TermsandConditions

MarqueeHireDirectisatradingnameofTheHighfieldGroup,theirsub-contractors,agentsandorrepresentativesandarereferredtointheseStandardTermsandConditionsasthe‘Owner’.The‘Hirer’istheperson,representative,agent,company,firmorthelike,takingtheOwnersEquipmentonhire/sale.The‘Equipment’istheequipmentorservicesuppliedonhire/salefromtheOwner.

01. General

01.1. TheseTermsandConditionsapplytoallContractsenteredintobytheOwnerandshallnotbeexcludedbyanyotherTermsandConditionswhatsoever.

01.2. AQuotationgiveninwritingwillbebindingbytheOwnerforaperiodof14daysfromthedateshownontheQuotationunlessshowndifferentlyontheQuotation.

01.3. AQuotationisacceptedbytheOwnerfromtheHirereitherbyemail,inwritingorverbally.Onacceptance,theOwnerwill issue aConfirmationofBooking and invoice for thedeposit payment if applicable. Thedeposit, if applicable, ispayableuponreceiptoftheinvoiceandwillnormallybe10%ofthevalueshownontheConfirmationofBooking.WhentheOwnerreceivesbothpaymentofthedepositANDasignedConfirmationofBooking,thehireisconfirmed.ThesignedConfirmationofBookingformstheContractbetweentheOwnerandtheHirerandisstrictlysubjecttotheseTermsandConditions.

01.4. TheOwnerretainstitleoftheEquipmentatalltimesunlessanitemofEquipmentisclearlyshownassold.Ifsold,titleoftheequipmentwillnotpassuntiltheOwnerhasreceivedpaymentinfullbyclearedfundsfromtheHirer.IntheeventtheHirersellstheEquipmentwithorwithoutpermissionoftheOwner,theHirerdoessoasanagentoftheOwnerandanymoniesdue/paidwillbepayabledirectlytotheOwner.AnymoniesreceivedbytheHirerforEquipmentsoldpriortopaymentinfulltotheOwnerwillbeheldforthebenefitoftheOwner.

01.11. ShouldtheOwnerfailtomeettheobligationscontainedintheConfirmationofBooking,thetotalliabilityoftheOwnerwillbelimitedtoanamountbeingtwicethehirechargeasshownontheConfirmationofBooking.

01.12. TheOwnerwilldoallpossibletosupplytheEquipmentasshownontheConfirmationofBookingbutreservestherighttovarysuchEquipmentshouldtheneedariseandwillacceptnoclaimforcompensation.

01.14. TheOwnerwillnotberesponsibleforcolourmatchtootherequipmenteitherwherehiredfromelsewhereorownedbytheHirer.

01.15. TheOwnerwillnotberesponsible forcompatibilitytootherequipmenteitherwherehiredfromelsewhereorownedbytheHirer.

01.16. TheOwnerwillnotberesponsibleforbestfitoftheEquipmentwhereitistobeusedwithanyotherequipmenteither where hired from elsewhere or owned by the Hirer. The Hirer is totally responsible for making anynecessaryadjustmentstosuit.

01.17. TheOwnerwillacceptnoresponsibilityorliabilityfornon-fulfilmentduetowar,civilcommotion,riot,adverseweather conditions, force majeure, fire, breakages, government controls, priority regulation, scarcity ofequipment, labourproblems, transportdifficulties,actsofGodoranyothersituationwhichmay fromtimetotimeariseandarebeyondthecontroloftheOwner.

02.Insurance

02.1. It is theHirer’s responsibility toensure that theEquipment ishired fromtheOwnerona fullandold fornewreinstatement basis. Confirmation of cover in place at all times during a hire period is to be provided to theOwnerbytheHirerpriortosupplyofEquipment.TheOwnerwillretaininsurancedetailsprovidedbytheHirerfor the event of further hire. The total replacement cost will be shown on the Quotation/Confirmation ofBooking.

02.2. The Hirer is totally responsible for all Equipment on hire from time of delivery/collection by the Owner orcollection/returnbytheHirer.

02.3. TheHirerwillindemnifytheOwneragainstallclaimsforlossordamagehowsoevercausedunlessitcanbeproventhattheOwnerwasnegligentorinbreachofanyStatuteorCommonLaw.

02.4. TheHirerwillindemnifytheOwneragainstallclaimsforinjurytoanypersonwhosoeverandhowsoevercausedunlessitcanbeproventhattheOwnerwasnegligentorinbreachofanyStatuteorCommonLaw.

03.Cancellation

03.1. ShouldtheHirercancelaConfirmationofBookingmorethansevendaysbeforethehiredate,thedepositpaidisnon-returnable.TheHirerwillberequiredtopaythe fullamountof thechargeshownontheConfirmationofBookingifacancellationiswithin7daysofthecommencementdateoftheofthehireshownasshownontheConfirmationofBooking.

04.Delivery/CollectionandLateReturn/Loss

01.5. ‘Dryhire’isthetradehireofEquipmentonly.Dryhireisonthebasisthatcollection,return,buildanddismantleisthetotalresponsibilityoftheHirerusingtheirownvehicle/s,plantandqualifiedstaff.

01.6. ‘Wethire’isthetradehireofEquipmentwherebytheOwneralsobuildsanddismantlestheEquipmentonbehalfoftheHirer.ThepricewillincludefortheOwnertotransport,buildanddismantletheEquipment.01.7. Inrespect of ‘Wet Hire’, the Owner will do all possible to meet delivery/collection dates quoted on theConfirmationofBooking.TheOwnerwillhowevernotacceptresponsibilityforanylosseswhatsoeverinvolvedinanydelaycausedoutsidecontroloftheOwner.

04.1. WhenEquipment is tobecollectedby theHirer, theHirer is tobe totallysatisfiedwith theEquipmentbeforeleavingtheOwnerspremises.TheHirerisrequiredtosignfortheequipmentcollected.TheOwneracceptsnoresponsibilityforanyshortage/damageaftercollectionandsignatureoftheEquipment.

04.2. Equipmentistobecollected/returnedonthedatesshownontheConfirmationofBookingunlesspriornotifiedinwritingtotheOwnerbytheHirerandthereafteragreedinwritingbytheOwner.

04.3. TheOwnerwillchargeforEquipmentnotcollectedonthearrangeddateunlessithasbeenpreviouslycancelledinwritingbytheHirertotheOwner.

04.4. The hire period is as shown on the Confirmation of Booking. Any additional hire charge for Equipment notreturnedontheduedatewillbetheadditionaldailyrateshownonthePriceList,chargedforaperiodofthreedays.Onthefourthday,thenon-returned/lostequipmentwillbechargedforbyinvoiceatthefullreplacementvalue plus 15% cover handling and administration. This invoice is payable by the Hirer to the Ownerimmediately. In theperiodafter the thirddayanduntil payment cleared fundsof the replacement invoice isreceived,hirechargeswillcontinuetoapplyattheadditionaldailyrateandaretobepaidbytheHirertotheOwnerimmediatelyonreceiptofaninvoice.

04.5. WhenEquipmentisdeliveredtositeandcollectedbytheOwner,thecostwillbeshownontheConfirmationofbooking. TheHirer is responsible forarrangingeaseof access toand from the siteand theoffloading/loadingfrom/totheOwnersvehicle.

04.6. TheOwnerdeliversandcollectsonlyto/fromasuitablehardsurface.04.7. ItistheresponsibilityoftheHirertobepresenttoacceptdelivery/collectionoftheEquipment.TheHireristobe

satisfied with the Equipment before the Owner leaves site from delivery and collection. If the Hirer is notsatisfiedwiththeEquipment,theHirermustinformtheOwnerimmediatelyandconfirmitinwritingwithinthreedays.

04.8. WhentheOwnerdeliversorcollects theEquipment to/fromtheHirer,anyadditionalhandling,standingtime,obstructedaccess,deliverytootherthanasdetailed,increaseinchargesforlabourortransportcostsbeforeorduringthehireperiodwhichforwhateverreasonisbeyondthecontroloftheOwnerandnotallowedforintheConfirmationofBookingwillberecordedandatthediscretionoftheOwner,mightbecharged.

04.9. When theOwner collects Equipment from site, the Equipmentwill be visibly checkedbefore leaving and anydamage/shortagewillbeadvisedtotheHirer.AttheearliestopportunityonreturntotheOwner’sDepot,theequipmentwillbefullycheckedandanydamage/lossiffoundwillbereportedtotheHirerwithin24hours.Anydamage/loss will be charged at the repair/replacement value of the item plus 15% to cover handling andadministration. Payment is due upon receipt of the invoice. In the meantime, after collection and beforepaymentofanyinvoicefordamage/loss,hirechargeswillcontinue.SubstituteEquipmentwillnotbeacceptedby theOwner. TheOwnerwill on requestof theHirer,providewrittenevidenceof the cost to repair/replaceitems.

04.10 WhereEquipmentisreceivedbytheOwnereitherdamagedorshort,theOwnerwillreservetherighttodecideifthelossordamageistheresponsibilityoftheHirerortheOwner.WhereitisdecidedthatthelossordamageistheresponsibilityoftheHirer,itwillbechargedatcostplus15%tocoverhandlingandadministration.

04.10. AllEquipmentshouldbereturnedtotheOwneringoodconditionandnotbeabnormallysoiledi.e.requiringadditionalcleaningbeforebeingre-usedelsewhere.Anadditionalcleaningchargeforsuchsoileditemswillbemade.

05.Payment

05.1. TheHireristomakepaymentstrictlyinaccordancewiththeConfirmationofBooking.05.2. Equipment will not be provided when payment has not been made in accordance with the Confirmation of

Booking.05.3. FurtherEquipmentwillnotbesuppliedtoaHirerifanyoutstandingmoniesareowedbytheHirertotheOwner.05.4. TheOwnerreserves theright tocharge interestonanyamountoutstandingontheduedateata rateno less

than2%permonthaccruedonadaytodaybasis.05.5. Anydiscountshownisconditionalonstrictcompliancewithpaymentterms.05.4. AllpricesareplusVATunlessshown.

06.PowerConnection

06.1. Thehireofelectrical/heatingequipmentdoesnotincludeforconnectiontothepowersupply.

07.Fuel

07.1. Fuel(dieselorLpgas,etc)isnotincludedinthehirecostandistheresponsibilityoftheHirerunlessshown.
