3. Registered Body: FEDERATION OF APARTMENT ASSOCIATION BENGALURU shall be a Registered Body under the Karnataka Societies Registration Act, 1960.

4- . Non-Profit Organisation: FEDERATION OF APARTMENT ASSOCIATION BENGALURU shall be a Non-Profit Organization and shall apply all its income to the promotion of its objectives and shall not distribute any dividends/income to its members.

5. Objectives of the Association:

1) To be and to act as the Federation of all Apartments associations, committees, societies etc; in Bengaluru City in such a manner so as to protect the lawful rights, privileges / interests and to espouse the common cause of all the members without prejudice or favour towards any one.

2) To safeguard the welfare of the members / residents of all the Apartments in the City of Bengaluru.

To take up any common cause , issues pertaining to all Apartment associations, committees, societies etc; in Bengaluru City which shall include issues related to civic amenities, Cauvery water supply, ground water, electricity, garbage collection and disposal, street lights, sanitary . drainage and sewage lines, roads, public transport system, health and hygiene, Fire safety measures, ownership related issues like land and

* . building roads, Khatha, Completion certificates, Occupancy Certificate, c-;'1\10Cs or any other welfare / common facilities / infrastructural related

issues of all the members and residents of apartments in Bengaluru city.

4) To endeavour to protect environment and work towards a clean /green and pollution free city.

5) To represent the members of the society in all matters pertaining to their problems before State Government and its departments including BBMP, BWSSB, BDA, BESCOM , BMTC, KSRTC, Pollution Control

Board and any other agencies of both the Union & state Governments,

public or private agencies, regarding various issues relating to civic

amenities and allied issues including drinking/ground water,

sanitary/sewerage waters pipelines, sewerage treatment plants, garbage

disposal, electricity, fire safety measures, public transport, health and

hygiene, akrama-sakrama issues, property tax, preservation of water

bodies/lakes, parks, trees, public roads and any other issue touching the

welfare/interest of the members/residents of the apartment/ apartment

buildings in Bengaluru City.

6) To Liaison with all Govt. Departments, and or any other

organisations /body/NGOs to achieve the objectives of the Federation.

7) To Foster spirit of brotherhood among the members of the Federation.

8) To initiate and encourage the members about tree plantation/protection

and rejuvenation of water bodies and lakes in the city, protection of parks

and trees, storm water drains, and to maintain environmental / ecological

balance.

9) To promote common interest, well being and welfare among the

members/residents of Apartments and assist and advise individual

member in respect of formation/registration and their

administrative/maintenance related issues.

10) To frame rules and regulations for the administration and functioning of

the Federation.

11) To establish and carry on jointly or individually any institutions of

educational, social, recreational purposes and to organise cultural activities

for the benefit of all the members.

12) To promote and engage in educational, cultural, literary activities for the

benefit of all.

To promote and engage in promoting interest and spread knowledge in

the scientific, technological and medical field for the benefit of all.

14) To establish and maintain recreational facilities, library and reading room

for the benefit of its members.

15) To establish and run sports facilities and conduct sports competitions.

16) To celebrate national festivals.

17) To conduct / organize or promote cultural events / festivals.

18) And to generally do all such acts and deeds and things incidental and in relation to achieving the objectives as stated above.

19) To Register the Federation with the relevant Governmental bodies and

effectively interact with the Government agencies to obtain the best

facilities and redressal of public grievance.

20) To be a forum for collective representation of Rights and duties of Citizens

of this City, State and the Country.

21) To maintain transparency in all its dealings, administration and financial matters.

22) To do all lawful acts for the attainment of the aforesaid activities.

23) To engage the services of professionals like Engineers, Advocates,

Architects, Chartered Accountants, licensed Contractors in the field of

civic amenities, environmental and ecological experts etc., in furtherance

of the achievement of the aims and objectives.

24) To do all other things as may be considered as incidental or conducive

for the attainment of these objectives. 25) The President/General Secretary of the Federation / Forum , are

authorised to correspond with the Registrar , Bangalore District,

Bengaluru, under The Karnataka Societies Registration Act, 1960.

26) The Federation/Forum shall not act beyond the scope of these objectives

without duly amending the provisions of the Bye laws for the purpose.

27) The income of the Federation/ Forum shall be utilised strictly for the

attainment of the objectives of the Federation/Forum only.

BYE-LAWS

BYE-LAWS OF FEDERATION OF APARTMENT ASSOCIATION BENGALURU

1. SHORT TITLE AND APPLICATION : a) These Bye Laws shall be called the Bye Laws of FEDERATION OF APARTMENT ASSOCIATION BENGALURU, herein after referred to as Federation, located at Flat No.403, Andes Block, Heritage Estate, Doddaballapura Main Road, Yelahanka, Bengaluru — 560 064. (b) These bye laws shall be applicable to all the members, associate members of the Federation/Forum, existing and future Apartment Residential Welfare Associations, Societies, organisations etc., their members and the owners /tenants/lessee, their blood relatives and dependents and other residents who are residing in the apartment/apartment building located within the limits of Bangaluru City.

2. DEFINITIONS: In these by laws, unless the context otherwise requires: (a)ACT : Means the KARNATAKA REGISTRATION OF SOCIETIES ACT, 1960 and the RULES framed thereunder from time to time.

(b) FEDERATION: Means FEDERATION OF APARTMENT ASSOCIATION BENGALURU, being a representative body of all the Apartments Residential

-- Welfare Associations/Committees/Societies etc., in the limits of Bangaluru City.

(c) COMPETENT AUTHORITY : Means the Competent Authority under the Karnataka Societies Registration Act, 1962.

MAJORITY : Means : (i) In relation to regular meetings and special Wings, 51% of the members present and voting (ii) In relation to Special

General Body, Annual General Body meetings and any other Special meeting, convened for the purpose of amending the Bye-laws, two thirds of total number of the members of the Federation.

(e) MANAGEMENT COMMITTEE : Means the committee of office bearers elected to manage and administer the day to day affairs / activities of the Federation.

f)EXECUTIVE COMMITTEE: Means the Committee comprising of (20)

members, four from each Zone, elected by the Management Committee, to

assist and co-ordinate the day to day work of management committee.

(g) OFFICE BEARERS : Means the members elected as President, Vice

President, General Secretary, Secretary, Joint Secretary, Organising Secretary,

Treasurer; and all other Vice Presidents, Secretaries, Organising Secretaries,

Joint Secretaries at Zonal Level And members of Executive Committee elected by Management Committee.

(h) MEMBER : Means all the Apartments Residential Welfare Associations,

Committees, Societies or Organisations etc., located within the limits of

Bangaluru City, whether registered with the competent authority or not,

enrolled as member of the Federation/Forum

(i) ASSOCIATE MEMBER: Means any tenant/lessee/their dependents/relatives

etc., ordinarily residing in an Apartment or Apartment Building.

(j) PROXY : Means any office bearer other than the President, Secretary or any

Member of Apartment Residential Welfare Association, residing in their

respective apartments and who are authorised specifically in writing by the

President/Secretary of their respective associations, to attend/represent/vote

in any meetings of the Federation.

(k) APARTMENT : Means one single Apartment irrespective of number of

individual flats/units in the apartment.

(1)-APARTMENT BUILDING: Means a cluster apartments with more than one

Apartment located within the same premises irrespective of number of

individual flats/units in such Apartment Building.

(m) UNIT: MEANS each individual flat located within an apartment or apartment

building.

:(-4) RESIDENT: Includes the owner/tenant/lessee/residents, their legal heirs and

va —relatives/dependents who are residing in any part/ unit of an

apartment/apartment building.

o) BLOOD RELATIVE : Means the spouse, major son and daughter of an owner of individual unit/flat or flats in an Apartment or Apartment Building, but does not include married daughter.

p) APARTMENT ASSOCIATION : Means an association, society, committee, council or any organisation of the owners/tenants/lessee/residents/their blood relative etc., residing in any individual apartment or apartment building, whether registered with the competent authority or not, hereinafter referred to as AA.

(q) In these bye laws, singular shall include plural and masculine form shall include feminine form according to the context wherever required. (r) YEAR : means Financial Year starting from April to March of next year.

3. MEMBERSHIP/MEMBERSHIP FEE: a) All the existing Apartment Associations in the city of Bengaluru, represented

by two members of the association duly authorised by the association which shall include any of the Office bearers or MC members, whether registered or not and all such Apartment Associations to be constituted in future, shall be the members of the Federation.

b) Each individual Apartment Association shall pay to the Federation: (a) Non refundable Joining fees of Rs.2,000/ = (Rupees Two thousand only) and ( b) Non refundable Annual membership fees which shall be decided at the first MC meeting of the Federation. Both Joining fees and Annual Fee shall be revised annually by the management committee.

c) In case of an Apartment Building (cluster of apartments) comprising more than one associationlocated within the same premises/complex, the Joining fee7annual membership fees payable, shall be charged in respect of each individual apartment association located within the same premises/complex of such Apartment Building.

4. MEETINGS : a) GENERAL BODY MEETING: The first General body meeting shall be held

within one month from the date of registration of the Federation. All subsequent Annual General Body meetings shall be held on any day, preferably on a holiday during the first quarter of the subsequent Financial year ( April, May or June months)

b) The office bearers of the Federation shall be elected at the Annual General

Body meeting through secret ballot. In the event of any delay in

convening the General Body meeting, the Management Committee shall

decide upon the earliest date of such General Body meeting.

c) A Special General Body meeting may also be convened on any day by

the Management Committee to deal with any emergency situation or

within 7 days from the date of demand made in writing by 1/4 th ( One-

fourth) members of the Management Committee to discuss and decide

any specific issue/issues requiring immediate/urgent attention.

d) SPECIAL MEETINGS: Special meetings of the members may be

convened on any day by the managing committee to discuss an deal with

any issue which may arise affecting the members in any manner or

for the purpose of amending the bye laws.

e) REGULAR MEETINGS: The Regular Meetings shall be held once in two months, preferably on

holidays to discuss current issues and transact business relating to the

welfare/problems/administrative issues etc.,

1) MEETINGS OF THE MANAGEMENT COMMITTEE: The newly

elected management committee with its office bearers shall convene its

first meting within 15 days from the date of their election and

thereafter regularly once in a month on the date and time fixed by the

President or Genl. Secretary to discuss current issues and any

administrative, management or organisational issues.

g) The President / General Secretary are authorised to convene any of the

above meeting.

5. N TICE /MINUTES OF THE ME'TINGS: a) The General Secretary shall communicate the notice of all meetings to all

concerned indicating the date/time/ place and agenda of all such

meetings, through electronic media like email, SMS, messaging Whatsapp

Group, website of the Federation.

b) Such notices shall be communicated (7) days in advance in respect of

Regular Meetings and Special meetings and 21 days in advance for Annual

General body meeting. However, in respect of Special General Body

meeting or meetings convened to deal with any emergent/urgent situation, intimation shall be given as soon as possible deemed fit and proper. Every such intimation shall contain the Agenda/business/issues to be discussed in the meetings.

c) The minutes of all the meetings (MOM) shall be recorded by the General Secretary or any Zonal Secretary nominated by the General Secretary. Copies of the minutes of the meetings shall be updated as soon as possible on the website of the Federation/Forum, besides affixing on the notice board at the office. Copies of such MOMs duly signed by the Genl. Secretary, shall also be furnished to all office bearers of the management committee and to any owner of an apartment/flat on his request made in writing addressed to the General Secretary.

6. QUORUM AND ADJOURNMNT OF MEETINGS:

a) A minimum 1 / 3 rd members of individual Apartment/ Apartment Building ASSOCIATIONs shall constitute quorum for any meeting.

b) In case of lack of quorum at any regular meeting , the meeting shall be adjourned for one hour and reconvened thereafter without further intimation to any one and decisions shall be taken with the available number of members.-

In case of special meeting convened to amend the Bye Laws, the minimum quorum shall be thl /4th of the members the Federation. In case the meeting is adjourned for lack of quorum, the subsequent meeting shall be held within (7) days from the date of adjournment, with due notice to all concerned and decision shall be taken with the available members in the

7. ORD OF BUSINESS AT GENERAL BODY MEETING : The order of business at annual General Body meetings shall be governed by an Agenda which includes the following among other things : a) Roll call and election of Chairman to conduct the meeting followed by reading of the Agenda of the meeting. b)Consider and approve the minutes of the preceding general body meeting

and special meeting, if any. c) Consider and approve the annual report of the General Secretary.

d) Consider and adopt reports of Sub Committees with necessary changes and to initiate action if required on such reports. e) Adoption of audited accounts , Auditors Report and Treasurers report for the preceding year and discussions thereon.

I) Election of new Office Bearers of the Management Committee/Executive Committee members

g) Adoption of the Budget proposals for the ensuing year. h) Amendments, if any to the Bye Laws, rules and regulations of the Federation. i) Scrutiny and approval of the Annual Financial Statement/Income and Expenditure statement.

j) Consider and initiate action on the report of the Competent Authority, if any k) Consider and deal with any appeals against the action of the Managing Committee or any office bearer thereof.

1) Any other business/issue with the permission of the Chair / vote of thanks

8. OFFICE BEARERS OF THE FEDERATION: The office bearers of the Federation shall be : One President ; Five Vice

Presidents; One General Secretary ; Five Joint Secretaries; One Treasurer to be

elected by the management committee. Each Joint Secretary and Vice President

shall be from each Zone namely North, South, East, West and CBD zones of

Bengaluru City. Besides the Office Bearers, there shall be 12 Management

Committee Members drawn from all the five zones of Bengaluru City.

9. POWERS AND DUTIES OF THE MANAGEMENT COMMITTEE: The Management Committee comprising of all the office bearers and

Management Committee members of the Federation shall : al_Be_ responsible for overall management and administration of day to day

oltif1494'the Federation and to do all such other acts and things as are

permissible by ;these bye laws to protect/safeguard the overall welfare and

interest of the members.

b) Do all such acts deemed fit and proper to attain the aims and objectives of

the Federation/Forum.

c) Elect (12) members to the Management Committee to aid and assist the

Management Committee in the discharge of its day to day functions.

d) Engage the services of Engineers, apartment building technical experts, licensed contractors, Legal Advisors (Advocate), Financial Advisors/Auditors

etc., to aid and advise and represent the Federation at all levels .

e) Represent the Federation/Forum at all Government Departments, other

instrumentalities/agencies of Government ,BBMP, BWSSB, BDA,

BESCOM,BMTC, KSRTC , KPTL and Courts, Quasi judicial Forums and

Authorities , Tribunals etc., on behalf of the Federation/ Forum f) Appoint a Manager and other employees of the Federation/ Forum for the purpose of day to day administration and management and

g) Constitute various committees as and when required to look into any issue

related to administration /management affairs of the Federation

h) Inspect and scrutinize the books of accounts, receipts, vouchers etc., at regular

intervals and initiate necessary follow up action as deemed fit and proper.

i) Hear and dispose of any complaints by any member.

j) Make payments to the Government, quasi Government agencies, employees of

the Federation as are due/payable by the Federation.

k) Frame rules and regulations in respect of the employees of the Federation. 1)Present Budget proposals and accounts duly audited by the auditors at the

annual General Body meetings.

m) Appoint internal auditors to conduct audit of the accounts at every quarter

ending of each year.

n) Be responsible for the collection and judicious spending of all types of funds

of the Federation.

o) Initiate and defend all legal proceedings on behalf of the Federation or brought

against the Federation in any Court of Law, quasi judicial forums or Tribunals etc.

p) Fix the salaries of the employees and also sanction all kinds of payments to Government and other agencies of the Govt., legal and auditors fees, salaries of

the employees and all such other payments to any private agencies, payable/due

by ,the, Federation.

,04.) -Hear and dispose of any complaints relating to accounts, funds, or other

Asues relating to the discipline and conduct of the employees.

r) Nominate Representatives at ward level to coordinate the work of Zonal level

office bearers.. These representatives shall discharge their

duties/responsibilities as directed by the management committee.

s) All the office bearers/Members of Executive Committee/Representatives of

the Federation/Forum, shall discharge their duties and responsibilities

voluntarily out of free will and consent WITHOUT ANY

REMUNERATION / PAYMENT etc.

t) All the office bearers shall give an undertaking in writing to the

President/ General Secretary affirming their allegiance and agreement to adhere

strictly to these bye laws of the Federation.

10. POWERS AND DUTIES OF THE OFFICE BEARERS :

A. PRESIDENT: The President shall be the overall head of the Federation. He shall guide and supervise all the activities and day to day functioning of the Federation/Forum. He shall preside over all the meetings and ensure smooth conduct of the business as per agenda. He shall be vested with all the administrative and management powers as ordinarily exercised by the President of any similar Federation. The Management Committee shall function/discharge its functions under his administrative control and supervision.

B. VICE PRESIDENT: The Vice President shall exercise all the powers of the President in his absence. He shall assist the President in the discharge of his day to day functioning.

C. GENERAL SECRETARY: The General Secretary shall be responsible to the Management Committee and discharge all such duties as are required for the day to day administration and affairs of the Federation. He shall also : i)Deal with all administrative and management related correspondence and record the minutes of all the meetings of the Federation ii)Execute the decisions, directions and resolutions/taken at all the meetings. iii)Judiciously manage the Funds and ensure proper/fair and transparent accounting procedure of the funds. iv)Verify from time to time all the bills, vouchers and all such documents relating , to financial transactions including the income and expenditure/annual

.,financial statements prepared by the Treasurer and also counter sign them. v) He should also publish on the website of the Federation, the Income and Expenditure, statements prepared by the Treasurer. Besides, present Annual Report and Audited Annual Financial Statements of Accounts at the Annual General Body meeting. vi) Initiate any 'disciplinary action against the employees of the Federation.

otii)Institute, prosecute and defend all suits, legal proceedings relating to the Federation. as when directed by the management committee. viii)Discharge all such other duties and responsibilities as directed by the Management Committee. ix)Communicate the notices/minutes of all the meetings to all concerned x) Maintain in his custody all the registers, files and correspondences relating to the administration/maintenance and affairs of the Federation. xi)Perform all such duties authorised/directed by the Management Committee, which are incidental to the office of General Secretary of Federation.

D. TREASURER: The Treasurer shall :

i)Be responsible proper/transparent management of the funds of Federation and keep full and accurate accounting system with proper receipts and payments. ii)Maintain all the registers of accounts including Cash Book, Income and Expenditure statements, Annul Financial Statements etc. iii)Deposit all the money/funds received from members /other sources without delay in the Savings Accounts of the Bank designated by the Management Committee.

iv)Be authorised to keep an amount of Rs. 10,000/- as working expenses to meet any immediate administrative/organisational requirements. The Genl. Secretary shall sanction such amount from time to time on a written request filed by the Treasurer.

v) Prepare quarterly Income and Expenditure Statement and present the same to the General Secretary/management Committee for its approval in the monthly meeting of the management committee.

vi) Prepare Annual Financial Statement in consultation with the General Secretary and present the same to the General Secretary/Management Committee for approval and subsequent auditing by the auditor and final presentation in the annual General Body Meeting.

vii) Shall co-operate and coordinate the entire accounts work with the internal auditors nominated by the management committee from among the members of

the Federation.

viii) All the records, ledgers, files , books of accounts, pass book, cheque books, bank statements, vouchers, receipts and any other document relating to the accounts/accounting system, shall be under the custody of the Treasurer.

E. JOINT SECERTARY: All the Joint Secretaries shall: t.

i)Exercise such powers and discharge such other organisational duties in their as directed by the Management Committee. ii)Assist the General Secretary in his functioning and send him the feed back/reports from time to time regarding all the activities and functioning at

their respective zonal level.

T. MANAGEMENT COMMITTEE MEMBER: The members Of Management

Committee shall be part and parcel of the management committee to assist the Managing Committee in its functioning and discharge such duties/responsibilities as directed by the management committee from time to

time.

1 1 . TERM/TENURE OF MANAGEMENT COMMITTEE AND OFFICE BEARERS: a) The term/ tenure of office of the Managing Committee/Office bearers of the Federation shall be ONE YEAR from the date of election.

b) The General Body may, by a resolution adopted by the Majority, direct the

out-going management committee/ office bearers to continue in the office for

the SECOND SUCCESSIVE TERM/TENURE. c) An office bearer elected shall be eligible to contest for the second successive term/tenure.

d) No office bearer shall be eligible to contest or continue for the third

successive term/tenure.

12. REMOVAL/DISQUALIFICATION/RESIGNATION OF THE OFFICE BEARERS: a)An office bearer may be removed from his post for alleged misconduct ,

unbecoming of an office bearer or mis-management of funds. He shall be given

Reasonable opportunity of submitting written explanation to the President in his defense.

b)The President shall convene a special meeting wherein the members of

management committee present in the meeting shall consider the written

explanation and adopt a resolution supported by simple majority, either to

exonerate or remove the office bearer as the case may be. A successor to fill up

the vacancy caused by such removal, shall be elected by the Managing

ornmittee in the same meeting.

(13)An' y office bearer of the Federation stands disqualified immediately on being

convicted by any Court of Law on Criminal Charges. The order or such

disqualification shall be issued by the President. The office bearer so disqualified

shall not be eligible to contest for any post.

d)Any office beaier may resign from his post by addressing a letter to the

President. The resignation shall come into effect from the date of acceptance

or one month from the date of his resignation, whichever is earlier.

13. ELECTION OF OFFICE BEARERS/VOTING : a) The election of the office bearers of the Federation shall ordinarily be

unanimous. In the absence of unanimity, elections may be held through secret ballot or show of hands whichever is agreed upon simple majority.

b) All the members shall have right to vote to elect the office bearers.

c) A proxy who is an office bearer of any member Apartment ASSOCIATION,

but not being an associate member, duly authorised in writing by the

14. FUNDS OF THE FEDERATION:

1.The funds of the Federation/Forum shall comprise of contributions from the members of the Federation towards : (a)Non Refundable Joining Membership Fees (b)Non Refundable Annual Membership Fees which is revisable annually by the management committee ( c) Corpus Fund (d) Legal Fund (e)Administrative Fund and (e) Donations from the members/NGOs or other organisations with similar aims and objectives of the Federation/Forum 2.The funds shall be deposited without delay in the Savings Bank Account to be opened in the name of the Federation/Forum with any nationalised/ scheduled banks identified by the management committee. 3.The Savings Bank Account shall be operated with the Joint Signatures of the President And either Treasurer or General Secretary — i.e., ( President and Treasurer) OR ( President and General Secretary) 4.The management committee shall fix the total quantum of amount to be raised towards Legal Fund ; Corpus Funds and Administrative Fund, not exceeding Rs. One Lakh towards each type of Fund. The management committee is authorised to enhance the quantum of these Funds with the approval of majority at any Special meeting. 5. The contribution by the members towards each of these Funds — Legal, Corpus and Administrative Funds shall be on pro-rata basis, payable proportionately per each/single Apartment in an Apartment Association or Apartment Building Association. 6. The Legal , Fund shall be used/spent exclusively to meet all types of legal expenditures involving any legal proceedings, court fees, legal documentation , advocates remuneration etc. 7. The Corpus Fund shall be invested in renewable annually and may be used/spent

term deposits for one year /auto to meet any emergency/urgent

financial commitment by the Federation/Forum with the approval of the Apex Level office bearers in management committee. 8. The members may remit their proportionate share of Legal Fund / Corpus Fund either in one single / (lump sum) payment or equal number installments to be decided by the management committee. 9. The Administrative Fund shall be payable in single instalment (Lump sum) payment to meet day to day administrative expenditure, purchases, salaries of the employees , office management, stationary and printing , Bill payments and

President/Secretary of the Apartment ASSOCIATION concerned, for the purpose, is also entitled to vote. d) An associate member has not right to vote either during the elections or at any of the meetings of the Federation.

all such expenditure incidental and relevant for the day to day administration of the Federation.

10. All payments/disbursements of Rs. 5000/- and above shall be made only

through A/C payee/ Crossed bank cheques and all cash payments above Rs.

1000/- shall be sanctioned by the General Secretary.

15 . ACCOUNTS :

1. The Federation/Forum shall publish an audited Annual Financial Statement

every year in the month of April with complete details of profit and loss /

income and expenditure statement of the preceding year, accompanied by list

of all the properties of the Federation and its members.

2. The Treasurer shall publish bi-monthly income and expenditure statement

and present the same at the Regular meeting for approval

3. The General Secretary shall publish the bi-monthly Income and Expenditure

and Annual Financial Statements on the web-site of the Federation/Forum and

also furnish a copies of such statements to all the members of Management

Committee and to any other member on his written request.

4. Any member Apartment ASSOCIATION represented by President/Secretary

are authorised to inspect any books of accounts, receipts/vouchers, cheques

issued, any other statements relating to accounts of the Federation, on any day, , preferably on holiday, at the office of the Federation, in the presence of the

Treasurer and any other office bearer (Apex level) nominated by the President

-/S ' 5. The member intending to inspect the books of accounts shall submit his c\ 1,3 r, written request (i0) days in advance to the President who shall fix the date of

inspection. -c- ' 16. APPOINTMENT OF AN AUDITOR :

The Federation shall appoint an Auditor at the Annual General Body Meeting

to audit the accounts of the Federation. The auditor shall examine all the

relevant financial statements, vouchers, receipts to certify the Annual Financial

Statement. He may either sign the same as found by him to be correct, duly

verified, in accordance with law, or specifically report to the Federation on any

matter which appears to him to require attention of the management committee.

17. POWERS OF THE AUDITOR : The Auditor shall be entitled to call for and examine any papers or documents

belonging to the Federation and shall make special report to the Federation

upon any matter connected with the accounts which appears to him requiring the

attention of the management committee.

18. INTERNAL AUDITORS: The Management Committee shall appoint as many internal auditors as deemed

fit, preferably from among the members who possess expertise in the field of

accountancy/financial matters. The internal auditors shall audit the accounts of

the Federation every quarter during each year and submit their report with any

observations to the President and Genl. Secretary. They shall also co-ordinate

with the Treasurer in proper/fair maintenance of books of accounts and

preparing income and expenditure statements and annual financial statements

etc.,

19. DUTIES OF MANAGER : 1. The Manager shall be appointed by the Management Committee, preferably

from among the owners of any member apartment ASSOCIATION to assist the

Management Committee in the discharge of its day to day administrative,

management and organisational duties.

2. He shall specially assist the General Secretary in the execution and

implementation of all the decisions taken in the meetings.

3. He shall also assist the Treasurer in the accounts related work and look after

deposit/withdrawal of funds from the Savings Bank account of the Federation/Forum, up-dating of Pass Book etc., look after bank related works

from time to time.

4. He shall supervise/monitor the work of all the employees of the

Federation/Form and enforce discipline among them.

5. He shall p6rform such other duties as are entrusted to him by the

Managemcnt Coinmittee from time to time

6. The General secretary shall sanction an amount of Rs. 5000/- to be retained

with the Matiager to meet any emergency or day to day expenditure if

required. He shall submit to the Treasurer, the voucher/receipts of the amount

spent by him to meet such exigencies.

20. SEAL OF THE FEDERATION : The Federation/ Forum shall have a common seal which will be in the custody of General Secretary. It shall be used under the direction of the President. Every deed to which the seal is attested/affixed shall be counter signed by any two members of the management committee. A register shall be maintained indicating the chronological record of the use of the seal.

21. RULES AND REGULATIONS: The management committee, by a simple majority, is authorised to frame rules and regulations deemed fit and proper, under these bye-laws for effective day to day administration.

22. AMENDMENT OF THE BYE LAWS: 1)These Bye-Laws may be amended at any Special Meeting or Special General Body meeting convened by the President for the same purpose or at any annual General Body meeting. Such proposed amendments shall approved by 2/3 rd of the total membership of the Federation/Forum. 2) A copy of the amendment so ratified in the General Body meeting shall

be filed with the Competent Authority,
