TENDER NOTICE

1. Sealed tenders on behalf of the Prasar Bharati, DoordarshanKendra, Patna are invited under Two Bid System i.e. Technical Bid and .Financial Bid from reputed experienced and financially sound ManpowerAgencies for providing skilled Data Entry Operator's I Peon I Messengerservice/Mali/Safaiwala to Prasar Bharati, India's Public Service Broadcaster,Doordarshan Kendra, Patna including Skilled, Semi-skilled & Unskilledlabours in Doordarshan Kendra, Patna initially for one year from the date oftaking up of supply of manpower in pursuance of contract unless extendedfurther by mutual consent of the Doordarshan Kendra, Patna and serviceprovider, on the same terms and conditions.

The contract will be initially for One year from the date of taking up of supply ofmanpower. The period of the contract may be further extended on the satisfactoryservices rendered by the agency provided the requirement of the DoordarshanKendra, Patna for additional manpower persists at that time, or, may be curtailed 1terminated at any time before the normal tenure owing to deficiency in service orsubstandard quality of manpower deployed by the selected Company 1 Firm 1Agency. The Doordarshan Kendra, Patna however, reserves right to terminate thisinitial contract at any time after giving one-month notice to the selected serviceproviding Agency.

The Doordarshan Kendra, Patna has initial requirement for skilled Data EntryOperators (DEO's) & Peon, Mali, Safaiwala etc. DEO's should be well conversantwith computers & essentially will trained in MS Word, Language also possesknowledge of LAN functioning, MS-Excel, MS Power Point package language,Internet Wave. Knowledge of MS Access, Data base management systems &Networking may be desirable knowledge but not essential. The Peon/MaliSafaiwala should be physically fit & known their respective jobs.

The requirement of the Doordarshan Kendra, Patna may increase of decrease duringthe initial period of contract also.

The interested Agencies may submit the tender document completed in all respectsalong with earnest money deposit (EMD) of Rs. 10,0001- (Rupees Ten thousand)only drawn in favour of DDO, Doordarshan Kendra, Patna also a non refundableprocessing fee 1 tender fee of Rs. 2,5001- (Rupees Two thousand five hundred) onlydrawn in favour of DDO, Doordarshan Kendra, Patna.

The tenders have been invited under two bid system i.e. Technical Bid andFinancial Bid. The interested agencies are advised to submit two separate sealedenvelops super scribing "Technical Bids for providing manpower in DoordarshanKendra, Patna." & "Financial Bids for providing manpower in Doordarshan Kendra,Patna" respectively.

8. The Earnest Money Deposit (EMD) ef Rs 10,0001- (Rupees Ten thousand) onlyrefundable (without interest) should be necessarily accompanied with the Financial Bidof the agency in the form of Demand Draft 1 Pay Order drawn in favour of " D.D.O,Doordarshan Kendra, Patna" and Rs 2,500 (Rupees Two thousand five hundred) onlyas a non-refundable processing fee with other requisite documents in a sealed coveraddressed to Director, Doordarshan Kcndra, Patna, failing which the tender shall berejected summarily. 9. The successful tenderer will have to deposit a Performance Security Deposit ofRs. 50,0001- (Rupees Fifty thousand) in the form of Fixed Deposit Receipt (FOR)Doordarshan Kendra, Patna covering the period of contract. In case, the contract isfurther extended beyond the initial period, the FOR will have to be accordingly renewedby the successful tenderer.

10. The tendering Agencies are required to enclose photocopies of the following documents(duly attested by Group 'A' Gazetted Officers of the Government of India or Class-IOfficer of the State Government) along with the Technical Bid, failing which their bidsshall be summarily lout-rightly rejected and will not be considered any further :-

11. The conditional bids shall not be considered and will be out lightly rejected in very firstinstance.

12. All entries in the tender form should be legible and filled clearly. If the space forfurnishing information is insufficient, a separate sheet duly signed by the authorizedsignatory may be attached. No overwriting or cutting is permitted in the financial BidForm. In such cases, the tender shall be summarily rejected. However, the cutting, if any,in the Technical 1 Financial Bid Application must be initialed by the person authorized tosign the tender bids.

13. Doordarshan Kendra, Patna reserves the right to annual any or all bids without assigningreason.

Notes:

1. The rates quoted by the tendering agency should be inclusive of allstatutory/taxation liabilities at the time of entering into the contract.

2. The payment shall be made by Cheques only on conclusion of the calendarmonth only on the basis of number of working days for which duty has beenpertained by each manpower.

3. DDK, Patna will be liable to make the payment on the basis of consolidatedfee/wages of each employee. No payment over & above the quoted rates as perS.N. 7 shall be made any case. However, the company / firm / agency mayclaim the minimum wages, when increased or decreased by the State Govt.with prior intimation to this Kendra.

TERMS AND CONDITIONS

General

1. The contract shall likely to commence from 01.03.2016 which will be for a period of Oneyear unless it is curtailed or terminated by Doordarshan Kendra, Patna owing todeficiency of services, sub-standard I poor quality of manpower deployed, breach ofcontract, reduction or cessation of manpower requirements etc.

2. The contract may be extended, on the same terms and condition or with some addition Ideletion I modification, for h further specific period mutually agreed upon by the successfulservice providing Company I Finn I Agency and Doordarshan Kendra, Patna.

3. The contracting Agency shall not be allowed to transfer, assign, pledge or sub contract itsrights and liabilities under this contract to any other agency without the prior writtenconsent of this Department.

4. Doordarshan Patna at present requires 10 Nos of DEO's & 10 Nos of Casual Labour(PeonlMali/Safaiwala etc.) on urgent basis. The requirement of Doordarshan Patna mayincrease or decrease the period of initial contract also & tender would have to provideadditional DEO's I Casual Labour (PeonlMali/Safaiwala) if required on he same terms &conditions at any point of period.

5. The tenderer will be bound by the details furnished be him I her to this Department, whilesubmitting the tender or at subsequent stage. In case any of such documents furnished byhim/her is found to' be false at any stage, it would be deemed to be a breech of terms ofContract making him I her liable for legal action besides termination of contract withoutgoing any service to this effect.

6. Doordarshan Kendra, Patna reserves right to terminate the contract during initial period ofcontract with a week notice to the contracting agency or one month notice at any timeduring the period of contract.

7. Apart from' the above specified work, the workers can be utilized byDy. Director (Programme) IHead of Office as per its discretion and requirements for suchwork as shifting of records & furniture's or any other manual work any other related work.

LIABILITIES, CONTROL ETC. OF THE PERSONS DEPL YED

8. The contracting hiring agency shall ensure that the individual manpower deployedwith Doordarshan Kendra, Patna confirm to the technical specifications of age,educational and skill qualification prescribed as per tender.

9. Data Entry Operator / Casual Labour may be called on Saturday or on holidays forwhich no additional salary will be paid a per minimum wages act 1948 but may begiven compensatory off on recommendation of officer with whom DEO/Casual labour(PeonlMali/Safaiwala etc.) is working.

10. Manpower so deployed will work on shift basis.

11. The contracting Agency shall furnish the following documents in respects of theindividual Manpower who will be deployed by it at Doordarshan Kendra, Patna beforethe commencement of work.

12. In case, the person employed by the successful Company / Firm / Agency commitsany act omission/commission that amounts to misconduct / indiscipline /incompetence, the successful Company / Firm / Agency will be liable to takeappropriated disciplinary action against such persons, including their removal fromthe site of work required by Doordarshan Kendra, Patna.

13. The tendering Company / Firm / Agency shall replace immediately any of itspersonal who is found unacceptable to this Doordarshan Kendra, Patna because ofsecurity risks, incompetence, conflict of interest, improper conduct etc. uponreceiving a notice from Doordarshan Kendra, Patna.

14. The agency shall ensure that its workers do not disturb the employees / staff of DDK,Patna or make any sort of noise in the premises or rooms:

15. Any dispute regarding working hours and compensation to be paid to the workersdeployed will be the responsibility of the agency and no representation from theworkers will be entertained on this issue by DDK, Patna.

16. The agency shall strictly abide by all the instructions issued by the Security Wing ofDDK, Patna from time to time.

17. The Dy. Director General/Head of Office, DDK, Patna will be at liberty to set upcommittee (s) of officers to supervise the work.

18. The person deployed shall be required to report for duty as per shift and would notleave office before completion of 7 hours and 20 minutes of duty. In case, persondeployed is absent on a particular day or come late / leaves early on three occasions,one-day wage shall be deducted.

19. The agency shall depute a coordinator who would be responsible for immediateinteraction with Doordarshan Kendar, Patna so that optimal services of the personsdeployed by the agency could be availed without any disruption.

20. The selected agency shall immediately provide a substitute in the event of any personleaving the job due to his / her personal reasons. The delay by the agency inproviding a substitute beyond three working days shall attract a pre-estimated agreedliquidated damages @ Rs. 200/- per day on the service-providing agency.

21. It will be the responsibility of the service providing agencies to meet transportation,food, medical and any other requirements in respect of the persons deployed by it(Agency) in Doordarshan Kendra, Patna will have no liability in this regard.

22. For all intents and purpose the service providing agency shall be the "Employer" withinthe meaning of different Labour Legislations in respect of manpower so employed anddeployed in Doordarshan Kendra, Patna. The persons deployed by the agency inDoordarshan Kendra, Patna shall not have claims of Master and Servant relationship nohave any principal and agent relationship with or against the Doordarshan Kendra,Patna. An undertaking to this office may be obtained from such deployed manpowerbefore his / her deployment in Doordarshan Kendra, Patna. A copy of suchundertaking will be endorsed to Doordarshan Kendra, Patna by the companies / firm /agency at the time of deploying the manpower.

23. The Service providing agency shall be solely responsible for the redressal of grievances/ resolution of disputes relating to person deployed. Doordarshan Kendra, Patna shall,in no way be responsible for settlement of such issues whatsoever.

24. This Doordarshan Kendra, Patna shall not be responsible for any damages, losses,Claims, financial or other injury to any person deployed by service providing agency inthe course of their performing the functions / duties, or for payment towards anycompensation.

25. The person deployed by- the service providing agency shall not have any claim or beentitled to pay, perks and other facilities admissible to casual, ad-hoc, regular /confirmed employees of this Doordarshan Kendra, Patna during the currency or afterexpiry of the contract.

26. In case of termination of this contract on its expiry or otherwise, the persons deployedby the service providing agency shall not be entitled to and will have no claim for anyabsorption nor for absorption nor for any relaxation for absorption in theregular/otherwise capacity in Doordarshan Kendra, Patna. There will be no separatenotice required to be given to any of the persons deployed being the hired persons.

LEGAL

27. The tendering agency will be responsible for compliance of all statutory provisionsrelating to minimum wages, Provident Fund and Employees State Insurance etc. inrespect of the persons deployed by it in Doordarshan Kendra, Patna.

28. The tendering agency shall also liable for depositing all taxes, Cess etc. on account ofservice rendered by it to Doordarshan Kendra, Patna to the concerned tax collectionauthorities from time as per extant rules and regulations on the matter.

29. The tendering agency shall maintain all statutory registers under the applicable law.The agency shall produce the same, on demand, to the concerned authority ofDoordarshan Kendra, Patna or any other authority under law.

30. The Tax Deduction at Source (TDS) shall be deducted as per the provisions of theIncome Tax Department, as amended from time to time and a certificate to this effectshall be provided to the agency by Doordarshan Kendra, Patna.

31. In case, the tendering agency fails to comply with any statutory/taxation liability underappropriate law, and as a result thereof Doordarshan Kendra, Patna is put to anyloss/obligation, minority or otherwise, Doordarshan Kendra, Patna will be entitled toget itself reimbursed out of the outstanding bills or the Performance Security Deposit ofthe agency, to the extent to the loss or obligation in monitory terms.

FINANCIAL

32. The Technical bid should be accompanied with Earnest Money Deposit (EMD),refundable, of Rs.l 0,000/- (Rupees Ten thousand) only in the form of Demand Draft /Pay Order drawn in favour ofDDO, Doordarshan Kendra, Patna failing which thetender shall be rejected out rightly.

33. The EMD in respect of the agencies which do not qualify the Technical Bid (FirstStage) shall be retuned to them without any interest. However, the EMD in respect ofthe successful tenderer shall be adjusted towards the Performance Security. Further, ifagency fails to deploy required number of persons against the initial requirement within10 days from the date of placing the order the EMD shall stand forfeited without givingany further notice.

34. The successful tenderer will have to deposit a security amount of Rs. 50,000/-(Rupees Fifty only) in the form of Fixed Deposit Receipt (FDR) made in the nameof the agency but hypothecated to the Doordarshan Kendra, Patna covering the periodof contract. In case, the contract is further extended beyond the initial period, the FDRwill have to be accordingly renewed by the successful tenderer.

35. In case of breach of any terms and conditions attached to his contract, the PerformanceSecurity Deposit of the agency will be liable to be forfeited by the DoordarshanKendra, patna besides annulment of the contract.

36. The agency will ensure that the payment to the deployed manpower is made throughCheques only under intimation to this Kendra at the end of every month after payment.

37. The agency shall raise the bill, in duplicate, along with attendance sheet (duly verifiedby Admn.) in respect of the persons deployed and submit the same to theAdministration wing of Doordarshan Kendra, Patna in the first week of the succeedingmonth. As far as possible the payment will be released by the second week of thesucceeding month.The payment to the DEO's 1 Casual Labour (Peon/Messanger/Mali/Safaiwala) shouldbe made through ECS in hislher Bank Accounts.

38. The claims in bills regarding Employees State Insurance, Provident Fund and ServiceTax etc. should be necessarily accompanied with the documentary proof pertaining tothe concerned month bill. A requisite portion of the bill 1whole of the bill amount shallbe held up till such proof is furnished, at the discretion of the Doordarshan Kendra,Patna.

39. The amount ofpre-estimated agreed liquidated damages calculated @ Rs. 2001- per dayon account of delay, if any, in providing a suitable substitute for the period beyondthree working days by the agency shall be deducted from the monthly bills of theservice providing Agency 1 in the following month. In the case of termination suchrecovery shall be made from the FDR 1 Performance Bank Guarantee which will beagreed upon by the firm.
