MARIN BUILDERS ASSOCIATION CELEBRATES PASSAGE OF BILL THAT WILL REDUCE LANDFILLNovember 25, 2014 – San Rafael, CA —
The Marin Builders Association presents
a certificate of appreciation to Assembly
Member Marc Levine for his efforts as the
author of the Marin Builders Association
sponsored bill, AB 2355 (Levine).
Because of this new legislation, by
January 1, 2017, a local government that has
jurisdiction over a street or highway must
either adopt the standards developed by the
Department of Transportation for recycled
paving materials and for recycled base,
sub-base, and pervious backfill materials, or
discuss why it is not adopting those standards
at a public hearing.

Association said “This important piece of
legislation will allow the construction industry
to be responsible stewards and do our part
in complying with AB 32. We are honored
to have been part if this process and look
forward to working with Assembly Member
Levine in the future on other legislation
important to our industry and our community.”
Assembly Member Levine said “This
bill reduces demand on raw materials and
furthers our zero waste goals by diverting
recycled materials from our landfills. It’s a win
for our environment that we all can celebrate.
I thank the Marin Builders Association.”
AB 2355 (Levine) was the outcome of
Marin’s Roofs to Roads project. The Marin
Builders Association in partnership with Marin
Sanitary Service and ZeroWasteMarin.org
began the Roofs to Roads project in 2013.
Local roofers are able to recycle composition
shingles at Marin Sanitary Service. The
discarded roofing shingles will be turned into
a renewable asphalt base or hot mix additive
for paving.

For a change, something refreshing! Following
are two articles showing how government is
working hard to ‘level the playing field’ for
legitimate contractors.
California Labor Commissioner Bans Cheating Contractors from Public Works ProjectsThree years ago, Labor Commissioner Julie
A. Su was appointed to lead the Department
of Industrial Relations’ (DIR’s) Division of
Labor Standards Enforcement, commonly
known as the Labor Commissioner’s Office.
Since that time, her Public Works unit has set
new records for the efficacy of its labor law
enforcement.
In 2012, the combined total of over $25 million
in wages and penalties found due on public
works projects was the highest in a decade. In
2013, the Labor Commissioner’s Public Works
unit broke its own record and found over $40
million in wages and penalties owed. One
of Commissioner Su’s most effective tools
against corruption in public works projects is
debarment.
“Commissioner Su and her team are focused
on providing a fair and balanced playing field
for contractors who abide by the laws,” stated
DIR Director Christine Baker. “Without our
enforcement, businesses that abide by our
laws have a difficult time competing against
cheating contractors.”
Debarments
The Labor Commissioner works to ban
contractors from participating in the public
works arena at all when they intentionally
deny their workers proper wages. Debarments
can range from one to three years and prevent
contractors from bidding or working on a
public works project. Additionally, the Labor
Commissioner may choose to publish the
terms of debarment in construction industry
publications.
“My office is focused on using every tool in
our belt to combat wage theft on public works
projects. Debarment and criminal prosecution
by proactive district attorney’s offices are
an intentional strategy to keep bad acting
contractors from receiving public funds when
they steal from their workers and to protect the
good guys,” stated Commissioner Su.
This year, Commissioner Su has already
signed debarment orders against 23 contractor
entities and/or their representatives, the highest
number of debarments on record with the
Labor Commissioner’s office. There are also
additional debarment cases currently going
through the legal process. The following are
examples of some recent cases.
In March, Commissioner Su signed an order
debarring Tadros & Youssef Construction,
Inc., as well as Kamel Shaker Tadros and
Makram Youssef individually from doing
public works through May 9, 2017. Mr.
Tadros and Mr. Youssef failed to report
workers on certified payroll records, and in
some instances, they shaved workers’ hours
on certified payroll records by requiring 50
hours of work a week and only paying for 40.
They also intentionally misplaced workers into
lower pay classifications for work performed at
higher skill levels.
In June, Commissioner Su debarred National
Drywall Corporation and individually
debarred Miguel and Dora Contreras through
August 3, 2017. The Contreras’ required
employees to work under several different
names and to use multiple fraudulent social
security numbers. As a result, the names on

the certified payroll records did not match the
actual workers’ names. These workers were
not paid for all of the hours they worked, and
were misclassified as drywall stockers for
doing drywall finishing work.
In September, Commissioner Su debarred
Titan Electrical Construction, Inc. and
individually debarred Oliver Stickney and
Jamie Noel Furr through November 2, 2017,
for public works projects in Contra Costa
County. Both men lied on certified payroll
records, and lied to workers about paying
prevailing wages into their pension plans. Mr.
Stickney admitted that fringe benefit payments
were used to keep the business afloat instead.
“These contractors gained a competitive
advantage against their competitors by directly
stealing from their hard working employees,”
stated Commissioner Su.

Criminal Prosecutions
In addition to using debarments to prevent
labor law violations, Commissioner Su and her
staff continually meet with district attorneys
throughout California to work collaboratively
on criminal prosecutions. As a result of these
meetings, several criminal cases are being
prosecuted across the state. One such case
includes the matter of Reza Mohammedi, who
pled guilty to embezzling over $350,000 from
his employees in 2013 in Orange County. Mr.
Mohammedi was sentenced to two years in
prison for this wage theft.
Another case concluded on September 25,
2014, when Sourin Babayan, a fire sprinkler
installer contractor, plead guilty to 17 felony
counts of taking and receiving a portion of
his workers’ wages and six felony counts
of dissuading a witness from prosecuting a
crime in Orange County Superior Court. Mr.
Babayan stole more than $80,200 from his
workers and will spend two years in state
prison.
“I want to acknowledge the excellent work of
my Public Works Team, led by Assistant Chief
Eric Rood, and Statewide Regional Manager
Susan Nakagama,” said Commissioner
Su. “We have re-energized public works
enforcement in California, invested in our staff
through continuous training, and embrace our
law enforcement role.”

News From The Contractors State License Board
Notorious Transient Paver Finally Lands Long State Prison TermGeorge Stanley’s failed probation finally
wraps up CSLB case that started in 2008
It took more than six years… and thousands of
hours of investigative and staff work, and now
the Contractors State License Board (CSLB)
can finally close its case against George Joseph
Stanley. This month Stanley, also known as
Inmate Number AV1570, began serving an 11-
year state prison sentence at Deuel Vocational
Institution in San Joaquin County.
Stanley was caught by CSLB throughout
California, and by contractor boards from
other states, since 2008 for cold-calling
residents and businesses with a truckload of
fresh asphalt and offering inexpensive paving
work because he has “leftover material from a
job he just completed in the area.” Networks of
traveling criminals in the construction arena
use this common ploy to hook unsuspecting
consumers. When the job is completed, they
immediately demand a significantly higher
amount, claiming that more material had to be
used, and the customer later finds the pavers
used thinly-applied, useless material.
Stanley was on criminal probation from
Butte County for multiple counts of fraudulent
use of a contractor license and grand theft by
false pretenses. He had been ordered not to
work in the construction industry, and pay

consumer restitution, that is, until he was
found, once again, working as a paver. For
not following probationary terms, Stanley
has been convicted and ordered to prison
for 13 felony counts (Penal Code sections
487(a) – grand theft, and 532(a) – theft by
false pretenses), and misdemeanor charges of
contracting without a license (Business and
Professions Code section 7028), for work he
performed in Kern County.
In addition to prison time, Stanley’s
sentence, handed down November 5, 2014,
includes 13 new victim restitution orders that
total more than $360,000. He was admitted to
Deuel on November 14, 2014.
“The tremendous amount of investigative
work by CSLB’s Statewide Investigative Fraud
Team (SWIFT), and local investigators and
prosecutors from several counties, has paid
off,” said CSLB Registrar Steve Sands. “This
individual may be behind bars, but consumers
still need to watch out for these types of
construction scams by first checking CSLB’s
website to make sure the person is a state-
licensed contractor.”
Stanley and his associates and/or relatives,
have been caught engaging in paving scams
in Tulare, San Joaquin, Stanislaus, Butte,
and Yuba Counties. He also was known to
be in Imperial, Fresno, and Ventura counties.
His relatives, Kevin and George Snow, were
arrested on similar contracting violations in
Monterey and San Benito counties. Originally
from Moosup, Connecticut, Stanley has
been living in Stockton in recent months to
meet his California probation terms. This
group of swindlers also has been known to
harm consumers, including the elderly, in
Massachusetts, Pennsylvania, Colorado,
Washington, and Hawaii.

Driver Safety – Winter Driving
Fair or foul weather driving always presents hazards. But winter months present drivers with conditions that are far different from those they face during the rest of the year. Brakes:
• Know your brakes: When your brakes lock up on wet and slippery roads or during a panic stop, you lose steering control and your vehicle can spin.
• Anti Lock Braking Systems (ABS): In vehicles equipped with ABS, the driver's foot remains firmly on the brake pedal, allowing the system to automatically pump the brakes. Rear wheel ABS prevents wheel lockup so your car stays in a straight line. If your car has ABS control on all four wheels, you also keep steering control. If you have steering control, it is possible to avoid a crash by steering around hazards if a complete stop cannot be accomplished in time.
• Get the feel of the road: While braking or accelerating, do so gently. Be aware of how slippery the road is and adjust your speed accordingly. Rising temperatures greatly increase the slipperiness of ice and snow.
• Brake before curves: All vehicles are particularly sensitive to over-powering and over-braking on curves. Unseen hazards around the bend may require an evasive action, so turn your steering wheel slowly and smoothly, keep a constant speed in the turn, and pump your brakes carefully if it's necessary to slow down or stop.
• Stretch your "following" distance: Knowing that winter surfaces increase stopping distance three to 12 times, the smart driver increases their normal dry road following distance. Heavy trucks require a longer stopping distance on slippery roads than passenger cars. Remember… don't tailgate.

Driver Safety – Winter Driving
Tires:
• Make sure you have the right tires: Tires with deep treads are essential for safe cornering and handling on slippery roads. Check the air pressure frequently to maintain the manufacturer's recommended pressure.
Visibility:
• Be able to see and be seen: Clean all the snow and ice off of your windshield, other windows, outside mirrors, lights, and reflectors.
• Make sure your vehicle is equipped with good wipers: Check that wiper arms exert enough pressure on the blades to ensure a clean sweep. If moisture or ice builds up on the inside or outside of your windshield, stop and clean it off.
Lights:
• Use proper lights: Never drive with parking lights instead of headlights during late winter afternoons or in the early evening. Parking lights can cause an oncoming driver to think you are farther away than you are. Keep headlights clean; dirty headlights can greatly reduce your long-distance vision at night.
Lastly, assure that you and your vehicle are prepared for winter weather with emergency gear and proper tires, chains, and excellent vehicle maintenance.

Seguridad al conducir – En invierno
Conducir en clima bueno o malo siempre implica riesgos. Pero los meses de invierno presentan a los conductores condiciones que son muy diferentes a las que enfrentan durante el resto del año.
Frenar:
• Conozca sus frenos: Cuando se bloquean sus frenos en las carreteras mojadas o deslizantes o al frenar de emergencia, pierde el control de dirección y su vehículo puede sufrir un trompo.
• Sistemas de frenos antibloqueo (ABS): En vehículos que cuentan con ABS, el pie del conductor permanece firmemente sobre el pedal del freno, permitiendo que el sistema bombee los frenos automáticamente. In the event of an emergency, our first responders will be overwhelmed. It is critical for citizens to be prepared to take care of themselves, their neighbors, and their community for at least 3 days, and preferably 5-7.
ReadyMarin.org is Marin County’s website for information on emergency preparedness, whether you are just learning or an experienced emergency volunteer. Our mission is to provide guidance, training and resources to keep you and your family safe during an emergency, whether it requires you to evacuate or shelter in place. For those of you who wish to step beyond preparing your home and reach out to help your community in an emergency, train to be a Community Emergency Response Team (CERT) member.

The BA is a central part of the Estimating Team and is primarily responsible for acquiring, preparing and submitting bid documents. The BA is the liaison between Owners and the Estimators where bid documents and procedures are concerned as well as be-tween Estimators and the Bid Runner on bid days. DUTRA IS SEEKING ESTIMATING ADMINISTRATOR
Dutra is currently looking for an Estimating Administrator. This position supports the Estimating Department. Successful applicant will be re-sponsible for distributing, organizing and maintaining bidding documents such as plans, specifications, addenda and quotes. Will also work to support the Chief Estimator and Proposal and Contracts Manager in preparing estimates, proposals, Statement of Qualifications and marketing materials. Additionally, will assist the Contract Administrator with bonds, contracts and tracking SBE participation.
ESSENTIAL DUTIES AND RESPONSIBILITIES:• Distribute, organize and maintain bidding documents including printing, copying, filing and tracking distribution.• Assist in the preparation of estimates, proposals, SOQs and marketing materials.• Assist in the preparation of contract documents, bond requests and Small Business Enterprise (SBE) requirements and goals.• Keep accurate records of SBE participation. Ensure company is compliant with SBE regulations.• Maintain detailed and organized files on future, current and past projects.• Prepare reports, maintain estimating schedule and track contract deadlines.• Identify and track bidding opportunities.

importance of the team-related aspects of the essential duties, the aggres-sive timeframes under which the employee will operate, and the need for face-to-face interaction with employees in Estimating and Operations in order to properly perform job-related functions.
SUPERVISORY RESPONSIBILITIES: This position has no supervi-sory responsibilities.
