Illegal Use of Electricity. - It is hereby declared unlawful for any

person, whether natural or juridical, public or private, to:

(a) Tap, make or cause to be made any connection with overheadlines, service drops, or other electric service wires, without

previous authority or consent of the private electric utility or rural

electric cooperative concerned;1awphil@alf 

(b) Tap, make or cause to be made any connection to the existing

electric service facilities of any duly registered consumer without

the latter's or the electric utility's consent or authority;

(c) Tamper , install or use a tampered electrical meter , 

 jumper , current reversing transformer , shorting or shuntingwire, loop connection or any other device which interferes

with the proper or accurate registry or metering of electric

current or otherwise results in its diversion in a manner 

whereby electricity is stolen or wasted;

(d) Damage or destroy an electric meter , equipment, wire or 

conduit or allow any of them to be so damaged or destroyed

as to interfere with the proper or accurate metering of 

electric current; and

(e) Knowingly use or receive the direct benefit of electric

service obtained through any of the acts mentioned in

subsections (a), (b), (c), and (d) above.1awphil@alf

Wholesale Electricity Spot Market Overview

What is WESM?

The WESM allows suppliers and buyers to trade electricity as a commodity.

Electricity is a peculiar commodity. It cannot be stored and it is not possible to trace

which generator produced the electricity consumed by a particular customer, thus

necessitating a "pool" from which all output from generators are centrally

coordinated. As a spot market, electricity is traded in real time. And as a wholesale

market, it is open to distributors, directly connected customers, large users andeventually supply aggregators.

Designed to provide private entities with an efficient venue for trade and investment

in the power industry, the WESM aims to: 1) provide incentives for the cost-efficient

dispatch of power plants through an economic merit order, 2) create reliable price

signals to assist participants in weighing investment options, and 3) protect a fair

and level playing field for suppliers and buyers of electricity, wherein prices are

driven by market forces.

WESM's role in the country's overall energy reform is to create a fair, transparent

and reliable trading environment that will attract investments and encourage healthy

competition.
