DepartmentofHealthandHumanServicesarecurrentlyworkingonrevisionstofederaldietaryguidelines.

RequiredbyCongress,therevisionsaresupposedtoensurethatguidelineswillcontinueto“promotehealthandreduceriskformajorchronicdiseases…basedonthemostsoundscientificinformation.”

ButJefflearnedthattheagencieshaveinsteadbeentryingto use the guidelines to advance an ideological agenda that hasnothingtodowithhealthyeating.

MembersoftheDietaryGuidelinesCommittee,thecommitteeoverseeingtherevisions,arepushingtomake“sustainabledevelopment,”“globalclimatechange,”andeven“immigration”partofthedietaryguidelines.

JeffblewthewhistleonthecommitteeinacolumnintheWashingtonExaminer.Henotedthatfarfrompromotinghealthyeatinghabits,therevisionstheywereseekingcouldthreatenpublichealthbymakinghealthyfoodslessaffordable.

“Thenewguidelineswillincreasethepricesyoupayforwhatyoueat,”hewrote.

TheUSDAisapparentlyfeelingtheheat.AfterJeff ’scolumnappeared,theUSDAtriedtobacktrackonitspoliticalactivism.

“Thecommitteeisstillintheearlystagesofitswork,soitis…prematuretospeculatewhatwillbeincludedinthefinaldietaryguidelines,”aUSDAspokesmansaid.“Someofthetopics discussed by the committee are not intended to have policyimplications.”

Shouldthefederalgovernmentforcethecharity“PriestsforLife”topayforearly abortion drugs?

SupportersofObamaCare’sHHSabortion drug and contraception mandate,whichrequirescoveredemployers to provide contraception and early abortion coverage to their employees,say“yes.”

Theyclaimacharityofpro-lifepriestsisn’treligious,norisareligiousschool,norisanon-profitpublisherthatprintsBibles.

Mandatesupportersclaimthatwhen most religious people go to work,theystopbeingreligious.

They also claim employers who don’toffercontraceptionorearlyabortioncoverageare“meddling”intheiremployees’lives.

But,quitetheoppositeistrue.Bypayingemployeesinmoney,notinbenefitstheemployeecan’tevenchoose,employersarestayingoutoftheiremployees’privatelives.

Supportersalsoclaimthatifyoupreventthedevelopmentofafertilizedeggthathasnotyetimplanted,itisnotabortion,butifyoupreventthedevelopmentofonethathasimplant-ed,itisabortion.

Butthisargumenthingescomplete-lyonthedefinitionoftheword“abor-

tion”;eitherway,afertilizedhumanegg’sdevelopmentisstopped,andnohumanisborn.Peoplewhobelieveitiswrongtostopthedevelopmentofafertilizedeggobjecttothisregardlessofwhatitiscalled.

Supportersalsoarguethatemploy-ersdon’thavetherighttodenyemployeesaccesstocontraceptives.

That’strue,butitalsoisirrelevant,becauseemployerswhodonotpayforemployees’abortiondrugsandcontra-ception are not denying access to those items any more than they are denyingaccesstofoodbynotbuyingtheiremployeesgroceries.

Employeeslikecashcompensation,andforgoodreason:Theycandecideforthemselveswhattobuy.Itmightbecontraception;itmightbegasforthecar.

Thisiscalledfreedom,andthegov-ernmentwillbetakingsomeofyoursawayifitsucceedsinforcingyouremployertoconvertsomeofyourpaytospecifichealthcareservicesyoumightnotevenwant.

Some people mistakenly think the mandategivesemployeesfreecontra-ceptionandabortiondrugs.Itdoesn’t:Employerspaytheiremploy-eesbasedonthemarketvalueoftheirwork.Ifthegovernmentforcesemployerstopaysomeofthatcom-pensationincontraceptionandabor-tioncoverage,employerswilldeductthatamountfromthecashpayments.

Employeeswhogethealthinsuranceatworkaren’tgettingitfree.They’retakingsomeoftheirpayinhealthinsurance.Andthat’sOKiftheywantto.

It’swhenthefederalgovernmenttriestoforcecertainbenefitpackagesonemployeesthatproblemsarise.

In1993,Democrats,Republicansandthen-PresidentClintonover-whelminglypassedtheReligiousFreedomRestorationAct(RFRA).

UnderRFRA,thefederalgovern-mentcanonlyforcepeople,including

businessowners,toviolatetheirreli-giousbeliefsifthegovernmenthasa“compellinginterest”indoingso.

The government also has to prove themandateisthe“leastrestrictive”wayitcanaccomplishitsgoalofmak-ing certain employed people have access to contraception and early abortiondrugs.

Thatwillbehardforthegovern-menttoprove,becausethepublicalready has access to abortion drugs andcontraception.

They’relegal,widelyavailableandinexpensive.Theabortiondrugscov-eredbythemandatesellfor$39-$49.Birthcontrolcanbehadfor$15orlessamonth.

TheHHSmandateisunfair,unconstitutionalandunnecessary.

It’salsounpopular.ANovemberRasmussenpollfoundthepublicopposed51-38percent.SubstantialnumbersoftheCatholic,Protestant,Jewish,Mormon,Buddhist,Hindu,Muslim,Sikh,Baha’i,andZoroastrianfaithsopposeit.

I predict the Supreme Court will tossthemandateout.

TheObamaAdministrationshouldwithdrawitnow,prophylactically.

WhenthepresidenttoldFox’sBillO’Reillythatthere’s“notevenasmid-genofcorruption”intheIRSpoliticaltargetingscandal,hedestroyedanycredibility his administration had to investigateitself.

UnlikeWatergate,there’snospecialprosecutor investigating the dirty trickscampaignagainsthundredsofconservativegroups.Becausethereisn’t,Obama’swordshavemoreseriousimplicationsthanNixon’s.

TheIRSinvestigationsupposedlyhasn’tbeencompletedyet.

Daysbeforethepresident’sinterview,U.S.AttorneyGeneralEricHoldertriedtoreassuretheSenateJudiciaryCommittee that his department is conductingaserious,unbiasedinvesti-gation.

He dismissed press accounts that the DOJhadalreadydecidedthere’dbeennocriminalviolations.

ThenPresidentObamapulledtherugoutfromunderHolderbysuggest-ingthepresswasright.

ItremindsoneofalineheardinWesterns:“We’llmakesureyougetaproperhangin’,son,rightafteryourtrial”…onlyinreverse.

Thepresident’sstatementwasbadonmanylevels.

Foronething,therewerealreadygoodreasonstoquestiontheinvestiga-tion’svalidity.

JusticeselectedanObamadonorandcampaignvolunteerasakeyinves-tigator.ThisisatoddswithDOJguidelinesrequiringimpartialinvesti-gators.

Andaftereightmonthsof“investi-gating,”noneoftheIRSvictimshadbeencontacted.WhenaskedaboutthisintheSenate,EricHolderresponded,“Idon’twanttogetintothat.”

Andthere’sthefactthattheIRScontinuedtoslow-walkapplicationsfortax-exemptstatus,makeunreason-abledocumentrequests,andauditconservativegroupsmonthsafterthescandalbroke.

Butperhapsthemostseriousindict-mentofthepresident’swordsisthattheycouldbeseenasobstructionofjustice.

Thereis,atleastintheory,anongo-ing investigation that could eventually leadtothepresidenthimself.

There’sareasonpeopleunderinves-tigationtypicallydon’tcommenttothepress.It’sbecausethiscanbeinterpreted as an attempt to coordinate storiesandimpedeinvestigations.

ByclaimingnolawswerebrokenandthatIRSofficialsweremerelyconfused,thePresidenttransmittedwhathewantedthoseofficialstotellinvestigators.

AnyDOJinvestigationthatclearstheIRSofviolationsoflawnowwillrightlybecalledillegitimate.

Let’sbeclearhere:TheIRSwaspursuingapoliticalagenda.

WeknowthisbecauseemailsbetweenIRSofficialsrevealtheywereobsessed about curbing political speech to circumvent the Supreme Court decisioninCitizensUnited.

Andweknowthisbecauseofwhat

IRSagentstoldvictims.Myorganizationwashitwithan

IRSauditin2012thatlasted15monthsandtheagentassignedtocon-ductitindicateditwaspolitical.

Itwaspromptedbyoneofourpub-licationscriticalofadministrationpol-icy.

The agent said he saw nothing wrong with the publication and lamented,“Idon’tknowwhattheyexpectmetofind.”

There’snothingwrongwithwhatwewrote,butouropinionwasnonethe-lessthebasisofafullfieldaudit?That’sharassment;that’sintimidation.

The only way the investigation is goingtobecrediblenowisifEricHolderusestheUnitedStatesCode’sgeneral delegation provision to seek a specialprosecutor.Asanyonehe’dselectwouldbesuspect,heshouldaskforacourtappointmentoftheprose-cutor.

IfHolderrefuses,CongressshouldreauthorizetheIndependentCounselActtoallowittodoso.

PresidentNixonknewwhathadtobedonetoensureacredibleinvestiga-tion.PresidentObamashouldfollowhisexample.ReachingNixon’sethicalbarshouldn’tbethatdifficult.
