The agenda was taken out of order and continued with “Chapter 91, HRS, Adjudicatory Matters”.

Chapter 91, HRS, Adjudicatory Matters: Vice Chairperson Polischeck called for a recess from the Board’s meeting at

8:36 a.m. to discuss and deliberate on the following adjudicatory matters pursuant to HRS chapter 91.

1. Settlement Agreements

a. In the Matter of the Contractor’s License of Daniel F. Gates,

doing business as Clean Construction; CLB 2012-390-L

Daniel F. Gates (“Respondent”) is licensed in the “B” General Building classification and RICO alleges that he failed to include requisite homeowner contract provisions, including but not limited to, bond and lien rights. Respondent does not admit to violating any law or rule, but agrees to pay a fine in the amount of $1,000.00. After brief discussion, it was moved by Mr. Kamai, seconded by Mr. Matsuzaki, and unanimously carried to approve the above Settlement Agreement Prior to Filing of Petition for Disciplinary Action and Board’s Final Order. b. In the Matter of the Contractors Licenses of I C E Builders Inc.,

and Robert A. Moore; CLB 2014-75-L

RICO alleges that I C E Builders Inc. and Robert A. Moore (“Respondents”) may have violated Hawaii law by failing to have a responsible managing employee in residence in the State while the large Waikiki store project was under construction. The project was primarily managed by Respondent Moore from the mainland, through onsite managers, by telephone and e-mail. Respondents dispute any violation of the RME requirements and do not admit to violating any law or rule, but agree to pay, jointly and severally, a fine in the amount of $25,000.00. After discussion, it was moved by Mr. Kamai, seconded by Mr. Kagawa, and unanimously carried to approve the above Settlement Agreement Prior to Filing of Petition for Disciplinary Action and Board’s Final Order. c. In the Matter of the Contractors Licenses of Rons Construction

Corp. and Ronald K. Oshiro; CLB 2014-275-L

RICO alleges that Rons Construction Corp. and Ronald K. Oshiro (“Respondents”) utilized unlicensed persons for plumbing work at the construction site for the new Walgreens store in Honolulu.

After discussion, it was moved by Mr. Kamai, seconded by Mr. Kagawa, and unanimously carried to approve the above Settlement Agreement Prior to Filing of Petition for Disciplinary Action and Board’s Final Order.

Following the Board’s review, deliberation and decisions in these matters, pursuant to HRS chapter 91, Vice Chairperson Polischeck announced that the Board was reconvening to its open meeting at 8:40 a.m.

At 8:54 a.m., it was moved by Mr. Matsuzaki, seconded by Mr. Kamai, and

unanimously carried to move out of executive session and to reconvene to the Board’s regular order of business.

After discussion, it was moved by Mr. Matsuzaki, seconded by Mr. Kamai, and

unanimously carried to defer Mr. Neill’s application for licensure in the C-13 classification pending the submittal of a project list verifying four years of supervisory experience and verification of payment of credit report matter.

RICO alleges that Superior Electrical Mechanical & Plumbing Inc., and Henry W. Schobel, III (“Respondents”) failed to meet the 1:1 ratio for licensed journey worker electricians and non-licensed helpers; that their licensed electricians failed to display their journey worker electrician licenses on their persons; and that the Responsible Managing Employee was not in residence in Hawaii for approximately 10 to12 days during the project.

Respondents voluntarily cooperated with the investigation into this case and

Respondent Schobel had a family emergency during the project period. Respondents do not admit to violating any law or rule, but agree to pay a fine in

the amount of $12,000.00.

After discussion, it was moved by Mr. Matsuzaki, seconded by Mr. Takamine, and unanimously carried to approve the above Settlement Agreement Prior to Filing of Petition for Disciplinary Action and Board’s Final Order.

Following the Board’s review, deliberation and decisions in these matters,

unanimously carried to enter into executive session pursuant to HRS section 92-5(a)(1) to consider and evaluate personal information relating to individuals applying for professional or vocational licenses cited in HRS section 26-9, and to consult with Rodney J. Tam, deputy attorney general, on questions and issues pertaining to the Board’s powers, duties, privileges, immunities, and liabilities pursuant to HRS section 92-5(a)(4).

Mr. Matsuzaki left the meeting at 10:55 a.m. Recess: Vice Chairperson Polischeck called for a short recess at 10:56 a.m. The Board reconvened at 11:04 a.m. Committee Reports: 1. Examination Committee: Aldon Mochida, Chairperson None.

2. Recovery/Education Fund Committee:

DAG Tam informed the Board that with the passing of Mr. Lee, the Attorney General’s office will need to go through the procurement process to obtain a new Recovery Fund attorney. 3. Legislation Committee: Peter H. M. Lee, Chairperson Mr. Kamai reported that House Resolution No. 54, Senate Resolution No. 102, and Senate Concurrent Resolution No. 166 requesting the auditor’s office to conduct a feasibility study for the creation of a structural licensing board were introduced on March 13, 2015.

Executive Officer Ito stated that it appeared that the structural licensing board would be similar to the Board of Electricians and Plumbers, however it would also issue contractors’ licenses for C-38 Post tensioning, C-41 Reinforcing steel, C-48 Structural steel, and C-56 Welding classifications. The intent of these resolutions is unclear. Arnold Wong of the Ironworkers Stabilization Fund Local Union 625 stated that they are asking for a study on the licensure of trade people. For example, people who work under an engineer may need to be licensed. Presently, for the welding classification, there is no state wide welding certification that is required. The Board believes that the resolutions contain inaccurate statements such as the Contractors License Board is not set up to specifically address the specialized licensing needs and concerns that involve structural steel and that the Board members are not well versed in the requirements to install and erect structural steel. The Board believes that it has the expertise to evaluate the experience of applicants in the structural steel classification and has been licensing contractors in the C-38 Post tensioning, C-41 Reinforcing steel, C-48 Structural steel, and C-56 Welding classifications for decades. Mr. Wong agreed with the Board. DAG Tam related that the resolution asks the auditor to suggest amendments to the practice of issuing C-38 Post tensioning, C-41 Reinforcing steel, C-48 Structural steel, and C-56 Welding license classifications. The Board opposes creating different licensing requirements for contractor licenses. All contractor license requirements should be the same. The Board already has jurisdiction over these classifications and the does not want them transferred to a structural board because it will be confusing to have two boards issuing contractors’ licenses. Mr. Wong related that licensure was meant to be for the individual trade people, not the licensing of contractors. Mr. Wong related that House Resolution 54 may be heard next week, and HCR 91 will be gutted and replaced with a request for the auditor’s office to conduct a feasibility study for the creation of a structural licensing board. It was noted that all other bills are no longer eligible to become a law this session:

S.B. No. 164 – Prohibits general engineering contractors and general building contractors from performing incidental or supplemental work. Requires general engineering contractors and general building contractors to engage an appropriate specialty contractor to perform incidental work. Defines incidental work.

S.B. No. 548 - Requires a general building contractor on construction projects involving more than four, rather than two, unrelated building trades or crafts. Allows a specialty contractor to take and execute a construction contract involving two or more crafts or trades without

requiring the performance of the work to be incidental and supplemental.

S.B. No. 838 - Allows the board to accept in lieu of a specific experience requirement for licensure, equivalent knowledge, training, or experience, including self-employed or unlicensed experience, if the board investigates and makes a detailed written finding available for public inspection.

S.B. No. 839 - Prohibits a general engineering and general building contractor from doing any work that requires it to act as a specialty contractor in an area the general contractor is not licensed to operate.

4. Rules Committee: Tyrus Kagawa, Chairperson Mr. Kagawa noted that the Board received PAMCA’s responses to GCA’s concerns over their proposed “incidental and supplemental” language changes, which the Board will take under advisement. The Board also received amendments to the C-55 Waterproofing classification from Tim Lyons of the Roofing Contractors Association of Hawaii, which the Board will also take under advisement. Mr. Wong asked if the Board received the amendments to the C-41 Reinforcing steel classification and information on the new glass fiber reinforced polymer rebar. Executive Officer Ito responded that she did not receive it and asked Mr. Wong to resend it to the Board. 5. Investigation Committee: Kent Matsuzaki, Chairperson None. 6. Scope of Activity Committee: Nathan T. Konishi, Chairperson Michael Dutton – Mr. Dutton asked if it would be permissible for a C-13 Electrical licensed entity to install a non-utility scale solar PV array rated at 1,000 volts DC, given that the installation would be classified as premises wiring and fall under the jurisdiction of the local electrical authority and the NEC? After discussion, the Board deferred Mr. Dutton’s inquiry and intends to take the matter up again at its April 24, 2015 meeting.

Whitewater West Ind. Ltd. – Whitewater West Ind. Ltd. (“Whitewater”) is requesting an exemption from HRS chapter 444 to perform refurbishment and resurface coating of water slides. The contract is for the servicing and maintenance of existing proprietary equipment manufactured, supplied and originally installed by a locally trained contractor under strict supervision and quality control by Whitewater. Mr. Masatsugu stated that he could not tell from the agenda why Whitewater was seeking the exemption. Executive Officer Ito explained that Whitewater was requesting the exemption in reference to HRS chapter 444-2(9), where it is determined by the board that less than ten persons are qualified to perform the work in question and that the work does not pose a potential danger to public health, safety, and welfare. Recommendation: The exemption in HRS section 444-2(9) does not apply to this inquiry. A contractor’s license is not required for the repair and maintenance of the water slides in question as the work involved is not new construction, and involves servicing and maintenance of existing proprietary equipment manufactured, supplied, and originally installed by a locally trained contractor under strict supervision and quality control by Whitewater West Ind., Ltd.

Jennifer Whitmore – Ms. Whitmore asked if an independent contracts consultant, providing consulting services for Forest City Residential, is required to obtain a contractor’s license. Independent contracts consultant services involves assisting Forest City Residential, LLC in finding reliable licensed contractors to perform quality work in trades (including but not limited to, carpentry, HVAC, and plumbing) for Navy housing located on the Hickam/Pearl Harbor Joint Military base and the Marine Corps Base Hawaii.

Recommendation: Yes, pursuant to HRS section 444-1’s definition of a “contractor” and Hawaii Administrative Rules (“HAR”) section 16-77-4(c), the Board believes that a contractor’s license is required to perform the independent contracts consultant services described. However, if the services are being provided on federal property, it is up to the federal government to determine whether a Hawaii contractor’s license is required. County of Kauai Department of Public Works – This inquiry was deferred at the Board’s February 20, 2015 meeting. Additional information was received on March 12, 2015. The County of Kauai (“County”) is working on a design-build RFP for a chiller replacement project. The work will include C-2 Mechanical insulation, C-13 Electrical, C-15 Electronic systems, C-48 Structural steel, and C-52 Ventilating and air conditioning work. The primary work is in the C-52 Ventilating and air conditioning classification and the balance of the work could be considered incidental to the C-52 work. Is the County correct in recommending that either a “B” General Building or C-52 Ventilating and air conditioning contractor bid on the contract?
