Officer’s recommended order as the Board’s final order in the above case.

Mr. DeMattos submitted exceptions to the Hearings Officer’s

Recommended Order within the deadline of 15 days from receipt of the order, but he sent it to RICO instead of the Hearings Office, so the exceptions were not considered by the Board at the February 24, 2012 meeting.

The Board reviewed his exceptions and his request for

reconsideration.

and unanimously carried to reaffirm the Board’s Final Order of February 24, 2012, therefore denying Mr. DeMattos’ request for reconsideration.

Following the Board’s review, deliberation and decisions in these matters,

pursuant to HRS chapter 91, Chairperson Arita announced that the Board was reconvening to its open meeting at 8:43 a.m.

Petition for Declaratory Relief: a. In the Matter of the Petition of Access Lifts of Hawaii for Declaratory

Relief Access Lifts of Hawaii (“Access Lifts”) filed a Petition for Declaratory Relief

(“Petition”). After brief discussion, it appeared that Access Lifts was requesting the Board’s interpretation of the Americans with Disabilities Act and other federal guidelines and requirements that are outside of the Board’s jurisdiction.

It was moved by Mr. Dill, seconded by Mr. Sadowski, and unanimously carried

to defer acting on the Petition pending Access Lift’s clarification on the specific Board statute or rule applicable to their request.

unanimously carried to deny Mr. Mokkapati’s application for licensure in the “A”, “B”, C-13, C-15b, and C-63 classifications due to lack of experience.

Recess: Chairperson Arita called for a short recess at 10:14 a.m. The Board reconvened at 10:22 a.m. Committee Reports: 1. Examination Committee: Guy Akasaki, Chairperson The Examination Summary for March 2012 was distributed in the Board’s

packet.

3. Legislation Committee: Denny Sadowski, Chairperson

Mr. Sadowski reported on the following bills: S.B. No. 2412 – This bill initially created new sections in Chapter 444

relating to performance bond and retainage on all projects, and amended Chapters 103 and 507 (procurement and mechanic liens). The latest version, S.B. No. 2412, S.D.2, H.D.2, only amends section 444-25, and requires contractors to pay their subs within 10 (instead of 60) days after receipt of invoice and receipt of payment for the work by the owner. This bill will probably be scheduled for conference between the Senate and House to work out differences.

H.B. No. 1295 – This is the task force bill that places unlicensed

contractor activity within the penal code. This bill will probably be scheduled for conference between the Senate and House to work out differences of the H.D.3 and S.D.2.

contract value. H.B. No. 1898/S.B. No. 236 – Changes the composition of the Board

to six contractors, four non-contractors, and three “exclusive representatives of collective bargaining units”.

H.B. No. 2748 – Licenses AC pipefitters, fire sprinkler technicians, and

solar technicians under the Board of Electricians and Plumbers. 4. Rules Committee:

Engineering and “B” General Building contractor, it can perform window removal and replacement. It is part of the King Kekaulike High School renovation project on Maui (DAGS Job No. 15-14-7456, Hardening of Hurricane Shelters) which includes selective demolition, masonry, structural steel, carpentry, flashing and sheet metal, steel doors and frames, wood doors, steel windows, skylights, painting, protective metal screens, hurricane tie-downs, and miscellaneous related work.

Window work involves removal and replacement of prefabricated metal

windows, and no glazing or glass cutting is necessary. Recommendation: The window work may be performed under F&H’s C-5

Cabinet, millwork, and carpentry remodeling and repairs classification. After discussion, it was moved by Mr. Sadowski, seconded by Mr. Alcantara,

and unanimously carried to approve the above scope recommendation. The agenda was taken out of order and continued with “Applications

Committee” report.

At 10:34 a.m., it was moved by Mr. Kamai, seconded by Mr. Suehiro, and

unanimously carried to move out of executive session and to reconvene to the Board’s regular order of business.

After discussion, it was moved by Mr. Arita, seconded by Mr. Suehiro, and

unanimously carried to deny Mr. Nelson’s request for a conditional license and deferred his application pending verification of payment or payment arrangements of the accounts in question.
