The meeting at Kaiwaka will involve the Auditor-Generals’ department, the Mangawhai Residents and Ratepayers Association executive, Kaipara Mayor, Neil Tiller, council chief executive, Steve Ruru, and community activists, Clive Boonham and John Dickie.

At the meeting, the chairman of the MRRA, Bruce Rogan, will raise his private concerns that some $40 million appears to be unaccounted for by the Kaipara District Council in the EcoCare scheme, for which council now says the debt stands at $63 million.

Council has levied over $9 million in rates, which have since been found to be invalid, and are the subject of a threatened rates strike by Mangawhai residents.

“I would expect any inquiry to encompass this concern I have over some $40 million that seems to be missing. The investigation by the Auditor-General must uncover what happened, otherwise there will be no point in conducting an investigation,” Mr Rogan said.

“My own opinion, not necessarily that of the MRRA, is that something like $40 million has disappeared without trace. It could have been spent on contractors, consultants and lawyers, but that can’t explain why a scheme that has optimistically been valued at $35 million — and a local engineer says something like $20 million would be a more reasonable estimate — has cost over $70 million to build.”

Commenting on Mr Rogan’s claim, the corporate services manager for the KDC, Barbara Ware, said it was the purpose of the investigation to highlight any such problem.

“We would expect that this review by Audit New Zealand would identify if any money had gone missing.”

‘‘We at council know we need to own the problems, but I say to those who raised the concerns, let’s look to the solutions together.”

At the grand fi nal showdowns last Saturday night, Rowland was pipped for the two top places, despite being a stong favourite with wins in seven different competitions over the past fi ve weeks leading up to the fi nal.

In the Open contest, shearers had to shear 20 sheep against the clock and in the all-kiwi result, Napier’s John Kirtkpatrick was fi rst in 16min 8.967sec, Waipawa’s Cam Ferguson second in 17min 16.884sec, and Rowland Smith, faster at 16min 37.881sec, but losing points on quality.

The fi nals contest attracted Prime Minister, John Key, and Governor General, Sir Jerry Mateparae, and more than 600 competitors representing 25 countries participating over the four days of shearing and woolhandling contests.

“The last time Masterton hosted the World Shearing Championships in 1996, just 13 countries were entered, making this the biggest world championships New Zealand had ever experienced,” said Golden Shears president, Mavis Mullins.

But the organisers of Dargaville’s most popular Thursday fi xture aren’t content to rest on their laurels — this year promises new stalls, more entertainment, more fun and the chance to win some very tasty prizes as the popular local market kicks into high gear.

There’s also an interactive community focus coming to the markets in 2012, with the just over one-year-old weekly event fi rmly cemented as a Kaipara favourite. For starters, the ever-popular marketplace espresso machine (operated from the back of that distinctive green van) will have a double role this year. As well as dispensing hot and creamy drinks to patrons, it will also serve as a training centre for tomorrow’s baristas, as students of Otamatea school come to learn the fast-growing trade of brewing up the perfect coffee. Another way the markets are giving back to the community is through live cooking demos — a way to put all the fresh, delicious produce you’ve just bought into world-class and inexpensive meals. From March 8 you’ll be able to stop by and watch the culinary magic happen, and maybe even have a taste. It’s the perfect way to expand your repertoire of recipes!

Finally, in an exciting twist, the Riverside Produce Markets now also feature a weekly prize. Come down and shop around to enter, and you could walk away with a prize voucher to spend among the many market stalls. It’s a great way to fi ll your pantry, but you have to be in to win — drop in and pay a visit to the Riverside Markets this week and join in the fun.

Over the three days of the event, there were 25,278 people through the gate — 7117 on Thursday, 9294 on Friday and 8867 on Saturday.

“We were delighted we broke gate attendance numbers on Friday and that Saturday’s results exceeded expectations considering the weather that had been forecast,” said president Lew Duggan. “The organisers have already put their order in for sunshine in 2013.”

Major winners at this year’s fi eld days included the Best Indoor Site Award, to Tongue Hammer Food Ltd; Best Outdoor Site Award to Hynds Pipe Systems and Best New Exhibitor Award to Woodcraft Creations. The major gate prize winners were John Constantino, Rural, while the Lifestyle prize went to Lana Hodges.

“The Field Days’ committee has issued a ‘thank you’ to the many volunteers and helpers that have made this event such a great success. This is our 28th event and the fi fth on this site. Our thanks also to the residents of Awakino Point East Road for your patience again this year.”

This is a series of regular articles keeping you informed of happenings on our harbour today, and from bygone days — truly the ‘Jewel of the Kaipara’.

Just a timber ship— but she had a pastSailing ship watchers around Kaipara Harbour during the kauri milling

days may not have realised that the timber carrying schooner Lark, was not all she seemed to be. The three-masted ship had a varied career before she ever became a regular visitor to Kaipara.

Built in 1880 at Barnstaple England for the Royal Navy, she was sent to Australia as a survey ship. HMS Lark was armed with a 12-pound Armstrong gun, a Gatling machine gun, and surprisingly, a ‘war-rocket’ tube.

As part of the Australian Squadron her fi rst task, with a crew of fi ve offi cers and thirty men, took her to survey Bougainville Strait and New Hebrides. In between the voyages north she returned to Auckland for refi ts. While there the survey gun ship surveyed and corrected charts for the harbours of Auckland province.

In 1887 HMS Lark was sold to a Sydney owner for passenger and cargo trade between Sydney, Adelaide and the Solomon Islands. Originally rigged as a topsail schooner it was beyond the smaller merchant

marine crew to handle and she was converted to the three-masted schooner that Kaipara knew.

Lark had sometimes taken kauri timber to Australia during 1892 and 1893 but regular Kaipara trading days began when she was added to the Craig stable of ships.

An advertisement had appeared in the Otago Times in June 1900, ‘the schooner Lark will sail for Kaipara at an early date. For freight or passage apply John Seymour. The master or owner will not be responsible for debts contracted by the crew’. When she did arrive at Kaipara she tangled with the bar, stranded near the Heads anchorage and suffered partial damage. Perhaps not a happy ship.

One month later Lark was bought by Mr J J Craig at Helensville. She went straight to work but was bar bound for a while, waiting for good conditions before eventually leaving on her fi rst trip for the Craig Line.

For the next fi ve years she carried timber to Auckland, Wellington and Dunedin. A typical load of 26,000 feet went to Wellington in 1902. Everything went well on that voyage until they entered Cook Strait, met a heavy north west gale and lost two sails. The trip took six days.

Sometimes it was off to Australia with timber and back loading with sugar for Auckland’s Chelsea Sugar Works or with coal. On at least one trip home, she arrived in Timaru with a load of salt from South Australia. On another from Lyttelton it was with

a cargo of 1500 sacks of produce for Kaipara.

Kaipara Harbour gave her a close shave again in 1905 when she went ashore on the Tory Shoal. Said to be an exceptionally strongly built ship of 197 tons, they managed to fl oat her off on the top of the next morning tide.

How Lark met her end is something of a mystery. In his ‘Tall Spars, Steamers and Gum’, author and qualifi ed historian Wayne Ryburn, says Lark, still owned by Craig Lines was wrecked at Wellington in 1909.

But Edgar Bradley wrote in his ‘Great Northern Wairoa’ that she was in a creek at Helensville where the old ship ‘rests on her laurels. When fi rst laid up her tall masts still stood. Now her decks have collapsed, her sides are toppling inwards and soon very little will be left.’ He wrote that in 1972 and it seems as if he had seen the remains himself.

The fi rst two of four own-your-own units under construction at the Maungaturoto Community Charitable Trust retirement village will soon be ready for new owners, with the other two not far behind.

“Two units are now being lined and the brick work on the others has been completed, “said trust chair, Don Mckay.

The OYO development will be completed with a total of eight units, which will see the site fully developed.

“We have sold two of the almost completed units and another is under negotiation,” Mr McKay added. The units cost $250,000, while others in the village are available at a weekly rental of $105.

Brogan Builders have been responsible for the construction work with Huband contractors laying drainage services and roading and landscaping, while local contractors have undertaken the required plumbing and electrical work.

Some jokers have said that if one misses the Kaihu ‘express’ he may run after it and catch it up along the line.

Some idea such as this must have been in the minds of three young fellows on a recent Saturday. The train had been delayed for the football match and the young fellows missed it but attempted to board it at the Hokianga Road crossing. The fi rst one managed to do so but the other two fell, one on the cattle stop sustaining bruises and torn clothing. They were brought before the Court on Tuesday and fi ned 1/- each and costs.

It is time again for the annual Ruawai Lions Charity Auction. Lion’s members are out in force collecting donated items that are saleable, from around the district. The auction is to be held at the Kaipara Kumara forecourt on Saturday, 24 March, with viewing from 9.30am and the auction starting at 10.00am.

There will be bargains galore — electrical goods, furniture, bric-a-brac, books, toys, tools and farming goods, will all go under the hammer. A trading table with lots of small goods will be open for buying prior to the auction. Sponsors’ products will be available.

“The auction has been held every year for more than 25 years and every year it is fun. Who knows, you might get the odd bargain or special piece. Food and refreshments will also be available.

“Everything donated is sold,” said Ruawai Lions Club secretary, Dorothy Simpson.

After 25 years people are still keen to grab a bargain at the Lions Charity Auction in Ruawai

Choppy seas and winds gusting up to 25 knots make this year’s kayak fi shing world cup event into a test of skill and endurance, but while literally thousands of other fi shos took to the beaches and the water for the Century Batteries Beach and Boat fi shing contest a fi eld of more than 200 kayak anglers were amongst the thick of it, vying for the title of world champion.

And while heavy hitters from Australia, America, Canada and around the world came to test their skills on the waters of Bream Bay, it was Jai who managed to score the most points across fi ve species of fi sh and bag the trophy for Aotearoa. Jai, president of the Hibiscus Kayak Fishing club, has a reputation as a skilled and competitive angler, taking out many local and regional trophies before this world-class event.

Ocean Kayaks, the sponsors of the event and the craft of choice for many of the top-placed contenders, supported a team of Kiwi anglers including Jai and local Dargaville kayak fi shing pro, Jason Dassler. While Jason didn’t make the podium this time, the Ocean Kayaks’ team can share a little in the glory of the new world champ from Auckland’s Hibiscus Coast.

With kayaks of many makes and models from around the world competing, the Kiwi-made Ocean Kayaks’ Prowler Ultra 4.3s and 4.7s tackled the rough conditions with ease, which may be a contributing factor behind the prevalence of Prowler models represented in the top ten.

The sport of Kayak Fishing continues to grow internationally, and footage of the beach and boat was televised across many countries. Future winners will be able to look back at this fi rst tournament with the knowledge that (just as with the Webb Ellis Cup) the fi rst victory belongs to New Zealand.

New rules cover rural homesLike any new set of regulations, there are lots of things to check out.

If you apply for a building consent from March 1, you must make sure that the tradesmen and professionals you employ are correctly licensed to carry out the work.

This covers designers, carpenters, roofers, external plasterers, brick and blocklayers and foundation specialists.

Professional engineers, architects, plumbers and gasfi tters are treated as licensed building practitioners and can carry out some restricted building work.

Not all work that requires a building consent is restricted. The fi ne details can be checked with your local council.

If you are applying for building consent your building design must be done by a licensed designer, a registered architect or a chartered professional engineer.

If you undertake structural work or work that affects the weathertightness of a building, and the building is residential, then that work may be classifi ed as restricted building work or RBW.

Most building plans that need building consent from your council, will include RBW. Work that needs building consent such as kitchen installation and pool fences are examples of exceptions to this. If it doesn’t involve work to the home’s primary structure or weathertightness, it is not classifi ed as RBW.

If you already have a design drawn up, and consent application is made after March 1, then the building consent application will need to comply with RBW requirements regardless of when the plans were drawn.

There are a lot of different ways that you might go about organising the building or renovating of your home. You might build through a contracting company who will hire

the right licensed professionals for you or you might hire a builder who holds a carpenter LBP licence. They may then hire other LBPs to do work such as roofi ng and plumbing. Other options are hiring each type of tradesperson directly or asking your designer to project manage the work for you.

Registered plumbers and registered gasfi tters are automatically treated as LBPs in the roofi ng, external plastering, and bricklaying and blocklaying licensing classes. This is in recognition they carry out this type of work in the ordinary course of their business, and they must only carry out work that falls within their own competence levels.

Registered Architects, Chartered Professional Engineers and Registered Plumbers and Registered Gasfi tters have their own registration systems — architects with the New Zealand Registered Architects Board, engineers with IPENZ Engineers New Zealand and plumbers and gasfi tters with the Plumbers, Gasfi tters and Drainlayers Board.

If you want to do restricted building work to your own house you can, but if you are unlicensed you will need to be supervised by a Licensed Building Practitioner.

Restricted Building Work regulations have now come into effect — as of March 1, 2012 and these apply to most residential buildings or renovation work, meaning only a licensed building practitioner (LBP) can undertake or supervise the work involved

Plumbers and Gasfi tters — Should carry a card which lists them as either ‘licensed’ or ‘certifi ed’ — two separate levels of ability. Electricians should carry a similar card to prove that they are qualifi ed, as should Drainlayers and Fireplace Installers. Remember that it is best practice to ask to see the card of ANY tradesperson before you hire them to complete a job — make sure that it is legal, current, up-to-date, and for the right kind of trade!

minimum skill requirements to build in New Zealand. A builder who displays the Licensed Building Practitioner emblem has passed these tests, and is legally allowed to undertake the new list of ‘restricted’ building jobs — across the disciplines of carpentry, roofi ng, internal plastering, brick and blocklaying and foundation work.

The law change doesn’t exactly put an end to DIY — it’s still OK to build a deck, for example. But any work which might affect the safety, structure and weathertightness of a building is now the sole preserve of the professionals. They will be the ones held responsible if things go wrong, so it’s up to them to make sure everyone working on the job is correctly qualifi ed. It’s also going to be far more common to need a legal contract when undertaking big building jobs.

Groups such as the Master Builders and the Certifi ed Builders aren’t an alternative to Licensed Building Practitioners — they are organisations offering a form of higher accreditation with skill levels and requirements particular to each organisation. In the same way, designers, architects, engineers and plumbers have their own accreditation (and often their own organisations) for specifi c kinds of work. As always, it’s best to ask any tradesperson for their credentials before they begin work, just to be sure.

Under the new law everyone who works on a build will need to provide a paper trail, leading up to the fi nished building being accepted with a Code Compliance Certifi cate. In this way, individuals or companies without the correct accreditation will not be able to have their work signed off — and they’re unlikely to get the job in the fi rst place.

Last year we wrote to the then Minister of Local Government Hon Rodney Hide regarding our concern over the financial position of the Kaipara District Council. We requested the appointment of a commissioner. The Minister did not agree, but acknowledged a problem existed and was watching the situation closely. Public confidence is now at an all time low and the situation is far too serious to give a clearly incapable council until April to sort themselves out.

The Kaipara District Council continues to self-destruct and we believe the situation is beyond the ability of the current council to resolve. They have relied on inadequate financial reporting, have authorised loans without sufficient reliable information on which to make good decisions, and entered contracts without careful consideration of the ability to fund the expenditure. Through poor governance, this council has seriously and unnecessarily indebted the Kaipara community for decades to come and struck rates unlawfully.

It recently adopted an expensive new proposed district plan that the community never required or requested and that the Northland Regional Council advised against. Their lack of understanding of the Resource Management Act, and their inability to govern both council management and consultant planners has resulted in bringing what little growth we have in the district to a grinding halt, while spending many times their original budget.

The council’s financial mismanagement was publicly highlighted during the last election. However Mayor Neil Tiller consistently and forcefully advised the electorate that his council was in good financial health and that what was being alleged against the council, was untrue. We were accused of scaremongering and spreading falsehoods. He stated the Kaipara Council had a strong financial heart and had a great future as an independent organisation. The community now knows the truth and who was really spreading the falsehood.

Millions of ratepayer dollars have flowed to international planning consultants from one of the poorest districts in New Zealand with the average wage of $23,000.

It is our opinion the people of the Kaipara have been mislead for political gain. Due to a failure to disclose the true financial situation regarding debt and liquidity candidates were re-elected for a further term. The voters placed their trust in the current mayor and believed his assurances. He has recently apologised to the community, admitted mistakes were made, and announced he has no intention of standing again for local government. We believe he lacks both courage and sincerity in times of crisis — he has announced retirement before. Apologies do not resolve the very real issue of incompetence.

It is interesting to note that similar behaviour in the private sector is not tolerated and directors can be jailed for failure to disclose or worse misinform shareholders and investors. The recent Lombard court decision is case in point. Why is it that directors of large private sector companies must quite correctly adhere to strict guidelines of governance, while in local government we have people continually elected to run large enterprises who are not competent, but escape any serious level of accountability?

Farmers of New Zealand believe that over a number of years the mayor and some of his councillors misled the public, failed to act on advice and obvious evidence before them, and did not perform their duties with appropriate professional diligence. We believe that not only a commissioner should be appointed but an investigation be undertaken to determine if breaches of law have occured and whether criminal charges are an appropriate action. We believe the council have shown a lack of duty of care by not checking facts, or in many cases even requiring the facts. Under Common Law a duty of care is defined as:

attention, caution and the prudence that a reasonable person in the circumstances would. If a person’s actions do not meet this standard of care, then the acts are considered negligent, and any damages resulting may be claimed in a lawsuit for negligence’.

The fact that the council failed to strike the appropriate level of rates to meet their financial commitments is but one of many examples that supports a charge that they did not act in a reasonable and responsible manner.

In addition, councillors have personal liability under the Local Government Act 2002 for an act, or failure to act, that causes a loss to the local authority. We believe there is a case to answer. Councillors failed to avail themselves of professional legal advice and have relied only on summaries from the CEO even when challenged by the community.

On the 15 December 2010, the council voted against an amendment moved by Cr Larsen and seconded by Cr Linton that council be provided with all requests for legal advice, the legal advice received, plus all financial information relating to the Mangawhai Wastewater Scheme. Mayor Neil Tiller and Deputy Mayor Julie Geange persuaded council to vote against this amendment, arguing it was not necessary.

A second incident 22 June 2011, Cr Larsen moved that the decision to strike the rate be deferred to a special meeting to allow time to get the rates correct and lawful. This amendment failed to obtain a seconder.

Denying access to professional legal advice is a clear indication of recklessness, unbelievable and appalling governance, and not acting in good faith. Any criticism of management and staff, past and present, cannot be upheld by councillors, if the majority of council refused themselves, and their fellow councillors, access to pertinent information.

We would also take this opportunity to state that the recent debate over further local government amalgamation is not addressing the real problem. In our opinion asking ordinary people in the community, who often have little business experience or skill to make objective and professional million-dollar business decisions, is ludicrous.

Would Telecom or Fonterra hire people without the appropriate governance and business skills to their Boards? Would the government appoint similar people to State Owned Enterprises? A lack of general competency in local government has been blindingly obvious for many years but the solution to simply make councils bigger does not and will never solve the real problem. In fact it will make matters worse.

Accountability, expected and policed in the private sector, must be imposed on local government. This country can ill afford the waste of capital forcibly taken in rates to run ineffective and badly managed council entities or lost to poorly conceived and drafted regulation. Those that stand for office must be made personally accountable for their actions and this requirement alone will start to improve standards. Councils should be made accountable to the same commercial laws protecting shareholders and investors in the private sector.

If the government does not act swiftly and decisively in the Kaipara they are simply reinforcing the message that local government incompetence, and in our opinion unlawful commercial behaviour, is not only acceptable but supported and defended.

To ensure the protection and wellbeing of the Kaipara community we again request your urgent intervention, the immediate removal of this council and mayor, an investigation to determine whether any criminal charges may be laid, and the appointment of a suitably qualified and experienced commissioner.

Tolls on the Northern Gateway Toll Road have increased for all vehicles. The rise took effect on March 1, and it’s the fi rst since the route was opened three years ago.

Tolls for cars, light commercial vehicles and motorcycles will increase by 20 cents a trip to $2.20, and the toll for heavy commercial vehicles increases by 40 cents a trip to $4.40.

The NZTA’s national tolls manager, Andy Thackwray, said the rise was necessary to ensure the repayment of funds borrowed to construct the highway early remain on track.

“Although the legislation covering the toll road allows for tolls to be annually adjusted in line with increases in the Consumer Price Index (CPI), they haven’t increased since the road opened in January 2009. Infl ation and the 2010 GST increase have made it necessary,” he added.

A Ruawai College horse trek fundraiser will be held on Saturday, March 24, taking in the Kai Iwi Lakes, Maunganui Bluff, and the west coast surf beach.

“This year the cost is $45.00 per adult and $25.00 for children under 16, and this includes a hearty lunch provided by the PTA,” said PTA secretary, Lisa Salter.

It is often noted that Dargaville was at fi rst the privately owned town of Irishman Joseph Dargaville. The huge contribution made to the town and Northern Wairoa by his son, Francis J. Dargaville, is not so well known.

Some have said that Joseph wasn’t always a popular man. ‘He was a shrewd businessman and a commanding fi gure with a dominant personality’ wrote historian Janice Mogford.

But judging by his success in local politics, son Francis seems to have been well thought of and popular. He was born in 1868, three years before Joseph bought the future Dargaville Borough lands from local Maori. The second son of Joseph and Anne, Francis was one of a family of two boys and fi ve girls.

By the age of twenty-one, Francis was in business as an auctioneer and land agent in town. At twenty-three he had opened a new store. ‘The goods are tastefully laid out. Lettuce, radishes and cabbages, although it is something new for gum merchants to sell salads of the season,’ commented a newspaper article.

Both politically minded, father and son stood in the 1893 General Election, Joseph for Eden and his twenty-fi ve-year old son for Bay of Islands. Neither was successful. Joseph died at sea in 1896.

Francis’s community activities became almost too many to count. A year after his father’s death he became a member of U.A.O.D Lodge rising to President of District 17 in 1914. In 1901, he was a provisional director of the soon to be registered Wairoa Steamship Company.

Service to Hobson County Council began with election as Dargaville riding member in 1891 for four years, going on to be

in 1909 for a term of nine years.Beginning a dual role in 1910, he stood successfully

in an intense battle for the mayoralty. He had missed out on the fi rst ever election won by Fred Day with a six votes margin. Francis was now Dargaville’s mayor and a Hobson County councillor.

While he was mayor he became vice-president of Northern Wairoa Racing Club and chairman of the Primary School committee.

He served on the Crown Land Board, the Chamber of Commerce, Te Kopuru Hospital Board and was a JP.

As vice-president of North Auckland Development Board he argued for it to be based in Dargaville. Francis plugged for the railway to come right to town and spoke strongly with Government suggesting they accept the offer of Trounson Park from Mr. Trounson.

During Francis’s mayoral watch the town gas works and water reticulation was planned and building started. Surprisingly, he found enough spare time to hunt, to work for the local Acclimatisation Society and to serve nationally as Hobson’s representative. He even played golf, selected as a local representative against Whangarei.

In 1910 he chaired the meeting that set up Dargaville Bowling Club, successfully tendering to sell them a half-acre of land. When electricity was about to arrive in Northern Wairoa he represented Hobson on the Hobson Electric Power Board.

Francis Dargaville married Ada Florence Cook. She also worked hard for Northern Wairoa as a foundation member of

Plunket Society, the Golf Club and Croquet Club. Ada died in 1964 aged 91 years.

Ada and Francis had two daughters. Marjorie became Mrs A. H. Grant and Nora married Ernest Harding, bringing up a family four. Some of them still live in this district.

Francis Dargaville certainly worked hard for Northern Wairoa. He may have been doing the work that he felt his father didn’t have time to do. Or perhaps his business sense saw opportunities in his adopted hometown.
