The function was inaugu-rated amid lockdown due tocovid- 19 strict restrictionsand guidelines, maintainingsocial distance, with thelighting of traditional lampbefore the photo images ofthe Martyrs S/Shri SushilKumar Bhat, RavinderKabu and Ashok Raina whowere selectively killed by theIslamic terrorists while theywere going to Gool to jointheir duties in 1997. The twoother martyrs who werebrutally killed near Sarthal-Kishtwar and Doda in-cluded S/Shri Kanya Lal

Duda and Shiban Lal Garib.Floral Tributes were offeredto the martyrs on the occa-sion while, besides a largenumber of communitymembers, the families ofthe martyrs also attendedthe function.

Rich tributes were alsopaid to Ajay Pandita Bhartiwho was martyred das-tardly in Anantnag districtrecently in Anantnag dis-trict by the Islamic terror-ists.

Ashwani Kumar Chrun-goo in his address said thatthe crusade against Hindu-Sikh communities inJammu and Kashmir con-tinues for the last threedecades. The killing of AjayPandta shows that theprocess of ethnic cleansing

and genocide unleashedthree decades ago still existthere and there is no let upor much difference on theground for the minorities inthe valley.

plete intelligence failureand a security lapse andurged upon the govt to pro-vide foolproof security tothe minority political ac-tivists on individual basisand to the PM package em-ployees on collective basisas they are always soft tar-gets. At first place their se-curity and safe accommoda-tion should have beenensured. The immature po-litical adventurism will al-ways lead to casualty.

Jammu Municipal Cor-poration has started homedelivery of Birth & DeathCertificates and approvedbuilding permission casesunder “Doorstep Gover-nance” initiative. The onlinesystem is launched byHon’ble Mayor, Sh. Chan-der Mohan Gupta &Hon’ble Deputy Mayor,Smt. Purnima Sharma inthe presence of Ms. AvnyLavasa, Commissioner,Jammu Municipal Corpo-ration. In view of theCOVID-19 pandemic situa-tion this system is intro-duced to avoid enormousgathering of general publicand to promote contactlessefficient public service de-livery system. This initiativeis being taken to promoteDigital India and E—Gover-nance initiative of Govt. ofIndia. This is 1st such typeof Government public ser-vice delivery initiative in theUT of Jammu and Kashmir.Only very few States/UT'sare providing such type ofGovernment services atdoorstep. It will providegreat relief to the generalpublic and also eliminate

the requirement to reachJMC office for such services.This is in-house technologydeveloped by the Informa-tion Technology depart-ment of Jammu MunicipalCorporation.

The requisite Fee is Rs 40per birth/death certificateand Postal and ConveyanceCharges Extra as per the be-low mentioned rates :

Within JMC Limits - Rs50, Outside JMC Limits butwithin district - Rs 100,Outside District/Divisionbut within JK UT- Rs 150,Outside JK UT - Rs. 200.

For building permissioncases the fee is as per the ap-proved plan and the Postaland Conveyance Chargesare Rs 150 within JK UTand Rs 250 outside JK UT.

In this system, SMS, E-mail & online payment

gateway integration hasbeen done and all the pay-ments shall be received on-line through secure mecha-nism directly into the JMCbank account. The onlinereceipt and the paymentsuccessful acknowledge-ment shall be provided tothe applicant online.

For DoorstepBirth/Death Certificate andBuilding permission, publichas to visit www.jmc-jammu.org then has to useMenu Option “E-Gover-nance > Doorstep Gover-nance > Apply online forbirth/death certificate”and “E-Governance > On-line Building Permission >Register for building per-mission” respectively.

In case of Birth/Death,applicant shall be commu-nicated through e-mail :

sahuliatjmc@gmail.com foravailable record verifica-tion. Self attested docu-ments shall be asked fromthe applicant in case of al-teration/corrections are re-quired in the availablerecord. Then documentsverification and alter-ation/modifications of theavailable record done byJMC and an online pay-ment fee link sent to the reg-istered e-mail & mobilenumber of the applicant. Onsuccessful online fee pay-ment, confirmation sent byJMC to the applicant and fi-nally Birth/Death Certifi-cate shall be dispatchedthrough speed post to theapplicant's registered ad-dress.

In case of building per-mission cases after the ap-proval of building permis-sion cases by BOCA, anonline payment fee linkshall be sent to the regis-tered email & mobile num-ber of the applicant. On suc-cessful online fee payment,confirmation sent by JMCto the applicant and finallybuilding permission shall bedispatched through speedpost to the applicant's regis-tered address.

JMC starts home delivery of birth, deathcertificates, building permission

To help them to overcomefinancial hardships duringCovid-19 pandemic, theLabour department has dis-bursed Rs 1,00,52,000( Rsone Crore fifty two thou-sand) among the districtKathua workers registeredwith the Jammu & KashmirBuilding & Other Construc-tion Workers WelfareBoard (JKBOCWWB).

As per the Department,the amount was paid to theworkers in three install-ments @Rs 1000/- each inthe month of March, Apriland May-2020.

The relief was transferredto the account of workersthrough DBT mode, to helpthem survive the financialhardships in absence ofwork due to Covid -19 Lock-down. The department alsoreached out to Inter StateMigrant Labourers stuck upin the district due to thelockdown.

The Labour DepartmentKathua took immediate

measures to mitigate thesuffering of these migrantworkers, which were pre-sent in the district in largenumbers to meet the labourneeds of industrial units aswell as other skilled trades.

Initiatives such as provid-ing food and shelter to thestranded migrant labour-ers, establishing of HelplineNumbers to receive theircalls were taken so that theirgrievances are redressed ontime. Labourers ap-proached the departmentseeking ration and with thedesire to return to theirhometown. Accordingly thegrievances regarding ra-tion were redressed by pro-viding them food grain incoordination with the Dis-trict Administration.

A detailed survey wasconducted by the LabourDepartment to enumeratethe Inter State MigrantLabourers stranded in var-ious parts of the district.

In the process, 12051 in-ter-state migrant workers(including brick kiln and in-dustrial workers) were regis-

tered. Their consent was ob-tained about whether theywish to stay here or want toreturn to their native places.

The Labour Departmentalso distributed 5000Masks among the migrantworkers in District Kathua.

On the directions ofSupreme court, DistrictEmployment and Counsel-ing Centre, Kathua coun-seled 1250 interstate mi-grant labourers/workers indistrict Kathua about thepreventive measures andSOPs for protection againstthe Covid infection. The de-partment also counseledthe labours which havecome from other districtslike Jammu and Samba onfoot to go to their homestate and stuck at Lakhan-pur.

Facilitating the migrantworkers willing to go backto their home states, ahelpdesk was established inthe district office of LabourDepartment, to carry outtheir registrations. The datacollected was digitized inthe prescribed format and

area wise list of the workerswas also compiled.

After receiving directionsfrom the Labour Commis-sioner’s office for move-ment of interstate migrantworkers from districtKathua to railway stationKatra as per the train sched-ule, the interstate migrantworkers were screened bythe medical team beforetheir departure to railwaystation Katra.

On the day of departure,boarding points were se-lected as per the conve-nience of the interstate mi-grant workers/labourers.Refreshment and water wasalso provided to them be-fore departure. Buses weredeployed by JKSRTC.Thereafter, the inter-statemigrant labourers were dis-patched from their respec-tive boarding points to rail-way station Katra. Duringthe whole process, norms ofsocial distancing werestrictly followed and no farewas charged from any inter-state migrant labourer.

As per latest data receivedfrom Labour DepartmentKathua, a total of 2889 mi-grant workers, including2188 hailing from Chhatis-garh, 341 from Bihar, 249from Madhya Pardesh, 86from Uttar Pardesh, 05from Orrisa, 17 from Jhark-hand, 01 from Uttrakhandand 12 from Rajasthan wereferried to Katra RailwayStation for onward journeyto their native statesthrough trains.

KATRA, JUNE 15 : Mr. RameshKumar, Chief Executive Officer, ShriMata Vaishno Devi Shrine Board tooka holistic review of the functioning ofthe Shri Mata Vaishno Devi College ofNursing (SMVDCoN) and Shri MataVaishno Devi Gurukul at a meetingheld at Katra today.

Among those who participated inthe meeting included Mr. Hem KantPrasher, Chief Accounts Officer of theShrine Board; Dr. Sunil Sharma, Dy.CEO of the Shrine Board and Adminis-trator of SMVDCoN and SMVD Gu-rukul; Dr. Shailla Cannie, Principal ofthe SMVD College of Nursing and Dr.Dhananjay Mishra, Principal of theSMVD Gurukul.

The CEO took stock of the onlineclasses being organised for the stu-dents of both these institutions sincethe lockdown and also discussedmodalities for regularly organising on-line internal tests for evaluating the

level of preparation of the students.During review of the progress

achieved under online teaching-learn-ing process by the SMVDCoN, it wasinformed that different modes likeGoogle classroom, Google Duo, What-sApp video call, telephonic communi-cation and SMVDCoN portal wereutilised and one to one group interac-tion was also conducted. The CEOasked the Principals of the College ofNursing and the Gurukul to organiseweekly telephonic sessions with thestudents at a fixed time by makinggroups of students for better conceptclearance. He asked the Principal ofthe Gurukul that, besides the onlinemode, if need be, the study materialshould be despatched to the students attheir residences also.

Underscoring the need for optimallyenhancing the prospects of suitableplacements of the passing-out stu-dents of the Nursing College, Mr.

Ramesh Kumar asked the Principal totie-up with various leading healthcareinstitutions in the country for arrang-ing placements for the students of thecollege as the first batch of the B. Sc.Nursing students of SMVDCoN ispassing-out this year.

The CEO while reviewing the initia-tives being taken for enhancing em-ployability of the students of the Gu-rukul, emphasised the need forguiding the students about various ca-reer options and available opportuni-ties. In this context, he asked the Prin-cipal to contact various organisationsfor exploring possibilities of the jobplacements for the passing-out stu-dents of the Gurukul. Despite a lot of disruptions, distrac-tions and innumerable challengesposed by the spread of COVID-19 pan-demic and consequent lockdowns,J&K Board of School Education hassuccessfully concluded the evaluationprocess of Secondary School Exami-nation (Class 10th), Session Annual,Regular, 2020, Summer Zone ofJammu Division with the declarationof its result today. Spread over 541 Ex-amination centres, 53807 candidatesappeared in the said examination, outof which 29487 were boys and 24320were girls. Girls have again outnum-bered boys by scoring a pass percent-age of 72.00 whereas boys stand at68.%. 3,465 students got A1 grade,4,999 got A2 grade, 6,033 students gotB1 grade, 7,549 got B2 grade, 8,469 gotC1, 6,229 stood at C2 grade whereas723 got D grade.

J&KBOSE declares 10th class result

JAMMU, JUNE 15 (JNF): In a significantjudgment, Justice VinodChatterji Koul today dis-missed petition filed byNayeem Akhtar AndrabiEx-Minister of PDP chal-lenging the order of trialCourt in defmation casefiled by Ex-Chief MinisterOmar Abdullah.

A complaint under Sec-tion 499 and 500 of theRanbir Penal Code, 1932AD, of erstwhile State ofJ&K (which is pari materiato Section 499 and 500 ofthe Indian Penal Code) wasfiled by Public Prosecutor,Srinagar - respondent no.1herein, against petitioner,before the court of PrincipalDistrict and Sessions Judge,Srinagar (for short "TrialCourt") on the grounds de-tailed therein.

The Trial Court, whiletaking into account the alle-gations made in the com-plaint and the record con-comitant therewith, tookcognizance of the complaintand issued process vide or-der dated 29th September2010, and bailable warrantin the amount of

Rs.20,000/- each was is-sued for securing presenceof the accused.

Nayeem Akhter Andrabi,feeling aggrieved of afore-said complaint and the pro-ceedings initiated thereonby the Trial Court, seeksquashment thereof on theedifice of case set up andgrounds taken in petitionon hand.

Justice Vinod ChatterjiKoul after hearing both thesides in length observedthat inherent powers can-not naturally be invokedwith respect to any mattercovered by specific provi-sions of the Code of Crimi-nal Procedure. It is onlywhere the High Court is sat-isfied either that an orderpassed under the Codewould be rendered ineffec-tive or that the process ofany court would be abusedor that ends ofjustice wouldnot be secured, that theHigh Court can and mustexercise its inherent powersunder Section 482 of theCode. This power can be in-voked only in an event whenaggrieved party is being un-necessarily harassed. The

power under Section 482Cr.P.C., is not intended toscuttle justice at thresholdbut to secure justice.

High Court further saidthat needless to say, thatwhen exercising jurisdic-tion under Section 482 ofthe Code, the High Courtwould not ordinarily em-bark upon an enquirywhether the evidence inquestion is reliable or not orwhether on reasonable ap-preciation thereof, accusa-tion would not be sustained.That is the function of thetrial Judge. The scope of ex-ercise of power under Sec-tion 482 Cr.P.C. and the cat-egories of cases, where theHigh Court may exercise itspower under it relating tocognizable offences to pre-vent abuse of process of anycourt or otherwise to secureends of justice were set outin detail in the case of Bha-jan Lal (supra). The powerspossessed by the HighCourt under Section 482Cr.P.C. are very wide and atthe same time the power re-quires great caution in itsexercise. The Court must becareful to see that its deci-

sion in exercise of thispower is based on soundprinciples. The inherentpower should not be exer-cised to stifle a legitimateprosecution.

With these observationsHigh Court dismissed thepetition with directions thatparties to appear beforeTrial Court on July 20,2020.

Thec ase that a complainthas been moved by OmarAbdullah before the TrialCourt under Section 499,500 RPC/IPC. While givingintroduction of Mr OmarAbdullah, the then ChiefMinister of erstwhile Stateof Jammu and Kashmir, itis stated in the complaintthat on 25th August 2010, aPress Conference was heldby petitioner and respon-dent no.2, at the office ofJ&K Peoples DemocraticParty, No.2, Circuit House,Emporium Lane, ResidencyRoad, Srinagar, which wasattended by several othermembers of the Party, in-cluding legislators of theState Legislature as well asmembers of public and me-dia persons.
