ORDINANCE NO. 1800
AN ORDINANCE CHANGING THE ZONE FROM IBD (INDUSTRIAL BUSINESS DEVELOP-MENT) TO GR-C (GENERAL RESIDENTIAL-CIVIC LOT) FOR 6.258 ACRES OF PROPERTY LOCATED AT CORNER OF RUSSELL STREET, ROY ARNOLD BOULEVARD, DILLEHAY STREET AND BEATTY AVENUE IN DANVILLE, KENTUCKY.
WHEREAS, at a public hearing held on December 7, 2011, Centre College presented a petition for a zoning ordinance map amendment for 6.258 acres of property located at the corner of Russell Street, Roy Arnold Boulevard, Dillehay Street and Beatty Avenue in Danville, Kentucky, from IBC (Industrial Business Development) to GR-C (General Residential-Civic Lot), and the Danville-Boyle County Planning and Zoning Commission, after making specific findings of fact, recommended approval of the zone change on December 7, 2011; and
WHEREAS, the Board of Commissioners of the City of Danville agrees with the recommendation of the Planning and Zoning Commission; and
WHEREAS, the Board of Commissioners of the City of Danville, at its meeting on January 9, 2012, did approve the rezoning request mentioned herein; and
WHEREAS, the Board of Commissioners of the City of Danville does now deem it appropriate to approve, ratify, and confirm the rezoning of the subject property by ordinance;
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF DANVILLE, KENTUCKY, AS FOLLOWS:
Section 1: That the Zoning Ordinance for Boyle County and the Cities of Danville and Perryville be amended to reflect a change in zone from IBC (Indus-trial Business Development) to GR-C (General Residential-Civic Lot) for 6.258 acres of property located at the corner of Russell Street, Roy Arnold Boule-vard, Dillehay Street and Beatty Avenue in Danville, Kentucky, as depicted on the Zone Change Plat of Centre College – Athletic Fields prepared by Estes Engineering and dated November 11, 2011.
Section 2: That the Danville-Boyle County Planning and Zoning Commission is directed to show the amendment of the official zone map atlas and make refer-ence to the number of this Ordinance.
Section 3: The provisions of this Ordinance are severable. If any section, sentence, clause, or section of this Ordinance or the application thereof to any particular case is for any reason found to be unconstitutional or invalid, such unconstitutionality or invalidity shall not affect or repeal any of the remaining provisions, sentences, clauses or sections or part of this Ordinance.
Section 4: This Ordinance shall be effective upon its final passage and pub-lication, and the City Clerk is hereby directed to publish this Ordinance in the Danville Advocate-Messenger of Danville, Kentucky.
