HOW TO USE THE DIVISION HANDBOOK

The Loudoun County Public Schools’ Employee Handbook provides alphabe tized sections, as well as policy/regulation reference numbers, and a comprehensive index to help the user find information quickly. Organizationaland personnel information, found in the front of the document, are followed byalphabetized sections which outline important rules, regulations, policies, and benefits. Following are the administrative, classified, and teacher salaries for theyear. Policy and/or regulation reference numbers are shown where applicable.These numbers correspond to the specific location in the School Board PolicyManual where an in-depth account of the relevant policy is provided.

I am happy to introduce the twenty-fourth edition of ourLoudoun County Public Schools’ Employee Handbook. TheHandbook provides a quick reference for policies and regula-tions and an overview of the benefits available to us as full-time staff members.

Be sure to consult the School Board Policy Manual located in all school facility offices or visit us at our website atwww.lcps.org for the most detailed and up-to-date information on policies. If you have questions, please discuss them withyour immediate supervisor. The Department of PersonnelServices in the Administration Building (571-252-1100) is alsoavailable to provide assistance.

As members of the Loudoun County Public Schools’ EducationTeam, you and I are involved in some of the most importantwork there is to be done. Whether we are teachers, bus drivers,office staff, maintenance personnel, cafeteria workers, oradministrators, each of us plays a key role in helping to shapethe future of our young people, our county, and our nation.

ANNUAL LEAVE SCHEDULE (P7-68)Administrative personnel (p7-68)New hire administrators will beadvanced annual leave (depending onthe date of hire). Thereafter, annual leavewill be advanced in July of each year.

Administrative personnel shall earnannual leave as follows:

20 days for the first and second yearsof employment

21 days after two (2) years of service

22 days after four (4) years of service

23 days after six (6) years of service

24 days after eight (8) years of service

Annual leave will be prorated based onthe number of contract/assignment days actually worked after July 1 of thecurrent school year.

Full-Time Twelve (12) Month classified personnel (p7-68)A new hire employee in a twelve-monthposition earns one day of annual leave amonth (depending on date of hire) forthe first six (6) consecutive months ofemployment for a maximum of six (6)days. At the completion of six (6)months, the remainder of the first year’sannual leave will be advanced. There-after, annual leave will be advanced inJuly of each year. One additional day isearned for each additional year of serv-ice up to the thirteenth (13th) year. Amaximum of twenty-four (24) days ofannual leave may be earned per yearafter the 13th year of service.

Annual leave for a person hired after the first working day of the month isprorated according to the number ofdays actually worked in the month.

CHILD ABUSE AND NEGLECT (P8-55)Duty to reportPursuant to state law, any personemployed by LCPS shall immediatelyreport suspected cases of child abuse or neglect in accordance with the proce-dures set forth.

Definition of Abused or Neglected childAn abused or neglected child shallmean any child less than eighteen yearsof age whose parent or other personresponsible for the child’s care:

1. creates or inflicts, threatens to createor inflict, or allows to be created orinflicted upon such child a physical ormental injury by other than accidentalmeans, or creates a substantial risk ofdeath, disfigurement, or impairmentof bodily or mental functions;

2. neglects or refuses to provide carenecessary for a child’s health, provid-ed, however, that no child who ingood faith is under treatment solelyby spiritual means through prayer inaccordance with the tenets and prac-tices of a recognized church or reli-gious denomination shall for thatreason alone be considered to be anabused or neglected child;

3. abandons such child; or,

4. commits or allows to be committedany sexual act upon a child in viola-tion of the law.

ABSENCE FROM WORKWhen schools are in session, Divisionemployees are responsible for the safe-ty and supervision of students. Duringsevere weather conditions or emer-gency situations, no employee is authorized to leave his/her assignedduties until these responsibilities havebeen fulfilled as determined by the prin-cipal or immediate supervisor.

Employee responsible to Obtain School Opening and closing InformationWhen severe weather or emergencyconditions exist, the Division Super in ten -dent decides to close or to continueoperating the schools. This decision is based primarily on student safety and welfare. While schools are in session, the decision is communicatedby telephone to the principal. Whensuch conditions occur during hoursother than school hours, the decision is communicated over local radio and television stations, as well as the Loudoun County Public Schools’website—www.lcps.org. Weather-related closing and delay messages are also sent using the Connect-Ed Phone Messaging System.

ACCEPTABLE USE (P7-32)Computer hardware, software, and net-works are the property of LCPS and areaccessible to Loudoun County PublicSchools employees to support the mis-sion and goals of the Loudoun CountySchool Board. Employee use of electron-ic communications equipment and serv-ices is a revocable privilege. As acondition of employment, each LCPSemployee must sign a copy of theAcceptable Use agreement and mayretain or request a copy of it.

ACCIDENTS AND INJURIES (P7-48)All personnel should be certain thateverything possible is being done toprevent accidents and injuries. If anadult or student accident does occur,state liability regulations require that the principal be notified immediately.The school will attempt to notify thestudent’s parents and/or the adult’sdesignee without delay.

Statutory Workers’ Compensation ben-efits cover injuries resulting from acci-dents arising out of or sustained in thecourse of employment. In all instances,employees and/or supervisors mustimmediately report injuries and safetyissues to the Retirement & DisabilityPrograms Division at 571-252-1240.

Persons with criminal conviction/childabuse records who do not report thisinformation on their employment applica-tion are subject to denial of employment,or dismissal if already employed, for fal-sifying their employment applications.

DRUG- AND ALCOHOL-FREE WORKPLACE (P7-37)The Loudoun County School Board iscommitted to maintaining a Drug- andAlcohol-Free Workplace.

A. On-School Board property or atSchool Activities — It is the policy ofthe Loudoun County School Board toprohibit employees from being underthe influence of and to prohibit the use,sale, dispensing, possession, or manu-facture of illegal drugs and narcotics oralcoholic beverages on its premises, atany school activity, on any school-spon-sored field or foreign trip and on or inschool buses and vehicles.

B. Off-School Board property — Theuse, sale, dispensing, possession, beingunder the influence or manufacture ofillegal drugs and narcotics or alcoholicbeverages off School Board propertywhich affects an employee's ability toperform his/her duties, or which gener-ates publicity or circumstances whichadversely affect the school division, itsemployees, or students shall be groundsfor discipline up to and including termi-nation.

c. Enforcement — The above prohibi-tions also cover the misuse/abuse of alllegal, prescription drugs, “over thecounter” drugs or any other substancewhich impair an employee's ability toperform his/her job safely or properly.

Violations may result in discipline up toand including termination and/or therequirement to participate in a drug oralcohol abuse assistance and rehabilita-tion program.

D. Notification to School Board —Employees who are criminally convictedof any drug or alcohol offense mustnotify in writing the Department of Per-sonnel Services immediately, but notlater than, five calendar days after suchconviction. Within 30 calendar days oflearning of the conviction, appropriatedisciplinary action up to and includingtermination may be taken and/or theemployee may be required to satisfacto-rily participate in a drug or alcoholabuse and rehabilitation programapproved under federal, state or locallaw or regulations.

E. Employee Awareness program — Anemployee awareness program will pro-vide employees information on the dan-gers of drug and alcohol use/abuse, theprovisions of this policy, the availabilityof the Employee Assistance Program forhelp and the disciplinary repercussionsfor violations of this policy. Informationwill be provided in the annual employeehandbook, new employee orientationand periodic reminders.

F. Monitoring and reporting — Allsupervisors are required to observe,monitor, and take effective action todetect and address alcohol and druguse and abuse among employees. Allemployees who reasonably suspectalcohol or drug use or abuse by co-workers on school board property or atschool activities shall report their obser-vations to their own Supervisors. Super-visors shall immediately notify theAssistant Superintendent of PersonnelServices if a violation is suspected.

ELECTIVE DEFERRAL PLANS (P7-47)All employees may participate in the LCPS403(b) and 457 Elective Deferral plans.

EMPLOYMENT PERIODSContracts or assignment letters areissued for various periods of time asdetermined by the requirements of

no later than 24 hours after the employeehad reason to suspect a reportableoffense.

CORPORAL PUNISHMENT (P8-30)No employee of Loudoun County Public Schools shall subject a student to corporal punishment. “Corporal pun-ishment” means the infliction of, orcausing the infliction of, physical pain on a student as a means of discipline.

CREDIT UNIONLoudoun Credit Union, founded in 1977,provides financial services for all employ-ees of the School Board, County, Countymunicipalities, and contracted groupswith the County. Vehicle Liability Insurance — Coveragefor vehicle risk exposures is provided byLCPS as per the following:

Persons Covered: Board members,employees, student teachers, andauthorized volunteers all while using,with permission, vehicles owned, hired,or borrowed by the School Board. Inaddition, covered persons using privatelyowned vehicles on official School Boardbusiness are insured for liability on anexcess basis, over and above the insur-ance protection on the privately ownedvehicle used.

Persons Not Covered: Students, organi-zations, or other entities (such as parent-teacher associations or booster clubs)that do not operate under the directionand control of the School Board.

Limits of Coverage: Coverage is limited to$10 million per occurrence for all cov-ered bodily injury and property damageclaims arising out of any one occur-rence. Defense costs are provided out-side the limit of liability.

Scope of Coverage: Liability coverage is provided in excess of any other collectible insurance for all non-ownedvehicles used on School Board business.

Major Exclusions: Any obligations forwhich the covered persons may be heldliable under any workers’ compensationor disability benefits law or under anysimilar law. Claims involving physicaldamages to any privately owned vehicle are specifically excluded.

Important Note —All inquiries from citi-zens, parents, and students concerningreimbursement for expenses because ofschool-related accidents should bereferred to Financial Services. No employ-ee or volunteer may ever agree, on behalfof the School Board, to pay any expensesor attempt to evaluate liability for any

incident. All claims against LoudounCounty Public Schools are investigatedby professional claims adjusters, and per-sons making claims are officially notifiedof the results of these investigations.

Employee’s possessionsLoudoun County Public Schools has noresponsibility for an employee’s personalbelongings he/she brings to work. Whenan employee brings personal items tothe work site, the employee is acceptingresponsibility for the items. If an employ-ee’s personal materials are stolen ordamaged at the work site, they will notbe replaced by the school system.

Health Insurance (p7-49)Health insurance coverage will be pro-vided for eligible employees. You areconsidered eligible if you are:

• Grandfathered as a result of a FT status prior to July 1, 2013, or

• Hired full-time on or after July 1, 2013

The Board will make a monthly contri-bution toward payment of the premium.

Once you meet eligibility requirements,you must file the appropriate electionform and supporting documentationwithin 30 days after you first becomeeligible. Enrollment is on a pre-tax basisunless otherwise specified by theemployee at time of enrollment. General and Professional Liability —Insurance coverage is provided by LCPS as per the following:

Persons Covered: Board members,employees, student teachers, andauthorized volunteers.

Persons Not Covered: Volunteers actingin their capacities as medical profes-sionals, students, organizations, andother entities (such as parent-teacherassociations or booster clubs) that donot operate under the direction andcontrol of the School Board.

Limits of Coverage: Coverage is limitedto $10 million per occurrence for bodilyinjury, property damage, personal injury,advertising injury, and professionalwrongful acts. Defense costs are provided outside the limit of liability.

Major Exclusions: Liability under any contract not relating to the conduct ofSchool Board business and liability of anunauthorized person assumed by thatperson under a contract on behalf of theSchool Board. Willful violation of a penalstatute or ordinance committed by orwith the knowledge or consent of thecovered person. Libel or slander or thepublication or utterance of defamatoryor disparaging material made by or atthe direction of a covered person withknowledge of the falsity thereof. Claimsinvolving allegations of fraud, dishonesty,or criminal acts or omissions; certaindefense coverages may be extendeduntil grounds are proven. Short-Term DisabilityLoudoun County Public Schools offers ashort-term disability plan for full-timeemployees. After a 13-day eliminationperiod, this plan provides a maximumdisability benefit of 60 percent ofincome for up to 13 weeks. EffectiveJanuary 1, 2014, the plan will have a 20-day elimination period and provide amaximum disability benefit of 60 per-

cent of income for up to 10 weeks. TheSchool Board pays for the full cost of thisinsurance. Questions about Short TermDisability should be directed to the Retire-ment and Disability Programs Division.

Donated Family Sick leave Bank (p7-66)A Donated Family Sick Leave Bank isavailable to all full-time employees to be used when (long-term illness or a serious health condition occurs) a spouse,child, or parent of the employee requiresthe absence of the employee. Participa-tion is voluntary. A maximum of 30 work-ing days each school year can be drawnby any one member. To be eligible towithdraw sick days from the bank, anemployee must be out of work 30 workdays and have exhausted all leave.

should consider these factors when mak-ing recommendations to reassign staff tospecial education positions.

c. reassignmentPrincipals shall submit to the AssistantSuperintendent for Personnel their rec-ommendations for employees to be invol-untarily transferred to achieve the staffingallocation for the upcoming school yearand the rationale for each selection. TheAssistant Superintendent for Personnelwill review the recommendations basedon several factors to ensure fairness andgrant the final approval for all involuntarytransfers. The factors to be consideredshall include: the strength of the rationalesubmitted by the Principal, the employee’slength of service to LCPS, the employee’snumber of previous involuntary transfers,the employee’s home address and licen-sure areas, and if the employee has madea request for a voluntary transfer that canbe granted.

LEAVE REGULATIONSSick leave (p7-57[b])Personal Illness. Personal illness isdefined as incapacity to perform dutiesbecause of a medical condition or con-finement on the advice of a licensedphysician. However, under the provi-sions of this section, dental or medicalcheck-ups may be counted as illness.An employee on sick leave may berequired after three consecutive days’absence to have verification from alicensed physician (or dentist) thathe/she is unable to perform his/herduties because of a medical conditionor confinement, or that he/she has amedical or dental check-up.

personnel covered — Eligibility andAccumulation (p7-57[a])1. A full-time, full-day employee under

regular contract (probationary or continuing) shall accumulate sick leaveduring the time the employee has

performed his/her assigned duties,including paid leave, under the termsof the contract. The maximumallowance per year is:

12 month position: 14 days11 month position: 11 days10 month position: 10 days

When the length of a contract has beenshortened (e.g. late start or earlyrelease), the number of sick leave dayswill be pro-rated.

2. A full-time, part-day (no less thanone-half day) employee under regularcontract (probationary or continuing)shall accumulate sick leave during thetime the employee has performedhis/her assigned duties, including paidleave, under the terms of the contract.The maximum allowance per year is10 pro-rated days for a 180–206 part-day position.

Family Illness (p7-57[c])Family Illness/Death. As used in thissection, family of an employee shall beregarded to include birth or adoptiveparents, foster parents, stepmother,stepfather, wife, husband, children(including stepchildren and foster chil-dren), brother and sister, grandparents,great-grandparents, grandparents-in-law, mother-in-law, father-in-law, sisters-in-law, brothers-in-law, daughters-in-law,sons-in-law, grandchildren, aunts, uncles,nieces, nephews, and any other relativeliving in the household of the employee(“any other relative living in the house-hold of the employee” is limited only inthat the relative, however distant, mustlive in the household of the employee),and anyone over whom the employeehas “power of attorney.”

FURLOUGH (P7-71)The Loudoun County School Boardadopted Policy 7-71 at its April 27, 2010School Board Meeting. This policy pro-vides guidelines for adoption and imple-mentation of School Board-approvedfurlough days. A furlough requiresemployees to take unpaid leave whenthey would have otherwise worked andbeen paid. In the event that furloughdays are approved by the School Board,implementation will be in accordancewith this policy, the Federal Fair LaborStandards Act, and the Virginia Adminis-trative Code.

GRIEVANCE PROCEDURE (P7-4)The procedure by which a grievance isprocessed by Loudoun County PublicSchools was prescribed by the Code ofVirginia and the Virginia Board of Edu-cation and adopted by the LoudounCounty School Board. It provides anorderly procedure for resolving disputesconcerning local School Board policies,rules, and regulations as they affect thework of employees, and disciplinaryactions which include dismissal or pro-bation.

Employees who have the assistance ofthe Loudoun Education Association inemployment-related matters are notentitled to LEA representation in meet-ing with their immediate supervisorunless the supervisor agrees or unlessthe employee is in a formal grievanceproceeding.

INTRODUCTORY PERIOD (P7-8 C)All new Classified Employees will servean introductory period of six months.Such employees will be given regularstatus upon the successful completionof the introductory period.

INVOLUNTARY REASSIGNMENT(P7-28)A.  purposeThe purpose of this policy is to estab-lish a procedure by which LoudounCounty Public Schools will reassignschool-based licensed personnel whenthe Superintendent determines that anexcess number of school-basedlicensed personnel exist at a particularschool. Reassignment situations willarise, from time to time, when theSchool Board or the Superintendenthave increased class sizes, eliminated orreduced programs, or due to enrollmentreductions. The Superintendent willinform the School Board when an invol-untary reassignment process will beimplemented.

B. reassignment Decisions By School principalsWhenever a principal must make recom-mendations as to specific individuals toreassign, the principal shall ask for vol-unteer(s) for reassignment in their areaof active assignment. The Principal willconsider as a minimum the followingfactors: the employee’s length of serviceto LCPS, the employee’s number of pre-vious involuntary transfers, the employ-ee’s home address and licensure areas,and if the employee has made a requestfor a voluntary transfer that can begranted. In consideration of educationalneeds, principals may exclude from reas-signment a minimum of 5 licensed staffmembers or up to 10% of current staff,whichever is greater.

Teacher assignment for special educationteachers requires that the individuals belicensed in the field as well as be highlyqualified in the assignment or contentarea. Therefore, principals in consultationwith the Director of Special Education

Sick leave may be used for the death ofa family member (as defined above).

Family Medical leave Act (FMlA) (p7-63)Up to twelve weeks of leave is availableto Loudoun County Public Schoolemployees who have been employed ina full-time position for twelve (12) consec-utive months, as designated in the FamilyMedical Leave Act of 1993. All appropri-ate paid leave must be used within thesetwelve weeks before the employee mayuse leave without pay. An employeeintending to use family medical leavemust contact the Retirement & DisabilityPrograms Division in the Department ofBusiness and Financial Services.

Your Rights under the Family and Medical Leave Act of 1993 FMLArequires covered employers to provideup to 12 weeks of unpaid, job protectedleave to “eligible” employees for certainfamily and medical reasons. Employeesare eligible if they have worked for acovered employer for at least one year,and for 1,250 hours over the previous 12 months, and if there are at least 50employees within 75 miles.

Effective January 28, 2008, an eligibleemployee who is a spouse, son, daugh-ter, parent, or next of kin may take up to26 workweeks of leave to care for amember of the Armed Forces, includinga member of the National Guard orReserves, who is undergoing medicaltreatment, recuperation, or therapy, isotherwise in outpatient status, or is oth-erwise on the temporary disabilityretired list, for a serious injury or illness.An eligible employee may also takeFMLA leave for any qualifying exigencyarising out of the fact that the spouse,or a son, daughter, or parent of theemployee is on active duty or has beennotified of an impending call or order to

active duty in the Armed Forces in sup-port of a contingency operation.

reasons for Taking leaveUnpaid leave must be granted for any of the following reasons:

• to care for the employee’s child afterbirth, or placement for adoption or foster care;

• to care for the employee’s spouse,son, daughter, or parent, who has a serious health condition; or

• for a serious health condition that makes the employee unable to perform the employee’s job.

At the employee’s or employer’s option,certain kinds of paid leave may be sub-stituted for unpaid leave.

Advance Notice and Medical certificationThe employee may be required to pro-vide advance leave notice and medicalcertification. Taking of leave may bedenied if requirements are not met.

• The employee ordinarily must provide30 days advance notice when theneed for leave is “foreseeable.”

• An employer may require medical certification to support a request forleave because of a serious health condition, and may require second orthird opinions (at the employer’sexpense) and a fitness for duty report to return to work.

Job Benefits and protections• For the duration of FMLA leave,

the employer must maintain theemployee’s health coverage under any “group health plan.”

• Upon return from FMLA leave, mostemployees must be restored to theiroriginal or equivalent positions withequivalent pay, benefits, and otheremployment terms.

• The use of FMLA leave cannot resultin the loss of any employment benefitthat accrued prior to the start of theemployee’s leave.

pregnancy, childbirth, and Adoptionof Infant child (p7-57[c])Sick leave for absence incident relatedto pregnancy and childbirth is allowedfor that period of time, as certified by aphysician, that the employee is physi-cally unable to perform her assignedduties up to the number of sick leavedays for which the employee is eligible.Sick leave may be used for adoption, for the mental health and bondingneeds of an infant child one year old orless as certified by a physician. The useof sick leave for pregnancy, childbirth, oradoption of an infant child one year oldor less is limited to the twelve weekperiod allowed in the Family MedicalLeave Act. It shall be the responsibilityof the employee concerned to providethe required physician statement definingthe exact period of disability or mentalhealth and bonding needs and to con-sult with the Retirement & Disability Pro-grams Division in the Department forBusiness and Financial Services toestablish the total period of absence. Aleave without pay may be granted tothe employee, upon proper request tothe Board, when absence beyond thatof accountable sick leave is desired. If aleave without pay is approved by theBoard as stated in this section, all provi-sions of the leave without pay policyshall be in effect.

Transfer of Sick leave (p7-57[d])Upon separation from employment,except for retirement, employees are not entitled to payment for unusedaccumulated sick leave. Loudoun County Public Schools will approve thetransfer of accumulated sick leave to orfrom another Virginia division unless the

separated employee has (a) acceptedemployment other than in Virginia pub-lic schools since leaving employment inLoudoun; (b) been absent from employment in the public schools of Virginia for more than three (3) years.

leave Without pay (p7-58)All employees with debilitating or life-threatening illness or injury, or other circumstances as determined by the Division Superintendent, can be affordedleave without pay opportunities.

The School Board recognizes that incertain instances an employee may need to have extended leave. For thatpurpose, the School Board establishesthis Policy enabling it to grant discre-tionary leave without pay for reasonsother than those specified in statute,including but not limited to:

1. Family and Medical Leave Act (see Policy §7-63)

2. Religious Observance (see Policy §7-64)

3. Extended Leave (see Policy §7-60)4. Emergency Leave (see Policy §7-57)5. Adoption Leave (see Policy §7-57)6. Childcare Leave7. Educational Leave

Leave without pay is not a regular leave benefit; it is a discretionary leaveprovision designed to address unusualcircumstances that cannot beaddressed by other forms of leave. The abuse of leave without pay shall be subject to disciplinary action, up toand including termination.

Eligibility — All professional staff, on therecommendation of the Division Super-intendent and approved by the SchoolBoard, are eligible to take sabbaticalleave. The first such leave may be grantedafter the completion of the staff mem-ber’s sixth year within Loudoun CountyPublic Schools. Additional sabbaticalleave may be granted after each succes-sive period of six (6) years of profes-sional service in Loudoun County PublicSchools. Paid leave is not available dur-ing the 2013–2014 school term.

Misuse of leave (p7-62, p7-58, p7-57)Misuse of any type of leave may resultin termination or other disciplinaryaction. Unauthorized leave of anynature may be grounds for dismissal.

LICENSURE (P7-10)requirementsA candidate for appointment to a newposition or a replacement position must qualify for the appropriate Provisional, Technical Professional, Collegiate Professional, Vocational Evaluator, Pupil Personnel Services, or Postgraduate Professional License.The appointment must be in field. Anyexception to this general rule must befor cause and only in circumstanceswhere a fully qualified and suitableapplicant is not available, as deter-mined by the Division Superintendent.

license renewalThe basic requirement for licensurestates that each holder of a renewablelicense in Virginia shall accrue a totalof 180 points during the five-yearvalidity period of the license. Require-ments are specifically described forlicense holders who do not have aMaster’s Degree and for holders of theTechnical Professional License who donot have a Bachelor’s Degree.

Each employee is responsible forlicense renewal. A lapsed license willresult in a null and void employmentcontract, if any.

Questions regarding the Virginia PointSystem for relicensure may be directed tothe Department of Personnel Services.

NATIONAL BOARD CERTIFICATIONAt its May 23, 2002 meeting, theLoudoun County School Board approveda National Board Certification incentivefor teachers. Any teacher employed byLoudoun County Public Schools earningNational Board Certification will beawarded ninety (90) relicensure points inaddition to the (90) points awarded bythe State of Virginia, all or part of whichshall be eligible for credit in “one” reli-censure cycle. Further, teachersemployed by Loudoun County PublicSchools earning National Board Certifi-cation who have achieved a continuingcontract will be allowed the exemptionfrom the Loudoun County PublicSchools’ evaluation cycle procedure for athree-year period, beginning with theschool year immediately following theNational Board Certification. (For exam-ple: National Board Certification awardedin 2001–2002 — evaluation proceduresuspended for school years of2002–2003, 2003–2004, 2004–2005,resuming with the 2005–2006 schoolyear). However, a teacher holdingNational Board Certification may beobserved and evaluated as deemed nec-essary by the Principal (in accordancewith the current evaluation practice asaddressed in the Licensed EmployeeEvaluation Procedures). Additionally,Loudoun County Public Schools willreimburse the teacher any out-of-pocketexpenses of the certification processapplication fee when National BoardCertification is achieved. Each teacher

During leave without pay, health insur-ance and/or life insurance may be elect-ed to continue by paying the total costof the premium. At the end of the leaveperiod, employees may be eligible topurchase Virginia Retirement Systemcredit for this absence.

The Division Superintendent has devel-oped regulations to implement this Policyand provide the terms and circumstancesfor the utilization of leave without pay.

Regulations that support the implemen-tation of Policy §7-58 include informa-tion outlining the guidelines for eachtype of Leave Without Pay requestedwith regard to 1) Eligibility, 2) Period ofLeave, 3) Application Process, 4) Bene-fits, and 5) Return to Work procedures.

Military leave (p7-70)It is Loudoun County Public Schools’objective to grant military leave toemployees for active duty in the armedservices of the United States or foremployees who are former members ofthe armed services, or current membersof the reserve forces of any of the Unit-ed States’ armed services, or of theCommonwealth’s militia (NationalGuard, naval militia, and Virginia StateDefense Force), or the National DefenseExecutive Reserve in accordance withfederal and state law and is based uponthe state military leave policy.

Employees of the Loudoun County Public Schools must specifically requestthe use of military leave.

Leave for military purposes will begranted by the Assistant Superintendentfor Business and Financial Services, (571-252-1400).

personal leave — personnel covered(p7-60)A full-time employee not covered byannual leave is eligible for personal leave

each year. The maximum allowance ofpersonal leave per year is three (3) days.

Personal leave not used during a schoolyear will be automatically transferred tosick leave. Persons transferring from a 10-month or 11-month position to a 12-monthposition who have unused personal leavewill have their unused personal leavetransferred into their sick leave balance.

public Service leave (p7-69)Public service leave without pay for full-time employees who have completedthree (3) continuous years of satisfacto-ry service in LCPS may be granted.

religious Observance (p7-64)An employee may be absent three(3) days in any school year for obser-vance of recognized religious holidays.Such leave may not be for less thanone-half day and shall be requested inadvance of such leave, and haveapproval of the immediate supervisor.Such leave will be deducted from theemployee’s accumulated leave or leavewithout pay.

Jury Duty or Subpoenaed Witness(p7-67)An employee shall not suffer loss of payupon being called for jury duty or as asubpoenaed witness in a court proceed-ing to which the employee is not a party.

Sabbatical leave (p7-65)Purpose of Sabbatical Leave — The pur-pose of a sabbatical leave is to provideincentives for professional staff mem-bers to be granted time to engage informal study designed to increase theemployee’s competence or for such purpose as may be recommended bythe Division Superintendent andapproved by the School Board.

Length of Sabbatical Leave — Sabbaticalleave shall be granted for a period notto exceed one calendar year and notless than one semester.

The School Board will from time-to-time, if and to the extend funds are bud-geted and appropriated for suchpurposes, make monthly contributionstowards the cost of such health insur-ance coverage of behalf of the partici-pating retirees.

If eligible for retiree health insurance, thefollowing service requirements apply:

retiree’s Terminal pay for Sick leaveAny employee who retires from LoudounCounty Public Schools will be eligible toreceive 25% of his/her daily wage foreach day of unused accumulated sickleave, the total amount not to exceed anindex of 25% of the previous year’s aver-age teacher salary for Loudoun CountyPublic Schools as reported in the Stateof Virginia’s Annual School Reportunder the following conditions:

1. Eligibility for retirement under the Virginia Retirement System.

SEXUAL DISCRIMINATION/ HARASSMENT (P7-2)The School Board has established a policy, and the Division Superintendentshall follow implemented procedures, forresolving complaints arising from allegedsexual harassment or discrimination of alleged violations of Title IX of the

All Full Time Employees are coveredunder the Virginia Retirement System.During the 2012 session of the GeneralAssembly, legislation was passed tochange the funding make-up of the plan. Effective July 1, 2012, School Division VRS members must begin to pay the member contributions. Continuing staff for 2013-2014 will pay 2% and all new full timehires or rehires will pay the full 5% share.The school division has until July 1, 2016to fully implement the full 5% share. Theschool system also pays an employershare at a rate which is regulated byactuarial information provided to theGeneral Assembly. PERSONNEL FILES (P7-17)All information in an employee’s file, with the exception of pre-employmentrecords, is available for the employee toinspect. Employees who wish to reviewtheir files should contact Department ofPersonnel Services in advance to requestsuch an inspection.

PROFESSIONAL ETHICSThe conduct and conversation of personsemployed by Loudoun County PublicSchools should not reflect adversely uponthe Division. Consult the policy manualfor specific information on such issuesas use of tobacco (P6-40), drug use (7-36, 7-37), use of correct English (7-25),dress code (7-24), harassment (7-34),and professional conduct (7-35).

REDUCTION IN FORCE (P7-73, 7-74)A reduction in force policy has beenadopted by the School Board. The com-plete text of policies 7-73 and 7-74 can befound in the School Board Policy Manual.

REPORTING PUPIL PROGRESSCommunication between teacher and parent is regarded as an essentialelement of the instructional process.Teachers are encouraged to use a varietyof methods to communicate: notes, tele-phone calls, and conferences.

A formal Progress Report is given tothe parents of all elementary, middle,and high school students at nine-weekintervals.

STAFF DEVELOPMENT/ IN-SERVICE EDUCATIONLocal in-service education during theschool year and during the summermonths is provided for the purpose ofcurriculum development and staff training.

STUDENT CONDUCT (P8-26)School personnel are authorized toemploy the disciplinary measures con-

tained in this policy to maintain appro-priate behavior of students and enforceschool rules. Except as authorized bythis policy, all disciplinary measures shallbe imposed by the principal of theschool or a person designated by theprincipal. The principal or designeeshould use discretion in selecting disci-plinary measures appropriate to theoffenses and the behavior records of thestudents.

SUBSTITUTE TEACHERS (P7-22)regular SubstitutesAny teacher requiring a substitutemust give as much advanced notice aspossible. A substitute must be on anapproved list. The individual school’spolicy must establish the rules andprocedures for securing a substitute.

Substitutes (long-Term)A long-term substitute, licensable in aspecific field, may be assigned when theabsence is long and indeterminate or when the circumstances are such asdeemed necessary by the DivisionSuperintendent.

TOBACCO USE (P6-40)The use of tobacco products on schoolproperty, including all schools andschool athletic facilities, parking lots andgrounds, support facilities and vehiclesincluding school buses, is prohibited.

TUBERCULOSIS EXAM (P7-13)A new employee must have at the time of employment, or have had within one yearprior to employment, documentation (bya licensed physician or Virginia HealthDepartment nurse) of either a tuberculinrisk assessment, tuberculin negative skintest, or, if tuberculin positive (10mm ormore in duration), a normal chest x-ray.An employee will need no further re-eval-uation unless there is a known high inci-dence of tuberculosis infection or disease

in the school(s), known exposure to pul-monary tuber culosis, or development ofpersistent respiratory symptoms.

Upon the written advice of a licensedphysician, “other examination/testing”may be substituted for the skin test orchest x-ray.

UNIFORM HIRING OF TEACHERS (8 VAC 20-440-10)The State Board of Education regulationsgoverning the Uniform Hiring of Teachersare under revision at the time of publica-tion. Please consult the Virginia Depart-ment of Education website for updatedinformation or contact the Department ofPersonnel Services.

UNITED WAYLoudoun County Public Schools joinslocal industries and other organizationsin supporting the community and otheragencies which are financed by theUnited Way. Employees are offered theopportunity to contribute funds collect-ed by school representatives. Author-ized contributions may be deductedfrom salary checks.

VIOLATIONS RELATED TO SECUREMANDATORY TESTS (VAC 22.1-292.1)The Board of Education may suspendor revoke the administrative or teachinglicense it has issued to any person who knowingly and willfully commitsany of the following acts related tosecure mandatory tests administered tostudents as required by this title or bythe Board of Education:

1. Giving unauthorized access to securetest questions;

2. Copying or reproducing all or anyportion of any secure test booklet;

3. Divulging the contents of any portionof a secure test;

4. Coaching or assisting examinees dur-ing testing or altering test materialsor examinees’ responses in any way;

5. Making available any answer keys;6. Failing to follow test security proce-

dures established by the Departmentof Education;

7. Providing a false certification on any test security form required by the Department of Education;

8. Retaining a copy of secure test questions;

9. Excluding students from testing whoare required to be assessed; and

10. Participating in, directing, aidingassisting in, or encouraging any of the acts prohibited by this section.

VISITORSVisitors are welcome to our schools, butall visitors including employee familymembers are required to report to theschool office and obtain visitor passeswhile on school property. Schools areresponsible for maintaining an environ-ment conducive to learning and pro-tecting students. School officials askthat parents and other citizens supporttheir effort.

VOLUNTEER PROGRAMEach school has Volunteer Coordina-tors who promote and schedule theprogram in that school. Questionsabout the Volunteer Program may bedirected to the Outreach Office in theDepartment of Instruction.

WORKING HOURS AND OVERTIME(P7-52)The working hours of non-exemptLoudoun County Public School employ-ees are established consistent with theprovisions of the Fair Labor StandardsAct, as required by the workload of theschool division, and the efficient man-agement of its human resources.

The normal work week for full-timeemployees is Monday through Sundayand will consist of forty hours exclusiveof meal time. The schedule of hours foremployees will be determined by thedepartment or school to which theemployee is assigned. Departmentheads or school principals may, at theirdiscretion, allow non-exempt employeesto make up lost time during a givenwork week. However, under no circum-stances will make up be allowed if thelost time is the result of conditions theemployee could control.

For the purposes of overtime compen-sation, only hours worked in excess offorty hours during a normal work weekwill be counted. For work performed inexcess of forty hours in a normal workweek, non-exempt employees will bepaid at a rate equal to one and one halftimes their regular rate of pay.

Non-exempt employees, who aredesignated as essential or emer-gency personnel, will be eligible tobe paid an overtime rate of one andone half times their regular rate ofpay when they are required to reportto work on a scheduled work day ora day the school division is closed asdesignated by the Superintendent.

The Loudoun County Public Schoolsretains the option of granting compen-satory time in lieu of overtime pay-ments for non-exempt employees.

On a day when the school division is closed as designated by the Super-intendent, the employee shall be paid their regular rate of pay whichwould constitute double pay for that day worked.
