The Supreme Court should please take notice that Respondent, the Honorable

Administrative Judge Mark A. Betleski, on October 3, 2014 entered and served upon Relators,

the Lorain County Coinmissioners, an order that modifies the August 27, 2014 order that

Relators contest in this case. The new order (file-stamped copy attached) provides Relators with

the option of providing to the Common Pleas Court General Division itself, rather than the

Sheriff, the required funds for court-facility security. There is presently no security whatsoever

for court facilities that house the court's Adult Probation Department and Presentence

Investigation Unit.

Thzs matter came before the Court following the request of the I.oraia County Sleriffforfimd°uQg to provide secudty for the Adult Probation Department with offices loeated at 308 SecnndStreet, and 216 Third Street, Elyria, Ohio.

The relevant facts in this matter are as follows:On July 24, 2014, the Office of Court Securirty for the Supreme Gourt of Obio provided this

Court with a Physical Secwrity Assessment for the Court facllities co :° ` the Adnlt PrflbationDepsrtment and Presentence lnvestiSation Unitl In conforaiity with the Oluo Court SecurityStandards, the Assessment recommended, iater slia, that secor.rty searches be conducted on all personsentering these facffities? Additioaally, wallc t6rough msgnetometexs with accom,panying x-ray forviewang packages and handbags are also enotd to ensure a safe eavimnmenL To perform thesefimctions, uniformed court seourity ojMcers must to be assigned in sufficient numbers to ensure thesecurity of these faoilities.3

Cuaently there are no uniformed count secunty offi.cers located in eitlzer of these facilities.AcxordiagIy, on July 31, 2014, the Com sent a letter to the Lorain County Sheriff theassigament of uaifamied deputies and appropriate screening devices for both facilitie^s.4 ^pln'So RevisedCode §311.07 dirwts th^ee Sheriffto attend upon the Court and furthermore vests the Sheriff withrespom'biiity for Cowt facilities. Ptiusuent to this mmulate, the Sheriff presentty provides secucity forthe entire I,orain County Jus6oe Center.

On August 13, 2014, Sheriff Stammrttf sent a letter to the Lorain County Commissionersreque.sting additionai fuading ta meet the security needs of the Court, Aocording to the Sherff s letter,"I do not have this fimdding in my present budget and am requesdng the fimding from you to meet therequirements that have beea recommrended by the Ohio Supreme Court Security Assessment and alsothe letter of compli.ance from Administrastiiive Judge Jmaes M. It is the determination of this Court that a safe and secure Court f3cility is essential for theperformaace of the Conrt's obligations. This necessity stems not only from a duty to the public whovisit these locations, but also a responsibiiity to the employees of the Court who must ocoupy thesefacMes on a regular basis. In a:ccordance with the Ohio Court Secuniiy Standards and the SeciuityAssessruent s;ondncted by the Offi ce of Court Secutity for the Supreme Court of Ohio, the LorainCounty Sheriff has requested additional fuading to provide the necessary security for the Cotut's AdultProba#ion Department and T'resentnce Investigation Unit.
