On Friday, December 31, after 41 years, Larry Temple will retire from the Texas Mortgage Bankers Association. While Larry will continue to practice law in Austin, this Texas Gentleman will no longer be a fixture in and around the Texas Capitol representing the best interests of our industry. If you are reading this letter, it’s not hyperbole to say you may have your job, in part, because of Larry’s hard work. I hope you will take a moment this week and think of what Larry has done for the mortgage industry and thank him for what he has done for you. I also hope you will join me in welcoming John Fleming to our mortgage family. If anyone is capable of following Larry as our new General Counsel, it’s John Fleming. He is a man of great veracity and intellect. Like Larry has for the past 20 sessions, John has a tremendous grasp of the issues facing the mortgage industry next session. The Board has every confidence in John. His quick wit, good heart and work ethic will serve him well in what looks to be a very difficult legislative session. So, as 2010 ends, let us thank Larry, remember our blessings and welcome John on board. 2011 is going to be a great year. On Friday, December 31, after 41 years, Larry Temple will retire from the Texas Mortgage Bankers Association. While Larry will continue to practice law in Austin, this Texas Gentleman will no longer be a fixture in and around the Texas Capitol representing the best interests of our industry.

If you are reading this letter, it’s not hyperbole to say you may have your job, in part, because of Larry’s hard work. Mortgage servicing rights are under attack. MSR’s are already classified as a Level 3 asset (illiquid). Receivers (FDIC and NCUA) are repudiating servicing contracts in their normal course of disposing of the assets of insolvent financial institutions - ignoring the remaining value that servicers have on their books... Basel 3 (worldwide accounting standards) conferees are proposing to reduce the amount of capital devoted to MSR’s to a maximum of 10%. All these actions have already and will continue to negatively affect the value of servicing. Whether a Lender retains or sells servicing, these actions will affect profitability.
