Commissioners said the Pledge of Allegiance.

Commissioner Lundy gave an inspirational word of the day.

Commissioner Kokoski presented a female German shepherd mix or choose from 15 other dogs. August 4 is dog days at the kennel.

WHEREAS, to improve the aesthetics of the corridor, attract investment, encourage job creation, and provide the County and the City of Vermillion with an implementable set of recommendations; and

WHEREAS, in accordance with ORC Section 307.86. MS Consultants was selected through a competitive bidding process; and

WHEREAS, the Lorain County Community Development Department has entered into negotiation with MS Consultants to provide consultant services for preparation of a corridor study of State Route 6 from its intersection with Baumhart Rd and continuing west to the county line; and

WHEREAS, MS Consultants has agreed to assist Lorain County with preparation of a strategic plan to assist with identifying funding and implementing corridor improvement; and

WHEREAS, MS Consultants has agreed to enter into contract to provide these services for an amount not to exceed $35,000; and

WHEREAS, $35,000 of these services will be paid from Economic Development 1000. 0000.100.116.01.6200.6218;and

NOW, THEREFORE BE IT RESOLVED, based upon the above information, the Lorain County Board of Commissioners hereby authorizes the County Administrator to enter into a contract with MS Consultants to conduct a State Route 6 corridor study.

WHEREAS, Lorain County Transit was awarded FY2018 Ohio Transit Preservation Partnership Program funds from the Ohio Department of Transportation (ODOT) in the amount of $240,000 which includes Transportation Development Credits in the amount of $48,000 to purchase four (4) 25-foot replacement light transit vehicles;

WHEREAS, Lorain County Transit received approval to purchase replacement vehicles thru ODOT’s Cooperative Purchasing Program, contract #248-17;

WHEREAS, Bus Service Inc. is the vendor that was awarded the contract under ODOT’s Cooperative Purchasing Program to purchase the light transit vehicles.

NOW THEREFORE BE IT RESOLVED, by the Lorain County Board of Commissioners that we hereby authorize Lorain County Transit to purchase four (4) 25-foot replacement light transit vehicles from Bus Service Inc. in an amount not to exceed $240,000. In the matter of authorizing the Lorain County )Engineer to reimburse the Village of South Amherst )For the necessary repairs done to Russia Road Bridge) June 27, 2018No. 0160 as part of the Russia Road Phase 2 project ) WHEREAS, Ken Carney, Lorain County Engineer by letter dated June 18, 2018 submitted the following:

“Repairs were made to Russia Road Bridge No. 0160 as part of the Russia Road Phase 2 project within the Village of South Amherst. The repairs included removing the asphalt pavement down to the existing precast concrete bridge beams, re-waterproofing the entire bridge, and repaving. These repairs were necessary to maintain the integrity of the structure as the existing waterproofing had failed and moisture was causing damage to the structure, particularly the bridge beams.

The construction project was competitively bid and awarded to Crossroads Asphalt Recycling, Inc. for the amount of $179,984.20 with only a portion of that, $10,327.45, being attributed to the work on Russia Rd Bridge No. 0160. The project was primarily funded through OPWC and the Village of South Amherst. The final cost for the work on the bridge was $10,183.00 with OPWC paying $4,531.43 as a grant, leaving $5,651.57 as the local share. The Village of South Amherst has already paid for this work and is requesting reimbursement from the County for the $5,651.57 as this is a County maintained structure. This funding is available through the Engineer's MVGT funds.

At this time, the Engineer’s Office is respectfully requesting that the Board of Commissioners approve the Engineer's Office to reimburse the Village of South Amherst for the necessary repairs done to Russia Rd Bridge No. 0160 as part of the Russia Road Phase 2 project.”;

NOW, THEREFORE, BE IT RESOLVED by the Board of Lorain County Commissioners, that based upon the recommendation of Lorain County Engineer in letter dated June 18, 2018 we do hereby authorize the Lorain County Engineer to reimburse the Village of South Amherst in the amount of $5,651.57 for the necessary repairs done to Russia Road Bridge No. 0160, a county maintained structure, as part of the Russia Road Phase 2 project.

RESOLUTION NO. 18-433

In the matter of amending Resolution No. 18-374, adopted )May 29, 2008 clarifying when the Tax Exemption authorized)Thereby pursuant to Ohio Revised Code Sections 5709.77 )Through 5709.81 and 5709.85 commences ) June 27, 2018

WHEREAS, this Board, pursuant to Ohio Revised Code (“R.C.”) Sections 5709.77 through 5709.83 (the “TIF Statutes”), adopted Resolution No. 08-374 (the “Original Resolution”) creating an incentive district (the “Incentive District”) in the unincorporated territory of Lorain County (the “County”) and declaring “improvements (as defined in the TIF Statutes) to parcels of real property located within the Incentive District to be a public purpose and exempt from real property taxation, specifying public infrastructure improvements that would benefit or serve those parcels, providing for payments in lieu of taxes by the owners of the parcels and establishing a redevelopment tax equivalent fund; and

WHEREAS, this Board amended the Original Resolution by Resolution No. 18-433 (the “Amending Resolution”) to update the commencement date of the tax exemption provided for in the Original Resolution; and

WHEREAS, the County Auditor’s office has requested clarification of the Original Resolution, as amended by the Amended Resolution; and

WHEREAS, this Board has given notice of this proposed amendment of the Original Resolution to the Board of Education of the Midview Local School District and the Lorain County JVSD and to Eaton Township;

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF LORAIN COUNTY, STATE OF OHIO:

Section 1. Amendment of Section 3. Section 3 of the Original Resolution, as amended by Section 1 of the Amending Resolution, which reads:

Pursuant to Ohio Revised Code Section 5709.78, the County Administrator is hereby directed to deliver a copy of this Resolution to the Director of Development Services of the State of Ohio within fifteen days after its passage. Further, and on or before March 31 of each year that the exemption set forth in this Resolution remains in effect, the County Administrator or other authorized officer of the County shall prepare and submit to the Director of Development Services of the State of Ohio the status report required under Ohio Revised Code Section 5709.78(H).

Section 4. Open Meetings. This Board finds and determines that all formal actions of this Board and any of its committees concerning and relating to the adoption of this Resolution were taken in an open meeting of this Board or committees, and that all deliberations of this Board and any of its committees that resulted in those formal actions were in meetings open to the public, all in compliance with the law including Ohio Revised Code Section 121.22.

Section 5. Effective Date. This Resolution shall take effect at the earliest opportunity allowed by law.

Wayne L. Pretti, resident Lorain County and he will exercise 1 of his 5 rights under the 1st amendment. The right to petition the government of grievances, he does not have a grievance. He only has an opinion. The sale of the confederate battle flag, also known as the Stars & Bars and called the Confederate Flag specifically at the upcoming Lorain County Fair. He has read the Chroncile Telegram at least the last 2 years and individuals who have expressed opposition to allow merchants to sell. He is here personally to think the merchants should be able to sell it if they wish too. His reason is twofold; first, you cannot tell by looking at him, but he is a trained engineer and unfortunately/fortunately he sees things black and white. He sees this as 1st a restriction on speech, it is not illegal for this to be sold and not declared by any government or law or what, so if you get into you can’t sell this item or that, people will always be offended.

The second is revisionism – a revision of history. He is sorry, you can see by the color of his skin that he has no ability to relate to the history of the flag but he is troubled when because a particular organization or group of people are offended and wish to somehow revise history. Granted you can’t get it out of the books, this is the history, but he is here because he is having difficulty and he is not here offending anybody but felt an obligation to himself that he had to voice this and that there would be at least one individual who would be supportive.
