THE EXECUTIVE COMMITTEE RECOMMENDS THAT 1.544 hectares (3.815 acres), more or less, of vacant land being Part of Lot 57, Concession 1 East of Yonge Street and designated as Blocks 6, 7 and 8 on a draft plan of survey prepared by Schaeffer Dzaldov Bennett LTD Ontario Land Surveyors, dated 14 August 2013 being Job. Negotiations have been conducted with Paul Tobia an Associate Planner at Evans Planning, acting as agent on behalf of the owner.

Attached is a plan showing the location of the subject lands.

RATIONALEThe subject lands are within TRCA's approved master plan for acquisition for the Rouge River watershed as outlined in the approved Greenlands Acquisition Project for 2011-2015.

Through the review of draft plan of Subdivision 19T-88016 for proposed residential development of the site, TRCA staff established the limits of the open space lands (i.e. Block 6, 7 and 8 on the draft plan of survey) which are comprised of an environmental protection area, a buffer area and an open space area within a portion of the valley corridor of Rouge River at this location.

TAXES AND MAINTENANCEBased on TRCA's preliminary review of the criteria for lands that are eligible to receive a property tax exemption under the provincial Conservation Tax Incentive programs, staff estimates that approximately 80% of the subject property may be eligible. With an exemption, taxes for 2015 are estimated to be approximately $1,400. The addition of the subject parcel of land is not expected to significantly impact TRCA's maintenance costs at this location.

THE EXECUTIVE COMMITTEE RECOMMENDS THAT WHEREAS Toronto and Region Conservation Authority (TRCA) has been requested by York University (York) to enter into a lease agreement for lands located adjacent to the Restoration Services Centre at 9741 Canada Company Avenue, City of Vaughan, Regional Municipality of York, Humber River watershed;

AND WHEREAS it is the opinion of TRCA that it is in the best interested of TRCA in furthering its objectives, as set out in Section 20 of the Conservation Authorities Act, to cooperate with York in this instance;

THEREFORE LET IT BE RESOLVED THAT TRCA enter into a lease with York for approximately 0.4 hectares (1 acre), more or less, together with an access right-of-way, to operate and monitor an apiary, inclusive of a 30 foot (30') trailer and associated equipment, said land being Part of Lot 18, Concession 7, located in the City of Vaughan, Regional Municipality of York, Humber River watershed;

AND FURTHER THAT the lease with York be premised on the following general terms and conditions:

(i) the initial term of the lease shall be five years, with an additional two five year renewal period at TRCA's sole option;

(ii) the lease rate shall be a nominal sum of $50.00 per annum plus HST, $75.00 per annum plus HST for the first renewal period, and $100.00 per annum plus HST for the second renewal period;

(iii) York shall be responsible for any and all approvals required for monitoring and operation of the apiary;

(iv) York shall be solely responsible for any and all costs associated with the apiary;

(v) the lease be subject to relocation of the apiary to a mutually agreeable location, at TRCA's option;

(vi) any further terms or conditions as deemed necessary TRCA staff and solicitor;

CARRIEDBACKGROUND TRCA is in receipt of a request from York to enter into a five year lease for a one acre parcel of TRCA-owned land located adjacent to the Restoration Services Centre at 9741 Canada Company Avenue, City of Vaughan, Regional Municipality of York, for the purposes of operating an apiary.

The apiary is for a research lab for a faculty member who is undertaking research on the genetics of honey bee behaviour. They have several experiments on the relationship between genetics and the individual behaviour of honey bee workers as well as the behaviour of the colony as a whole.

Accordingly they are requesting a longer term lease as this is a long term study.

The following are the key terms of the proposed lease arrangement: 1. Lease Payment: $50.00 per annum. 2. Term: Five years. 3. Renewals: Two five year renewal periods subject to TRCA approval. 4. Insurance: York shall provide commercial general liability insurance with $2,000,000

coverage per occurrence and TRCA is to be shown as an additional named insured.5. York shall be solely responsible for the cost of maintaining, monitoring and operating the

apiary operation.6. The lease is subject to relocation of the apiary to a mutually agreeable location, at TRCA's

option.

RATIONALE TRCA staff feels this is an opportunity to partner with an education institution to further research. It will allow to further their research while also allowing for pollination and propagation efforts within TRCA existing seed orchard.

FINANCIAL DETAILS The revenues generated from this lease are to offset utility costs.

Inc. and the City of Pickering to provide a permanent easement for a new storm sewer outfall, located on the south side of Park Crescent and west of Cliffview Road, in the City of Pickering, Regional Municipality of Durham, Lake Ontario waterfront.

THE EXECUTIVE COMMITTEE RECOMMENDS THAT WHEREAS Toronto and Region Conservation Authority (TRCA) is in receipt of a request from Orchard Ridge (Pickering) G.P. Inc. (Orchard Ridge) and the City of Pickering to provide a permanent easement for a new storm sewer outfall, located on the south side of Park Crescent, west of Cliffview Road, in the City of Pickering, Regional Municipality of Durham, Lake Ontario Waterfront;

AND WHEREAS it is in the best interest of TRCA in furthering its objectives as set out in Section 20 of the Conservation Authorities Act to cooperate with Orchard Ridge and the City of Pickering in this instance;

THEREFORE LET IT BE RESOLVED THAT a permanent easement containing a total of 0.023 hectares (0.057 acres), more or less, be granted in favour of the City of Pickering for a new storm sewer outfall, designated as Parts 1 and 2, on Plan 40R-28658, subject to the following terms and conditions;

i) the easement price be $10,000.00 to be paid by Orchard Ridge to TRCA, and in addition Orchard Ridge shall reimburse any legal, survey and other costs incurred by TRCA to complete this transaction;

ii) an archaeological investigation be completed, with any mitigative measures being carried out to the satisfaction of TRCA staff, all at the sole expense of Orchard Ridge;

iii) a permit pursuant to Ontario Regulation 166/06, as amended, be obtained by Orchard Ridge prior to commencement of construction;

iv) TRCA lands disturbed by the proposed works be revegetated or stabilized following construction and, where deemed appropriate by TRCA or City of Pickering staff, a landscape plan be prepared for TRCA staff review and approval in accordance with existing TRCA and City of Pickering landscaping guidelines;

v) Orchard Ridge and the City of Pickering shall fully indemnify and save harmless TRCA from any and all claims from injuries, damages or loss of any nature resulting in any way, either directly or indirectly, from the granting of this easement or the carrying out of construction;

vi) any additional considerations as deemed appropriate by TRCA staff or its solicitor;

THAT said easement be subject to the approval of the Minister of Natural Resources and Forestry in accordance with Section 21(2) of the Conservation Authorities Act, R.S.O. 1990, Chapter C.27, as amended, if required;

AND FURTHER THAT authorized TRCA officials be directed to take the necessary action to finalize the transaction including obtaining any necessary approvals and the signing and execution of documents.

CARRIEDBACKGROUNDOrchard Ridge has formally requested a permanent easement for a new storm sewer outfall, located on the south side of Park Crescent and west of Cliffview Road. Orchard Ridge is developing a 51 lot residential subdivision on a large, vacant parcel of land located at 560 Park Crescent. In accordance with approved draft plan of subdivision conditions, Orchard Ridge is required to upgrade the storm sewer system along Cliffview Road and Park Crescent to accept the increased runoff from the development. The new storm sewer system and outfall is the final municipal requirement in order for the subdivision to complete registration. The permanent easement will be assumed by the City of Pickering for maintenance following completion of construction.

The site of the new outfall is located within the Regulated Area of the Lake Ontario waterfront. A permit application pursuant to Ontario Regulation 166/06, as amended, is presently being reviewed by staff and will be brought forward to a future Executive Committee meeting.

The subject TRCA-owned lands were acquired from two owners at different times; the Estate of W. H. Moore on January 22, 1965, under the Petticoat Creek Conservation Area Project and from the Fairport Beach Ratepayers Association on October 1, 1993, under the Land Acquisition Project - Lake Ontario Waterfront Pickering / Ajax Sector.

Staff has carried out negotiations with Orchard Ridge's representative, Ms. Anna Fagyas, Development Manager, and have agreed to a payment of $10,000.00 for the permanent easement, plus applicable survey, legal and other costs incurred by TRCA. This compensation amount is consistent with past negotiations for easement requests of a similar nature across TRCA land.

PlantingsAll lands disturbed by construction will be stabilized and, where deemed appropriate by TRCA staff, revegetated with native woody and herbaceous plant material in accordance with existing TRCA and City of Pickering landscaping guidelines. A landscape plan will be prepared as part of the permit application submission.

A plan illustrating the permanent easement location is attached.

RES.#B16/15 - LICENSE AGREEMENT FOR EMERGENCY ACCESSMeadowbrook Golf and Country ClubTown of Whitchurch-Stouffville, Regional Municipality of York, Rouge River Watershed, CFN 48538. Request for a license agreement to facilitate crossing of Meadowbrook Golf and Country Club property for emergency access to the southern portion of Bruce's Mill Conservation Area, located to the south of Stouffville Road and east of Warden Avenue, Town of Whitchurch-Stouffville, Regional Municipality of York, Rouge River watershed.

THE EXECUTIVE COMMITTEE RECOMMENDS THAT Toronto and Region Conservation Authority (TRCA) enter into a license agreement with Meadowbrook Golf and Country Club for emergency access requirements;

THAT the term be one year and shall renew annually unless terminated by either party upon 90 days written notice to the other;

THAT the consideration be for the nominal sum of $2.00;

AND FURTHER THAT authorized TRCA officials be directed to take the necessary action to finalize the license agreement, including obtaining any necessary approvals and the signing and execution of documents.

CARRIEDBACKGROUNDTRCA staff has identified a lack of rapid access for emergency vehicles and personnel to the southern portion of Bruce's Mills Conservation Area (BMCA). In order to access this public safety concern, staff has approached the Meadowbrook Golf and Country Club (Meadowbrook), the neighbouring property to the south, to discuss the possibility of TRCA entering into an emergency access agreement across the existing parking lot at the golf course entrance located east of Warden Avenue. Subsequently, Meadowbrook has agreed to enter into a License Agreement with TRCA for this purpose.

RATIONALEAt present, should an emergency situation occur within the southern portion of BMCA, emergency vehicles and personnel would have to travel via the existing Stouffville Road entrance and internal roadway. This route is long with limited visibility and speed limits inconsistent with the requirements of emergency personnel and vehicles. The likelihood of police, fire and EMS vehicles travelling well above the posted speed limit of 20 km/hr. poses a hazard for other park guests travelling along the internal roadway as well as increases the anticipated average response time to the site of an emergency in the southern area of BMCA. While also improving overall public safety, given the existing conditions and associated constraints, staff is confident an emergency access through Meadowbrook's parking lot will assist in eliminating these concerns.

WHEREAS the Town of Whitchurch-Stouffville has requested an additional extension to lease for soccer fields within the Bruce's Mill Conservation Area, Regional Municipality of York;

Since 2001, between May 15th and September 15th TRCA has been leasing the subject parcel of land in Bruce's Mill Conservation Area to the Town of Whitchurch-Stouffville for the purpose of operating four mini soccer fields during week day evenings between the hours of 6pm to 9pm. Outside of these times the fields are available to Bruce's Mill Conservation Area visitors for both passive and active use.

The Master Plan for Bruce's Mill Conservation Area was completed and endorsed by TRCA in November of 2011. The soccer fields are located in an area that has been designated as Public Use space in the Master Plan. The Public Use management zone allows for recreational and educational uses, facilities or services and may accommodate low, moderate or high intensity public use. The Master Plan's recommendation for these fields is that they remain available as multi-purpose recreational activity fields. The multi-purpose recreational activity field uses continue to be refined. No specific opportunity or use has been determined or specified other than the soccer use.

Given the present arrangement, with the aim of continuing to allow for flexibility, staff recommends that the lease, inclusive of the same terms and conditions, with the Town of Whitchurch-Stouffville be extended for five years with one five year renewal period at TRCA's sole option.

FINANCIAL DETAILSThe lease rate for 2014 was $7,500. The lease rate has been incrementally increased by $200 per year over the last lease term and the two year options to renew; accordingly, staff will maintain an annual rate increase of $200 per year. Therefore, staff is proposing a lease rate of $7,700 for this year, $7,900 for 2016, $8,100 for 2017, $8,300 for 2018 and $8,500 for 2019.

CARRIEDBACKGROUNDThe Restoration Projects (RP) and Resource Management (RM) groups within Restoration and Infrastructure Division currently have 22 vehicles (10 RP, 12 RM) to transport supplies, materials and staff to various project sites throughout the TRCA jurisdiction.

Restoration Projects staff has identified a need for two additional vehicles to support the current and future projects within the group, increased workload from stormwater management pond enhancements (water quality, water quantity, pond volume), as well as various construction projects involving water quality improvements, natural channel restoration, enhanced terrestrial and aquatic habitat, and increased native tree and shrub cover.

Resource Management staff has identified a need to acquire two additional vehicles to support the increasing demand of the forestry and emerald ash borer programs, as well as assist with various planting programs, nursery deliveries and the increasing work schedule of construction projects.

The four vehicles must have the ability to carry up to six staff, access off-road project sites, carry all supplies and materials to project sites, and have the potential to tow a heavy trailer.

RATIONALERequest for Quotation #10000211 was publicly advertised on the electronic procurement website Biddingo (www.biddingo.com) on January 28, 2015 with a closing date of February 6, 2015.

The quotations were opened by the Procurement Opening Committee (Aubrey Orr, Judith Reda and Jenifer Moravek) on February 9, 2015. There were 13 suppliers that viewed the documents online; subsequently there were four submissions with the following results:

BACKGROUNDThe Albion Hills Field Centre (AHFC), which was originally constructed in 1962, is a large scale residential environmental/educational field centre located in the Town of Caledon. As part of TRCA’s framework plan for AHFC, the building has recently undergone five phases of extensive renovations to improve the buildings envelope, operational systems and infrastructure components that were at their end-of-life.

On June 2nd, 2014 TRCA staff retained C.L Construction through a competitive process to perform the work for Phase 5 of the retrofit which consisted of upgrades to the existing HVAC system, washroom upgrades (girls/boys dormitory room facilities and ensuites), and a new lighting plan for the entire building. During the tender process an assessment of C.L Construction's experience and ability to undertake the work was conducted through reference checks for projects of a similar nature which resulted in positive feedback that they were capable of undertaking the scope of work.

Site inspections performed by TRCA staff during the construction determined that the tile and waterproofing work performed by C.L Construction failed to meet the specifications outlined in the design drawings. C.L Construction's unwillingness to rectify the tile work or water proofing deficiencies resulted in the inability to utilize the washrooms which forced the cancellation of all scheduled fall programming. On November 10th, 2014 TRCA terminated C.L Construction's contract for failure to meet the contract timelines required to resume TRCA's scheduled client bookings and programming. Since the termination of the contract, the bonding company for C.L. Construction has been investigating the matter in order to recoup the costs to complete the work in a timely manner.

On December 3rd

, 2014 TRCA obtained approval through a competitive process to retain Berkim Construction Inc. to amend the deficiencies. While performing repairs to correct the tile work and waterproofing deficiencies, additional major issues were uncovered by TRCA staff related to the plumbing infrastructure installed by C.L Construction. The deficiencies were not originally discovered by the engineer and Town of Caledon inspector as C.L Construction enclosed these areas and did not submit photographic evidence that the work was completed as requested by the engineer and town inspector.

Upon further inspection by the engineer and the Town of Caledon inspector, it was concluded that the plumbing infrastructure was not consistent with the design drawings, thus not meeting current building code standards. Not knowing the extent of the plumbing deficiencies in the other washroom locations, TRCA staff utilized the on-site contractor Berkim Construction to rectify all plumbing related deficiencies on a time and material basis to ensure conformance to both the contract specifications and the building code, ensuring availability for scheduled bookings.

RATIONALEThe additional plumbing work consisted of demolition/removals, installation of piping, reinstalling the flooring substrate and fixtures. Having Berkim Construction mobilized on-site, and due to the additional costs and time associated with obtaining another competitive quote, the option to extend the scope of work on a time and material basis was reasonable. Given Berkim Construction Inc.'s particular knowledge of the extensive repair work to be performed and the urgency to resume client bookings and programming, it was advantageous to extend Contract RSD14-199 for washroom deficiency repairs at the Albion Hills Field Centre for an additional cost of $64,487.34, for a revised total cost not to exceed $165,252.34, plus HST.

The additional demolition/removals, installation of piping, flooring substrate and fixtures was completed on February 6th, 2015 at which time TRCA obtained occupancy for the building permit and was able to commence with regular scheduled bookings and school programming.
