DEAR MEMBERS :

I write this, my first President’s message, with 10 days to gobefore I officially become President of the FCBA. I want tobegin by expressing my gratitude for the opportunity to servethe association in this capacity. I look forward to working withmany old friends and to making new ones during the comingyear. I am fortunate to inherit an excellent slate of officers andExecutive Committee members, led by Sandy Wilson asPresident-Elect. With the FCBA’s tradition of staggeringexperienced leaders with newly-elected individuals, I amconfident that we will have a good mix of old hands offeringinsight and experience and greenhorns suggesting new ideasand thoughts on all levels.

We all owe our outgoing President, Margaret Tobey, a debt of thanks. Margaret will bea tough act to follow. She led the association with energy, aplomb and a strong senseof purpose. Margaret also managed to maintain her wonderful sense of humor and ahealthy perspective in a year in which we all lived through some dark times. Margaretreminded us at the first FCBA luncheon following September 11th about theimportance of community, which one finds in the FCBA. I know that I take over thehelm with things in good order as a result of Margaret’s tireless work and dedication.

I am nearly finished with the task of appointing the 110 or so co-chairs for the 2002-2003 year. I have done my best to include both veteran members and promisingnewcomers in leadership positions, including a half dozen or so “young” co-chairs inaddition to the co-chairs of the Young Lawyers Committee—Yaron Dori and RyanWallach. These young people have shown a willingness to become involved in avariety of capacities. The active participation of our members is one of theassociation’s greatest strengths; it not only helps the organization, it offers a personallyrewarding experience as well. New members, especially, can benefit fromparticipation and should not be concerned if they do not know many others in theassociation. I did not know anyone in the FCBA when I called Larry Roberts, thenChair of the Young Lawyers Committee, to ask how to get involved. I showed up asinstructed and have continued to seek out other opportunities over the years. I havefound the FCBA to be a truly volunteer bar association; that is, speak up and you canhave as much or as little responsibility as you desire. I encourage any of you who havean interest in becoming more active to pick up the phone and call a committee co-chair to volunteer and participate more actively this year.

We will hold our annual kick-off co-chairs meeting in mid-July so that we can use thesummer months for planning purposes. I have asked the new CLE co-chairs, MarkGrannis, Laura Phillips and Lauren VanWazer to work with each of the substantivecommittees on at least one CLE program, so you can expect earlier and more frequentCLE programs. I am happy to report that Seminar West 2002 is set for July 19-21 in SanDiego. The committee, led by Heather Grahame,Anne Hoge,Anita Wallgren and BryanTramont has raised the bar for taking leadership and organizing responsibilitiesseriously. They have planned a high-caliber program featuring Commissioners KathleenAbernathy and Kevin Martin,Congressman Darrell Issa (R-CA),and many others.

I can also report that the 20th annual PLI conference is already scheduled forDecember 12-13,2002. Dick Wiley,Henry Rivera and Clark Wadlow chair the planningcommittee and have an all-star line-up of participants, including Senator George Allen,Commissioners Michael Copps and Kevin Martin, the Honorable Nancy Victory, and

What is new today may be passé inthree years. How, then, can policies beanticipated over the next decade andbeyond? As wireless technologies con-tinue to gain ascendance in the market-place, the challenges for spectrum alloca-tion will become increasingly complex. Will secondary markets in wireless spec-trum take hold and find financial footingin the next decade? What pressures willthe emergence of software-defined radiobring to bear on the FCC’s policies dur-ing this time frame? What will be thefuture role of auctions and spectrumcaps in the domestic marketplace? Theevents of 9/11 have resulted in a resur-gence of security concerns regardinghow wireless spectrum is utilized, and inincreased sensitivity to the needs of themilitary. What will be the balancebetween defense and commercial usersof wireless spectrum by 2020? Ourspeakers will attempt to step back andtake a longer-term look at where wireless
