In a few short weeks, the FCBA will experience its own form of“back to school” frenzy. Committee activities will be in fullswing, and planning for some of our key fall and winter events(such as the Charity Auction and the Chairman’s Dinner) will bewell underway. We will also be launching the season’s CLEprograms, with issues as diverse as media ownership, localtelephone and broadband competition and regulation of faxcommunications being teed up over the next few months. And,speaking of teeing up, if you’re a golfer looking to enjoy theearly fall weather, I hope you’ll be able to participate in a charitygolf tournament being co-sponsored by the FCBA Foundationand the Association of Federal Communications Consulting Engineers on September19,which will help raise funds for their respective scholarship programs.

The FCBA, of course, has not ignored the traditional last month of “summer vacation.”Continuing a trend that is very beneficial to our members outside the beltway, ourchapters have taken the lead in holding FCBA events in conjunction with some of themajor summer conferences. On July 29, the Denver chapter hosted a well-attendedreception during the NARUC summer meeting. With the generous sponsorship of MCIand Level 3, the reception was held on the 42nd floor of the MCI building with asweeping view of the Rockies. Four FCC Commissioners, numerous state PUCcommissioners, and members of their staffs mingled with FCBA members and NARUCattendees before heading out to dinner and other evening activities. On August 10, theNorthern California Chapter helped to organize the FCBA’s annual reception at theAmerican Bar Association meeting in San Francisco. Held in honor of the members of theABA House of Delegates, this year’s reception was sponsored by Analysis Group, BETHoldings, Inc., Davis Wright Tremaine, Morrison & Foerster, Sidley Austin Brown & Wood,Steefel Levitt & Weiss, and Wiley Rein & Fielding. Many thanks go to the receptionorganizers and sponsors for planning and supporting two such well-received FCBA events.

The Executive Committee also was able to take advantage of the summer season,holding a planning retreat on August 7 to get ready for the year ahead. The retreatfocused on four main topics: reviewing and adopting a budget for Fiscal Year 2004;evaluating our key events and assessing the need for revisions or additions; exploringways to protect the association’s financial footing; and evaluating administrativeprojects that would improve operational efficiency and assist our professional staff inthe performance of their jobs. I’ll be providing more details about our decisions andplans in each of these areas over the next few months. In the meantime, I would like tothank the members of the Executive Committee, our officers and our staff for takingthe time out of their busy schedules to prepare for and attend the retreat; the progresswe made in addressing some key issues will stand the association in good stead foryears to come. Fortunately, we were able to inject a little fun into a session otherwisecharacterized by numbers-crunching and focused discussion – confirming, for example,that each Executive Committee member owns a least one adorable baby picture!

Finally, I would like to call your attention to an important organizational change in ourcommittee structure that was decided upon at the July Executive Committee meeting.A new committee, named the International Telecommunications Committee, has beenformed to enhance the services provided to FCBA members practicing in theinternational arena. Details about the new committee are provided in this newsletter,and I encourage all of you who work on international issues to participate in the manyevents and programs that the new committee will be sponsoring.

I look forward to seeing many of you “around campus”in the coming weeks!

December 4-5,2003: 21st AnnualTelecommunicationsPolicy andRegulationConferenceFor the 21st consecutive year, the FCBAand the Practising Law Institute will co-sponsor an annual Institute on“Telecommunications Policy andRegulation.” This year’s conference willbe held on December 4-5 at The RonaldReagan Center, scheduled to coincidewith the FCBA’s Chairman’s Dinner onDecember 4.

The Conference will be keynoted byCongressman Robert Goodlatte (R-VA),a Co-Chair of the House CommerceCommittee, and FCC CommissionersJonathan Adelstein and KevinMartin. Hewitt Pate, Assistant AttorneyGeneral, Antitrust Division, Departmentof Justice, will be the featured luncheonspeaker on December 4. Other programhighlights include three panels –conducted in the conference’s traditionalall question-and-answer format – dealingwith developments in wirelinetelephone, wireless telecommunications,and the Internet. Additionally, theInstitute will feature tutorials by key FCCstaff officials: William Maher, Chief ofthe Wireline Competition Bureau; JohnMuleta, Chief, WirelessTelecommunications Bureau; DavidSolomon, Chief, Enforcement Bureau;and General Counsel John Rogovin.Donald Abelson, Chief of the FCC’sInternational Bureau, and JaniceObuchowski, Ambassador to WRC, willalso provide a discussion on internationalissues.

Once again, the Institute’s agenda willinclude a panel discussion on thetelecommunications future and a debate– this year, on “The Role of Federal vs.State Regulation”, with BradfordRamsay, General Counsel of NARUCfacing off against Dorothy Attwood,

Vice President of SBC, and with HarryMartin, FCBA President-Elect, asmoderator. FCBA President AlexandraWilson will open the Institute, andHenry Rivera,Clark Wadlow and DickWiley, of the FCBA’s ConferencesCommittee, will serve as overall programchairs. In addition, a number ofAssociation members will moderatevarious program segments.

Creation of NewPractice CommitteeWe are pleased to announce theformation of a new FCBA practicecommittee, the InternationalTelecommunications Committee, tobetter serve our members. This newcommittee will provide services tomembers of the current GlobalTelecommunications Development andInternational Practice Committees. TheInternational TelecommunicationsCommittee will hold programs andevents and conduct membershipoutreach for communicationsprofessionals practicing in theinternational area. It will also serve as asingle point of contact for inquiries fromforeign regulators. At the same time, thenew committee will maintain a clear anddistinct focus on serving memberswhose practice involves U.S. regulationand policy in the international arena, aswell as those whose practice involvestelecommunications developments indeveloping and developed countries.Accordingly, the new committee will beled by four co-chairs, two of whom willfocus on the first area (Jennifer Hindinand Jennifer Gilsenan) and two of whomwill focus on the second (Julie Kearneyand Janet Hernandez). ANNUAL REPORT OF THE FCBAFOUNDATION JULY 1, 2002 to JUNE 30, 2003Having successfully concluded its 12thyear, the Federal Communications BarAssociation Foundation (the Foundation)remains an important vehicle forcommunity service because of thecontinued support of individual FCBAmembers and their firms and companies.The Foundation’s official mission remainsto:

(1) Support worthwhile communi-cations-related and educationalprojects, as well as other communityservice projects, particularly thosedirected toward children andstudents, through financialcontributions and volunteerservices;and

(2) Foster greater public awareness andunderstanding of the developmentof communications technology,resources and law, and the role ofcommunications law practitioners.

During the past year, the Foundationserved these goals in numerous ways. Itawarded college scholarships todeserving students at public high schoolsin the District of Columbia and arrangedfor mentors from the FCBA membershipto help those students in their transitionto college. The Foundation also awardedstipends to law students taking unpaidinternships in government positionsrelated to communications policy. Inaddition, the Foundation organizedvolunteer sessions each month to makemeals for the homeless at Martha’s Table,and to deliver those meals withMcKenna’s Wagon; arranged outings withthe Martha’s Table Youth Group; gatheredblankets for a new homeless shelterduring a brutally cold winter; andcollected holiday gifts for homeless

children.

A board of 12 Trustees from the FCBAmembership governs the Foundation.This year, our Trustees were DianeDavidson, Scott Delacourt, Brian Fontes,Audrey Glenn, Anna Gomez, DonnaGregg, Cheryl Leanza, Ruth Milkman,Greg Vogt,Tom Van Wazer, Kathy Zachemand myself. Anna and Kathy have bothcompleted their final year on the Board,and the Foundation will surely miss theirenthusiasm, leadership and generouscommitment of personal time.Fortunately, the Foundation will benefitfrom new Trustees elected by the FCBAmembership: James Coltharp, PraveenGoyal, Maureen O’Connell and Mark VanBergh. In particular, Mark hasphotographed our volunteer activities fora number of years, and may finally findhimself in front of the camera. Tom VanWazer will serve as the Board’s Chair forthe coming year.

Special thanks to both Wiley, Rein &Fielding and to Cingular Wireless forhosting the Foundation’s monthly boardmeetings this year. As usual, Stan Zenorand Heidi Kurtz provided us withdedicated and professional support.

SCHOOLS ANDSCHOLARSH IPS

The Foundation awarded six collegescholarships this year to deservingstudents from local public high schools.This year’s recipients are Thanh PhucTran of Francis L. Cardozo Senior HighSchool; Carolina Acevedo and DawnJennings of Theodore Roosevelt SeniorHigh School; and David Lloyd, ShanataHarvey and Ashley Williams of SpingarnSenior High School.

The Foundation’s college scholarships,which range from $8,000 to $20,000over four years, are awarded based upona number of criteria, including thestudent’s academic success, attendancerecord at school, participation in school

activities, service to the community,financial need, personal essays andinterest in communications, computersor information technology. All of theapplications we receive tell unforgettablestories of young people who overcameobstacles in their lives to prosper inschool and give back to their community.Each year, our Trustees undertake thetime consuming process of interviewingscholarship candidates in person beforemaking our selections. Cingular Wirelessand McDermott,Will & Emery generouslyprovided us with facilities to conductthese interviews.

Members of the Foundation’s Board ofTrustees attended the awards ceremoniesat Cardozo, Roosevelt and SpingarnSenior High Schools to present ourscholarships in person. At Cardozo HighSchool, we were joined by Mary Broonerof Motorola to present Thanh Phuc Tranwith the “Motorola Scholarship” in theamount of $12,000 over four years.

Once again,WBDC-TV (“WB-50”) here inthe District of Columbia created a specialvideo presentation featuring this year’sscholarship winners, which was shownat the FCBA luncheon on June 25featuring Chairman Powell. Thank you toShannon Days of the station and to TomVan Wazer of the Foundation forcoordinating this effort. Most of ourscholarship recipients were able toattend the FCBA luncheon, together withteachers and administrators from theirschools, to thank FCBA members inperson. At the luncheon, ChairmanPowell commended the Foundation andFCBA members who made thesescholarships possible.

Over the years, the Foundation hasawarded more than fifty collegescholarships to deserving students frompublic high schools. The Foundationgratefully acknowledges the past supportof Motorola, the SBC Foundation andthe Verizon Foundation, as well as thesupport of individual FCBA members, forits scholarship efforts.

Under the guidance of Anna Gomezand Scott Delacourt, the Foundationcontinued its mentoring program forscholarship winners. Each scholarshiprecipient is paired with an FCBA memberas his or her personal mentor, withwhom he or she can share experiencesand seek advice during the transition tocollege and thereafter. Thank you to allFCBA members who volunteered toserve as mentors this year, and to Annaand Scott for coordinating this program.

ST I P ENDS FOR SUMMERINTERNS

The Foundation also awarded stipends tofour law students who took unpaidpositions in government this summer towork on communications policy matters.These awards were made from theChairman Robert E. Lee ScholarshipFund, established in memory of theformer FCC Chairman and Commissionerwho passed away after nearly thirty yearsof service at the agency. This year’srecipients were Sarah Kenney ofAmerican University’s WashingtonCollege of Law, who interned at theEnforcement Bureau of the FCC;MichelleKozlov of Boston College Law School,who interned at the Office of theAttorney General of Massachusetts,working on high tech and computerfraud issues; Jerry Brito of the GeorgeMason University School of Law, whointerned at the FCC’s InternationalBureau; and Kara Wyrsch of theUniversity of Maryland School of Law,who interned at the WirelessTelecommunications Bureau.

Each of these interns received a stipendin the amount of $2,500 for the summerto help defray his or her expenses. Inaddition, the Foundation selected Ms.Kenney to receive an extra stipend as thewinner of this year’s Max Paglin Award.Mr. Paglin was the former GeneralCounsel and Executive Director of theFCC, and the founder of the Golden

Jubilee Commission onTelecommunications, which generouslydonated royalties from its definitivelegislative history of theCommunications Act to the Foundation.

COMMUNI TY S ERV IC E ANDVOLUNTEER OPPORTUN I T I E S

Continuing a rich tradition, the FCBAsponsored more than two dozenvolunteer events for FCBA members overthe past year. Volunteers led by HowardWeiss and myself continued to makemeals for the homeless at Martha’s Tableeach month. They were joined by anumber of distinguished guests this year,including Commissioner KathleenAbernathy and her staff; members of theInternational, Media and WirelessBureaus; and officials from the NationalTelecommunications and InformationAdministration. In addition, volunteersorganized by Tom Van Wazer and CaraSheppard Voth continued to delivermeals to the homeless on the streets ofDistrict each month in McKenna’sWagon, a mobile soup kitchen operatedby Martha’s Table.

Last December, FCBA volunteers againcelebrated the holiday season bycollecting gifts for needy families. Thosegifts were distributed by FamiliesForward, Inc., a local charity thatprovides housing, job counseling andrelated services for families “intransition.” Pam Cooper, David O’Neilland Mary Plantamura once againorganized our efforts. In the past sevenyears, the Foundation has donatedthousands of dollars worth of gifts tonearly 1,000 people in the DC area. Alsolast December, the law firm Lampert &O’Connor asked the guests at its annualholiday party to bring children’s toys,books and games, which the firm thendonated to Martha’s Table for distributionto needy children in the community.Thanks you to Donna Lampert and MarkO’Connor for their thoughtfulness.

In January, the local group FamiliesForward contacted the Foundationregarding their urgent need for blankets

to be used in a new cold weather shelterat D.C. General Hospital, one of the fewshelters in the District that providesassistance to families. Given the brutallycold conditions that month, the need forblankets at their new facility had becomeurgent. Within days of this request, FCBAvolunteers, led by Pam Cooper, collectednearly $2,000 and donated 100 blanketsto the shelter. Thank you to Pam and toeveryone who helped out with thiseffort.

The Foundation continued to createspecial events for the children of theMartha’s Table Youth Group. OnFebruary 1, FCBA volunteers took theYouth Group skating at the SculptureGarden Ice Rink on the National Mall.They were joined by members of thePrince William Panthers AA Youth TravelHockey Team, led by Brian Umansky, sonof former Foundation Board MemberBarry Umanksy. After skating, we treatedthe young people to a pizza lunch andawarded them the first ever Stanley(Zenor) Cup. Unfortunately, the snipercrisis last fall forced the Foundation tocancel its annual trip with the YouthGroup to a local pumpkin orchard.

At the luncheon on June 25th, theFoundation named Anna Gomez itsVolunteer of the year. Anna has led ourmentoring program and been an activeparticipant in the Foundation’s collegescholarship and intern stipend awards, aswell as its volunteer events. She madethese time commitments despite ademanding schedule as a Deputy BureauChief at the Commission.Congratulations to Anna.

FUNDRA IS ING

Fundraising remained a special concernof the Foundation this year, given thecontinuing economic downturn anduncertainty during the Iraq war. Becauseof this, we were particularly grateful forthe generous contributions made tosupport our activities. FCBA membersdonated $7,500 to our annual givingcampaign and contributed over $18,000through the membership dues check-off.

In addition, the Foundation receivedgenerous donations of $12,000 fromMotorola and another $12,000 from theVerizon Foundation in support of ourscholarship efforts.Special thanks to Brian Fontes and KathyZachem for coordinating our fundraisingefforts in a particularly difficult year.

As usual, the Foundation’s fundraisingefforts included three regular events: co-sponsorship of the Charity Auction, tobenefit a different non-profit organizationeach year; the Chairman’s Dinner;and theannual Golf Tournament. Thanks tocountless volunteers, each event was asuccess.

The 13th Annual Charity Auction,held onNovember 21, 2002, raised over $50,000for the non-profit organizations CollegeBound and Beacon House. CollegeBound provides mentoring, academicenrichment opportunities, andscholarships to local students to preparethem for college. Since 1999, CollegeBound has partnered with BeaconHouse, which works to empower,enhance, and assist local at-risk childrenand their families in enriching their livesand community. Special thanks goes toAuction Committee members YaronDori, Ryan Wallach, Jennifer Warren,Carolyn Groves, Pam Skipakoff, andCheryl Leanza, Scott Delacourt from theFoundation. Specialguests included FCC CommissionersKathleen Abernathy, Kevin Martin,Michael Copps and Jonathan Adelstein, aswell as Assistant Secretary of Commercefor Communications and Information,Nancy Victory, the Deputy AssistantSecretary of State for Communicationsand Information Policy, David Gross, andthe Chairman of the FrenchTelecommunications RegulatoryAuthority, Jean-Michel Hubert. Co-chairsClark Wadlow, Kathy Zachem and SallyBuckman produced an outstandingevent, which generated over $32,000 forthe Foundation.

On June 16th, 2003, the Foundation heldthe seventh annual Honorable Robert E.Lee Memorial Gulf Tournament, at BullRun Golf Club in Haymarket, Virginia.Once again, the success of thisTournament was a tribute to AlanCampbell and the other members of theGolf Tournament Committee, includingRobert Branson, Bruce Cox, ThomasDombrowsky,Sean Foley,Laura Holloway,David Lacki, Phillip Mallet, Dee May,Harold McCombs, Larry Movshin, CeliaNogales, Lee Petro, Michael Rosenthaland Ryan Watts. We estimate that thisyear’s Tournament raised over$24,000.00 for future scholarships.

My three years on the Foundation Boardhave been extremely rewarding. Thankyou to Sasha Field, who first asked me toserve on the Foundation’s VolunteerServices Committee, and to Peter Rossand Howard Weiss, the Chairs before me,whose shoes were impossible to fill butwho continued to provide me withimportant advice and supportthroughout the year.
