Dodoma. Plans are underway to table a Bill in Parliament that will regulate landlords and bar them from setting

unilateral rental charges.The Bill will also seek to prohibit house owners from demanding annual house rent paymentsResponding to a question from Catherine Magige (Special Seats-CCM), deputy minister for Lands Housing and Human Settlement Development, Mr George Simbachawene, said the government was currently preparing a policy on housing and human settlement after which the Bill would be drafted and tabled in Parliament.“This Bill will lead a law that will also help the government to earn revenue from owners

of houses at the same time help to ease the burden on our people,’’ he said.Ms Cecilia Pareso (Special Seats-Chadema) asked Mr Simbachawene to give commitment as to when the Bill would be tabled, reminding him of a private motion that was tabled by Bumbuli MP January Makamba in 2012 before he was appointed minister.for Communications Science, Technology.In February 2012, Mr Makamba tabled a private motion on the Rental Housing Bill, saying that the housing sector, just like any other sector in the country, should have a regulatory body. “There are very many aspects which touch the direct lives of people,’’ he said adding that

that there was a need for the government to create a regulatory body which would help govern landlords.“There is a need to ensure that there is a special law that will put in place the means in which our people should pay house rent in a way that will not create a burden,’’ said Mr Simbachawene.The deputy minister further asked landlords to refrain from compelling their tenants to pay annual rent or more this time when the government is preparing a new law.

Q: Hi! My name is Juma, I entered into a lease agreement with my landlady but after staying there for a month I don’t want to stay there any longer because the landlady makes my stay a living hell. Can you please advise on the way what I should do?I have already paid rent for a whole year.

A: Hello Juma! We are very sorry for the troubles you been experiencing with your land lady. Well you did not tell us the kind of a contract it was and whether your lease was periodic for that would have helped us in responding to your question properly. As a lessee you have the right to exclusively enjoyment over the leased property. Section 88(1) (a) of the Land Act gives you the right to enjoy the property. Moreover, if the lease is for a period of more than five years and it has been registered, the law under section 56 of Land Registration act CAP 334 binds the landlord to give you a peaceably and quiet possession and enjoyment of the land without any lawful interruption .The land lady is in breach of the implied covenants for lease, but you should make a complain and explain this first to your landlady. Try to find the best way possible to solve this by even trying out with the home owners association. The other option that you have that you have is to terminate the agreement with your land lady but to do so you will need to give her notice as stipulated in your agreement.

Q: Hello! I own a lot of properties in Mwanza and Dodoma. Recently most of my close friends have passed away and that has alerted me, I think I should have a will. Do I need a lawyer to write a will for me? James.

A:James Hi! First of all we are sorry for your loss; Our Lord gives and takes at his own pace of time. Well, it is important for you to have a will, as this will help you to properly administer and protect your estate when you are no more. A will also helps to minimize the time required for the administration of the estate once you are gone to the next world. In the absence of a will, your wishes may not be delivered as how you would have wanted your beneficiaries may not get full enjoyment of your estate. Some 60% of Tanzanians die without a valid will. The country laws then take over and will distribute your probate estate in accordance to a prescribed formula that may not match your wishes. If you know the rules underlying the making of a Will, you can make it by yourself. We have two types of a will namely; oral will and written will. Wills need

A:Hello Jameet! Well it depends upon the nature of the job, and the probable cause of death. As it is stipulated in the main contractor agreement for example the one involving road

to be witnessed with people who will approve that you are the one who wrote the will. An oral will is made in the presence of not less than four witnesses, two of which must be your relatives (a testator). If the witness dies before the testator then you may revoke or alter the will section 62 of the Indian Succession Act gives you the permission to revoke or alter the will. A written will is done by a literate testator in the presence of two witnesses one of whom must be a relative. A will must be written and signed or thumb stamp by the testator. However, a will is a very important legal document, and it’s wise to employ the expertise of a qualified attorney.

Q: habari! I would like to know. How can I sell my home with a mortgage?

A:Habari Nzuri! Tunatumaini u-mzima. Well coming to your question, selling a house with a mortgage is almost impossible. The position is that, unless the mortgagee consents to the sale, there cannot be any sale, bearing in mind that he is holding the original certificate of title. All mortgages on a house must be paid before a seller can give a buyer clear title.

construction they state that any contracting company hiring subcontractors must comply with all safety regulations pertaining to the type of work performed. Hence, if the subcontractor does not adhere to the health and safety rules of which is also demanded by all contractors in Tanzania, and then the liability falls onto him. However, to be on the safe side, a contractor needs to make sure that the workers of a subcontractor are properly trained and that the working conditions are safe. Both contractor and subcontractor have a duty to adhere to healthy and safety rules but the contractor carries the ultimate responsibility. A subcontractor’s employee is not employed by the contractor. in order to establish employment relationship there are three categories provided by Section 14 of the employment and labor relation act of 2004 these are; employees for an unspecified period of time, for a period of time this applies for professionals and managerial cadre and for specific task. A contractor can protect themselves against any legal implication by having a clause in the contract that has the subcontractor indemnify the contractor against any claim that may arise in connection with the contract.

Q: I am about to sign a contract for the biggest project of my life, I am afraid of the things that I might not be aware of “hidden ones” in the contract. We had agreed to draft it together with the developer but I am in doubt of terms he might propose, that is as to if they will protect me as well. James, Dar es salaam.

A: Well Sir what we can tell you is that, when in doubt, be as specific as you can. Conflicts involving purchase agreements are rare, but they do arise usually because some term has been left incomplete or vague. Problems often arise from user laziness: People don’t want to pin themselves or the other party down. Developer’s contracts are designed to give the builder all the advantages. Buyers who are not represented by a lawyer often sign them without being aware of the hidden land mines. For example in the contracts there are vague phrases that allow the builder to “modify” for example your floor plan, making it “similar” to the plans you agreed upon or to “vary only slightly”; substitution clauses that allow the builder to replace certain components of your home with “similar or better quality” items. In all of such instances you’ll want language in the contract that gives you and not the developer the right to make those decisions. You may also want to insert some precautionary language such as “If seller does not presently hold title, this contract may be rescinded by the purchaser.”We always advise developers, buyers, sellers and their representatives to always also avoid using a “one-size-fits-all” approach to contracts and set out to create agreements that reflect the risk they’re willing to assume in each transaction. In short, no matter how reputable the developer or builder, you will be well advised to request a contract for your attorney’s review long before you sign it. If the builder won’t agree to this, then its best for you to just walk away from the deal.

Q: Hello ABC Attorneys. Well my question is simple? Do people really need to hire a Real Estate Lawyer? It seems to me that almost everything is basic and most contracts are the same and simple. Mostly the contract only need to have the parties, the money to be paid and how it is to be paid, it’s that simple. Joyce, Dodoma.

A: Well I imagine you and many other people think the same. We have had clients who come in with their contracts and that is after that have had a misunderstanding. When you sit

and read the contract you come to find out that there are a lot of discrepancies in them. Whether you are buying, selling, or dealing with some other real estate transaction, a real estate lawyer can help you. There are many people involved at various stages in real estate transactions or disputes. Any one of them can make a mistake, potentially costing you a lot of time and money, and potentially your property. For example, if you are purchasing a home that has problems with the title to the property, you will likely have to take some legal action to remedy the situation. To avoid bias opinions, you should NOT rely on legal or real estate advice from the seller or one of the agents of the property. A seller or an agent makes money when the property is sold; your best interest may not be in their best interest. It is important to have a real estate attorney, who is only looking out for your concerns, review all real estate documents for accuracy and for your protection. Real estate law can be a complicated and time-consuming experience; a real estate lawyer will be able to help you navigate through real estate laws. So Joyce, do please hire a real estate attorney.

You aren’t concerned about the macroeconomic environment and how it affects the housing market, and you

don’t care about the happenings of Europe. You just want to sell your home and maximize your chances of selling quickly for close to your asking price. The problem may have nothing to do with the economy, but instead with what you’re doing, or not doing, to catch the eye of potential buyers. Are you making any of these mistakes?

No PicturesThe best thing you can do for your listing is to include pictures, a lot of pictures. It’s OK to post too many pictures, providing they show off your home in a way that will catch a buyer’s eye. If you have a higher-quality phone, that will work fi ne. If you don’t, ask somebody for help. Look at other people’s listings and see what kinds of pictures catch your eye and take similar pictures for your home. Take a

lot of pictures, but place the best shots at the beginning of the picture album on the listing site.

No Curb AppealIf you’re like many potential buyers, you scour the Internet for listings that fi t your criteria and then get in your car and drive by the home. If it looks nice from the outside, you schedule a showing. Your beautifully remodeled kitchen

will only ever be seen in a picture if your home doesn’t have curb appeal. Trim the trees, fertilize the lawn, replace aging exterior lights and put some work into the landscaping. You have to impress them with the outside before they can fall in love with the inside.

Bad TextThe text that goes with your listing is vitally important, and a little bit of creativity is appropriate. Like any type of writing, stay away from cliché and outlandish claims. How do you know that your home is “the best home on the market.” Is your home really “the perfect home for your family” if you’ve never met the reader? You can confi dently say that the neighborhood is well-suited for young children, you’ve remodeled the kitchen and bathrooms, and the home has quick access to two major highways. Your text space is limited so make it count.

Price Too LowEverybody knows that pricing a home too high won’t produce an offer, but what about pricing too low? Once you price it, it’s diffi cult to raise it back up because it may attract a stream of bargain hunters that are unqualifi ed buyers. One unqualifi ed buyer could take your home off the market for weeks or longer. Unqualifi ed buyers can result in it taking longer to sell your home than if you priced it at market price.

You’re Home for the ShowingThere’s nothing more awkward than walking into somebody’s home with your agent only to fi nd the homeowner is still there. You can’t speak openly to your agent and, most important, when the owners are there with their dog and children you can’t picture the home as your own. When a showing is scheduled, clean your house and take the family out to lunch. If you come back and you see the car in the driveway, run some errands. Don’t let the potential buyer see you until the closing.

The Bottom LineYou can’t control the economy, the housing market or the quality of your neighbors, but there are parts of the listing you can control. For a home to sell in a challenged housing market, make your home look as polished as possible and don’t make the above mistakes.

SYNDICATION a method of selling property whereby a sponsor (or

syndication) sells interests to investor. May take the form of a PARTNERSHIP,

LIMITED PARTNESHIP, TENANCY IN COMMON, CORPORATION, LLC, LLP,

OR SUBCHAPTER S CORPORATION.

Example: Syndication was formed where by limited partnership interests

were sold to investors. The partnership bought land with the equity raised.

TAKE OUT FINANCING a commitment to provide permanent fi nance

following construction of a planned project. The takeout commitment

is generally predicated upon specifi c conditions, such as a certain

percentage of unit sales or lease, for the permanent loan to takeout the

construction loan. Most construction lenders require takeout fi nancing.

Example: Young, a developer, applied for a construction loan on a small

offi ce building. The construction lender requires Young to obtain takeout

fi nancing in the form of a commitment from a permanent lender. The

takeout loan will be granted following construction and leasing of least

65% of NET RENTABLE AREA to creditworthy tenants.

MORTGAGE IN POSSESSION situation in which a lender takes possession

and control of a mortgage property upon foreclosure of the loan secured

by the mortgage. The lender possesses the property, collecting any income

product, until it is sold at the foreclosure sale.

Example: Following nonpayment of debt service for a period of 6

months, saving Bank fi eld for foreclosure of the loan. Fearing damages

to the property, saving immediately took possession under an action of

mortgage in possession
