    2. Returning Officers Report

    To receive the report of the Returning Officer following the Borough CouncilElections held on 22 May 2014 (Item 2) (Pages 26 to 28).

    (Committees and Political Groups) Regulations 1990

    The Council is required by the above Regulations to review the basis ofallocation of seats amongst the Political Groups either at its Annual Meeting,or as soon as practicable thereafter, or following by-election. In making itsreview, the Council is required, so far as reasonably practicable, to complywith the following principles:

    (a) Not all seats on each Committee are to be allocated to the same

    Group.(b) The majority of seats is to be allocated to a particular Group if the

    number of persons belonging to that Group is a majority on the Council.(c) Subject to the above paragraphs, the number of seats on the

    Committees allocated to each Group should bear the same proportionto the total of all the seats on the Committees as that borne by thenumber of Members of that Group to the Membership of the Council.

    (d) Subject to paragraphs (a) to (c) above, that the number of the seats onthe body which are allocated to different political groups bears thesame proportion to the number of all the seats on that body as is borneby the number of members of that group to the membership of the

    The Conservative Group holds 31.58% of the seats on the Council, theLabour Group 43.86% of the seats and the Liberal Democrat Group 22.81%of the seats. Also one seat on the Council is occupied by an IndependentMember (1.75%).

    4. Appointment of Leader

    To consider the appointment of a Leader of the Council.Note: If there are more than two people nominated for any position to be filled

    and there is not a clear majority of votes in favour of one person, thenthe name of the person with the least number of votes will be taken off

    the list and a new vote taken. The process will continue until there is amajority of votes for one person.

    5. Appointment of Deputy Leader / Cabinet

    To note the Leaders appointments to the position of Deputy Leader of theCouncil and the Cabinet, up to a maximum of 9 plus the Leader.

    6. Appointments to Committees/Groups/Panels

    To determine the number of Members and Membership to form the followingCommittees/Groups/Panels, in accordance with the political balance on the

    Council:

    Should the Council wish to determine that any of the above bodies need notcomply with the Local Government and Housing Act 1989 and LocalGovernment (Committees and Political Groups) Regulations 1990 (politicalbalance) it would be necessary for the Council to agree unanimously. It isrecommended that the Appeals Commission, Chief Officer

    Appointments Panel and the Constitution Commission be treated as notneeding to comply with the Regulations.

    With regard to the Chief Officer Appointments Panel it is recommended thatGroup Leaders be given delegated authority to appoint Members toAppointment Panels for Service and Assistant Directors on a onemember per Political Group basis, to include a member of the Cabinet,and for Corporate Directors, a Panel of 5 Members on a 2:2:1 memberper Political Group basis, to include a member of the Cabinet.

    The Council is also recommended to appoint all Members of the Council,

    with the exception of Cabinet members (unless they are substituting foranother Cabinet member), as substitutes to all bodies listed above,noting the requirement for Members to be trained before participating inmeetings of the Appeals Commission, Development Control Committee,Licensing Committee and Regulatory Committee.

    Note: The formal appointment of substitutes by the Council does notoverride the requirement to comply with Council Procedure Rule 23(Substitution on Committees, Sub-Committees and Overview andScrutiny Committees), which requires written notice to be given bythe appropriate Group Leader, Deputy Group Leader, the Chair or

    Group Spokesperson of the body concerned, to the MonitoringOfficer, or his/her representative before the scheduled start time ofthe meeting to which the substitution is to apply.

    7. Appointment of Co-opted Members

    (a) Children and Young People Select Committee

    Minutes of the extraordinary meeting of the MILTON KEYNES COUNCIL held onTHURSDAY 20 MARCH 2014 at 8.00pm

    CL110 FREEDOM OF THE BOROUGH OF MILTON KEYNES

    In accordance with Section 249(5) of the Local Government Act1972, the Council considered conferring the Freedom of theBorough on the Infiniti Red Bull Racing Formula One team.

    The Mayor moved the following motion, which was seconded byCouncillor A Geary:

    That in accordance with Section 249(5) of the Local GovernmentAct 1972, the Freedom of the Borough of Milton Keynes beconferred on the Infiniti Red Bull Racing Formula One team, inrecognition of the eminent service rendered to the Borough throughthe national and international profile achieved by the team as aresult of its outstanding and consistent success and the resultingcontribution to the local economy.

    The Council also heard from Councillors ONeill, I McCall, Barney,Bint and Brock, together with Mr R Phillips and Mr A Jarman.

    The Council noted that a motion to confer the Freedom of theBorough needed to be carried by a majority of at least two-thirds ofthose Members present.

    On being put to the vote, the motion was declared carriedunanimously.

    RESOLVED -

    That in accordance with Section 249(5) of the Local Government Act1972, the Freedom of the Borough of Milton Keynes be conferred onthe Infiniti Red Bull Racing Formula One team, in recognition of theeminent service rendered to the Borough through the national andinternational profile achieved by the team as a result of itsoutstanding and consistent success and the resulting contribution tothe local economy.

    The Mayor presented Christian Horner and Adrian Newey, on behalfof the Infiniti Red Bull Racing Formula One team, with the certificateand gift to commemorate the occasion.

    Christian Horner and Adrian Newey thanked the Council andpresented the Mayor with a gift.

    Christian Horner signed the Roll of Honorary Freemen, witnessed by

    the Mayor and the Chief Executive.

    CL111 MINUTES

    RESOLVED -

    That the Minutes of the meeting of the Council held on 19 February2014 be approved and signed by the Mayor as a correct record.

    CL112 DISCLOSURES OF INTERESTCouncillors D McCall and Richards declared personal interests inItem 5(b)(i) (Centenary of World War One) as Members of the RoyalBritish Legion involved in organising commemorative events.

    Councillor Bradburn declared a personal interest in Item 6 (Schemeof Members Allowances 2014/15) as an employee of Her MajestysRevenues and Customs.

    CL113 ANNOUNCEMENTS

    (a) Captain Raymond RobertsThe Mayor announced the death on 26 March 2014 of Raymond"Jerry" Roberts, one of the last surviving members of the WorldWar Two code-breaking team at Bletchley Park at age 93,following a short illness.

    (b) Milton Keynes Business Awards:

    The Mayor announced that the Council had been awarded theEnvironment and Corporate Sustainability Award at the MiltonKeynes Business Awards and requested that the staff involvedbe advised of the Councils congratulations.

    (c) Gail Tolley

    The Mayor announced that this was Gail Tolleys (CorporateDirector of Children and Families) last Council meeting beforeleaving the Council in April, to take up a post with the London

    Borough of Brent.On behalf of the Council, the Mayor thanked Ms Tolley for thework she had undertaken in overseeing the transformation of theCouncils Childrens Services in her 5 years at the Council andwished her success for the future.

    The Council also heard from Councillors Bradburn, Dransfieldand Miles

    (d) The Mayor announced that a Special Meeting of the Councilwould be held on the 1 May 2014 to formally agree theappointment of the new Chief Executive, preceded by aninformal meeting on 28 April 2014 to meet the candidates.

    (e) The Mayor announced that the Mayors Dinner was being held on4 April 2014 at StadiumMK to which all Councillors had beeninvited.

    (f) The Mayor announced that the MK Rose was being used asanticipated to commemorate a number of forthcoming occasions.

    CL114 QUESTIONS FROM MEMBERS OF THE PUBLIC

    Question from Mr Kendrick to Councillor Coventry (Chair of Housing

    and Communities Select Committee):

    Mr Kendrick asked Councillor Coventry how much money had beenallocated to the Council for Discretionary Housing Payments andhow much of this had been distributed.

    Councillor Coventry apologised that he did not have the figures tohand, but undertook to supply the information to Mr Kendrick.However, he understood that the money was underspent as not allthat could have been claimed, had been claimed.

    Mr Kendrick asked a supplementary question which was answered

    by Councillor Coventry.

    CL115 REPORTS FROM CABINET AND COMMITTEES

    (a) Pay Policy Statement

    Councillor Dransfield, (Chair of the Joint NegotiatingCommittee (Employers Side)), moved the followingrecommendation arising from the Joint NegotiatingCommittees meetings held on the 10 February and 13 March2014, which was seconded by Councillor Edwards:

    That the Pay Policy Statement for the financial year 2014/15be adopted

    (b) Overview and Scrutiny Annual Report 2013/14

    Councillor Miles, Chair of the Overview and ScrutinyManagement Committee, presented the Overview andScrutiny Annual Report, which had been considered by theManagement Committee at its meeting on 5 March 2014, andin so doing, drew attention to the work undertaken by thevarious select committees and review groups during 2013/14.

    The Chair expressed his thanks to the Members and officers

    who had been involved with, and supported, the overview andscrutiny process during the year.

    RESOLVED -

    That the Overview and Scrutiny Annual Report be received.

    CL116 MEMBERS QUESTIONS

    (a) Question from Councillor Legg to Councillor McLean (Cabinetmember for Transport and Corporate Services).

    Councillor Legg, referring to the undertaking given by the

    responsible Cabinet member at the Cabinets meeting on the16 October 2013 (Minute C71 refers) to investigate thepossibility of finding sufficient allocation in the CapitalProgramme to allow the phasing of traffic lights to allowpriority for buses, asked for an update, specifically whataction had been taken, what was the costs of any upgradeand when would any measures be implanted.

    Councillor McLean indicated that officers had analysed datafrom bus services through the Real Time PassengerInformation system which had highlighted some limited delaysat some junctions in Central Milton Keynes. In addition, theCouncil had unsuccessfully bid for 2m funding via theGovernment pinch point initiative for both signal changes andcarriageway widening. However, a lower cost scheme wasbeing developed which would deliver the benefits for publictransport through signal changes and would hopefully bedelivered as part of the Transport Capital Programme2014/15.

    Councillor McLean also indicated that the full pinch pointscheme was covered within the Mid-Term Financial Plan andwas highlighted within the Local Investment Plan as CMK

    Public Transport Improvements, with full delivery scheduledfor a future year.

    (b) Question from Councillor D McCall to Councillor Coventry(Chair of the Housing and Communities Select Committee)

    Councillor McCall, noting that Councillor Coventry appearedcritical, when answering the question from a member of thepublic of the fact that all residents had to pay 20% CouncilTax, asked Councillor Coventry whether it was a fact thet hehad voted for the 20%, rather than the 8.5% proposed by theLiberal Democrat Group.

    Councillor Coventry indicated that he believed that he hadvoted for scheme which as a package would save peoplemoney in the longer term, when taking account of theGovernment Subsidies which would be available, but as aprinciple he did not support that all residents had to pay 20%Council Tax irrespective of their circumstances.

    Councillor McCall asked a supplementary question which wasanswered by Councillor Coventry

    (c) Question from Councillor Bradburn to Councillor Dransfield(Cabinet member for Childrens Services and LifelongLearning

    Councillor Bradburn asked Councillor Dransfield if he agreedthat the CouncilsDiscretionary Fund for Housing and CouncilTax Benefit was a good thing.

    Councillor Dransfield indicated that his view, as he expressed

    at the recent meeting of the Childrens and FamiliesPartnership, was that the Council needed to only supportthose families in real need, so giving a hand up, rather thanconstant hand-outs which encouraged families to rely on thebenefits system. He also supported the view that any savingsachieved could be put into educating the families concernedto enhance their opportunities.

    Councillor Dransfield highlighted that the take up of thediscretionary fund in Milton Keynes was relatively low andthere was not a major arrears problem as in other areas ofthe Country which suggested to him that there might be a

    political motivation by some councils to keep people inpoverty, whereas this Council wanted to help people out ofpoverty.

    Councillor Bradburn asked a supplementary question whichwas answered by Councillor Dransfield.

    (d) Question from Councillor Miles to Councillor Dransfield(Cabinet member for Childrens Services and LifelongLearning)

    Councillor Miles asked Councillor Dransfield, bearing in mind

    his policy of only expanding the schools classed as good oroutstanding to meet increasing demand for school places, to

    explain his strategic vision for the time when there were nolonger any good or outstanding schools to expand, or currentgood or outstanding schools lost their status.

    Councillor Dransfield explained that the policy of onlyexpanding the best schools was currently ensuring that theincreased birth rate in the established areas in Milton Keyneswas being met and new school were planned in theexpanding expansion areas.

    Councillor Dransfield challenged Councillor Miles to explainhow he would meet the challenge of the increased birth rate,or would he be happy to see increasing numbers of childrenbeing sent to underperforming schools, which wouldinevitably divert the attention of the senior management awayfrom improving performance.

    Councillor Dransfield also recognised that there were parkingproblems around most of the schools, and where possible,expansion plans included schemes to try and alleviateparking problems as much as possible.

    Councillor Miles asked a supplementary question which wasanswered by Councillor Dransfield.

    (e) Question from Councillor Eastman to Councillor P Geary(Cabinet member Communities and Highways)

    Councillor Eastman noted that he had not yet received a

    response from Councillor P Geary to his question asked atthe Council meeting held on 15 January 2014 (Minute CL91refers), as to how many claims resulting from damage tovehicles from hitting potholes had been made during thecurrent year, how many had been rejected and how thiscompared with previous years.

    Councillor P Geary advised that a response should havebeen sent and he would chase it up.

    (f) Question from Councillor A Geary (Leader) to CouncillorDransfield (Cabinet member for Childrens Services and

    Lifelong Learning).Councillor A Geary, noting Councillor Dransfields recentendorsement of the policy of fining the parents of childrenwho took their children out of school during term-time, askedCouncillor Dransfield what his policy would be for teacherswho took themselves out of school during the term-time andto not teach the children.

    Councillor Dransfield indicated that he believed that everyhour a child missed was not helping their education andperformance would be improved the more time they spent in

    school. The impact of the recent industrial action by ateaching union had had limited as it was only one Union

    taking action, but some pupils still missed out on theireducation which Councillor Dransfield deplored.

    Councillor Dransfield, recognising that the Council was theemployer of very few teachers and then only in name as theSchool Governing Body undertook most elements of the role,stated that if it was left to him he would sack any teachertaking industrial action.

    (g) Question from Councillor Middleton to Councillor P Geary(Cabinet member Communities and Highways).

    Councillor Middleton asked for clarification as to how deep ahole needed to be before it was classified as a pothole.

    Councillor P Geary indicated that the generally acceptedcriteria for the depth of a pot-hole was 50 mm or two inches.

    Councillor Geary also indicated that, it was often the case thatthe Council repaired potholes of lesser depth and the371,011 which had been recently received fromGovernment, together with the additional 30,000 allocated bythis Council would contribute significantly to repairing morepotholes, whatever the depth, and improve the quality of theroads for all road users.

    Councillor Middleton asked a supplementary question whichwas answered by Councillor P Geary.

    Councillor I McCall asked Councillor P Geary, as to the costof inspecting a pothole to see if it met the criteria to berepaired.,

    Councillor P Geary indicated that changes to the responseprocedures on reports of potholes meant that it was now theaim to mend not measure and that if there was anotherpothole nearby that would be fixed at the same time, ratherthan ignoring it until it had been surveyed.

    Councillor P Geary undertook to provide Councillor I McCallwith a comparison in writing as to how many potholes hadbeen repaired, together with the cost of inspecting andrepairing potholes under the previous Liberal DemocratAdministration, compared to the current arrangements.

    Councillor P Geary indicated that there were two tranches ofsigns to be replaced, the first having largely been completed.Councillor Geary indicated that he would arrange for theschedule of replacements to be circulated with the MembersWeekly News.

    Councillor Geary also indicated that as there was moneyavailable in the budget the replacement of street time shouldhappen as a matter of course, and where signs were nolonger needed they should be removed.

    Councillor Brackenbury asked a supplementary questionwhich was answered by Councillor P Geary.

    Councillor Hoyle asked Councillor D McCall if he thought thatNick Clegg MP should retain the Leadership of the LiberalDemocrat Party, bearing in mind the view that he hadreceived a trouncing by Nigel Farage, Leader of the UnitedKingdom Independence Party, in this evenings televiseddebate.

    Councillor D McCall indicated that he could not contemplate

    Nigel Farage winning a debate against anyone, particularly onthe subject of Europe, particularly as he rarely bothered toattend debates in the European Parliament and fight for theinterests of the United Kingdom.

    Councillor Hoyle asked a supplementary question that wasanswered by Councillor D McCall.

    (ii) Engineering Skills College

    Councillor Marland moved the following motion which was

    seconded by Councillor Hopkins.

    1. That this Council notes that the Government hasannounced plans for a new high-skilled engineeringcollege to support the skills requirements for the HighSpeed 2 rail network linking London with Birminghamand the North and other major infrastructure projects.

    2. That this Council also notes that the college is plannedto open in 2017 in order to train the next generation ofengineers in rail, construction and environmentalstudies.

    3. That the Council recognises that the High Speed 2project is a major, long-term infrastructure schemewhich the Government estimates will generate morethan 2,000 apprenticeships.

    4. That this Council believes that Milton Keynes is ideallyplaced to host such a skills college, as Milton Keyneshas a strong rail history, already has a rail industryskills base, is home to the Network Rail HQ and isclose to the planned High Speed 2 route, which

    together with the strong apprentice and work-basedtraining sector in Milton Keynes means that MiltonKeynes is able to deliver such a project.

    5. That the Council notes that other cities and towns arepreparing bids to host the college, and Milton KeynesCouncil will need to lead a dedicated campaign tobring the college to the borough, working withSEMLEP, Milton Keynes College, UCMK, businesspartners and others.

    6. The Council also notes that a High Speed 2 Skills

    College in Milton Keynes would build on its emergingstatus as a transport innovation centre, with theTransport Catapult.

    7. The Council therefore agrees:

    (a) that it should support the work being undertakenby SEMLEP and Milton Keynes College todevelop a bid to host the college as part of itsskills strategy;

    (b) that officers should make contact with business

    partners in Milton Keynes and the wider area toassess their willingness to participate in any bid;

    Councillor A Geary moved the following amendment, whichwas seconded by Councillor Dransfield:

    1. That the word notes in clause 1 be replaced with theword welcomes.

    2. That the words will need be deleted from Clause 5and replaced by the words has responded positively tothe calls from local MPs and others.

    3. That the words and the Smart Cities project, be addedto the end of Clause 6.

    In accordance with Council Procedure Rule 13.6(c), the Mayormoved a procedural motion, seconded by the Deputy Mayor,

    requesting the Council to determine whether the amendmentcould be offered to the mover of the motion.

    On being put to the vote it was resolved unanimously that theamendment could be offered to the mover of the motion.

    Councillor Marland, the mover of the motion, accepted theamendment.

    On being put to the vote the motion, as amended, wasdeclared carried unanimously.

    1. That the report of the 2014 Independent Remuneration Panel

    be accepted.

    2. That the report on allowances for members of Parish andTown Councils be noted.

    3. That a Scheme of Councillors Allowances, based on therecommendations of the 2014 Panel, to take effect from 1April 2014 be adopted, subject to the current arrangementsfor the provision of Broadband and telephone rentals beingcontinued until 1 June 2014.

    Councillor D McCall moved the following amendment, which was

    seconded by Councillor A Geary:

    That Clause 3 of the motion be deleted and replaced by thefollowing wording:

    3. That the implementation of the Scheme of CouncillorsAllowances, based on the recommendations of the 2014Independent Remuneration Panel, be deferred for 12 monthsto allow any errors in in the Scheme to be amended and toseek advice from Her Majestys Revenues and Customs onthe tax implications of the Scheme.

    4. That in the meantime the 2013/14 Scheme of CouncillorsAllowances be adopted from 1 April 2014 as the 2014/15Scheme, recognising that:

    (a) the Scheme would be subject to an increase resultingfrom its indexation to the NJC pay award 2013/14 forstaff; and

    The Council was informed that Member Appointment Panels hadbeen established in liaison with group leaders, to undertake theappointments of the service director (legal and democratic services)and the service director (public realm services). the recruitmentprocess for the appointment of the service director (adult social careand health) was due to start shortly and an appointment panel wasneeded.

    It was noted that in addition, there were likely to be a number ofother chief officer recruitment activities required in the pre-Electionperiod that would require Member Appointment Panels to beestablished.

    It was reported that the membership of the Appointment Panelsestablished to date, on the nomination of the Group Leaders, was:

    (a) Service Director (Legal and Democratic Services)

    2.2 The postholder currently carries the statutory designations of Returning Officerand Electoral Registration Officer, and the Council needs to consider theallocation of these designations to another officer so as to ensure a smoothtransition.

    2.3 The Representation of the People Act 1983 requires the Council to designateone of its officers as Returning Officer for its elections and parish council

    elections. The designated person will also act as Acting Returning Officer forParliamentary elections, Local Returning Officer for European and Police andCrime Commissioner elections and Counting Officer for any futurereferendums.

    2.4 The Act also requires the Council to designate one of its officers as ElectoralRegistration Officer.

    There are no additional financial implications. The position of ReturningOfficer carries with it fees which are determined from time to time inaccordance with the Returning Officers Fees Order set by Parliament. Thepayment of the fees for local and ordinary parish elections is met by theCouncil. The cost of Parish By-Elections is met by the parish concerned inaccordance with the Parishes Protocol. The cost of other national elections ismet by the Government Department concerned.
