demonstrrurtd that the prop- known as the White Oak Plantation possesses special

significance in terms of its history, architecture, andlor culturd importance; and

WHE'IUAS, the property known as the White Oak Plantation is owned by James

andl Patxicia Mmo.

NOW, THEREPORE, BE IT ORDAIhBD by the m m b m of the City Council of

Charlotte. No& Carolina;

1. That the property known as the "Wrhite 13ak Plantation'' (listed under Tax

Parcel Numbers I 1 136293 and 11 136292 as of August 1, 2006, d including al l

buildings and the pm& of laad listed under Tax Parcel Numbers 11136293 and

11 136292 in the Mmklenburg County Tax Office, Charlotte, North Carolina as of August

1, 2006) is hereby designated as a historic landmark pursuant to Chapter 160A, Article

19, as mended, of the General Statutes of North Carolina. The location of Mid landmark

is noted as being situated along Rood Road in Mecklenburg County, North Carolina.

Featureg of the property ate more completely described in the Suney and Research

Report on White Oak (1976).

2. That said designated historic Ian- may be materially altered or restored

anly following issuance of a Certificate of Appropriateness by the Charlotte-MecMm

Historic Landmarks Commission. An application far a Certificate of Appropriateness

invoke a change in design, material or outer appearance thereof, nor to prevent or delay

the construction, reconstruction, alteration, restoration, demolition or removal of any such

fWwe when a building inspeetor or similar 08ticial certifies to the Commission that such

action is required for &e public safety because of an unsafe conditim Nothing herein

shall be construed to prevent the owner of the historic landmark from making any use of

the historic landmark not prohibited by other statutes, ordinances or regulations. Owners

of locally designated bistorio 1-ks are expected to be familiar with and to follow

The Secretmy of the Inferior's Standards for Rehabilitation and Guidelines for

Rehabilitating H&toric Buildings, the guidelines used by the Charlotte-Meeklenburg

Section 1. Chapter 20, "Subdivision Regulations" of the Code of the City of Charlotte is hereby amended as follows:

A. Section 2.100 Definitions.

1. Amend Section 2.100, 'Definitions", by adding a new definition in alphabetical order. The new definition shall read as follows:

BUILDING ENVELOPE. A threedimensional area on a lot that remains fbr placing a structure on a site after setbacks, yard, height, and bulk regulations are observed. c

B. Section 6.600 Final Plat Reo_uiremmts.

1. Amend 6.600, 'Tinal Plat Requirements", subsection 7 by requiring that approved final plats shall be recorded within 30 days of the date they are approved by the P l h g staff. Also, remove references to the Secretary of the Planning Commission. The revised section would read as follows:

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHARLOTTE:

Section 1. Appendix A, "Zoning" of the Code of the City of Charlbtte is hereby amended as follows:

A. CHAPTER 12: DEVELOPMENT STANDARDS OF GENERAL APPLICABILITY

1. PART 1 : SUPPLEMENTAL DEVELOPMENT STANDARDS

a. Amend Section 12.106, "Uses and structures prohibited and allowed in required setbacks and yards", subsection (3) by allowing encroachments into the rear yard for dnp1ex. triplex, and qnadraplex, in addition to attached and detached singlefamily units The remaining subsections c shall remain unchanged. The section shall read as follows:

(3) Certain portions of the required rear yard on a lot used for a single family (attached or detached) duplex, triplex, and qdaplex , may be utilized for attached garages, parches, decks, greenhouses, covered patios and utility room extensions of the principal structure in accordance with the following restrictions and as illustrated in Figure 12.106:

(a) No more than 20% of the area of the required rear yard may be used to accommodate extensions of the principal structure for attached garages, porches, decks, greenhouses, covered patios, or utility rooms;

@) No such extension may encroach into the rear yard more than 25% of the depth of the required rear yard; and

(c) No such extension may be more than 50% of the width of ffie dwelling at the rear building line.
