    Maintain a permanent urban growth boundary around Melbourne to create a more consolidated,sustainable city and protect the values of non-urban land.

    Objective

    To protect the green wedges of Metropolitan Melbourne from inappropriate development.

    Strategies

    Objective

    Ensure that sufficient land is available to meet forecast demand.

    Plan to accommodate projected population growth over at least a 15 year period and provide cleardirection on locations where growth should occur. Residential land supply will be considered ona municipal basis, rather than a town-by-town basis.

    Comprises a range of centres that differ in size and function.

    Growth areas

    Objective

    To locate urban growth close to transport corridors and services and provide efficient and effectiveinfrastructure to create sustainability benefits while protecting primary production, major sourcesof raw materials and valued environmental areas.

    Strategies

    Concentrate urban expansion into growth areas that are served by high-capacity public transport.

    Implement the strategic directions in the Growth Area Framework Plans.

    Encourage average overall residential densities in the growth areas of a minimum of 15 dwellingsper net developable hectare, and over time, seek an overall increase in residential densities to morethan 20 dwellings per net developable hectare.

    Deliver timely and adequate provision of public transport and local and regional infrastructure andservices, in line with a preferred sequence of land release.

    Provide for significant amounts of local employment opportunities and in some areas, providelarge scale industrial or other more regional employment generators.

    Include objectives for each growth area.

    Identify the long term pattern of urban growth.

    Identify the location of broad urban development types, for example activity centre, residential,employment, freight centres and mixed use employment.

    Identify the boundaries of individual communities, landscape values and, as appropriate, theneed for discrete urban breaks and how land uses in these breaks will be managed.

    Identify transport networks and options for investigation, such as future railway lines andstations, freight activity centres, freeways and arterial roads.

    Identify the location of open space to be retained for recreation, and/or biodiversity protectionand/or flood risk reduction purposes guided and directed by regional biodiversity conservationstrategies.

    Show significant waterways as opportunities for creating linear trails, along with areas requiredto be retained for biodiversity protection and/or flood risk reduction purposes.

    Identify appropriate uses for constrained areas, including quarry buffers.

    Develop precinct structure plans consistent with the Precinct Structure Planning Guidelines(Growth Areas Authority, 2009) approved by the Minister for Planning to:

    Establish a sense of place and community.

    Create greater housing choice, diversity and affordable places to live.

    Create highly accessible and vibrant activity centres.

    Identify and protect areas that are strategically important for the environment, biodiversity,landscape, open space, water, agriculture, energy, recreation, tourism, environment, culturalheritage, infrastructure, extractive and other natural resources.

    Provide for development in established settlements that have capacity for growth having regardto complex ecosystems, landscapes, agricultural and recreational activities including inWarragul-Drouin, Bacchus Marsh, Torquay-Jan Juc, Gisborne, Kyneton, Wonthaggi, Kilmore,Broadford, Seymour and Ballan and other towns identified by Regional Growth Plans as havingpotential for growth.

    Establish growth boundaries for peri-urban towns to avoid urban sprawl and protect agriculturalland and environmental assets.

    Coastal settlement

    Objective

    To plan for sustainable coastal development.

    Strategies

    Plan and manage coastal population growth and increased visitation so that impacts do not causeunsustainable use of coastal resources.

    Support a network of diverse coastal settlements that provide for a broad range of housing types,economic opportunities and services.

    Encourage urban renewal and redevelopment opportunities in existing settlements to reduce thedemand for urban sprawl.

    Identify a clear settlement boundary around coastal settlements to ensure that growth in coastalareas is planned and coastal values are protected. Where no settlement boundary is identified, theextent of a settlement is defined by the extent of existing urban zoned land and any land identifiedon a plan in the planning scheme for future urban settlement.

    Direct new residential and other urban development and infrastructure to locations within definedsettlement boundaries of existing settlements that are capable of accommodating growth.

    Support the sustainable management of growth around coastal, estuary and marine assets to protectenvironmental values, and to achieve regional economic and community benefits.

    Avoid linear urban sprawl along the coastal edge and ribbon development in rural landscapes.

    Protect areas between settlements for non-urban use.

    Avoid development on ridgelines, primary coastal dune systems and low lying coastal areas.

    Encourage the restructure of old and inappropriate subdivisions to reduce development impactson the environment.

    Ensure a sustainable water supply, stormwater and sewerage treatment for all development.

    Minimise the quantity and enhance the quality of stormwater discharge from new developmentinto the ocean, bays and estuaries.

    ENVIRONMENTAL AND LANDSCAPE VALUESPlanning should help to protect the health of ecological systems and the biodiversity they support(including ecosystems, habitats, species and genetic diversity) and conserve areas with identifiedenvironmental and landscape values.

    Planning must implement environmental principles for ecologically sustainable development thathave been established by international and national agreements. Foremost amongst the nationalagreements is the Intergovernmental Agreement on the Environment, which sets out key principlesfor environmental policy in Australia. Other agreements include the National Strategy forEcologically Sustainable Development, National Greenhouse Strategy, the NationalWater QualityManagement Strategy, the National Strategy for the Conservation of Australia’s BiologicalDiversity, the National Forest Policy Statement and National Environment Protection Measures.

    Planning should protect, restore and enhance sites and features of nature conservation, biodiversity,geological or landscape value.

    Objective

    To assist the protection and conservation of Victoria’s biodiversity.

    Strategies

    Use biodiversity information to identify important areas of biodiversity, including key habitat forrare or threatened species and communities, and strategically valuable biodiversity sites.

    Strategically plan for the protection and conservation of Victoria’s important areas of biodiversity.

    Ensure that decision making takes into account the impacts of land use and development onVictoria’s biodiversity, including consideration of:

    Cumulative impacts.

    Fragmentation of habitat.

    The spread of pest plants, animals and pathogens into natural ecosystems.

    Avoid impacts of land use and development on important areas of biodiversity.

    Consider impacts of any change in land use or development that may affect the biodiversity valueof national parks and conservation reserves or nationally and internationally significant sites;including wetlands and wetland wildlife habitat designated under the Convention on Wetlands ofInternational Importance (the Ramsar Convention) and sites utilised by species listed under theJapan-Australia Migratory Birds Agreement (JAMBA), the China-Australia Migratory BirdsAgreement (CAMBA), or the Republic of Korea-Australia Migratory Bird Agreement(ROKAMBA).

    Assist in the identification, protection and management of important areas of biodiversity.

    Coastal inundation and erosion

    Objective

    Plan for sea level rise of not less than 0.8 metres by 2100 and allow for the combined effects oftides, storm surges, coastal processes and local conditions such as topography and geology whenassessing risks and coastal impacts associated with climate change.

    In planning for sea level rise, an increase of 0.2 metres over current 1 in 100 year flood levels by2040 may be used for new development in close proximity to existing development (urban infill).

    Policy application

    This policy must be applied to all planning and decision making under the Planning andEnvironment Act 1987 relating to land that is:

    Within a designated bushfire prone area;

    Subject to a Bushfire Management Overlay; or

    Proposed to be used or developed in a way that may create a bushfire hazard.

    Objective

    To strengthen the resilience of settlements and communities to bushfire through risk-based planningthat prioritises the protection of human life.

    Strategies

    Protection of human life

    Give priority to the protection of human life by:

    Prioritising the protection of human life over all other policy considerations.

    Directing population growth and development to low risk locations and ensuring the availabilityof, and safe access to, areas where human life can be better protected from the effects of bushfire.

    Reducing the vulnerability of communities to bushfire through the consideration of bushfirerisk in decision making at all stages of the planning process.

    Bushfire hazard identification and assessment

    Identify bushfire hazard and undertake appropriate risk assessment by:

    Applying the best available science to identify vegetation, topographic and climatic conditionsthat create a bushfire hazard.

    Considering the best available information about bushfire hazard including themap of designatedbushfire prone areas prepared under the Building Act 1993 or regulations made under that Act.

    Applying the Bushfire Management Overlay to areas where the extent of vegetation can createan extreme bushfire hazard.

    Considering and assessing the bushfire hazard on the basis of:

    – Landscape conditions - meaning conditions in the landscape within 20 kilometres (andpotentially up to 75 kilometres) of a site;

    – Local conditions - meaning conditions in the area within approximately 1 kilometre of asite;

    – Neighbourhood conditions - meaning conditions in the area within 400 metres of a site; and

    – The site for the development.

    Consulting with emergency management agencies and the relevant fire authority early in theprocess to receive their recommendations and implement appropriate bushfire protectionmeasures.

    Ensuring that strategic planning documents, planning scheme amendments, planning permitapplications and development plan approvals properly assess bushfire risk and includeappropriate bushfire protection measures.

    Not approving development where a landowner or proponent has not satisfactorily demonstratedthat the relevant policies have been addressed, performance measures satisfied or bushfireprotection measures can be adequately implemented.

    Plan to strengthen the resilience of settlements and communities and prioritise protection of humanlife by:

    Directing population growth and development to low risk locations, being those locationsassessed as having a radiant heat flux of less than 12.5 kilowatts/square metre under AS3959-2009 Construction of Buildings in Bushfire-prone Areas (Standards Australia, 2009).

    Ensuring the availability of, and safe access to, areas assessed as a BAL-LOW rating under AS3959-2009 Construction of Buildings in Bushfire-prone Areas (Standards Australia, 2009)where human life can be better protected from the effects of bushfire.

    Ensuring the bushfire risk to existing and future residents, property and community infrastructurewill not increase as a result of future land use and development.

    Achieving no net increase in risk to existing and future residents, property and communityinfrastructure, through the implementation of bushfire protection measures and where possiblereducing bushfire risk overall.

    Assessing and addressing the bushfire hazard posed to the settlement and the likely bushfirebehaviour it will produce at a landscape, settlement, local, neighbourhood and site scale,including the potential for neighbourhood-scale destruction.

    Assessing alternative low risk locations for settlement growth on a regional, municipal,settlement, local and neighbourhood basis.

    Not approving any strategic planning document, local planning policy, or planning schemeamendment that will result in the introduction or intensification of development in an area thathas, or will on completion have, more than a BAL-12.5 rating under AS 3959-2009 Constructionof Buildings in Bushfire-prone Areas (Standards Australia, 2009).

    Areas of biodiversity conservation value

    Ensure settlement growth and development approvals can implement bushfire protection measureswithout unacceptable biodiversity impacts by discouraging settlement growth and developmentin bushfire affected areas that are important areas of biodiversity.

    Use and development control in a Bushfire Prone Area

    In a bushfire prone area designated in accordance with regulations made under the Building Act1993, bushfire risk should be considered when assessing planning applications for the followinguses and development:

    Subdivisions of more than 10 lots.

    Accommodation.

    Child care centre.

    Education centre.

    Emergency services facility.

    Hospital.

    Indoor recreation facility.

    Major sports and recreation facility.

    Place of assembly.

    Any application for development that will result in people congregating in large numbers.

    When assessing a planning permit application for the above uses and development:

    Consider the risk of bushfire to people, property and community infrastructure.

    Protect the brown coal resource in Central Gippsland by ensuring that:

    Changes in use and development of land overlying coal resources, as generally defined inFramework for the Future (Minister for Industry, Technology and Resources and Minister forPlanning and Environment, 1987) and the Land Over Coal and Buffer Area Study (Ministryfor Planning and Environment, 1988), do not compromise the winning or processing of coal.

    Coal-related development is adequately separated from residential or other sensitive uses andmain transport corridors by buffer areas to minimise adverse effects such as noise, dust, fire,earth subsidence and visual intrusion.

    Use and development within the buffer areas are compatible with use and development adjacentto these areas.
