President’s Message
By the time you read this Newsletter we would have celebrated Mother’s Day, Memorial Day and
looking forward to Father’s Day. Hope all your celebrations were fantastic and there are more to
come. There is so much happening this year it is it is unbelievable—before we know it summer
will be here and we’re especially looking forward to our Summer Seminar on August 22nd and
our Wine Tasting charity event on August 14th. These events are going to be fabulous and you
won’t want to miss any of them.
We had our Professional Designation test on April 18th and we have a new Certified Escrow
Officer among our members. Congratulations to Victoria Partridge, CEO!
Thank you to our April meeting speakers Michelle Marsico of Village Coast Escrow and Michael
Haas who were very informative about the fraud experiences Michelle went through and best
ways to avoid them. It was extremely interesting and we appreciate their sharing those events.
All of our committees are working hard to present our members with the best in education. Our
monthly meetings will always be informative - our committee chairs always report on our
charitable events, seminars, legislative updates and fun events being planned. Please don’t
miss any of our meetings!!!!
Membership is key!! If you are not a member of EASGV you are missing out—don’t delay and
join now so you won’t miss out on all of the benefits afforded members of our #1 Association!!
Remember this is the 4th and final year of our 4 year cycle for Professional Designation credits.

Recap of the upcoming speakers for May, June and July dinner meetings highlighting that AEA President Nick Nicholson will be joined by Art Davis, AEA General Counsel for July.
Members should send in their reservations ASAP especially for May and June as they will receive an email back with handouts and/or other information relative to the meeting which can be printed and brought to the meetings for reference.
National Title Companies do not escape Vetting issues. Josette also told a quick story about how a Vetting problem was handled at Old Republic National Title Insurance Co.

Recent trip to advocate on National Affairs Committee of the Escrow Institute of California in
Washington, D.C.
The group met with U.S. Representative Maxine Waters of 43rd Congressional District-CA to
discuss the possible exemption from the Dodd-Frank Act; support of a separate closing statement
and not combine the TILA and GFE; clarification from CFPB as to their regulatory bulletin to
require lenders to monitor and control title/escrow companies and the unregulated third-party
private vetters; and, H.R. 1265: Bureau Advisory Commission Transparency Act for CFPB

Described her horrific fraud case from 5 years ago where 26 wires were illegally sent from her
escrow account.
Additional Speaker Ken Holloman (IT specialist) - provided info from IT side – most firewalls and
spyware do not work and will not prevent a computer/account breach from hackers & thieves
persistent to get into your network and steal information. He suggested using a proxy computer to
allow contact to the internet rather, than having access on all office computers.
Michael Haas, CPA – discussed other recent fraud cases and how most could have been
prevented by following each office’s own “checks and balances” procedures which we are
sometimes too busy to follow. Having “Cyber Insurance” only covers you if money stolen from
within the company. Go back to “old school” and verbally verify everything!

April is always a very busy session. The bills have been written and identified as potentially affecting our
industry. This year there were about 2300 bills introduced and 110 of those bills could possibly affect escrow
and/or our industry as a whole. Here are a select number of those 110:
AB 139: (which could become known as the “Poor Man’s Bill”). This bill would allow an individual owner to
record a document during his lifetime that would effectively transfer the ownership interest upon death. In
its current state, the bill would NOT provide for “Death Deeds” for property held in joint tenancy, community
property or in a trust. There have been three previous attempts to pass this type of bill since 2007. The
judges, of course, oppose the bill as does the title industry, but this time they are not fighting it. CLTA is
attempting to improve the language. There are 20 states that have provisions for a type of Transfer on Death
instrument.
AB 661: This bill will clarify and add uniformity throughout the State regarding the recording of fraudulent
documents. Ultimately it would add a $10.00 recording fee to even the playing fields between the counties.
For example, Contra Costa charges $3.00 currently, while Alameda County charges $10.00. The documents
affected are all that do not have ability to transfer ownership…i.e. Deed of Trust.
AB 679: Simply put this bill would require that the number of pages being recorded will be noted on the
request for recording page of the document.
AB 704: CLTA has sponsored a bill that addresses requirements for underwritten title companies that
handle escrows. Among other things, a definition of escrow is provided. The definition seeks to establish
commonality. New requirements are proposed including required audits at the expense of the title company
similar to DBO requirements. It would also eliminate county by county licensing. The DOI currently opposes
as it is presented as it will lose revenue.
AB 1335: This bill proposes adding the $75.00 surcharge to recorded real estate documents to establish a
fund for affording housing. Recordings relating to the sale of residences for owner occupants would be
exempt. The revenue produced by this surcharge would be sent to the Dept. of Housing and Community
Development and would provide money in the fund for supporting affordable housing and other housing
related programs under the “Building Homes and Jobs Act”.

AB 1335 Continued…
This bill is similar to last year’s bill; however, this year will limit the charge to $225.00 per parcel. In addition a
new position would be created within the State Government…a Secretary of Housing to oversee all activities
related to housing in the state.
SB 736: This bill will be of interest to all independently owned DOC companies. The bill, as proposed,
would allow the DBO Commissioner to increase the minimum bond required of an escrow agent member of
EAFC (Escrow Agent’s Fidelity Corporation) by up to 100% of its face value should the commissioner
reasonably believes that there may be danger of liquidation of that escrow agent, and the commissioner
deems it necessary to protect the public. As of 5/19, this bill has been referred to the Appropriation
Suspense.
It has been sent there because the costs could exceed a monetary amount. This bill will be heard by that
committee and may die a quiet death just due to expenses. As of right now there is no date set in the
Appropriations Committee.
For those of you who are members, the most recent edition of CEA Magazine features additional bills of
interest which you may wish to follow. We shall keep you apprised of anything that may need action. In the
world of change, being passive is not an option. As a group of escrow professionals, it is in your best interest
to speak up. Let your voice be heard, or you will be stuck with the results of decisions made by people who
may not be familiar with our industry.
Governance Committee
In the April session, the time in committee was devoted to the organization of how the committee could
effectively update the Manual of Policies and Procedures that offer guidance to CEA. The manual was divided
into 5 committees. Sections and pages were assigned.
It was decided to make policy and procedural manual generic. Remove time sensitive entries and delete spe-
cifics. It was further suggested that the manual be compared to the strategic plan to discover any conflicts.

Membership:
At CEA’s Membership Committee Meeting the keys to membership were highlighted,
which included Ownership, Involvement and Value. We discussed how to reach out to the
new member, the non-renewals and better ways to retain membership at the end of the
year. We had an open conversation about what’s working and what is not. Overall CEA is
happy with the steady increase in membership. A few years ago we were losing members
but then in 2013 directors decided to make it a top priority just to maintain members.
Then, as the years progress, to focus on growth. We are pleased to report that thru March
in 2013 membership was at 918. In 2014, membership grew to 944. And in 2015,
membership was at 952, and counting since all applicants were not yet processed at the
time on the report.
Tip of the Month has been changed from the not-so-popular, “Did You Know? Do you
Care?” to the more catchy, “News You Can Use”.
Leadership:
Presidents were reminded to review their regional Bylaws, corporate filing status and to
set and have their Budgets approved by their boards of directors if they have not done so
already.
Presidents decided on what they will do for the President’s Walk at the upcoming CEA
Conference, which will include surprise guests from the past.

EXECUTIVE BOARD - Kathy Lozano, President: Here are some of the things that have come out of Executive Board that is of concern to the members: The Charles P Conner Education Perpetual Award WILL NOT be offered this year as it is being re-vamped.
Unfortunately, only EASGV submitted the award every year, so therefore, we always won. They will be re-assessing the guidelines.
There will be a CEA/EIC Joint Educational Meeting to be held on June 27th. More information to follow from the
Education committee. Scott Hunt, “Mr. Pep”, is seriously ill and we wish him all the best. Directors signed a card for him and many of
the regionals are doing the same. The CEA website is being re-designed and it will probably be going “soft” in November. Lena Signor, Past President, has resigned from the slate of AEA, removing her name from consideration as the
2015-2016 Treasurer. Directors voted for CEA delegates to AEA for the next year and they will be Donna Inman (EASGV) as Director
and Sammy Simpson (Orange County) as Alternate Director. NATIONAL AFFAIRS - Alma Rushing, Portfolio Chair, Sharon Strahlendorf, Committee Chair: CEA is tasked with doing the registration at the Conference in Albuquerque, NM this year so most of the
discussions centered on what was planned and asking for all regional delegates to get there early to help. Alma passed out raffle tickets to all Presidents of all regionals to sell at the regional level so that CEA can make
some money to support sending our CEA delegates to AEA. Each regional got 25 raffle tickets, to be sold at $5.00 each. There will be 4 drawings of $250.00 – 2 at AEA Conference and 2 at CEA Conference. Winners need not be present.
Regionals are requested not to forget to make their cash donation to AEA. Send them as soon as possible to
CEA and let Sharon know. “Bottle silent auction” - Each state to submit one (or more) mystery bottles filled with stuff with designated
price of $1 - $25 and $25 - $50. These bottles will be covered and auctioned off as a money making idea. If regionals want to participate and make such a bottle, they are welcome to do so. Let your regional AEA delegate and Sharon know and take it when you go to the Convention.

The committee members and the regional members from California are tasked to sign up and participate in one or more of their various committees. This will give each first hand knowledge on how these meetings are conducted and what is needed.
As Lena has resigned from the slate, there will not be any California members on the slate this year, UNLESS someone is willing to be nominated from the floor during the convention. We are all tasked to ask our regional delegates if they would consider this. Any AEA member in good standing can be nominated from the floor. If there is a member who might want to do so, it would be a good thing to let Sharon and Alma and AEA know in advance.
PROFESSIONAL DESIGNATION COMMITTEE – Juliana Tu, Portfolio Chair, Teresa Shaver, Committee Chair: Working on correcting the CET Test by May 31 Working on putting the CEO and CSEO test on the 11/2014 CAR contract by May 31
Working on finalizing the mobilehome test by May 31 Teresa will start the Mentor Program in which the test applicants can be assigned to a “Mentor” who will help
them with information on the test and what is involved. The Mentors are to be drawn first from committee members, and can be any CSEO in the membership.
The go-ahead was given to start the Commercial Escrow Officer designation. An ad-hoc committee was put
together to get this started. Another ad-hoc committee was put together to review the old tests taken by participants to see which
existing test questions are missed consistently, so that this question may be reviewed for content, accuracy and relevancy.
BILL REVIEW – Diane Boudreaux-Tschetter, Portfolio Chair, Claire Bartos, Committee Chair 2300 bills were introduced, CEA is watching about 110 bills All the committee members were given a list of bills to watch throughout the year. Judy Arrington will do her in-depth review of what happened in the committee so I won’t take up time and
space here! ESCROW PRACTICES – Diane Boudreaux-Tschetter, Portfolio Chair, Teri Olberg, Committee Chair A representative from HomeWise.com came to talk about the changes to the David Stirling Act about HOA
disclosures that must be given at a transaction. There were many questions and an ad-hoc committee was formed to liaison with them to get our question answered.

The Escrow Associates of San Gabriel Valley ended last year with 136 members. The year is just about half
way over and already we have 136 members. With a pledge of a 5% increase, that means we only need 7
more members to reach our goal. But with your help, we think we can do better than that. In fact, if you
have an escrow assistant and they’ve never been a member, we will even pay for ½ their membership
through our Pay-it-Forward program (see attached flyer). And if anyone would like to check us out before
they become a member, please invite them to attend our next Monthly Dinner Meeting at member price
(offered to first time attendees). With your help we can easily surpass our goal!

Two House Financial Services Committee members introduced a bipartisan bill last
Additionally, Reps. Blaine Luetkemeyer and Randy Neugebauer sent a letter to the CFPB asking for a hold harmless period of restrained enforcement and liability through the end of 2015. In March, ALTA joined 15 other groups encouraging the CFPB to implement restrained enforcement and liability period through the end of the year. The need for a hold-harmless period will be one of the issues that will be addressed with members of Congress during ALTA’s Federal Conference and Lobby Day.
“While the bureau provided 21 months to rewrite business processes, upgrade software and train staff to comply with the 1,888-page regulation,” said Michelle Korsmo, ALTA’s chief executive officer. “Unfortunately, our members are not able to test the processes to develop these new disclosures in real-life transactions before the implementation date. We know from implementing past regulations that unforeseen issues will arise in actual transactions. Therefore, a formal hold-harmless period through December 31 will allow our members to make a good-faith effort to comply with the TRID regulation without the fear of potential enforcement actions or lawsuits.”
A hold-harmless period allows the Bureau to work with industry to gather data about implementation and provide written guidance to address common industry implementation hurdles that emerge between now and the end of the year. Without more clarity, the result is likely to leave homebuyers with less flexibility to obtain the deal they bargained for and potentially fewer companies to work with, particularly in communities where real estate transactions are less frequent.

Insurance Task Force have nearly completed two long-standing tasks: a guideline for a title insurance guaranty fund
statue and a title insurance consumer shopping tool. Both are expected to be submitted to the task force for
approval in March. The regulators also heard a presentation form ALTA about the NAIC. Current ALTA president,
Diane Evans, explained how the CFPB’s rules will require incorrect disclosure of the cost of title insurance in
approximately half of the states. Not only will this violate state law in some jurisdictions, but it completely
contradicts the CFPB’s announce goals of transparency and making real estate settlements less complicated.
Another issue is the designation of owners’ title insurance as “optional” on CFPB disclosures. The optional tag will
likely dissuade many new homeowners from buying title insurance to protect their investment. It is hoped that the
NAIC will communicate with the CFPB in an efforts to protect consumers on both of these issues.
