PERSONAL SERVICES AGREEMENT WITH PETER A. CALLSTROM TO SERVE AS THE

EXECUTIVE DIRECTOR OF THE CONSORTIUM AND AS THE PRESIDENT AND CHIEF EXECUTIVE OFFICER OF THE PARTNERSHIP

THIS AGREEMENT is made by and among the Policy Board of the San Diego

Consortium ("Consortium" or "Policy Board"), the San Diego Workforce Partnership, Inc. ("Partnership"), and Peter A. Callstrom herein called "Contractor."

RECITALS

A. The San Diego Consortium was created by a Joint Exercise of Powers Agreement between the City of San Diego and the County of San Diego. The Policy Board is the governing body of the Consortium. The Partnership was created, in part, to administer the affairs of the Consortium.

B. An Agreement on Roles and Responsibilities among the Partnership, the

Consortium and the Partnership effective July 1, 1997, as amended, provides that: (1) representatives of the Policy Board, and Partnership participate in a Joint

Personnel Committee (JPC) which recommends to the Policy Board personnel actions regarding hiring, evaluating and determining Contractor’s compensation;

(2) Contractor serves as the executive director of the Consortium and the President

and Chief Executive Officer (CEO) of the Partnership; (3) the Policy Board designates, evaluates and determines Contractor’s compensation; (4) the Partnership pays Contractor the compensation established by the Policy Board. C. This Agreement describes Contractor’s general authorities and responsibilities

as the Consortium’s Executive Director and the Partnership’s President and CEO.

D. The Policy Board, after receiving input from the JPC, believes that Contractor is an individual who is experienced and qualified to supervise the operations of the Consortium, and the Partnership.

E. Pursuant to the Policy Board's approval of this Agreement, the Policy Board and the Partnership desire to hire Contractor to have him provide services as the Consortium’s executive director and as the Partnership’s President and CEO.

NOW, THEREFORE, in light of the above recitals and the mutual obligations of the parties as herein expressed, the parties agree as follows:

Item#5: CorrectiveAction:ComprehensiveTrainingSystems(CTS)

INFORMATIONITEM–NOACTIONREQUIREDInaccordancewithSDWP’spoliciesoutlinedintheOperationsManual,Chapter8,CTSwasplacedoncorrectiveactionforthefollowingcontractualdeficienciesfoundduringfilereviewandtheannualmonitoringprocess: Enrollments&Performance,Monitoring Findings,DataEntry andFiscal. Per the corrective action, CTS was required to demonstrate that all theobservations/findingswerecorrectedviaaresponsetothedraftauditreportbyApril14th.AsofApril14th,CTShadnotaddressedallthecontractualdeficiencies;giventhis,SDWPdoesnotanticipateexecutingfutureoptionyearsoftheCTScontract(PY16-17).BACKGROUNDCTSwasselectedthroughtheevaluationprocessandapprovedbythePolicyBoardonApril29,2016toprovideworkforceserviceintheSouthRegionofSanDiegoCounty.Thecontractamountis$343,040toserve61ofOutofSchoolYouthperyear,withprimaryperformancemeasuresofplacing72% ineducationoremploymentanda60%attainmentofdegreeor certificate. TheperiodofperformanceforthefirstyearbeganJuly1,2016andendsJune30,2017.

Sincethebeginningoftheprogramyear,SDWPprogramspecialistshaveperformedfilereviewsof 15 CTS files (November & March) and a third-party monitor, Simpson and Simpson, hascompletedPhaseIprogrammaticmonitoring(February)ofthecontract.Theinternalfilereviewnotedissueswithdataentryandcompliance;CTSwasprovidedtheopportunitytoaddressandcloseoutthefindingsbutdidnotdosoinatimelymanner.

Subsequently, Simpson and Simpson’s external monitoring in February identified 46programmaticandfiscalfindings,includingconcernsregardingseparationofduties,disallowedcostsandCalJOBS reportingcompliance (enrollments,performance,dataentry).Manyof theissuesidentifiedwerethesameasthosefoundduringinternalfilereviewinNovemberindicatinga trend of non-compliance. Simpson and Simpson noted that this is the highest number offindingsofanyYouthorAdultcontractmonitoredthisyear.

SDWPhasprovidedextensivetechnicalassistancetoCTS,beyondthetraininggiventoallWIOAYouthproviders,sincetheinceptionofthecontractandhasalsoprovideddetailedguidanceonthestepsnecessarytoaddresseachoftheopenfindings.Toclosealltheprogrammaticandfiscalfindings,CTSisrequiredtosubmitacorrectiveactionplan,participateinweeklymeetingwithProgram Specialist, provide regular updates detailing progress against their plan and attendrequiredtraining.SDWPhasprovidedseveraladditionaltechnicalassistanceopportunities,aswell as hosted multiple in-person meetings with SDWP’s programs and leadership team tosupportCTSinthecorrectiveactionprocess.

SDWP’scontractsfollowstandardpracticewithabaseyearandoptionyearstructure;executionofoptionyearsiscontingentonorganizational“need,performance,andavailabilityoffunds.”

Item#6: NewInitiative:CenterforLocalIncomeMoBilityINFORMATIONITEM–NOACTIONREQUIREDSDWPhaslaunchedanewinitiative,theCenterforLocalIncomeMoBilityorCLIMB.CLIMBwillspinupopportunitiesforSDWPtoinvestinfamiliesandinchildren-theveryfrontendoftheworkforcepipeline.SDWPcurrentlysupportsworkforcedevelopmentforolderyouthandadults,ages16andabove.Manyofourcustomerswereunsuccessfulintheirprioreducationexperiences,arenewtoourcountry,or their skillsandexpertisehavebeenmade lessvaluableorobsolete inour rapidlyevolvingeconomy.We are creating new capacity and commitment throughCLIMB to expandourwork.Wearedrivenbythreebigideas:

1. Incomemobility:Basedoncompellingresearchpioneeredbybig-datascholars(seeTheEqualityofOpportunityProject),wewillsupportchildrenandfamiliesinwaysthatbestpredictincomemobility–movinguptheeconomicladdertothemiddleclassorbeyond.

2. Prevention:Supportchildrenandyouthtoaccessqualityeducationopportunitiesthatputthemontracktoearnapost-secondarydegreeorcertificateandfamily-sustainingwages. Prevention is cost effective and delivers a higher return on investment thanremediationorinterventionafteryoungadultshavefallenoutoftheeducationand/orlabormarket.

3. 2Gen:Familiesaresocialecosystems,andwhenweinvestonlyinonegenerationofthatecosystem,suchastheemploymentofaparent,wemissacriticalopportunitytoassurelong-termeconomicsecurityforthewholefamily.CLIMBwillhelpSDWPjoinanationalmovementcalled2Gen–simultaneousinvestmentsintheeducationandskillattainmentofparentsandtheirchildren.Whenwedothis,wewillrealizeatripleworkforcebottomline:skillsoftheparent(s),workforceparticipationandstabilityoftheparent(s)becausetheir children are in quality child care, and improved workforce trajectory for thechild(ren).

Itwilltakesometimetobuildthisportfolio,butwearelaunchingwiththreemajorprojectsandmoreonthehorizonfocusedon1)foodsecurityandtheCalFreshprograminpartnershipwiththe County of San Diego, 2) A research project in partnership with the San Diego RegionalChamberofCommerceonthefamilysupports(i.e.childcare,paidfamilyleave,etc.)offeredbySanDiegoemployers,and3)developingaprenatalto3rdgrade(p3)earlychildhooddevelopmentandcaremodelforparentsandchildreninVistaUnifiedSchooldistrict.

Item#7: EligibleTrainingProviderList(ETPL)INFORMATIONITEM–NOACTIONREQUIREDIn Program Year 15/16, SDWP invested $3,610,268 for 732 American Job Center (AJCC)participantstoattendclassroom-basedtrainingprogramsacrossthecountythroughIndividualTrainingAccounts(ITAs).Participants going through the job centers work with career coaches to identify their skills,interests,abilities,studygrowingcareers intheregion,andselecttrainingprogramsfromtheEligibleTrainingProviderList(ETPL).Thisprocessforselectingandfundingtrainingprogramsisoutlined in the federalWIOA legislation and in State of California EmploymentDevelopmentDepartmentguidance.AsSDWPcontinuestoimplementboththeletterandthespiritofWIOA,staffhavebeenanalyzingdifferentapproachestoadministeringthesefundstobetteralignwithlocalneeds,prioritiesandassets.WithinthecontextofSDWPandthecommunitycollegesystem’sjointregionalplan,andafterintegratingfinancialandtrainingoutcomedata,SDWPstaffareexploringanewapproachtoETPLadministration.CurrentstateSDWP’s current ETPL policy, guided by federal and state regulatory oversight, requires thatprovidersmeetthefollowingelementstogetonandstayontheETPL:

• Institution must be recognized by an accrediting agency (i.e. Western Association ofSchoolsandColleges(WASC),AccreditingCouncilforContinuingEducationandTraining(ACCET),andotherDOEgroups).

• MostschoolsorinstitutionsapplyingforinclusionontheETPLmustpossess“approvaltooperate” or exemption status from the Bureau for Private Postsecondary Education(BPPE). Notable exceptions include public schools or institutions, such as communitycolleges, state-approved apprenticeships or school districts — these only need anaccreditation.

• Institutionsmusttrainforjobsthatareconsideredin-demandorhigherin-demandbasedonresearchbySDWP.

• Institutionmusthaveandmaintaina64%“EnteredEmployment”rateforparticipantsineach program – that is, 64% of studentsmust be working six months after programcompletion.Brandnewprogramshave18monthstomeetthisrequirement.

These standards reflect the state guidelines. However, local boards have the opportunity tocreateadditionallocalpolicytobestalignETPLinvestmentswithlocalneedsandpriorities.

ProposedchangesSDWPhasconductedarecentreviewofourexistingprovidersandisexploringwaystoensurethat all providers on the ETPL are equipped tomeet the needs of our local population. Keyadditionalguidancebeingconsideredincludes:

thanthepublishedrateontheinstitution’swebsiteorcatalog.• TrainingProviderhasbeeninoperationforatleastsixmonthsandisfinanciallysolvent

withoutneedofsubsidyfromWIOAtraining.• TrainingProviderprovidesnoticeofchangesinaccreditation,approvaltooperate,and

proposedchangesinprice.• ProviderhasnotbeendebarredfromdoingbusinesswiththeFederalGovernment.• TrainingProvideriscommittedtomeettargetsdesignatedbySDWP,specifically:

o 75%CompletionrateforWIOAparticipants.o 85%CredentialattainmentrateforWIOAparticipants.o 75%EnteredEmployment rate forWIOAparticipants.Formonitoringpurposes

theemploymentrateisdeterminedatthepointintimeperparticipantateachfollow-upforuptofourquarters.

o 50%SelfSufficiencyrateforWIOAparticipants.Thisisdefinedbyatleast50%ofparticipantsbenefitting from ITA funding supportwhoearnwhat constitutesaself-sufficientwageinSanDiegoCounty,currentlyat$13.09perhour.Allotherparticipantsmustbe in jobswhich leadtothiswage(e.g.demonstratedcareerladder).

Programsaresubjecttocontinuousmonitoringasstudentoutcomedataismadeavailable.SDWPis committed to the success of ETPL providers andwill take a proactive approach inmakingperformancedataavailable;however,SDWPmaydelistaprogramifthereisreasonableevidencethattheprogramisunderperformingorunabletocomplywithadministrativerequirements.

America’sJobCentersofCalifornia(AJCC)NetworkINFORMATIONITEM–NOACTIONREQUIREDForthelast12months,SDWPhasbeenplanningthereleaseofaRequestforProposals(RFP)toprocureservicesfortheAJCCNetwork.TheAJCCnetwork–andthecontractorsthatoperateit–arefundedthroughtheU.S.DepartmentofLabor(DOL)WorkforceInnovationandOpportunityAct(WIOA)AdultandDislocatedWorkerprograms,CountyofSanDiegoExpandedSubsidizedEmployment(ESE)andDOLWorkforceInnovationFund(WIF)grantprograms.Asaresultofthisplanning,SDWPisconsideringtwosignificantshiftsintheAJCCmanagementandcontractingstructuretoimprovetheeffectiveness,quality,andconsistencyofAJCCservices:

- ProcureoneleadcontractortobetheprimecontractorandsingularlyaccountablefortheAJCC system (currently theAJCCnetwork ismanaged through four separate contractswiththreedifferentorganizations);and

- Shift the administration of training funds directly to the procured AJCC operator(currently,SDWPadministersthesefundsseparatelyfromAJCCcontracts).

The changes proposed in the RFP framework are intended to bring operational and costefficienciesandimprovementstoboththeemployerandjobseekerexperience,asdiscussedinfurtherdetailbelow.PlanningProcessBeginninginMayof2015,theAdultProgramsCommittee,WorkforceDevelopmentBoardandSDWPstaffhavetakenthefollowingstepstoidentifyandunderstandcommunitypriorities,andplanforthereleaseoftheRFP:

RFPFocusAreas

a) OneAJCCServiceProviderforCountyofSanDiegoProposalswouldberequiredtodemonstratehowtheywillserveallfourregionsofSanDiegoCounty.Ashifttoasingleproviderwillpromoteastandardizedandstreamlinedexperienceforemployersandjobseekersregardlessofgeography,leverageeconomiesofscaleandincreaseregional collaboration with partners. One service provider increases cost-efficiencies inopportunitiestoleveragesupportstaffacrosstheregions(i.e.oneaccountant,onesitemanager,oneHRrepresentative).Theproposalmustalsodemonstratehowtheproviderwilladministertrainingfunds(On-the-Job-TrainingandIndividualTrainingAccounts),fromagreementthroughinvoicingandpayment.Administration of the training funds by the single provider will make the process foremployers/providersmoreefficientastheAJCCsalreadyworkwiththeseorganizationsdirectlytoestablishtrainingagreementsandgeneratenecessarydocumentation.SDWPwillcontinuetoprovideoversightandmonitoringforalltrainingfunds.

b) PartnershipsProposalswillberequiredtodemonstratelocalpartnershipsandgatheragreementsinwritingfor how they build a network of partners with community-based organizations, governmentagencies,educationprovidersandotherrelevantworkforcepartnerstodeliverthebestpossibleoutcomesforthecounty.

c) EmployerConnectionsProposalswill be required todescribe their relationshipwith employers and strategy for jobdevelopmentaswellastheimpactthattheirprogramswillhaveinmeetingemployerneedswiththehighestlevelsofsatisfaction.

d) UnderstandingTargetPopulationProposalswillberequiredtodemonstratetheirunderstandingofthedemographicsofthefourregionsinSanDiego,frombothacustomerandbusinessperspectives,andoutlinehowtheywilladdressthespecificneedsofeachregionandthenetwork.

e) AccessPointsProposalswillbeaskedtodemonstratehowtheywillcreatein-kindpartnershipsandstrategiestoincreasethecost-effectivenessandphysicalaccesspointsandpresenceoftheAJCCNetworkthroughouttheregion.

f) PerformanceBidderswill be required to submitprojectedperformance targetsaboveandbeyondSDWP’sminimallyrequiredperformancetodemonstratetheircapacityandabilitytodeliverincreasedresultsfortheirregion.Thisincludesdemonstratinghowtheywillachievebothoutcomeandimpactmetricsforbothemployersandjobseekers.GuidingtheseprojectedperformancetargetswillbetherequiredDOLperformancemeasuresandalllocalperformancemeasuresassetbytheWDB.Somemeasuresarestillbeingdefinedby
