BEFORE THE BOARD OF COMMISSIONERS OF COWLITZ COUNTY, WA

In the Matter of Cowlitz County honoring )

National Adoption Day 2012 ) Resolution No. 12-142

WHEREAS, Cowlitz County recognizes the importance of helping children find permanent,

safe and loving families through adoption; and

WHEREAS, more than 10,000 children are currently in foster care in Washington state; and

WHEREAS, more than 2,000 of those children currently in foster care have been legally and

permanently separated from their parents and are waiting for families to adopt them; and

WHEREAS, National Adoption Day was established in November 2000 by the Alliance for

Children’s Rights to raise awareness of more than 123,000 foster children across the United

States who are waiting for “forever families;” and

WHEREAS, Since 2000 more than 30,000 children have been adopted from foster care on

National Adoption Day; and

WHEREAS, more than 350 events are held each year throughout the country to finalize

adoptions of children in foster care; and

NOW, THEREFORE, the Board of Commissioners of Cowlitz County, Washington do hereby

proclaim Friday, November 2nd to be the 7th

Annual Adoption Day in Cowlitz County, and in

doing so, we urge all citizens to join in the national effort to raise awareness of the importance of

adoption for foster children and all children needing safe, loving families.

InformationSubject and Summary StatementThe suspension cables of the Public Elevator at the Hall of Justice are worn and are in immediate needof replacement in order to preserve the safety of visitors and County staff at the Hall.  In addition, thePublic Elevator is the primary mode of access between floors, especially for individuals with accessibilityand ADA accessibility needs. 

Although failure of the suspension cables is not eminent, the elevator inspector Washington StateDepartment of Labor and Industries, Elevator Program has indicated that the cables should be replacedas quickly as possible.  Only a brief period of time has been allowed for the cable replacement.  Failureto replace the cables in the allotted time could result in fines and/or suspension of elevator operation untilthe suspension cables are replaced.

Department RecommendationThe Facilities Maintenance Department Recommends that the Board of County Commissioners approveand sign the attached Emergency Resolution persuant to R.C.W. 39.04.280(3) and authorize theFacilities Maintenance Department to enter into contracts and incur obligation, without regard totime-consuming procedures and formalities prescribed by law (except mandatory constitutionalrequirements), necessary to replace the suspension cable serving the Hall of Justice Public Elevator inorder to preserve public and employee safety.  The estimated cost of the project is a sum not to exceed$11,000.

InformationSubject and Summary StatementThe Prosecutor's Office and the Sheriff's Office are re-applying for STOP Grant funding in the amount of$16,568 PER DEPARTMENT for the calendar year 2013.  This funding is through the Office of CrimeVictim's Advocacy.  This is a renewal of a Grant which the PAO has had for many years and the CCSOadministered for Law Enformcement training last year, as well as in other prior years.  Grant funds forthe PAO will go 100% toward Salary for a Victim Service Provider (Marissa Hardy).  Law Enforcementfunding will go toward training for Domestic Violence. The PAO will cover the required match of $16,568through payment of salaries to Marissa Hardy. No unbudgeted expense is necessary.

This year the grant application will be online.  I will include a signature page for the grant, once it isapproved, we will submit the grants electronically as required by the OCVA.  Thank you.

InformationSubject and Summary StatementThe Department of Public Works proposes that the Board of County Commissioners declare surplus andapprove for sale to other governmental agencies or disposal by auction, the vehicles and equipmentlisted on the attached Resolution.  All vehicles and equipment have been replaced in the 2012 budget orare part of fleet reduction of underutilized vehicles and equipment.  The Department further requests thatit be allowed to contract with Richie Bros. Auctioneers of Olympia, Washington, to dispose of the vehiclesand equipment by auction that are not needed by other governmental agencies.  The Cowlitz CountyProperty Management Policy, adopted by Resolution No. 92-148, requires the Board, prior to authorizingthe sale of County owned property, provide opportunity for public comment on the advisability of makingsuch sale.

This chapter may be cited as the “Cowlitz County Short Subdivision Code.” 37 [Ord. 80-146, § 1, 5-6-80.] 38 18.34.020 Purpose. 39

The Board of County Commissioners deems it necessary to establish 40 standards and procedures set forth in this chapter for the following purposes: 41

A. To insure the orderly development of small subdivisions of land; 1 B. To assure the orderly development of the unincorporated area of 2

Cowlitz County, consistent with the Comprehensive Plan, Zoning 3 Ordinance, and the State Planning Enabling Act; 4

C. To establish procedure which promotes the timely review of short 5 subdivision developments in the county; 6

D. To promote the public health, safety and general welfare; 7 E. To comply with the State Subdivision Law, RCW 58.17; 8 F. To enable the conveyance of land, by accurate land description, by 9

reference to an approved short subdivision. [Ord. 80-146, § 2, 5-6-80.] 10 11 12 18.34.030 Applicability. 13

A. Any division of land which will result in the creation of four or less lots, 14 tracts, parcels, sites or subdivisions, any one of which is less than five 15 acres in area, for the purpose of sale, lease or transfer of ownership; 16 provided, that land contained within a short subdivision shall not be 17 further divided for a period of five years from the date of filing of a short 18 plat without the filing of a final plat, except that when the short plat 19 contains fewer than four parcels, nothing in this chapter shall prevent 20 the filing of an alteration within the five-year period to create up to a 21 total of four lots within the original short plat boundaries. Contiguous 22 common parcels shall be treated as contained in a short subdivision 23 only for determining whether or not the division of land proposed is a 24 subdivision, a short subdivision or a resubdivision. 25

B. Divisions of land creating five or more lots shall be considered under 26 the provisions of the Cowlitz County Urban Subdivision Code, Rural 27 Subdivision Code, or Large Lot Subdivision Code, as applicable. 31 18.34.040 Definitions. 32

For the purpose of this chapter, the following terms shall be defined as 33 follows, and all other words used in this chapter shall carry the customary 34 meanings: 35

1. “Binding site plan” means a drawing to scale which: 36 a. Identifies and shows the areas and locations of all streets, 37

roads, improvements, utilities and open spaces; and 38 b. Contains provisions making any development be in conformity 39

with the site plan. 40 2. “Board” means Board of County Commissioners. 41 3. “Boundary line adjustment or BLA” means the alteration of the 42

boundary between two or more legal lots, tracts, or parcels which does 43 not result in the creation of any additional lot(s); also known as 44 boundary adjustment or lot line adjustment. 45

4. “Building site” means portion of a parcel of land occupied or intended 1 to be occupied by one main building and its accessory buildings; 2 subject to required setbacks. 3

5. “Commission” means Cowlitz County Planning Commission. 4 6. “Common Ownership (Ownership Interest)” means all contiguous lots 5

or parcels which are either owned by a single individual or entity 6 (corporation, LLC, etc) at the time of application and/or final plat 7 approval. Individual ownership and membership in an entity is 8 considered common ownership, provided that the individual is a 9 member of the entity under application. 10

7. “Comprehensive Plan” means a coordinated plan for the physical 11 development of the county, designating, among other things, elements 12 and programs to encourage the most appropriate use of land and to 13 lessen congestion throughout the county in the interest of public 14 health, safety, and welfare and promote efficiency and economy. For 15 purposes of this chapter, the Comprehensive Plan is the text and map 16 as adopted by the Board, and thereafter amended. 17

8. “Contiguous Parcels” means abutting, adjoining, or adjacent parcels 18 with a common boundary line, except that where two or more lots 19 adjoin only at a corner or corners, they shall not be considered as 20 “abutting.” It shall include the terms abutting, adjacent, and adjoining 21 parcels. 22

9. “County Engineer” means the County Road Engineer or his/her 23 designee. 24

10. “Critical Area” includes the following areas and ecosystems: (a) 25 wetlands; (b) areas with a critical recharging effect on aquifers used for 26 potable water; (c) fish and wildlife habitat conservation areas; (d) 27 frequently flooded areas; and (e) geologically hazardous areas as 28 defined in RCW 36.70A.030. 29

11. “Day” means days that the Department is open for business, unless 30 otherwise specified. 31

12. “Dedications” means the deliberate appropriation of land by an owner 32 for any general or public uses reserving to himself no other rights than 33 such as are compatible with the full exercise and enjoyment of the 34 public uses to which the property has been devoted. 35

13. “Department” means Department of Building and Planning. 36 14. “Director” means the Director of the Cowlitz County Building and 37

Planning Department. The term includes Planning Director, and may 38 include any person designated by the Director to administer the 39 provisions of this chapter. 40

15. “Division of land” means any conveyance, not otherwise exempt or 41 provided for in this chapter, which alters the legal description of any lot 42 or parcel that was segregated and recorded prior to the effective date 43 of the short subdivision ordinance of Cowlitz County or hereafter 44 amended. 45

16. “Easement” means a written grant by a property owner to specific 1 individuals, corporations or to the public or its agencies to use land for 2 specific purposes. 3

17. “Engineer” means a professional engineer, currently licensed by the 4 State of Washington. 5

18. “Final short plat” means the final drawing of the short subdivision, 6 including dedication, prepared for filing for record with the Cowlitz 7 County Auditor and containing all the elements and requirements that 8 are set forth in this chapter and regulations adopted pursuant to this 9 chapter. 10

19. “Health Officer” means the health officer of Cowlitz County or his/her 11 designee. 12

20. “Improvement” means any structure or works constructed including but 13 not limited to homes, accessory buildings, roads, storm drainage 14 systems, ditches and dikes, sanitary sewerage facilities, storm 15 drainage containment facilities and water systems. 16

21. “Large on-site sewage system (LOSS)” means an integrated 17 arrangement of components for a residence, building, industrial 18 establishment or other places not connected to a public sewer system 19 which: conveys, stores, treats, and/or provides subsurface soil 20 treatment and disposal on the property where it originates, or on 21 adjacent or nearby property; and includes piping, treatment devices, 22 other accessories, and soil underlying the disposal component of the 23 initial and reserve areas; and has design flows, at any common point, 24 greater than three thousand five hundred gallons per day. 25

22. “Legal lot” is a parcel of which is capable of being presumed as legal 26 under the regulations of this title. Even though a lot may be presumed 27 legal, it is buildable only if it was lawfully created prior to February 6, 28 1976, as evidenced by a recorded survey, or by either the payment of 29 excise tax or recording of the deed or the recorded commencement of 30 a contract of sale in the Auditor’s Office. 31

23. “Lot” means a fractional part of divided lands, having fixed boundaries 32 being of sufficient area and dimension to meet current minimum zoning 33 or Comprehensive Plan standards for width and area. The term shall 34 include tracts and parcels, but shall not include land divided for 35 purposes of financing or taxation. Lot area and dimensions shall 36 include any area within the public right-of-way bounded by the 37 centerline of the road and the side lines of the lot extended along the 38 same bearing as the closest section of the applicable side lot line to 39 the road right-of-way centerline. For the purposes of these regulations, 40 any portion of a lot lying below the ordinary high water mark or lawfully 41 constructed bulkhead of larger, navigable rivers may not be included in 42 lot area or dimension calculations. Larger, navigable rivers include the 43 Columbia, Cowlitz, Kalama, Coweeman, Toutle, and Lewis Rivers to 44 the extent that they are within Shorelines Jurisdiction as identified in 45 WAC 173-18. 46

24. “Lot width” means the horizontal distance between opposite side lot 1 lines as measured at the front building setback line and/or building site. 2

25. “On-site sewage system” (OSS) means an integrated system of 3 components, located on or nearby the property it serves, that conveys, 4 stores, treats, and/or provides subsurface soil treatment and dispersal 5 of sewage. It consists of a collection system, a treatment component or 6 treatment sequence, and a soil dispersal component. 7

26. “Original tract or parcel” means a unit of land which the owner holds 8 under single or unified ownership, or which the owner holds controlling 9 interest on the effective date of the short plat ordinance of Cowlitz 10 County, configuration of which may be determined by the fact that all 11 land abutting a tract is separately owned by others, not related to or 12 associated by business partnership with the owner. 13

27. “Owner” means the owner of record, as determined by the records of 14 the County Auditor, provided that the owner under a real estate 15 contract is the purchaser-vendee, the owner of mortgaged property is 16 the mortgagor, and the owner of property subject to a deed of trust is 17 the grantor. 18

28. “Person” means any individual, firm, partnership, association, social 19 and fraternal organization, corporation, estate, trust, receiver, 20 syndicate, branch of government, or any other group or combination 21 acting as a unit. 22

29. “Plat” means the map or representation of the subdivision showing 23 therein the division of a tract or parcel of land into more than four lots if 24 any one of the divisions is less than five acres in size with blocks, 25 streets, alleys and other divisions and dedications. 26

30. “Private road” means Any vehicular access way, designed or intended 27 to serve three or more lots or dwelling units or any commercial 28 business, which has not been dedicated as a public roadway; private 29 roadways may also include bridges. 30

31. “Professional land surveyor” as used in this chapter, “surveyor” means 31 every person authorized to practice the profession of land surveying 32 under the provisions of chapter 18.43 RCW. 33

32. “Public sewer system” means a public sewerage system. 34 33. “Right-of-way” is a general term denoting land, property or interest 35

therein, usually in a strip acquired to or devoted for transportation 36 and/or utility purposes. 37

34. “Road” means a private or public roadway, including right-of-way. 38 Private roads shall be as defined and regulated in Ch. 11.36 CCC. 39 Public roads shall be as defined and regulated in 36.75 RCW through 40 36.87 RCW. This term includes roads, streets, highways, avenues, 41 boulevards, and thoroughfares, and includes improvements such as 42 lighting, curbs, sidewalks, and pavement within the road right-of-way. 43

35. “Short plat” means the map of the short subdivision. 44 36. “Short subdivision” means the division or redivision of land into four or 45

fewer lots, tracts, sites, parcels or divisions for the purpose of sale, 46

lease or transfer of ownership, any of which is less than five acres in 1 size. 2

37. “State Environmental Policy Act (SEPA)” means the State 3 Environmental Policy Act as defined by Chapter 43.21C RCW as it 4 now exists or is hereafter amended. 5

38. “Subdivision” means a division or redivision of land into five or more 6 lots, tracts, parcels, sites or divisions for the purpose of sale, lease or 7 transfer of ownership, any of which is less than five acres in size. 8

39. “Survey Monument” means the physical structure, along with any 9 references or accessories thereto, used to mark the location of a land 10 boundary survey corner, geodetic control point, or local control point, in 11 compliance with WAC 332-120. 12

40. “Wastewater Designer” means a person who matches site and soil 13 characteristics with appropriate on-site sewage technology. 14 Throughout this chapter this term applies to both on-site sewage 15 treatment system designers licensed under chapter 18.210 RCW and 16 professional engineers licensed under chapter 18.43 RCW. 17

41. “Water Availability Certificate” is a certificate issued by the Cowlitz 18 County prior to application for a building permit of a building 19 necessitating potable water [RCW19.27.097], and prior to final 20 approval of rural and short subdivisions. 21

42. “Witness Corner” means a reference point, marked by a survey 22 monument, that is situated at a known distance and bearing from a 23 land survey corner, incompliance with WAC 332-120. 24

43. “Zoning Ordinance” refers to the Cowlitz County Land Use Ordinance, 25 CCC 18.10. 26

44. “Title” refers to Title 18 of the Cowlitz County Code. 27 [Ord. 82-022, §§ 1 – 9, 1-25-82; Ord. 80-329, §§ 11 – 14, 9-29-80; Ord. 80-28

146, § 4, 5-6-80.] 29 18.34.050 Exemptions. 30

Provisions of this chapter shall not apply to: 31 A. Cemeteries and other burial plots all used for that purpose; 32 B. Divisions made by testamentary provisions, or the laws of descent; 33

provided that newly created parcels are subject to all zoning and 34 building code regulations in effect at the time of the filing of a complete 35 development permit application for such parcel. 36

C. Any division of land pursuant to Chapter 58.17 RCW, governing the 37 divisions containing dedications and divisions of land into five or more 38 lots, parcels or tracts, as applicable under the Cowlitz County Urban 39 Subdivision Code or Rural Subdivision Code; 40

D. Boundary line adjustments; 41 E. Divisions of land for sale or lease to an agency or division of 42

government vested with the power of eminent domain; 43

F. All divisions of land prior to February 6, 1976, as evidenced by public 1 record, either through the payment of excise tax or recording of the 2 deed or contract of sale in the Auditor’s Office; 3

G. Divisions of land approved pursuant to the Cowlitz County Large Lot 4 Subdivision Code or exempted pursuant to CCC 18.38.050(H); 5

H. Any conveyance of land by a partial fulfillment deed under the same 6 name for financial segregation given to the original purchaser under a 7 real estate contract; provided that the entire lot within the original real 8 estate contract shall be recognized as a single legal lot and single 9 buildable parcel until the property is subdivided in compliance with this 10 chapter, and that there shall be no retransfer of any lot created by 11 partial fulfillment deed without compliance with this chapter; 12

I. Land divisions and transfers intended to be used for agricultural uses 13 or timber production as defined in RCW 84.34.020 for which no 14 development permits are necessary, are excepted from the standard 15 specified in CCC 18.34.070; provided any future development will 16 require full compliance with this title; 17

J. Binding site plans approved pursuant to the Cowlitz County 18 Commercial and Industrial Site Plan Code. [Ord. 98-008, § 4, 1-20-98; 19 Ord. 82-022, § 10, 1-25-82; Ord. 80-329, § 15, 9-29-80; Ord. 80-146, § 20 5, 5-6-80.] 21

22 18.34.055 Informal review. 23 Before making an application for short subdivision approval, the applicant may 24 arrange to have the proposal reviewed informally by submitting one copy of the 25 proposal to the director for a pre-submission conference. The applicant’s 26 proposal should include a map and a general project description. Based on the 27 provided information, the Director will provide relevant information concerning 28 potential requirements for the proposal. Information provided in the informal 29 review is not considered a requirement of short subdivision approval, but is for 30 informational purposes only to assist the applicant in determining the feasibility of 31 the project. [Ord. 80-329, § 10, 9-29-80; Ord. 80-146, § 6, 5-6-80.] 32 18.34.060 Application. 33

A. Procedure. Any person seeking to divide land in the unincorporated 34 area of Cowlitz County pursuant to this chapter, shall submit an 35 application for preliminary short subdivision approval to the 36 Department together with all required fees. Fees and charges for 37 processing applications, revisions, appeals, variances, plat approvals, 38 checking plans and specifications, recording documents, and other 39 administrative actions under this chapter, shall be as from time to time 40 established by resolution by the Board. 41

B. Preliminary Application. The preliminary application shall be on a 42 form provided by the Department and shall contain the following 43 information: 44

1. The name, address and telephone number of the owner; 45

2. The name, address and telephone number of the developer if 1 different from owner; 2

3. A certification by the owner identifying all contiguous parcels 3 under common ownership of land in which there is an interest 4 by reason of ownership, contract of purchase, earnest money 5 agreement or option by any person, firm or corporation in any 6 manner connected with the development, and the names and 7 addresses and telephone numbers of all such persons, firms or 8 corporations; 9

4. The existing zoning classification, and Comprehensive Plan 10 classification; 11

5. The proposed method of providing a potable water supply, and, 12 if a public system is used, the name of the supplier; 13

6. The proposed method of sewage disposal, and if sanitary sewer 14 is used, the name of the district or purveyor having 15 management over the system; 16

7. Signature of owner(s) and developer(s); 17 8. A copy of the most recent deeds of the property being 18

subdivided; 19 9. Vicinity map(s) showing the boundary line of the original tract 20

and of common parcels; 21 10. Copies of any development restrictions proposed to be imposed 22

upon the use of the land; 23 11. A copy of the short subdivision environmental checklist; 24 12. If required, a completed SEPA checklist; 25 13. The applicant shall consult with the Department if there are any 26

critical areas identified on the site, as defined in Critical Areas 27 Ordinance, Chapter 19.15; 28

14. Identification of Critical Areas on or within 200 feet of the 29 property to be subdivided. The applicant shall demonstrate that 30 all reasonable efforts have been examined with the intent to 31 avoid and minimize impacts to critical areas. Where avoidance 32 of critical areas is not possible, new lots with building envelopes, 33 access roads, and utilities may be permitted within Critical 34 Areas, provided an assessment by a qualified professional 35 demonstrates that the proposal will not adversely impact the 36 Critical Area or adjacent properties. Development within Critical 37 Areas or Critical Areas Buffers may be required to comply with 38 mitigation requirements in CC 19.15.170. 39

a. Any special reports, if required, will be submitted to the 40 Department prior to the application being deemed 41 complete. Special reports shall meet be prepared by a 42 qualified professional and meet the criteria for the 43 applicable report type as identified in CCC 19.15. 44

b. Any required reports shall be submitted within 90 45 calendar days following the date of the letter requesting 46

additional information; provided, a 90-day extension 1 may be available upon the applicant’s request. 2

15. A preliminary map shall contain the following information: 3 a. The date, scale and north arrow; scaled to an 4

appropriate size or other scale as approved, 5 b. The distances of the boundary lines, to scale, of the 6

tract to be subdivided and each lot contained therein, 7 c. The number assigned to each lot, 8 d. The location, names, widths and Auditor’s File Number 9

of any existing easements, existing and proposed 10 roads, existing and proposed rights-of-way for public 11 services or utilities within the area contained within the 12 short subdivision, and within 100 feet thereof, and 13 location of the nearest county road, if there is not a 14 county road within 100 feet, 15

e. The boundaries of all lands reserved in the deeds for 16 the common uses of the property owners of the short 17 subdivision, 18

f. The location of permanent and topographic features, 19 which will have an impact upon the short subdivision, 20 such as all existing or platted streets adjacent to the 21 short subdivision, critical areas, shorelines, 22 watercourses, floodplain/floodway boundaries, site 23 topography, railroad rights-of-way, all utility rights-of-24 way, township lines and section lines; 25

26 18.34.070 General Standards. 27

A. The following standards shall be applicable to all short subdivisions: 28 1. Lot Size. The minimum size of any lot within a short subdivision 29

located in an area that is districted pursuant to the Cowlitz 30 County Zoning Code, shall conform to the minimum lot size 31 specified in the Zoning Code, or such larger size as specified by 32 state health regulations. In undistricted areas of the county 33 where the Zoning Code does not apply, the minimum lot size 34 within a short subdivision shall be either as designated by the 35 County Comprehensive Plan for that area or of such size as is 36 required to meet state water and sewage disposal standards, 37 whichever is greater. In all areas of the County, new lots using 38 on-site septic systems must meet the minimum lot size 39 requirements established by WAC 246-272A-0320 (or hereafter 40 amended). 41

2. Lot Width. The minimum lot width shall be consistent with the 42 County Zoning Code for those zoned portions of the county. All 43 short subdivisions locating in unzoned areas of the county shall 44 be consistent with the lot widths prescribed in the 45 Comprehensive Plan designation for that area, as required by 46

health regulations, or no less than 60 feet in width at the 1 building line, whichever is greatest. 2

3. Easements. Easements may be required for, but not limited to: 3 road, road maintenance, utility installation and maintenance, 4 public access, drainage, and buffer strips or protective 5 easements. Dedications of easements on the face of the plat 6 are only allowed for and between the lots within the boundaries 7 of a short subdivision, and are subject to the incorporation of 8 appropriate dedication language on the face of the final plat. 9 Easements involving properties outside the boundaries of a 10 short subdivision shall be recorded separately prior to final plat 11 approval. The appropriate Auditors’ File Number shall be 12 identified on the face of the final plat. 13

4. Septic Suitability. Each lot within a short subdivision not 14 currently served by public sewer shall demonstrate the 15 capability to support, wholly within its boundaries, an on-site 16 septic system and septic reserve area(s), exclusive of any 17 easements. 18

a. On-site Soil and Septic Evaluations: All evaluations 19 shall be conducted by a wastewater designer or a 20 professional engineer licensed in the State of 21 Washington, and meet the requirements of WAC 246-22 272A and CCC 15.42(or hereafter amended). 23

b. Soils Test Approval: All soil tests for new and existing 24 lots, including all primary and reserve area dedications, 25 shall be submitted to the Cowlitz County Environmental 26 Health Unit for approval. 27

c. New Lots: Each new lot shall have an on-site septic 28 and soils evaluation completed identifying a septic 29 drainfield and reserve area. 30

d. Existing Lot(s): Existing septic systems shall be 31 professionally evaluated by a wastewater designer or a 32 professional engineer licensed in the state of 33 Washington. All dedications of reserve areas shall 34 include a soils test, and meet the requirements of WAC 35 246-272A and CCC 15.42 (or hereafter amended). 36

i. Existing septic systems less than two (2) years old 37 shall be professionally evaluated. Evaluation shall 38 include, at a minimum, observation/inspection of 39 drain line laterals and septic tank. 40

ii. Existing systems older than two (2) years shall be 41 professionally evaluated using one of the following 42 methods: 43 1. Evaluation of the septic system, including, at a 44

minimum, observation/inspection of the drain line 45 laterals, septic tank inspection, septic tank 46

pumping, and identification of a reserve area, 1 including the size and the potential system type. 2

2. An Operations and Maintenance inspection 3 meeting the standards of CCC 15.42.160, 4 including the identification of two reserve areas. 5

iii. For the purposes of this chapter, the age of a 6 system shall be measured from the time of final 7 inspection of the septic system to the date of 8 application for the short subdivision. 9

e. Septic Failures: If an existing system is found to be in a 10 state of failure, then it shall be replaced and/or repaired 11 in accordance with CCC 15.42 and WAC 246-272A (or 12 hereafter amended). 13

5. Water Availability. Each lot within a short subdivision shall be 14 required to demonstrate sufficient availability of potable water. 15

a. Availability of potable water shall be proven by one of 16 the following methods: 17

i. Certificate of Water Availability from the Cowlitz 18 County Environmental Health Unit for each lot 19 demonstrating the availability of potable water. 20

ii. Letter of water availability from the water purveyor 21 for each lot within the short subdivision. 22

iii. Other documentation as approved by the 23 Cowlitz County Health Department. 24

b. Easements, shared well agreements, identification of 25 the Source Protection Area, and/or restrictive 26 covenants shall be recorded prior to final plat approval. 27 All applicable Auditors’ File Numbers shall be identified 28 on the face of the final plat. 29

c. The 100-foot radius Source Protection Area 30 surrounding a new wellhead shall be contained 31 completely within the exterior boundaries of the original 32 property being subdivided, provided; an easement or 33 restrictive covenant, which shall run with the land, shall 34 be obtained from an abutting landowner(s) when the 35 Source Protection Area extends beyond the boundaries 36 of the subdivided property. 37

6. Surveys. Surveys shall be required for all short subdivisions 38 a. All surveys shall be required to comply with current 39

surveying standard practices and law. All surveys are 40 required to comply with RCW 58.09 and meet the 41 minimum standards as set forth in WAC 332-130 (or 42 hereafter amended). 43

b. Monumentation. Permanent control monuments shall 44 be established at each and every controlling corner on 45 the boundaries of the parcel of land being subdivided. 46

Permanent control monuments shall also be 1 established at each and every controlling corner within 2 the parcel of land being subdivided. Any monument set 3 shall be permanently marked or tagged with the 4 certificate number of the land surveyor setting it. All 5 monuments shall be shown on the face of the final short 6 plat. 7

c. Witness Corners. Witness corners shall be allowed 8 only when a physical impediment (i.e. tree, rock, 9 stream) to setting a land boundary corner exists. Other 10 situations requiring the use of witness corners must be 11 pre-approved by the County Engineer. 12

7. Access. Each lot within a short subdivision shall be provided 13 with satisfactory access by means of a public or private right-of-14 way connecting to an existing and developed public street, or by 15 some other legally sufficient right-of-access, inseparable from 16 the lot to be served; 17

a. New private roads shall not be allowed in areas that are 18 classified as urban or suburban by the Cowlitz County 19 Comprehensive Plan or the Zoning Code. 20

b. All new lots in areas that are classified as urban or 21 suburban by the Cowlitz County Comprehensive Plan 22 or the Zoning Code are required to physically front on a 23 publicly maintained roadway for a minimum distance of 24 25 feet. 25

c. All new and existing private roads serving lots within the 26 short subdivision shall meet the requirements of CCC 27 11.36, the Cowlitz County Private Road Ordinance. 28

d. New driveways may be required to be installed prior to 29 final plat approval in order to prove access viability. 30 Driveway approaches shall be constructed according to 31 Public Works road approach standards. 32

e. Any right-of-way or road surface not open to general 33 public use shall be retained as a privately owned and 34 privately maintained road. 35

f. Privately owned roads shall be open for necessary 36 public use. 37

8. All short subdivisions shall comply with the minimum 38 requirements of the International Fire Code, as adopted or 39 amended by the Board. 40

B. Standards applicable to all short subdivisions along public roads are as 41 follows: 42 1. Dedication, deeding, or granting of a road easement to the county 43

of such right-of-way as may be consistent with adopted county 44 standards, or as amended, for public roads, or a portion thereof, 45

shall be required within or along the boundaries of the short plat of 1 any lot(s) within, under the following circumstances: 2

a. Where the six-year capital improvement plan indicates the 3 necessity of a new right-of-way or portion thereof for road 4 purposes; 5

b. When there is less than the standard right-of-way from the 6 centerline of the road to the property line; 7

c. Where necessary to extend or complete the existing road; 8 d. When necessary to develop better traffic circulation in the 9

community or neighborhood. 10 2. Public roads right-of-way widths and improvements shall be 11

consistent with adopted county road standards and specifications. 12 [Ord. 96-012, § 1, 1-29-96; Ord. 82-022, §§ 12, 13, 14, 1-25-82; 13 Ord. 80-329, § 8, 9-29-80; Ord. 80-146, § 8,5-6-80.] 14

15 18.34.080 Administration. 16

A. Responsibility for Administration. The Director of the Building and 17 Planning Department shall be responsible for administering the 18 provisions of this chapter and with authority to summarily approve or 19 disapprove a proposed short plat under the guidelines set forth in this 20 chapter; to approve/disapprove variances and to approve or 21 disapprove final applications of short subdivisions. The Director shall 22 prepare and require the use of such forms as deemed essential to the 23 implementation of this chapter. 24

B. Preliminary Application. When the Director determines that the 25 proposed short plat application contains the required information and 26 data as a basis for its approval or disapproval, a file number and a date 27 of receipt shall be affixed and copies of the short plat application shall 28 be distributed to the following: 29

1. Health Officer or his designee; 30 2. County Engineer; 31 3. Fire District or Fire/Life Safety Coordinator; 32 4. Public Utilities District (PUD) No. 1; 33 5. Applicable water and sewer purveyor; 34 6. Federal, state, or local agency which may have an interest in 35

the short plat as determined by the Director; 36 7. Geographic Information System Department. 37 8. Washington Department of Transportation when adjacent to a 38

state highway right-of-way 39 C. Timing of Review. The Director shall set a date for return of findings 40

and recommendations from each agency, the date to be 10 working 41 days from the date of the respective agency’s receipt of application. If 42 the findings and recommendations are not so returned, then the 43 Director may make such findings as he deems just. 1 18.34.090 Review by agencies. 2

A. The Health Officer or his designee shall notify the Director that: 3 1. The sewage disposal methods contemplated for use in the 4

proposed short subdivision do or do not conform with current 5 standards; and 6

2. The feasibility of potable water supply has or has not been 7 demonstrated. 8

B. The County Engineer shall notify the Director that: 9 1. The proposed road, utilities and other improvements do or do not 10

conform to adopted road standards; 11 2. The adjacent public road right-of-ways do or do not conform to 12

adopted County standards. 13 3. Access to the boundary of all short subdivisions shall be provided 14

by an opened, constructed and maintained city or county road, 15 except that access to the boundary of a short subdivision by private 16 road may be permitted where such private roads are otherwise 17 permitted by this title; 18

4. That the legal description or survey does or does not conform to the 19 standard practice and principles of land surveying. 20

C. The appropriate Fire District or Fire/Life Safety Coordinator shall 21 respond to the Director of any concerns on fire protection and ingress 22 and egress of emergency vehicles. 23

D. Other agencies shall notify the Director of their concerns and shall so 24 list their concerns for consideration by the Director. [Ord. 80-329, § 6, 25 9-29-80; Ord. 80-146, § 10, 5-6-80.] 26

27 18.34.100 Preliminary approval. 28

A. Within 30 days of receipt of the complete preliminary short subdivision 29 application or a longer period as agreed to by the applicant, the 30 Director shall review the reports and comments of the reviewing 31 agencies, pursuant to CCC 18.34.080, and shall make a determination 32 to grant, condition or deny the preliminary short subdivision; such 33 determination shall be based upon consideration of the following: 34 1. Whether it is in conformance with the general purposes, standards 35

and requirements of the Cowlitz County Comprehensive Plan, 36 Zoning Ordinance, Environmental Policy Ordinance and with other 37 applicable laws and county policies. Conditions may be placed 38 upon the proposed subdivision to ensure compliance with 39 applicable local, state, and federal codes. 40

2. The physical characteristics of the short subdivision site. If the site 41 contains critical areas, the preliminary short subdivision may be 42 denied or conditionally approved. Conditions may be placed upon 43 the proposed subdivision to ensure compliance with the Critical 44 Areas Ordinance, CCC 19.15. 45

3. Whether the land has been included within a short subdivision 1 within five years preceding the date of filing. 2

4. All other relevant facts to determine whether the public use or 3 interest will be served by the short subdivision. 4

B. After consideration of the aforementioned concerns, the applicant shall 5 be notified of the Director’s determination. Such determination shall be 6 one of the following: 7 1. Approval of the preliminary short subdivision, including any 8

conditions or corrections to be met prior to final approval; 9 2. Denial of the preliminary short subdivision with written findings. 10

C. If the Director fails to act within 30 days of receipt of the complete 11 preliminary application, the applicant may request a review of the 12 application by the Hearing Examiner as provided in CCC 18.34.110. 13 [Ord. 95-193, § 28, 12-4-95; Ord. 80-329, § 5, 9-29-80; Ord. 80-146, § 14 11, 5-6-80.] 15

16 18.34.110 Appeal. 17

A. A person aggrieved by the decision of the Director may appeal said 18 decision to the Hearing Examiner, appointed pursuant to CCC 19 18.10.340, as amended. Any such appeal shall be filed in writing with 20 the Department along with the appropriate fee established from time to 21 time by resolution of the Board of County Commissioners within 20 22 calendar days of the issuance of the decision. The appeal shall specify 23 the reasons therefore. The Director shall provide the Hearing Examiner 24 with findings and documentation relating to the decision being 25 appealed. The Hearing Examiner, following a denovo hearing, shall 26 affirm, modify or reverse the Director’s decision with written findings 27 and conclusions. The appellant carries the burden of proof on appeal. 28

B. Upon the filing of an appeal with appropriate fee, the Director shall set 29 the public hearing before the Hearing Examiner. If the appeal is filed 30 20 calendar days or more before the Hearing Examiner’s regularly 31 scheduled monthly meeting, he/she shall hear the appeal at that 32 meeting as set by the Director. For appeals filed within 19 calendar 33 days of the regularly scheduled monthly meeting, the Hearing 34 Examiner shall hear the appeal in the subsequent month. 35

C. Notice of the time, date and place of the hearing shall be sent to the 36 appellant and the permittee by first class mail prior to the public 37 hearing. Legal notice of the hearing shall be published in a newspaper 38 of general circulation and the subject property shall be posted with the 39 notice not less than 10 calendar days prior to the public hearing. 40

D. Within 10 calendar days after the public hearing, the Hearing Examiner 41 shall issue a written decision, including findings of fact on which his/her 42 decision is based. 18.34.140 Duration of preliminary approval. 1 Preliminary approval will be effective for two years. During this period a final 2

short plat may be prepared. If the preliminary approval contains conditions, the 3 applicant shall submit proof of meeting such conditions. Upon application within 4 this period, for good cause having been shown, the Director may grant an 5 additional six-month time extension to the applicant for meeting conditions of 6 approval. [Ord. 04-189, § 1, 9-7-04; Ord. 80-329, § 2, 9-29-80; Ord. 80-146, § 14, 7 5-6-80.] 8 18.34.145 Final Approval and Recording. 9 When the short subdivision and the short plat meet all the requirements therefor, 10 and will serve the public use and interest, and the subdivider has provided all the 11 required documentation/certification, then the approval shall be inscribed upon 12 the face of the short plat. The Administrator and the County Engineer will 13 demonstrate approval by signing the short plat. 14 The action of approving a short plat shall become effective when the final short 15 plat and supporting documents are filed for record with the Auditor of Cowlitz 16 County. The submission for filing shall include four paper copies of the short plat. 17 The Auditor shall transmit copies of the approved short plat to the Administrator, 18 the County Engineer, the PUD, and the applicant. 19 No final short plat will be accepted for filing unless, for all property described 20 herein, all taxes payable to the county and secured by a lien against such 21 property or any portion thereof, including all real property taxes for the current 22 year, have been paid in full to the County Treasurer. 23 18.34.150 Final Short Plat 24 25

A. Final Plat. The final plat shall be in black on a sheet of mylar having 26 dimensions of 18 inches by 24 inches. The plat shall contain, but not be 27 limited to the following: 28 1. Date, scale, north arrow, point of beginning and basis of bearing; 29 2. The bearings and distances of the boundary lines drawn to scale, of 30

the tract to be short subdivided, and of each lot contained therein; 31 3. Legal description of the parcel being subdivided; 32 4. Lot number and area of each lot; 33 5. Location, name, width, and nature of existing and proposed roads, 34

rights-of-way, easements and the access to a public road; private 35 roads shall be labeled as “private road and utility easements”; 36

6. Signature block for the Director, County Engineer, and Treasurer; 37 7. Identification of proposed and existing septic drainfields and drainfield 38

reserve areas; 39 8. Identification of all well locations, well identification numbers and 40

source protection areas; 41 9. Auditor File Numbers for all easements outside of the boundaries of 42

the short subdivision that effect the proposed subdivision, as well as 43 Auditor File Numbers for all easements within the boundaries of the 44

proposed subdivision that effect property outside the boundaries of the 1 property being subdivided; 2

10. Identification of any critical areas impacting the property and necessary 3 critical area buffer. Appropriate buffer restriction language may be 4 placed on the face of the final plat; 5

6 (1) Land within this short subdivision shall not be further divided for a 7

period of five years unless a final plat is filed pursuant to Cowlitz 8 County Subdivision Code and RCW 58.17; 9

(2) The approval of this short subdivision does not guarantee the 10 issuance of any other permits. 11

(3) WARNING: Cowlitz County has no responsibility to build, improve, 12 maintain, or otherwise service any private roads contained within or 13 providing service to the property described in this short plat. 14

(4) In the event that any private road or driveway is improved to 15 Cowlitz County standards for public streets and the County is 16 willing to accept the dedication of such road, each lot owner shall 17 execute any documents necessary to accomplish such dedication. 18

19 11. Other plat notes may be required depending on the situation. These 20

may include, but are not limited to: Well Sanitary Zone restriction 21 language, fire protection language, and setback restrictions. 22

12. A signature block for all individuals having an interest in the property; 23 including a notary signature block. 24

13. When a short subdivision includes a public dedication, the following 25 Declaration of Short Subdivision shall be shown on the face of the final 26 plat: 27

“WE, THE UNDERSIGNED OWNER(S) OF THE HEREIN 28 DESCRIBED PROPERTY DEDICATE THESE LOTS TO THE 29 PURCHASERS THEREOF. WE DEDICATE THE ROADS HEREIN 30 AND THE EASEMENTS TO THE USE OF THE PUBLIC 31 FOREVER AND HEREBY GRANT TO THE PUBLIC THE RIGHT 32 TO MAKE ALL NECESSARY SLOPES FOR CUTS AND FILLS 33 UPON THESE LOTS IN THE ORIGINAL REASONABLE 34 GRADING OF THE STREETS. 35

B. Final Supporting Documents. The following documents shall 21 accompany each final short plat submitted: 22 1. Legal descriptions of the property being short subdivided, of each 23

proposed lot, and of all common areas; 24 2. Legal descriptions of private roads and easements contained within or 25

servicing the short subdivision; 26 3. A current title report or short subdivision certificate prepared by a title 27

company; 28 4. Covenants or restrictions, if any, proposed to be placed on the use of 29

the proposed subdivision; 30 5. When contiguous common parcels and/or original tract parcels exist, a 31

description(s) of such parcel(s). [Ord. 82-022,§ 15, 1-25-82; Ord. 80-32 329, § 1, 9-29-80; Ord. 80-146, § 15, 5-6-80.] 33

34 35 18.34.155 Short plat revisions. 36

A. Affidavit of Minor Correction of Survey. A professional land surveyor 37 may file an “affidavit of minor correction of survey” pursuant to WAC 38 332-130-050 to correct minor survey, spelling, mathematical or drafting 39 errors or omitted signatures. The surveyor shall file the affidavit of 40 minor correction of survey with the county auditor and provide a copy 41 to the Department of Building and Planning. 42

B. A recorded short plat may be revised if the following requirements are 1 met: 2

1. A total of no more than four lots may be created within the 3 boundaries of the short plat, either before or after revision. 4

2. All affected ownership interests within the boundaries of the 5 originally recorded short plat shall indicate agreement to the 6 proposed revision by signing the revised final short plat. 7

3. All short subdivision standards in effect at the time of revision 8 shall be met. [Ord. 82-022, § 18, 1-25-82; Ord. 80-146, 5-6-80.] 9

10 18.34.160 Variances. 11

Where the Director finds that extraordinary hardship may result from the strict 12 compliance with these regulations due to the size, shape, topography, location or 13 surroundings as it relates to the property, he may vary these regulations so that 14 substantial justice may be done and the public interest secured; provided, that 15 such variance will not have the effect of nullifying the intent and purpose of the 16 County Comprehensive Plan, and this chapter. The variance shall be subject to 17 the approval of the Hearing Examiner, appointed pursuant to CCC 18.10.340, as 18 amended, at a public meeting. A record shall be kept of all such grants of 19 variances and shall be available for public inspections. [Ord. 95-193, § 30, 12-4-20 95; Ord. 80-146, § 16, 5-6-80.] 21 18.34.170 Enforcement. 22

A. No person shall sell, lease or transfer any real property which is less 23 than five acres in area without full compliance with this title. All 24 development permits for the improvement of any lot which is less than 25 five acres in area, shall be withheld until the provisions of this title are 26 met, pursuant to Washington State Subdivision Law. Also, the 27 Administrator may revoke county development permits on parcels 28 divided and transferred or leased which do not comply with this title. 29

B. The County Treasurer shall refuse to accept excise tax payment for 30 any parcel of real property that has not been approved by the 31 Administrator pursuant to this title. 32

C. Exception for Innocent Purchaser for Value. An application for building 33 permit, septic tank permit, or other development permit for any land 34 divided in violation of state law or this chapter, shall not be granted 35 without prior approval of the Board at a public meeting, which approval 36 shall only be given if the applicant files a notarized affidavit attesting to 37 and demonstrating the following to the satisfaction of the Board: 38

1. The applicant purchased the lot, tract, or parcel for market 39 value, not reflecting the illegal division; 40

2. The applicant did not know, and could not have known by the 41 exercise of care, which a reasonable purchaser would have 42 used in purchasing land, that the lot, tract or parcel had been 43 part of a larger lot, tract or parcel divided in violation of the state 44 law or this chapter; and 45

3. The public interest will not be adversely affected by the 1 issuance of such permit. 2

4. The resulting lot would meet all Comprehensive Plan, Zoning, 3 and State Health minimum lot size and dimension requirements. 4 [Ord. 82-022, § 16, 1-25-82; Ord. 80-146, § 17, 5-6-80.] 5

6 18.34.180 Relief for an innocent purchaser for value. 7

A. Pursuant to RCW 58.17.210, and except as provided in CCC 8 18.34.170, all purchasers or transferees of property divided in violation 9 of this chapter shall comply with provisions of this chapter. Each 10 purchaser and transferee may recover his damages from any 11 individual, firm, corporation, or agent selling or transferring land in 12 violation of this chapter. This may include any amount reasonably 13 spent as a result of inability to obtain any development permit and 14 spent to conform to the requirements of this chapter as well as the cost 15 of investigations, suit, and reasonable attorneys’ fees occasioned 16 thereby. 17

B. Such purchaser or transferee may, as an alternative to conforming to 18 these requirements, rescind the sale or transfer and recover the costs 19 of investigation, suit, and reasonable attorneys’ fees occasioned 20 thereby. [Ord. 80-146, § 18, 5-6-80.] 21

22 18.34.190 Unapproved short plat – Filing. 23

The Auditor shall refuse to accept for filing any short plat which does not bear 24 the Administrator’s certificate of approval. 25

Should a short plat be filed without such a certificate, the Prosecuting Attorney 26 shall apply for a writ of mandate on behalf of the Administrator, directing the 27 Auditor to remove the unapproved plat from the Auditor’s files. [Ord. 80-146, § 28 20, 5-6-80.] 29 18.34.200 Resubdivision requirements. 30

Land within a short subdivision, including all land in the original tract or 31 contiguous common parcels, the short plat of which has been approved within 32 the immediately preceding five years, may not be further divided until a final plat 33 has been approved and filed for record pursuant to County Subdivision Code, 34 provided, nothing in this chapter shall prevent the filing of an revision within the 35 five-year period to create up to a total of four lots within the original short plat 36 boundaries [Ord. 80-146, § 21, 5-6-80.] 37 18.34.210 Violations – Penalties. 38

It is a civil infraction for any person to violate this chapter or assist in the 39 violation of this chapter, and a gross misdemeanor to violate or assist in the 40 violation of 58.17 RCW. Violations are subject to the provisions of Chapter 2.06 41 CCC. Any violation is a public nuisance. Each day a violation exists is a separate 42 violation. Payment of any penalty imposed for a violation does not relieve a 43 person from the duty to comply with this chapter. [Ord. 93-102, § 25, 7-6-93.] 44

18.34.220 Validity. 1 If any section, subsection, or other portion of this chapter is for any reason held 2

invalid or unconstitutional by any court of competent jurisdiction, such section, 3 subsection, or portion thereof shall be deemed a separate provision of this 4 chapter and such holding shall not affect the validity of the remaining portions of 5 this chapter. [Ord. 80-146, § 22, 5-6-80.] 6 18.34.230 Effective date. 7

This chapter shall be in full force and effect from the date of adoption by the 8 Board of County Commissioners. AN ORDINANCE TO REVISE CHAPTER 12.35 OF COWLITZ COUNTY CODE FOR ESTABLISHING PRIMITIVE COUNTY ROADS

A. Cowlitz County, pursuant to RCW 36.75.300 and WAC 468-95-290 is authorized to establish and designate public rights-of-way within the County road system as primitive roads; and B. The County desires to create a process whereby public rights-of-way can be established by the Board of County Commissioners, and designated and posted by the County Engineer as primitive roads; NOW THEREFORE BE IT ORDAINED by the Board of Cowlitz County Commissioners that: Section 1. Purpose. The purpose of this ordinance is to amend Chapter 12.35 of the County Code for PRIMITIVE ROADS, in accordance with the findings stated herein, and other County regulations and state law. Section 2. The following sections of amended Chapter 12.35 of Cowlitz County Code are herewith adopted:

12.35.010 Definitions. (1) “Board” means the Board of County Commissioners of Cowlitz County. (2) "Primitive road" means a road within a county right-of-way that meets the

requirements of RCW 36.75.300, which road may be maintained by the County or may be privately maintained, and is found to be a primitive road by the Board. Designated primitive roads shall be on file with the County Engineer.

12.35.020 Establishment. (1) The Board, upon finding that a road or a right-of-way, or portion thereof, meets

the requirements of a primitive road, may by resolution establish a primitive road, and direct the County Engineer to mark with signs and so designate the road.

Section 3. Codification. Code amendments in Section 2, above, shall be codified. Section 4. Severability. The provisions of this ordinance are declared separate and severable. If any section, paragraph, clause, or phrase of this ordinance is for any reason held to be unconstitutional or invalid, such decision shall not affect the validity of the remaining portions of this ordinance. The Board of Commissioners hereby declares that it would have passed this ordinance and each section, paragraph subsection, clause or phrase thereof irrespective of the

Cowlitz County Public Works - Sign Materials For a Period of December 1, 2012 through November 30, 2013 Sealed bids will be received at the office of the Board of County Commissioners of Cowlitz County, Washington, Attention: Clerk of the Board, County Administration Building, 207 Fourth Avenue North, Kelso, Washington 98626, prior to 11:00 o'clock a.m., the 20th day of November, 2012, at which time all bids received will be publicly opened and read in the chambers of the Board for furnishing sign materials to Cowlitz County for a period of December 1, 2012 through November 30, 2013. 2) Bid Description: Cowlitz County Public Works - Sign Materials 3) Date of Bid Opening: November 20, 2012 County offices are not open for mail or other deliveries on weekends, County holidays, or inclement weather closures. The County assumes no responsibility either for delays in USPS mail or County interoffice mail services, or for bids delivered to County offices or personnel other than to the specified office and personnel. Bids received after the date and time stated in this call for bids will not be accepted and will be returned unopened to Bidder. There will be no exceptions or waivers of this requirement. RCW 39.34 allows cooperative purchasing between public agencies in the State of Washington. Other public entities (cities, school districts, and so forth), which have filed an interlocal cooperative joint purchasing agreement with the County may elect to purchase sign materials from the vendor based on the terms and conditions of this agreement, subject to vendor's consent. Firm prices are solicited for sign materials listed below. Cowlitz County will accept no additional charges including, but not limited to freight, fuel surcharges and other charges. This includes bulk orders processed by the vendor and drop shipped to the County. No maximum nor minimum quantities are specified. The County does not guarantee to purchase any specific quantity and will not expect the suppliers to furnish or stockpile any specific quantities or products. Actual purchases will be made as needed by said County, based upon the following conditions:

1. The type of material available at the supplier's plant when needed; 2. Quality of products available; 3. The distance to the point of use by the County; and 4. Satisfactory service by suppliers,

all of which will be determined by the Engineer.

Prices will be held firm for the contract period. This is to be considered an open-ended bid, inasmuch as the materials will be purchased against this bid for a period of December 1, 2012 through November 30, 2013. This contract will be automatically renewed for two (2) additional one year periods subject to a price adjustment effective December 1st of each renewal year. Prices will adjust based on the percentage change in the Aluminum Ingot Base P1020 for the monthly average for Midwest U.S. Transactions in US Dollar per Pound from September of the previous year to September of the current year. Either the bidder or the County may cancel automatic renewal of the contract by submitting written notice to the other party at the address of record such that it is evidenced as being received no later than October 15th of each year. Payment for purchases will be made according to State Statute, in the month following use of materials, providing a properly detailed invoice has been furnished. After the bids are opened, the Board will determine the lowest cost qualified bidder for the sign materials. The bid has been arranged into sections of similar sign materials. The bid will be awarded by individual section to the lowest cost qualified bidder for each of the sections of sign materials. A bidder is qualified to be awarded a section if they submit a bid and thereby indicate that they are able to supply at least 90 percent of the total quantity of products in that section. All bidders will be notified of the bid results and the County’s intention to purchase materials during the period specified.

COWLITZ COUNTY PUBLIC WORKS - SIGN MATERIALS

SPECIFICATIONS AND PROVISIONS 1. All sign materials ordered hereunder shall be delivered by the vendor to the Kelso Sign Shop located

at 2215 Talley Way, Kelso, WA 98626. The unit prices stated in the bid shall include the cost of such delivery. No additional costs such as freight, surcharges, service charges, etc. may be added to invoices or in any manner affect the costs of materials outside of the unit prices bid.

2. Vendor must bid at least 90 percent of the total quantity of a section to be a qualified bidder for

award of that section. Vendor shall bid and supply materials as specified within the bid request unless specifically noted that an alternate is being quoted. The alternate must be identified by manufacturer name, product number and any other information that is necessary to determine suitability. Alternates will be reviewed and accepted or rejected at the discretion of the County. Rejection of an alternate product will be considered in the 90 percent qualification determination the same as a “no-bid”.

4. The County will order products as they are needed. Quantities stated within the bid are based on

estimates and are not binding. Vendor shall bill the County as products are purchased. The County shall make payment according to its customary payment schedule.

5. Vendor warrants that all sign materials and other items delivered hereunder shall be free from

defects in material and workmanship, shall conform to all applicable specifications and shall be fit for the County's intended use in road signage. Upon being notified that any item delivered hereunder fails to comply with the foregoing warranty, Vendor shall promptly repair or replace the defective item(s) to the County's satisfaction. No acceptance of, use of, or payment for such item(s) shall be deemed to constitute acceptance of any defect(s) nor release Vendor from its obligations under its warranty.

The bid proposal must be submitted on the form supplied by the County as an attachment to this Call for Bids, and the Bidder shall be bound by all terms and conditions contained therein.

To Interested Parties: Cowlitz County is the recipient of certain sales and use taxes, commonly known as rural county public facility funds. These funds may be used only for the purposes authorized by R.C.W. 82.14.370; namely, to finance public facilities serving economic development purposes in rural counties. The public facility must be listed as an item in the county’s capital facilities plan or the capital facilities plan of a city or town located in Cowlitz County. The statute defines public facilities as: bridges, roads, domestic and industrial water facilities, sanitary sewer facilities, earth stabilization, storm sewer facilities, railroad, electricity, natural gas, buildings, structures, telecommunications infrastructure, transportation infrastructure, or commercial infrastructure, and port facilities in the state of Washington. Economic development is defined as those purposes that facilitate the creation or retention of businesses and jobs in Cowlitz County. Cowlitz County is interested in identifying projects that meet the criteria of State law and the program intent of the Board of Commissioners. Cowlitz County believes public involvement is important in this process. Therefore, the Board of County Commissioners wishes to provide an opportunity for eligible recipients to present new project proposals and to receive public comment on other potential uses for the sales tax proceeds not already obligated. The Board of Commissioners may award up to $1 million toward one or more projects; which funds are to be distributed in 2013. The Board has developed a self-sustaining program to make funds available for economic development even after the County is no longer eligible to receive the sales tax rebate. This letter is to intended to give your agency expressed permission from Cowlitz Countyto move forward with the emergency regulation on Silver Lake allowing remediation ofthe grass carp based on recommendations provided to us by the two citizen groups onSilver Lake COWSLIP and Silverlake Watershed Advisory Committee SLWAC as wellas your agency

We recognize that the grass carp were introduced by Cowlitz County and citizen groupsrepresenting the health of Silverlake in 1992 in an effort to remove excess aquaticvegetation This endeavor proved successful after the majority of the vegetation withinthe lake was eradicated within five years It is now the determination of SLWAC and youragencies research that the continued presence of the grass carp are playing a significantnegative factor in the return of quality vegetation to the lake

Due to the extensive efforts to improve the water quality of Silverlake and the negativeeffects of the overpopulation of grass carp we support the allowance of nongame fishingto take place on the lake as a part of a Carp Derby to include the public in this importantremediation effort as well as the allowance of opening the lake up to commercial carpanglers including gill netting and electroshocking where and when necessary asdetermined by your agency

Re Transferring USFS Power Line Contribution Request

Thank you for your continued efforts in managing the federal forests in Cowlitz County and ourregion This letter is to address the transfer of 23 miles of buried US Forest Service USFStwentyfive kilovolt power line including duct bank and power cable to the Cowlitz County PUD

This power line runs parallel with Highway 504 from Kid Valley to the Coldwater Science andLearning Center and has been determined to provide important benefits to future economicdevelopment potential in this area Over the past few months the Gifford Pinchot National ForestCowlitz County PUD service line users and other stakeholders have met to develop a means totransfer the ownership and maintenance of the USFS power lines to the Cowlitz PUD and thisletter is our offering of complete support of this endeavor

We are aware of the power line will require approximately 100000 in maintenance upgrades as acondition of Cowlitz PUD receiving full transfer This letter is to inform you that we are willing tocontribute a portion of this cost and ask that your agency commit as well to a sum of20000

We have requested the other users participate as well explaining that due to substantialmaintenance costs incurred by all users in the past five years this is a quality return on investmentfor each entity

We have informed the PUD that they are a qualified applicant for Cowlitz CountysRuralEconomic Development Fund should they choose to participate in this process These funds maymake up any difference between what can be generated from the current line users and the fullcost of the necessary upgrades for transfer We will be receiving applications starting thisNovember 2012 and look forward to considering an application from them in this regard It is oursincere goal that a complete transfer occur at the very soonest process allows

The Finance Committee of Cowlitz County met in the office of Kathleen Hanks, County Treasurer

and committee chair. Attending the Finance Committee meeting was George Raiter, Chairman of

the Board of County Commissioners and Kristina Swanson, County Auditor.

Reports regarding investments from September 19, 2012 through October 12, 2012 were reviewed

and signed by committee members.

The State Pool earnings rate was 0.18070% in September 2012. The anticipated State Pool earnings

rate for October 2012 is estimated to be 0.19%.
