1.0 INTRODUCTION

The Township of Tay is undertaking a Class Environmental Assessment (Class EA) to

evaluate the need for and the feasibility of improving water and wastewater services for

all properties in the Grandview Beach and Paradise Point community (Community).

The Class EA is proceeding in accordance with the requirements of the Ontario

Municipal Class EA, October 2000, as amended in 2007 and 2011.

Public consultation is a key element of the Class EA process. As a result, this public

consultation plan has been developed to ensure that the public and other stakeholders

have numerous opportunities to be involved in and to provide comments throughout the

Class EA.

2.0 KEY CONSIDERATIONS

In meeting with Township of Tay staff and reviewing background material, a number of

considerations likely to impact the implementation of the public consultation plan

emerged. They represent both opportunities and constraints for engagement and

influence how this public consultation plan is structured. These considerations include

the following:

• Residents of Grandview Beach and Paradise Point live in the Community, either

on a permanent or seasonal basis, with approximately 50 percent permanently

residing in the Community.

• Development restrictions have been in place in the community since 1974 in

response to environmental and well water quality issues. Studies since 1974

have looked at various options to address environmental and well water quality

issues in the Community.

• Undeveloped lots make up approximately 22 percent of the lot inventory in the

Class EA study area.

• In the 2002 Class EA, there was mixed support for the ‘individual services’

alternative and the ‘communal services’ alternative.

• There was concern among health and environmental agencies about the health

and environmental impacts of the preferred servicing solution, as recommended

in the 2002 Class EA.

3.0 CONSULTATION OBJECTIVES

The research and analysis conducted during the development of this public consultation

plan have led to the identification of the following objectives for the consultation process

for the Class EA:

• Improving understanding and involvement through effective communications and

consultation among local residents and special interest groups concerning the

Class EA.

• Carrying out effective consultation activities with the assistance of a Public

Liaison Committee (PLC).

• Ensuring the feedback provided by the public and other stakeholders is reviewed

and understood by the consulting team.

• Providing easy ways for the public and other stakeholders to obtain information

about the Class EA process through the use of the Township website and

providing project contact numbers for information.

• Encouraging participation at Public Open Houses and other consultation

activities so that the consulting team understands local concerns and issues.



4.0 TARGET GROUPS FOR CONSULTATION

To satisfy the objectives of this public consultation plan, target groups should be

identified. The following list encompasses the audiences considered critical for the

success of the public consultation plan. As the Class EA unfolds, additional target

groups may be identified and included. The groups include the following:

The general public, including:

• Permanent and Seasonal Residents of Grandview Beach and Paradise Point

• Owners of Undeveloped Property

• Township/County Residents and Business Owners

• Affected Aboriginal communities

Special interest groups, including:

• Grandview Beach Cottagers Association

• ACTION Committee

• Port McNicoll – Gateway to the North Facebook Page

• Southern Georgian Bay Chamber of Commerce

• Tay Heritage Committee

• Local utilities (e.g. gas, electricity, and telecommunications providers)

Government organizations and agencies, including:

• Township Council and Staff

• Severn Sound Environmental Association

• Simcoe Muskoka District Health Unit

• County of Simcoe

• Ontario Ministry of Environment

• Ontario Ministry of Natural Resources

• Ontario Ministry of Aboriginal Affairs



5.0 ACCESSIBILITY STANDARD FOR CUSTOMER SERVICE

It will be critical throughout the Class EA that services are provided in accordance with

the Accessibility for Ontarians with Disabilities Act. This includes having respect for

persons with a disability and using all reasonable efforts to ensure they have an equal

opportunity to obtain and provide input.

Throughout the Class EA, the consulting team will:

• Ensure Public Open Houses and other consultation activities are held in buildings with barrier-free access; and

• Work with the Township in providing accessible formats and communications supports, upon request.

6.0 KEY MESSAGES

Consistent messages with the appropriate tone and content will improve understanding

among target audiences. The message statements listed below are built on a current

understanding of the existing audiences, constraints, opportunities and environmental

concerns surrounding the Class EA. These messages should be communicated

throughout the Class EA and refined, as required, as it unfolds.

• Concerns have been expressed by various agencies with respect to public health

safety and environmental impacts from the unfiltered migration of contaminants

into the groundwater and local drinking-water supply wells. As a result,

development restrictions have been in place in Grandview Beach and Paradise

Point since 1974. Finding alternatives that address issues related to public health

safety and environmental concerns will be a critical objective of the Class EA.

• To make important servicing decisions, an implementable plan is required by the

Township and property owners. Developing this plan is the purpose of the Class

EA. It will evaluate various means to improve water and wastewater services in

the Community.



• This is not simply a duplication of previous efforts. This Class EA will evaluate

previously studied options and new options, which will also include an analysis of

their financial impacts and how the associated servicing costs can be shared,

deferred and/or funded. Consideration will also be given to how effective the

alternative solutions are likely to be.

• The Township and consulting team members are committed to this Class EA and

are placing an emphasis on a seamless, open, transparent, and traceable Class

EA process.

7.0 RECOMMENDED COMMUNITY CONSULTATION ACTIVITES

A variety of public consultation vehicles and mechanisms are recommended to achieve

the objectives of this public consultation plan. Care has been taken in selecting activities

that recognize the needs of the local community and government organizations along

with their specific information requirements.

7.1 Establish a Public Liaison Committee

A Public Liaison Committee (PLC) should be established to ensure that all members of

the community are provided with opportunities to participate in the consultation process

and that information is provided to interested parties in a clear, transparent, and

inclusive manner. The PLC would meet periodically throughout the Class EA to provide

feedback on consultation activities and ensure that community information needs are

met.

Responsibilities:

Members would provide feedback on the consultation process, review and provide

comments on the reports developed after the Public Open Houses, and act as a

sounding board for consultation activities.



Qualifications:

Members should be active participants in the local community, have an open mind, and

have a strong interest in the future of the community.

Recommended PLC Size and Membership:

Three to five representatives from Grandview Beach and Paradise Point, including:

seasonal residents, permanent residents, and owners of undeveloped properties;

and

• One or two representatives from the community-at-large.

7.2 Establish a Technical Advisory Committee

A Technical Advisory Committee (TAC) should be established to provide technical

guidance to the consulting team and act as a sounding board for technical decision

making throughout the Class EA. The TAC could also assist in identifying potential

approval requirements. At a minimum, the following agencies/organizations should be

invited to be part of the TAC:

• Township of Tay Staff;

• Ontario Ministry of the Environment;

• Severn Sound Environmental Association;

• Simcoe Muskoka District Health Unit; and

• Ontario Ministry of Natural Resources.

7.3 Establish a Financial Impacts Committee

A Financial Impacts Committee (FIC) should be established to provide information on

possible funding models and to assess the affordability of the options being considered

as part of this Class EA.



The FIC would facilitate the decision-making that will be required to assess what level of

service improvement is affordable, and how costs can be shared, deferred, and/or

funded. The FIC could be made up of the Township’s project manager, a representative

from the Township’s finance department, the Township’s legal counsel, Township

Council, and consulting team members.

7.4 Two Public Open Houses

Two Public Open Houses are recommended. Open Houses provide a good mechanism

for the local community to be informed about the Class EA and for the community to

comment on the Class EA.

The Public Open Houses should be designed to be welcoming, and provide

opportunities for residents to speak directly with the consulting team and Township of

Tay officials. These can take a variety of forms (e.g. formal presentations with a

question-and-answer session and/or display boards with informal one-on-one

discussions).

The first Open House would explain the purpose of the Class EA and how it will be

undertaken; the second Open House would present the technical assessments of the

Class EA study area, the alternative solutions, and the preferred alternative, including

potential impacts and mitigation measures.

Residents would be encouraged to fill out comment sheets in order to provide feedback

to the consulting team and the information discussed.

7.5 Door-to-Door Visits

At the beginning of the Class EA, the consulting team should conduct door-to-door visits

with Grandview Beach and Paradise Point residents to inform them about the Class EA

and how they can get involved. Residents could also be asked to complete a short

questionnaire and provide a water sample from the property.



7.6 Ongoing Promotion and Consultation

In order to engage the public and other stakeholders, Class EA updates and Open

House notices should be placed in the information pages of local newspapers. The

Notice of Study Commencement and the Notice of Completion will be direct mailed to

property owners in the study area and published in the local newspaper.

Class EA updates could also be provided to the Township Council so that Councillors

could then inform their constituents about the Class EA.

7.7 Website

To assist the public in obtaining information about the Class EA and to provide an on-

going mechanism for feedback to the consulting team, the Township of Tay should

continue to provide space on their website for the Class EA.

Information for the website should include: notices for Public Open Houses, frequently

asked questions, minutes of meetings, reports, technical memos and contact

information.

7.8 Opportunities to Comment

At all public meetings, the public and other stakeholders should be encouraged to leave

comments following the meeting. Following each consultation activity, a report would be

written that summarizes and records the comments and input received from the

participants.

At the beginning of the Class EA, email and voice mail feedback tools should also be

established to provide the public and other stakeholders with numerous avenues to

provide input and ask questions. These feedback tools should be promoted on all

communications materials.

Additional informal meetings may be required, and could be considered if local residents

or the business community appear disengaged or dissatisfied with the extent or

frequency of consultation activities.



8.0 EVALUATION MECHANISMS

The following activities should be undertaken to evaluate the effectiveness of this public

consultation plan.

• Reviewing attendance numbers at the Public Open Houses;

• Requesting formal and informal feedback on the consultation process at Public

Open Houses, Committee meetings and on the study website;

• Tracking the number of visits to the study website and evaluating changes in

traffic that occur in response to particular consultation events (e.g. mailing or

emailing out notices); and

• Examining the number and content of emails received from the public and other

stakeholders.

9.0 CONCLUSIONS

The Township of Tay is undertaking an important Class EA for the servicing of the

Grandview Beach and Paradise Point Community.

The activities contained in this public consultation plan reflect the need to have an

enhanced outreach program for local residents throughout the Class EA process. As the

Class EA process unfolds, especially with the first Public Open House, public interest

will grow. The public consultation plan has been developed to focus this interest and

ensure that the public and other stakeholders are meaningful participants in the Class

EA process.

The fact that a previous Class EA was conducted on this issue and evoked strongly

mixed responses from the community and agencies presents a unique challenge.

However, maintaining a clear, transparent, and inclusive consultation process will help

to ensure that meaningful dialogue takes place so that innovative and achievable

servicing strategies can be realized.

Schedule B Class Environmental Assessment

The Township of Tay has initiated a Class Environmental Assessment (Class EA) to investigate opportunities to improve the water and wastewater services to all properties in the Grandview Beach and Paradise Point community.

The study will assess the quality of drinking water and the effectiveness of wastewater treatment in the community, review the planning and development freeze in place since the 1970s, and consider funding models to support the study recommendations. Public and agency consultation is a key element of the process, and input will be sought throughout the study to identify options to address the study findings. Based on this input, alternative strategies will be evaluated to identify optimal community, environmental and economic opportunities.

Door-to-door visits will be conducted in late July. A mailing list for notification of study status and opportunities for public input is being compiled. Infrastructure Ontario is the strategic manager of the provincial government's real estate with a mandate of maintaining and optimizing value of the portfolio while ensuring real estate decisions reflect public policy objectives of the government. As you may be aware, IO is responsible for managing property that is owned by Her Majesty the Queen in Right of Ontario as represented by the Minister of Infrastructure (MOI). There is a potential that IO manages lands fall within your study area. As a result, your proposal may impact IO managed properties and/or the activities of tenants present on IO-managed properties. In order to determine if IO property is within your study area, IO requires that the proponent of the project conduct a title search by reviewing parcel register(s) for adjoining lands, to determine the extent of ownership by MOI or its predecessor’s ownership (listed below). Please contact IO if any ownership of provincial government lands are known to occur within your study area and are proposed to be impacted. IO managed land can include within the title but is not limited to variations of the following: Her Majesty the Queen/King, OLC, ORC, Public Works, Hydro One, PIR, MGS, MBS, MOI, MTO, MNR and MEI*. Please ensure that a copy of your notice is also sent to the ministry/agency on title. As an example, if the study area includes a Provincial Park, then MNR is to also to be circulated notices related to your project. IO obligates proponents to complete all due diligence for any realty activity on IO managed lands and this should be incorporated into all project timelines. Potential Negative Impacts to IO Tenants and Lands General Impacts Negative environmental impacts associated with the project design and construction, such as the potential for dewatering, dust, noise and vibration impacts, impacts to natural heritage features/habitat and functions, etc should be avoided and/or appropriately mitigated in accordance with applicable regulations best practices as well as Ministry of Natural Resources (MNR) and Ministry of the Environment (MOE) standards. Avoidance and mitigation options that characterize baseline conditions and quantify the potential impacts should be present as part of the EA project file. Details of appropriate mitigation, contingency plans and triggers for implementing contingency plans should also be present. Impacts to Land holdings Negative impacts to land holdings, such as the taking of developable parcels of IO managed land or fragmentation of utility or transportation corridors, should be avoided. If the potential for such impacts is present as part of this undertaking, you should contact the undersigned to discuss these issues at the earliest possible stage of your study. If takings are suggested as part of any alternative, these should be appropriately mapped and quantified within the EA report documentation. In addition, details of appropriate mitigation and or next steps related to compensation for any required takings should be present. IO requests circulation of the draft EA report prior to finalization if potential impacts to IO-managed lands are present as part of this study.

Impacts to Cultural Heritage Should the proposed activities impact cultural heritage features on IO managed lands, a request to examine cultural heritage features, which can include cultural landscapes, built heritage, and archaeological potential and/or sites, could be required. If the potential for such impacts is present as part of this undertaking, you should contact the undersigned to discuss these issues at the earliest possible stage of your study. Potential Triggers Related to MOI’s Class EA IO is required to follow the MOI Public Work Class Environmental Assessment Process for (PW Class EA). The PW Class EA applies to a wide range of realty and planning activities including leasing or letting, planning approvals, dispostion, granting of easements, demolition and property maintenance/repair. For details on the PW Class EA please visit the Environment and Heritage page of our website found at http://www.infrastructureontario.ca/Templates/Buildings.aspx?id=2147490336&langtype=1033 Please note that completion of any EA process does not provide an approval for MOI’s Class EA obligations. Class EA processes are developed and in place to assess undertakings associated with different types of projects. For example, assessing the impacts of disposing of land from the public portfolio is significantly different then assessing the best location for a proposed road. IO is providing this information so that adequate timelines and project budgets can consider MOI’s regulatory requirements associated with a proposed realty activity in support of a project. Some due diligences processes and studies can be streamlined. For example, prior to any disposition of land, at minimum a Phase I Environmental Site Assessment and a Stage I Archaeological Assessment and the MOI Category B Environmental Assessment should be undertaken.. Deficiencies in any of these requirements could result in substantial project delays and increased project costs. In summary, the purchase of MOI-owned/IO-managed lands or disposal of rights and responsibilities (e.g. easement) for IO-managed lands triggers the application of the MOI Class EA. If any of these realty activities affecting IO-managed lands are being proposed as part of any alternative, please contact the Sales, Easements and Acquisitions Group through IO’s main line (Phone: 416-327-3937, Toll Free: 1-877-863-9672), and also contact the undersigned at your earliest convenience to discuss next steps. Appendix ‘G’ Public Liaison Committee Terms of Reference

A Public Liaison Committee (Committee) has been established to ensure that all members of the community are provided with opportunities to participate in the consultation process and that information is provided to interested parties in a timely, clear, transparent, and efficient manner. The Committee will meet periodically throughout the Class Environmental Assessment (Class EA) to provide feedback on consultation activities and study findings. The Committee was established prior to the first Public Information Centre, held September 13, 2014. The following Terms of Reference were provided to all potential applications for the committee. Should you require this information in an alternate format, please contact one of the people listed on the following page. RESPONSIBILITIES OF THE PUBLIC LIAISON COMMITTEE 1. Providing input on consultation activities to ensure that community information

needs are met; 2. Providing input on information to be presented at each Public Information Centre

and reviewing the consultation reports completed after each Committee meeting and Public Information Centre; and

3. Attending Public Information Centres to provide a link between the Technical Advisory Committee and the Grandview Beach and Paradise Point community.

WHAT TO EXPECT ON THE COMMITTEE Time Commitment: Committee members will be expected to attend approximately four meetings during the year-long study. Committee meetings are expected to last approximately two hours. Committee members are also encouraged to attend the two proposed Public Information Centres. Public Information Centres will typically occur in the evening and generally last two to three hours. Reviewing documents prior to each meeting is expected to take from one to four hours. The anticipated time commitment is four hours every two months, with opportunities to contribute more time if desired. Meetings will be held in wheelchair accessible locations and additional accessibility accommodations will be provided, if requested. Responsibilities: Committee members will provide feedback on the consultation process, as well as review and provide comments on the reports developed after each Public Information Centre, and inform decisions related to consultation activities. Qualifications: Committee members should be active participants in the local community and have a strong interest in the future of the community.

We ask that all members familiarize themselves with the study Commitment Charter (attached) and be willing to enter discussions with an open mind. The Township of Tay staff and Consultants for this study have committed to doing the same. COMMITTEE SIZE AND MEMBERSHIP If you would like to help ensure that the public consultation process is inclusive, effective, and transparent, the Township of Tay welcomes you to apply to join the Committee. We are seeking input from enthusiastic community members with a variety of backgrounds and experiences. There is a need to ensure that a variety of perspectives are represented, so an effort will be made to select Committee members from several different categories. The Committee is expected to be comprised of:

• Three to five representatives specifically from the Grandview Beach and Paradise Point community, including seasonal residents, permanent residents, and owners of vacant properties; and

• One or two representatives from the local community (members-at-large).

SELECTION Where the number of interested participants is greater than the above stated targets, a review of applications will be completed, which will be based on the Selection Criteria for Public Liaison Committee Members (attached). Individuals who score the highest will be invited to participate on the Committee. All who express an interest will be provided opportunity to provide input at the Public Information Centres and through the feedback forms. If there are insufficient interested individuals from one category, the Township of Tay may choose to offer an opportunity to other interested applicants.
