seas & Ian Flemming International Airport Developments
The Acting Chief Executive Officer stated that there are two(2) major developments in the
parish to which an update is desired. Namely the former site of Golden Seas Resort and Ian
Flemming International Airport
Mr. Morrison stated that he had reported on Golden Seas and the Airport expansion has
commence on a small part of the terminal
The Acting Director of Planning read a report from Building Enforcement Officer, Mr. Walter
Gordon regarding the notices served for the month of May.
