Daryl Correa, Jr., Masons Union Ricky Tamashiro, Masons Union Call to Order: There being a quorum present, Chairperson Lau called the meeting to

order at 8:32 a.m. Agenda: The agenda for this meeting was filed with the Office of the Lieutenant

Governor, as required by Hawaii Revised Statutes (“HRS”) section 92-7(b).

The agenda was taken out of order and continued with “Chapter 91, HRS,

Adjudicatory Matters”. Chapter 91, HRS, Adjudicatory Matters: Chairperson Lau called for a recess from the Board’s meeting at 8:33

a.m. to discuss and deliberate on the following adjudicatory matters pursuant to HRS chapter 91.

1. Settlement Agreements

a. In the Matter of the Contractors Licenses of Volk Pacific

Builders, Inc.; Brian Volk, RME; CLB 2013-215-L; CLB 2013-225-L

RICO received two complaints alleging that Volk Pacific Builders, Inc. and Brian Volk, RME (“Respondents”) exhibited poor workmanship in performing tile installation at two different units at the Kaanapali Shores Drive project resulting in problems with tile cracking. Respondents allege that the problems with tile cracking were caused by the faulty Latricrete membrane and not their workmanship. The Respondents also allege that the contracts included dispute resolution clauses that required the homeowners to pursue their claims for restitution in Small Claims Court or to submit their claims to binding arbitration. RICO also alleges that the Respondents’ contracts did not include the required bond and lien rights disclosures, percentage of work to be performed by subcontractors, or a Contractor Repair Act notice. The Board discussed the settlement agreement in which Respondents do not admit to violating any law or rule, but agree to pay an administrative fine of $5,000.00.

After discussion, it was moved by Mr. Lee, seconded by Mr. Suehiro, and unanimously carried to approve the Settlement Agreement Prior to Filing of Petition for Disciplinary Action and Board’s Final Order in the above case.

Following the Board’s review, deliberation and decisions in these matters, pursuant to HRS chapter 91, Chairperson Lau announced that the Board was reconvening to its open meeting at 8:38 a.m.

Amendments to Agenda: It was moved by Mr. Lee, seconded by Mr. Suehiro, and unanimously

The agenda continued with another item under “Chapter 91, HRS, Adjudicatory Matters”.

Chapter 91, HRS, Adjudicatory Matters: Chairperson Lau called for a recess from the Board’s meeting at 8:39

a.m. to discuss and deliberate on the following adjudicatory matters pursuant to HRS chapter 91.

b. In the Matter of the Contractors Licenses of Town and

Country Electric Maui, Inc., and Mickey A. Mehlmauer; CLB 2013-402-L

At its January 17, 2014 meeting, the Board approved the

Settlement Agreement Prior to Filing of Petition for Disciplinary Action and Board’s Final Order for Town and Country Electric Maui, Inc. and Mickey A. Mehlmauer, CLB 2013-402-L (“Final Order”). The Respondent agreed to the terms of the Final Order which included, among other things, restitution payment in the amount of $3,500.00 to Michael Sullivan with payments of $200.00 per month due at the end of each month; and that failure to comply with the terms of the Settlement Agreement would result in the automatic revocation of Respondents‘ licenses upon the filing of an affidavit by RICO with the Board attesting to such failure.

The Board received an Affidavit of Tammy Y. Kaneshiro, RICO

attorney, on February 27, 2014 notifying the Board that the Respondents failed to comply with the terms of the Settlement Agreement because they did not submit the January 31, 2014

restitution installment of $200.00 and that RICO is filing the affidavit to request the automatic revocation of Respondents’ licenses. RICO also requests that the payment of the outstanding restitution and fines in the total amount of $6,300.00 be made a condition for relicensure.

After discussion, it was moved by Mr. Lee, seconded by

Mr. Kamai, and unanimously carried to allow Mr. Mehlmauer an opportunity to appear before the Board at its April 25, 2014 meeting.

2. Board’s Final Orders

None.

Following the Board’s review, deliberation and decisions in these matters,

pursuant to HRS chapter 91, Chairperson Lau announced that the Board was reconvening to its open meeting at 8:41 a.m.

Executive Session: At 8:42 a.m., it was moved by Mr. Lee, seconded by Mr. Suehiro, and

unanimously carried to enter into executive session to consult with Rodney J. Tam, deputy attorney general, on questions and issues pertaining to the Board’s powers, duties, privileges, immunities, and liabilities pursuant to HRS section 92-5(a)(4).

At 9:00 a.m., it was moved by Mr. Lee, seconded by Mr. Suehiro, and

unanimously carried to move out of executive session and to reconvene to the Board’s regular order of business.

The agenda was taken out of order and continued with approval of the

minutes and appearances before the Board. Minutes: It was moved by Mr. Lee, seconded by Mr. Suehiro, and unanimously

carried to approve the February 21, 2014 meeting and executive session meeting minutes as circulated.

At 9:15 a.m., it was moved by Mr. Suehiro, seconded by Mr. Lee, and

unanimously carried to move out of executive session and to reconvene to the Board’s regular order of business.

After discussion, it was moved by Mr. Lee, seconded by Mr. Polischeck,

and unanimously carried to deny Mr. Lazaro’s application for licensure in the C-37 classification because he did not meet the experience requirement.

d. Ebrahim A. Erieh, RME (Additional classification) Beta Construction LLC C-22 Glazing & tinting Executive Session: At 9:20 a.m., it was moved by Mr. Suehiro, seconded by Mr. Lee, and

unanimously carried to enter into executive session pursuant to HRS section 92-5(a)(1) to consider and evaluate personal information relating to individuals applying for professional or vocational licenses cited in HRS section 26-9, and to consult with Rodney J. Tam, deputy attorney general, on questions and issues pertaining to the Board’s powers, duties, privileges, immunities, and liabilities pursuant to HRS section 92-5(a)(4).

At 9:35 a.m., it was moved by Mr. Suehiro, seconded by Mr. Lee, and

unanimously carried to deny Mr. Erieh’s request for reconsideration of the denial of his application at the Board’s January 17, 2014 meeting.

e. Charles A. Walker, II (Individual) C-13 Electrical Executive Session: At 9:36 a.m., it was moved by Mr. Lee, seconded by Mr. Polischeck, and

unanimously carried to enter into executive session pursuant to HRS section 92-5(a)(1) to consider and evaluate personal information relating to individuals applying for professional or vocational licenses cited in HRS section 26-9, and to consult with Rodney J. Tam, deputy attorney general,

After discussion, it was moved by Mr. Suehiro, seconded by Mr. Lee, and

unanimously carried to defer Mr. Walker’s application for licensure in the C-13 classification pending the submittal of a copy of a certificate verifying that he completed his education at the technical and vocational school.

The agenda was taken out of order and continued with “Committee

Reports, 2. Recovery/Education Fund Committee”. Committee Reports: 2. Recovery/Education Fund Committee: Executive Session: At 10:00 a.m., it was moved by Mr. Kagawa, seconded by Mr. Lee, and

unanimously carried to enter into executive session pursuant to HRS section 92-5(a)(4) to consult with Gary B.K.T. Lee, the Board’s recovery fund attorney, on questions and issues pertaining to the Board’s powers, duties, privileges, immunities, and liabilities.

At 10:03 a.m., it was moved by Mr. Suehiro, seconded by Mr. Kagawa,

and unanimously carried to move out of executive session and to reconvene to the Board’s regular order of business.

The agenda continued with the “Appearances Before the Board”. Executive Officer Tamanaha informed the Board that Mladena Yankova

Kukin of Access Tiles, LLC was present for an appearance but was not on the agenda. Ms. Kukin claimed she did call the Board’s office to tell them that she would like to make an appearance. The Board agreed to see her after the rest of the appearances.

unanimously carried to move out of executive session and to reconvene to the Board’s regular order of business.

After discussion, it was moved by Mr. Mochida, seconded by Mr. Lee, and

unanimously carried to defer Mr. Fainga’s application for licensure in the C-27 and C-31 classifications pending the submittal of revised and additional project lists.

g. Guomeng Chen, RME Sullivan International Group Inc. “A” General Engineering “B” General Building C-5 Cabinet, millwork, & carpentry remodeling & repairs (approve) Executive Session: At 10:20 a.m., it was moved by Mr. Suehiro, seconded by Mr. Kagawa,

and unanimously carried to enter into executive session pursuant to HRS section 92-5(a)(1) to consider and evaluate personal information relating to individuals applying for professional or vocational licenses cited in HRS section 26-9, and to consult with Rodney J. Tam, deputy attorney general, on questions and issues pertaining to the Board’s powers, duties, privileges, immunities, and liabilities pursuant to HRS section 92-5(a)(4).

At 10:40 a.m., it was moved by Mr. Suehiro, seconded by Mr. Lee, and

unanimously carried to move out of executive session and to reconvene to the Board’s regular order of business.

After discussion, it was moved by Mr. Mochida, seconded by

Mr. Polischeck, and unanimously carried to deny Mr. Chen’s application for licensure in the “A” and “B” classifications because he did not meet the experience requirement; and to approve Mr. Chen for the C-5 classification which he accepted.

h. Steven M. Watson, RME Blue Mountain Mechanical Inc. “B” General Building Executive Session: At 10:44 a.m., it was moved by Mr. Suehiro, seconded by Mr. Lee, and

unanimously carried to enter into executive session pursuant to HRS section 92-5(a)(1) to consider and evaluate personal information relating to individuals applying for professional or vocational licenses cited in HRS section 26-9, and to consult with Rodney J. Tam, deputy attorney general,

At 10:49 a.m., it was moved by Mr. Suehiro, seconded by Mr. Kagawa,

and unanimously carried to move out of executive session and to reconvene to the Board’s regular order of business.

After discussion, it was moved by Mr. Lee, seconded by Mr. Suehiro, and

unanimously carried to approve amending Mr. Watson’s application from the “B” to the C-4 Boiler, hot-water heating, and steam fitting, C-20 Fire protection, C-36 Plastering, C-38 Post tensioning, and C-43 Sewer, sewage disposal, drain, and pipe laying classifications, and to defer his application pending verification of his completion of trade school or an associate’s degree for boilers, and separate project lists for the C-20, C-36, C-38, and C-43 classifications.

Mr. Watson asked if he will be allowed to hire subs with the “C”

Tam, deputy attorney general, on questions and issues pertaining to the Board’s powers, duties, privileges, immunities, and liabilities pursuant to HRS section 92-5(a)(4).

At 10:56 a.m., it was moved by Mr. Suehiro, seconded by Mr. Lee, and

unanimously carried to move out of executive session and to reconvene to the Board’s regular order of business.

When asked if he attended an apprenticeship program with the

carpenters union, Mr. Clarke stated that he did but did not complete the program. Mr. Mochida quickly reviewed his list again.

After discussion, it was moved by Mr. Mochida, seconded by Mr. Lee, and

unanimously carried to defer Mr. Clarke’s application for licensure in the “B” classification pending the submittal of revised and additional project lists verifying four years of supervisory experience on the job site doing “ground-up” work.

unanimously carried to enter into executive session pursuant to HRS section 92-5(a)(1) to consider and evaluate personal information relating to individuals applying for professional or vocational licenses cited in HRS section 26-9, and to consult with Rodney J. Tam, deputy attorney general, on questions and issues pertaining to the Board’s powers, duties, privileges, immunities, and liabilities pursuant to HRS section 92-5(a)(4).

At 11:13 a.m., it was moved by Mr. Suehiro, seconded by Mr. Lee, and

unanimously carried to move out of executive session and to reconvene to the Board’s regular order of business.

After discussion, it was moved by Mr. Mochida, seconded by Mr. Lee, and

unanimously carried to deny Mr. Spencer’s application for licensure in the C-37 and C-52 classifications because he did not meet the experience requirement.

Mr. Spencer stated that on the mainland they do the design work and hire

contractors to do the work, but they do the supervising. Mr. Spencer was informed that they could hire a qualified RME to be their

employee, which will then qualify the company for the above licenses. l. Mladena Yankova Kukin, RME Access Tiles LLC C-51 Tile Executive Session: At 11:16 a.m., it was moved by Mr. Lee, seconded by Mr. Suehiro, and

unanimously carried to enter into executive session pursuant to HRS section 92-5(a)(1) to consider and evaluate personal information relating to individuals applying for professional or vocational licenses cited in HRS section 26-9, and to consult with Rodney J. Tam, deputy attorney general, on questions and issues pertaining to the Board’s powers, duties, privileges, immunities, and liabilities pursuant to HRS section 92-5(a)(4).

At 11:30 a.m., it was moved by Mr. Mochida, seconded by Mr. Lee, and

unanimously carried to move out of executive session and to reconvene to the Board’s regular order of business.

After discussion, it was moved by Mr. Lee, seconded by Mr. Kagawa, and

unanimously carried to deny Ms. Kukin’s application for licensure in the C-51 classification because she did not meet the experience requirement.

Recess: Chairperson Lau called for a short recess at 11:31 a.m. The Board reconvened at 11:45 a.m. The agenda was taken out of order and continued with “6. Scope of

Activity Committee”.

6. Scope of Activity Committee: Gerald Yamada, Chairperson

O’Connor Playdon & Guben Kevin Simpkins, Vice President of Certified Construction, Inc., and Kristi

Arakaki, attorney from O’Connor Playdon & Guben, were present. Ms. Arakaki, on behalf of Certified Construction, Inc., requests a determination that the following re-roofing work for a fire maintenance shop and fire dispatch/warehouse project may be performed under a C-42 Roofing or C-44a Gutters contractor license, and that the C-44 Sheet metal contractor license is not required.

The project includes, but is not limited to, the following general items of

work:

Remove and replace pre-engineered steel building and roofing;

Remove and replace purlins and eave struts;

Remove and replace roofing on a wood framed roof structure;

Remove/replace and add gutters and downspouts;

Painting; and

All other related work as shown on the drawings.

All labor materials and equipment necessary to install flashing, counter-flashing, metal edging, splash guard, gutters and downspouts and other related work required for a weather-tight, secure and functioning roof system will be provided. Mr. Simpkins stated that they have done similar projects for the State and federal government with their existing licenses. Chairperson Lau inquired about the purlins. Mr. Simpkims explained that the purlins sit on the framing and hold the metal roofing. If they are rusted or damaged, they are replaced. This is a pre-engineered building with purlins on a steel frame. Ms. Arakaki clarified that their inquiry only pertains to the roofing portion of the project. Neal Arita, Executive Director of the Sheet Metal Contractors Association, provided written testimony as he was not able to appear at today’s meeting. He commented that the metal roofing work can be performed by a C-44 Sheet metal and a C-42 Roofing contractor; the gutter and downspout work can be performed by a C-44 Sheet metal and aC-44a

Gutters contractor; and the metal siding work can be performed by a C-44 Sheet metal contractor only.

Recommendation: A contractor’s license in the following classifications is required:

C-48 Structural steel or C-68MI Prefabricated metal buildings classification is required to remove and replace pre-engineered steel building and roofing; and to remove and replace purlins and eave struts.

C-42 Roofing, C-44 Sheet metal, C-48 Structural steel, or C-68MI Prefabricated metal buildings classification is required to remove and replace roofing on a wood framed roof structure;

C-44 Sheet metal or C-44a Gutters classification is required to remove/replace and add gutters and downspouts;

C-33 Painting and decorating classification is required to paint new purlins;

C-42 Roofing classification is required to install flashing, counter-flashing, metal edging, and splash guard; provided that it is related to the roofing work; and

C-42 Roofing, C-44 Sheet metal, or C-68MI Prefabricated metal building classification is required to install non-motorized prefabricated roof vents.

Hawaiian Telcom Hawaiian Telcom requests a determination on whether a license is required to install a fall protection system on their building. Information provided by Hawaiian Telcom showed the installation of a permanent fall protection system. Recommendation: A C-31 Masonry or C-48 Structural steel contractor’s license is required to install a permanent fall protection system on a building. City and County of Honolulu The City and County of Honolulu (“C&C”) requests a determination on whether the C-68MI Prefabricated metal buildings contractor may install clear span covered structures. The clear span covered structures will be prefabricated by the manufacturer and the Hawaii licensed contractor will perform the site installation work. At the Board’s January 17, 2014 meeting, the C&C had asked for the Board’s determination on this project, and at that time the Board determined that the “B” General Building or C-48 Structural steel license was required. The C&C is now asking whether the C-68MI Prefabricated metal building license is also allowed to do this work.

Arnold Wong of the Ironworkers Local 625 stated that the C-48 Structural steel license is required because it is a steel structure. Recommendation: The “B” General Building, C-48 Structural steel, or a C-68MI Prefabricated metal building contractor’s license is required to install temporary clear span covered structures. Austin Mauch Austin Mauch requests a determination on whether he can build a 700 square foot building that will be used as a certified kitchen as part of an agricultural processing operation under an owner-builder permit. This is not a retail location that will be visited by the public, but the proposed structure is to be used for commercial purposes. It is a small family operation that will make food products to be sold elsewhere. Recommendation: The above project does not qualify for an owner-builder permit as owner-builder permits are limited to residential or farm buildings or structures and does not include buildings or structures that are used for commercial purposes. Gramercy Group Inc. Gramercy Group Inc. requests a determination on whether they can perform developing exploratory digging for human remains with its C-24 Building, moving and wrecking contractor’s license. Developing exploratory digging would involve using small machinery to dig up material. The material that is dug up will be placed in piles and someone will sift through this material for human remains. Recommendation: The “A” General Engineering or C-17 Excavating, grading and trenching contractor’s license is required to perform exploratory digging for human remains. Derek Furukawa Mr. Furukawa requests determination on the license required to perform Enduracrete concrete floor polishing, and to apply Vinylshield, a clear coat for vinyl flooring. This item will be deferred until additional information is received to make a determination. After discussion, it was moved by Mr. Kamai, seconded by Mr. Suehiro, and unanimously carried to approve the above scope recommendations.

in the Board’s agenda packet.

3. Legislation Committee: Peter H. M. Lee, Chairperson Mr. Lee reported on the following bills: HR 63/HCR 88 and SR 42/SCR 89 – These resolutions are encouraging the Board to reconsider its October 18, 2013 Board’s Final Order in the DC 50 case, and follow legislative intent and the Hawaii Supreme Court’s ruling that the “incidental and supplemental” exception for specialty contractors to complete work for which they are unlicensed is very limited in scope. HR 80/HCR 109 – These resolutions are urging the use of Hawaii-based union contractors and workers for state correctional facility construction or renovation projects. Arnold Wong of the Ironworkers Local 625 stated they are supporting the resolutions. These resolutions were heard yesterday and passed. H.B. No. 570 – This bill enhances penalties when an elderly person is targeted (maximum fine increased from $10,000 to $20,000). The Board testified in support. This bill crossed over to the Senate where the Committee on Commerce and Consumer Protection (“CPN”) held a hearing on March 13, 2014 and passed the bill, unamended. S.B. No. 2475 (H.B. No. 2583) – These bills propose to clarify that a licensed contractor who aids and abets an unlicensed contractor may be subject to additional discipline by the Board. The Board testified in support. S.B. No. 2475 crossed over to the House where the Committee on Consumer Protection & Commerce (“CPC”) held a hearing on March 12, 2014. At its decision making on March 19, 2014, CPC passed the bill, unamended. HR 92/HCR 127 and SR 69 – These resolutions are requesting the Governor to issue an Executive Order requiring State agencies, boards, and commissions to post meeting minutes on the website of the agency, board, or commission within 30 days after the meeting.

Mr. Lee stated that the Board opposes HR 63/HCR 88and SR 42/SCR

89. The Board believes that there is confusion and a misunderstanding of the Board’s Final Order (“BFO”) in the DC 50 case as the resolutions inaccurately convey that the Board determined that any work that represents less than 50% of the project would qualify as “incidental and supplemental” work. The cost or percentage is only one factor the Board considers when determining whether work is “incidental and supplemental”

The Board proposes to clarify its October 18, 2013 BFO by explaining its analysis when reviewing inquiries pertaining to “incidental and supplemental” work. When making determinations on whether work is considered “incidental and supplemental”, the Board also considers the “nexus” factor, which is whether the work is subordinate to, directly related to, and necessary for the completion of the work of greater importance that is within the scope of the licensee’s license. Thus, both factors or components have to be satisfied in order for work to be considered “incidental and supplemental”. Cost or percentage alone is not enough.

Chairperson Lau stated that historically, the Board has not considered

49% of the project as the benchmark in determining whether work is “incidental and supplemental”. The key is the “nexus” factor above. In applying the “nexus” factor above, the Board considers the cost, extent of work, number of man hours, amount of materials involved, proximity of the other specialty contracting work to the primary work, life safety, and the plans and specifications, and then determines whether the other specialty contracting work represents less than 50% of the project.

Chairperson Lau asked DAG Tam to further explain the Board’s position.

DAG Tam explained that the Board generally begins its review by looking at the work involved, and determining the primary work of the project. Once that is identified, the Board determines what license is required to act as the prime contractor. Next, the Board reviews the other work to determine if it is subordinate to, directly related to, and necessary for the completion of the work that is within the scope of the prime contractor’s license. If the answer is “yes”, then the Board looks at the cost and percentage of the other specialty contracting work. If the answer is “no”, then the work is not “incidental and supplemental”, and the cost or percentage is irrelevant (no matter how small it is). The Board only looks

at the information presented to them and determinations are made on a case-by-case basis.

Chairperson Lau volunteered to draft a flow chart or summary of the

Board’s process to determine when work is “incidental and supplemental” to help bring clarity to the BFO. The Board could not recall any prior cases that were close to the 49% that is being complained about.

HR 80/HCR 109 are not related to licensing and thus, the Board takes no

position on the resolutions. It was then moved by Mr. Lee, seconded by Mr. Suehiro, and

unanimously carried to approve the Board’s position of the above measures.
