DEAR MEMBERS :

During this FCBA fiscal year, I want to focus on some broadinitiatives to promote our core missions. Among these are (1)making sure the FCBA is doing all it can to attract new membersand keep the ones it has, (2) providing more and even betterprofessional education to our members, and (3) creating moreopportunities for interaction among our members.

To remain healthy as an organization, the FCBA needs tomaintain its membership base. Four years ago,our membershipcrested at approximately 3400 but now stands at 2800. While we add approximately200 new members each year,we lose as many as several hundred annually. To stem thisoutflow, I have asked our president-elect, Michele Farquhar, to head up a study ofmembership trends and to come up with recommendations for attracting newmembers and making sure current members renew. Michele’s group will look not onlyat expanding our membership to include, for instance, more in-house and governmentlawyers, but also at administrative improvements to help us know who our membersare, what they want from the association and what makes them want to renew.Improving membership at the chapter level also will be a focus of the study.

The FCBA’s principal vehicle for professional education is our highly successful CLEprogram. In appointing the co-chairs for our practice area committees (Cable,CommonCarrier, Mass Media, Online Communications, State and Local, Transactional, WirelessCommunications) and for the Professional Responsibility Committee,I have asked eachcommittee to come up with plans for one or more for-credit CLE programs. Thesepresentations involve prepared remarks by panelists, the distribution of valuable hand-out materials and opportunities for our members to interact with experts in areas inwhich they may not concentrate their daily work. Plus, these programs provide aconvenient and inexpensive way for those of us subject to mandatory CLE to meetthose requirements. My hope is that under the leadership of this year’s CLE co-chairs,Bob Pettit, Lee Petro and Charla Rath, we will improve on the already excellentrecord of the past year, when we put on 10 CLE programs.

I plan to appoint a few current officers and other senior FCBA members to study our“Commlaw 101” seminar program with an eye to whether it should be changed interms of scheduling, location or content. Originally intended for first- and second-yeargovernment and private sector lawyers, this two-day seminar has evolved into morebroadly aimed, if narrowly focused, CLE-type program. This is as a result of negativemarket trends that have tended to cap the number of young people starting careers incommunications law. We hope the trend will reverse itself as the economy picks upbut, if it continues, we need to decide what changes are needed. The goal is to makesure Commlaw 101 continues to be responsive to the FCBA’s evolving needs forspecialized legal education not provided in our two-hour traditional CLE programs.

Besides emphasizing our educational programs, I want to promote social interactionamong our members—not only with each other but with the FCC and other agencieswe deal with. Our 70th Anniversary Reception on June 3 at the Washington Hiltondrew over 350 persons and a large number of enthusiastic sponsors. With our privatesector and government attorneys now dispersed throughout the region (and the nationfor that matter), such gatherings are essential not only to promote the association’sidentity,but to facilitate “networking.” Our members, like most lawyers,depend heavilyon their business contacts to improve their efficiency and effectiveness. With this inmind,I plan to schedule at two or three such receptions this year,and want to have four

Annual Meeting andLuncheon held onJune 24Celebration as well as orders of businesswere attended to at the June 24, 2004FCBA Annual Meeting and Luncheonwhere Commissioner Kathleen Q.Abernathy was the Keynote Speaker.

Tom Van Wazer, Chair of the Foundation,introduced the attendees to this year’shigh school scholarship winners fromBell, Cardozo, Spingarn and RooseveltHigh Schools (see related article in theJune FCBA News). The five Lee SummerInterns were also introduced. All five areworking in various bureaus at the FCC.Stefanie Zalewski, Ryan Harrington, AnnLawrence, Anjali Patel, and MarjorieManne received stipends from theFoundation’s scholarship and internshipfund. The Corporations and Law Firmssupporting the Foundation’s scholarshipprogram were also recognized.

Van Wazer thanked the Trustees on theboard for serving and his assistant,TamiSmith for all of her support throughouthis involvement with the Foundation.

The “Volunteer of the Year Award”went to Cara Voth, an active volunteer

in the Foundation’s program to provideservice to McKenna’s Wagon, a mobilesoup kitchen. Voth was recently electedas a Trustee to the Foundation’s Board.Voth was not able to be present.

Alexandra M. Wilson, FCBA President(2003-2004), presided over the meetingwhere proposed amendments to theFCBA’s Constitution were voted on.The ballots sent out in May from theFCBA included several proposedamendments to the FCBA’s Constitution.All proposed amendments passedunanimously. Ms. Wilson presented “DistinguishedService Awards” to Ryan Wallach andYaron Dori. Both won based on theirexceptional service to the organization,including, but not limited to, serving asco-chairs of the Young LawyersCommittee, and Ryan and Yaron’sexemplary efforts supporting theExecutive Committee in membershipoutreach and sponsorship solicitationrespectively.

The “passing of the gavel” betweenAlexandra Wilson and Harry Martinalso took place. Harry Martin becameFCBA President as of July 1,2004.

Our members owe a huge “Thank you”toour outgoing president, Sandy Wilson.Sandy has been tireless in her efforts toimprove the infrastructure of theassociation. For instance, due to Sandy’sinitiatives,we now have a bookkeeper onstaff and are implementing newassociation software. Theseimprovements and others will enhancethe association’s ability to deliver servicesefficiently and reliably. In spite of theadditional costs we have incurred, Sandyhas managed to keep us in the black thisFY.Sandy has been a firm,effective leaderin every respect. From a personalstandpoint, I thank Sandy for includingme in every major decision this year andfor taking the time to make sure I wouldhave the necessary background to takeover as president. August 14The FCBA’s Young Lawyers Committee organizes volunteers to spend three hoursonce a quarter helping lower income individuals through a clinic sponsored bythe DC Bar.We co-volunteer with the DOJ Antitrust Division. Attorneys receive ahalf-hour overview/orientation beginning at 9:30 am over bagels and juice.Volunteers are expected to assist clients only during the time they are at theclinic.

No special legal knowledge is needed — attorneys generally need to keep an eyeout for potential legal issues while using their common sense to solve a myriad ofquestions and make referrals to other organizations.Experienced attorneys on-sitewill assist FCBA attorneys and other volunteers with any questions. Previousattendees have described this as “the most satisfying volunteer experience I’vehad as an attorney.”

You must either be a member of the DC Bar, have an application pending to theDC bar, or be an employee of the federal government to provide advice.Thosewho are not DC bar members,paralegals and law students are needed,however, toprovide intake and triage. 8th Annual FCBA FoundationGolf TournamentSuccessful AgainThe 8th Annual FCBA FoundationHonorable Robert E. Lee Memorial GolfTournament was held on Friday, June 18,2004. The group returned to Bull RunCountry Club in Haymarket, Virginia,raising nearly $20,000 for the FCBAFoundation’s Scholarship Fund, whichprovides college funds for deservingDistrict of Columbia high schoolgraduates as well as stipends for unpaidLaw School summer interns atgovernment agencies.

The tournament is named in memory offormer Federal CommunicationsCommission (FCC) Chairman Robert E.Lee, who passed away in April 1993 afterserving on the FCC for almost thirtyyears. Chairman Lee’s son, Bobby Leeplayed and sponsored a team through hisrestaurants Mister Days and SoBe inNorthern Virginia.

IN MEMORIAM

Alfred C. Cordon(1916-2004)Longtime broadcast attorney and FCBAmember Al Cordon died on May 22 inSeattle,Washington.

He was born in Rigby, Idaho, graduatedfrom Pocatello High School,attended UtahState University, Idaho State University,andThe George Washington University,obtaining his LL.B. degree from the latterin 1952. His college education wasinterrupted by World War II, during whichhe served his country with distinction inthe Army Air Corps, including service inthe China-Burma-India theater.

Al was admitted to the practice of law inthe District of Columbia in 1952. In thatyear he joined the law firm of Dow,Lohnes and Albertson, where he was anassociate and a partner. In 1968 he leftDow Lohnes and, with the late John B.Jacob, founded Cordon and Jacob. Uponthe retirement of Mr. Jacob in 1984, Aland Dennis J. Kelly formed Cordon andKelly, where Al practiced until hisretirement in 1990. Upon his retirement,Al moved to Bainbridge Island,Washington and later to Seattle.

Al’s career was principally devoted to therepresentation of radio and televisionstations before the FederalCommunications Commission. His manyclients benefited from his skill andwisdom, and he was widely respectedand well liked by his contemporaries inthe communications bar.

As well as his membership in the FederalCommunications Bar Association, Al wasactive in the Delta Theta Phi lawfraternity, and served as its nationalchancellor between 1967 and 1969. Hewas a member of the InauguralCommittee for the 1953 inauguration ofPresident Dwight D. Eisenhower. Aformer college football player, he was amember of the Touchdown Club ofWashington and the local chapter ofKiwanis.

Al is survived by his wife of some 57years, LaVonne, and by his daughterClaire,a practicing attorney in Seattle.

William C. Koplovitz(1909-2004)Former FCBA President WilliamKoplovitz died on May 9 in Washington,D.C. He served as the Association asPresident in 1958-59. Many presentFCBA members will remember himprincipally as a partner in Dempsey &Koplovitz.

Bill was born in St. Louis, attendedWashington University on a full four-yearscholarship, and earned a Masters Degreefrom the George Warren Brown Schoolof Social Work. He was awarded a meritscholarship to Harvard Law School andgraduated cum laude in 1933. While at

Harvard, he was recruited by the RussellSage Foundation to collect and analyzeemployment data. That work wasincluded in a book he co-authored titled“Emergency Work Relief.” It became thepolicy underlying the Public WorksAdministration.

Bill went to work at the PWA in 1933 andthere met William Dempsey. They bothwent to the Federal Power Commissionin 1936, where Koplovitz was appointedGeneral Counsel. He transferred to theFederal Communications Commission towork again with Dempsey, who hadbecome the FCC’s General Counsel. Thetwo Bills had an unbroken series offavorable decisions from the SupremeCourt upholding powers of the FCC.

In 1940, they formed their law firm, oneof the first firms founded exclusively byNew Deal lawyers. The firm’s practicewas principally devoted to therepresentation of radio and televisionstations before the FCC. Among itsclients were many newspaper companiesthat owned broadcast stations, such asScripps-Howard, Hearst, and Belo/DallasMorning News.

Upon retirement in 1974, Bill Koplovitzmoved to Europe and settled ultimatelyin Costa del Sol. He and his wifereturned to Washington in 1986 and livedat the Watergate.

Bill was president of the WashingtonHebrew Congregation, was a member ofthe founding board of the Jewish SocialService Agency, and on the board of theUnion of American HebrewCongregations.

He is survived by his wife of 63 years,Beatrice, by his daughter Susan, and sonWilliam,Jr.
