Pin Numbers
Pin numbers are confidential secure credentials that allow you to submit reports and updatepersonal information. The enclosed sealed envelope contains confidential pin numbers for you.By copy of this letter, a confidential pin number to access the EFS was sent to your treasurer.
Each candidate is required to provide the Division of Elections with confidential personalinformation that may be used to allow access in the event this password is forgotten or lost. Whenyou enter the campaign account screen, there will be a drop down box where you pick a question(such as What is your mother's malden name?) and supply an answer. All passwords and answersto questions are stored as encrypted data and cannot be viewed by Division staff and given outover the phone. Please notify the Division if your credentials have been compromised.
Timely Filing
All reports filed must be completed and filed through the EFS not later than midnight of the duedate. Reports not filed by midnight of the due date are late filed and subject to the penalties inSection 106.07(8), Florida Statutes. In the event that the EFS is inoperable on the due date, thereport will be accepted as timely filed if filed no later than midnight of the first business day theEFS becomes operable. No fine will be levied during the period the EFS was inoperable.
Any candidate failing to file a report on the designated due date shall be subject to a fine of $50per day for the first 3 days late and, thereafter, $500 per day for each late day, not to exceed 25%of the total receipts or expenditures, whichever is greater, for the period covered by the late report.However, for reports immediately preceding each primary and general election, the fine shall be$500 per day for each late day, not to exceed 25% of the total receipts or expenditures, whicheveris greater, for the period covered by the late report.
Electronic Receipts
The person submitting the report on the EFS will be issued an electronic receipt indicating andverifying the report was filed. Each campaign treasurer's report filed by means of the EFS isconsidered to be under oath by the candidate and campaign treasurer and such persons are subjectto the provisions of Section 106.07(5), Florida Statutes.

To Whom It May Concern:
Your office has contacted me on two (2) separate occasions asking me to re-designate mycandidacy from Group 12 to another Group that is up for election this year, or to withdraw mycandidacy altogether.
This morning, as part of the second request, I was informed that my name has beenremoved from the website showing my candidacy for Judge. While your office informed me thatthis does not affect my candidacy, it does affect the ability for individuals to confirm that I am, infact, able to campaign. Therefore, I am requesting that the Division of Elections place my nameback on the website today and place "not designated" where the Group number would be.
In addition and most importantly, I am requesting that the Division of Elections confirmin writing that I am required to re-designate the Group of candidacy or withdraw my candidacy,and the reason why Group 12 is no longer open. As the qualifying period commences April 28,2014, time is ofthe essence and this information and rationale are needed by this afternoon.

AFFIDAVIT OF DAVID P. TROTTI
BEFORE ME, the undersigned authority, personally appeared David P. Trotti, who
being duly sworn, declared as follows:
I, David P. Trotti, on April 1, 2014 submitted the necessary qualifying forms to qualify as
a candidate within Group 12 of the Fourth Judicial Circuit of the state of Florida ("Group 12").
The papers were properly filed with Florida Division of Elections, a subdivision of the Florida
Department of State. On April 3, 2014, I received a letter from the Division of Elections
acknowledging receipt of his qualifying papers understanding that the qualifying period had not
officially begun. At approximately the same time I was added to the Division of Elections
website and listed as a candidate in Group 12. On April 25, 2014 at 5:32PM I received an email
from the Division of Elections stating:
"Dear Mr. Trotti, Judge Donald Moran, 4th Judicial Circuit, Group 12, has submitted his
resignation and it has been accepted by the Governor. As a result, the vacancy created
will be filled by appointment by the Governor and this seat is will not be up for the 2014
election. As we discussed, you will need to withdraw your candidacy or submit a new
DSDE 9 designating a different group no later than 12 noon on May 2, 2014. Please let
me know if you need additional information."
Prior to the email, I received two phone calls from the Division of Elections demanding
that I switch my candidacy to a different group. During the second call, on April 24, 2014, I
requested a written explanation for the closing of the group. Additionally, he followed the verbal
request with a written request sent to the Division of Elections April 24, 2014. I was removed as
a judicial candidate from the Division of Elections website.
Group 12 of the Fourth Judicial Circuit is currently occupied by the Honorable Donald
Moran, Jr.. The Qualifying period for Judicial Candidates for the Fourth Judicial Circuit of
Florida is scheduled to conclude at noon on May 2, 2014. All judicial candidates are required to
submit their qualifying papers and filing fee on or before noon May 2, 2014. Judicial Elections
are scheduled to occur in August 2014 and November 2014 (if necessary). All successful
candidates are scheduled to take office Monday January 5, 2015.
