How embarrassing stopped by asecurity employee as you leave the storeand accused o shoplifing! Youre takento a back room to wait while the police arecalled. And now youre looking at going tothe station to be photographed and ngerprinted and appearing in court to ace themusic.

I this has happened to you, youre arrom alone. Shoplifing is perhaps the

most common criminal offence in Canada.And despite popular belie , its not onlythe young or desperately poor who do it people rom all walks o li e get caughtshoplifing.

Young people may sometimes do it ona dare. For adults, it may be just a suddenimpulse or even sheer orget ulness. Butno matter, taking store property withintent to deprive the owner amounts tostealing. Even i its only a chocolate bar, itconstitutes thef under $5,000 under theCriminal Code.

I convicted, the potential penalties orthef under are a ne o up to $2,000 anda jail term o up to 6 months. And youdend up with a criminal record. Some othe consequences are restrictions on travel you may not be able to enter the US, orexample and employment difficulties,both with your current boss and potential

uture employers.

And since thef is seen as a crime odishonesty, theres a certain stigma attached toit and a conviction may disquali y you romcertain jobs altogether.

But depending on the circumstances, theremay well be things that a good criminalde ence lawyer can do to minimize the nastyconsequences o a shoplifing charge.

Particularly i its a rst offence, shemay be able to persuade the Crownprosecutor that diversion (sometimescalled alternative measures) would beappropriate. Te prosecutor is in a positionto divert the case out o the criminal justice court process altogether andsubstitute alternative measures. Tis mayhappen i you acknowledge youre sorry orwhat you did and agree to make amends.Te alternative measures could meanreturning or paying or the stolen property,counselling, making a gif to charity and/orspending time doing community service.I the prosecutor agrees to divert the case,theres no court hearing, no conviction andno criminal record. But beware even iobtained, its a one-time-only pass.

Or your lawyer may be able to improvethe outcome o a shoplifing charge, eveni it goes to court. Maybe, or example,you can get an absolute discharge or aconditional discharge and probation. Inthis case, so long as you ul l the conditionso probation, theres no conviction and nocriminal record.

Separate rules apply to young offenders,so i your child or teenager is caught up insuch a situation, seek good legal help rightaway too.

I you nd yoursel accused o shoplifing,dont try to go it alone. Remember you havethe right to remain silent you dont haveto say anything to the store personnel orpolice that could incriminate you. Andremember you also have the right to ask totalk to a lawyer. Make use o that right, and
