knowledge, insight and expertise in the energy field allowed NMPP members to benefit from numerous innovative energy and service projects.

Hedquist was honored for his work in creating numerous partnerships with public and private agencies resulting in cost-savings in taxes and utility rates for South Sioux City residents. Under Hedquist’s leadership South Sioux City has various partnerships in the areas of housing, infrastructure, renewable energy, public safety and general quality of life in advancing the community.

The partnerships have resulted in improved services to South Sioux City’s citizens, an enhanced environment and provided a focus for the community’s future. As the recipient of the award, Hedquist received $350 which will be designated to go to the South Sioux City Public Library Foundation.

Child Abuse Prevention Month

Proclamation

Whereas, children are vital to our state’s future success, prosperity, and quality

of life, as well as being our most vulnerable assets;

Whereas, all children deserve to have the safe, stable, nurturing homes and

communities they need to foster their healthy growth and development;

Whereas, child abuse and neglect is a community responsibility affecting both the current and future quality of life of our community;

Whereas, communities that provide parents with good social supports, knowledge of parenting and child development, and concrete resources that families may need to cope with stress, will help ensure that all children grow to their full potential;

Whereas, effective child abuse prevention strategies succeed because of partnerships created among citizens, human service agencies, schools, faith communities, health care providers, civic organizations, law enforcement agencies, and the business community;

Therefore, I Rod Koch, Mayor do hereby proclaim April as Child Abuse Prevention Month in of South Sioux City and call upon all citizens, community agencies, faith groups, medical facilities, elected leaders, and businesses to increase their participation in our efforts to support families, thereby preventing child abuse and strengthening the communities in which we live. Arbor Day Proclamation

ARBOR DAY

PROCLAMATION

WHEREAS: In 1872, J. Sterling Morton proposed to the Nebraska Board of Agriculture that a special day be

set aside for the planting of trees, and

WHEREAS: this holiday, called Arbor Day, was first observed with the planting of more than a million trees in

Nebraska and

WHEREAS: Arbor Day is now observed throughout the nation and the world, and

WHEREAS: trees can reduce the erosion of our precious topsoil by wind and water, cut heating and cooling

costs, moderate the temperature, clean the air, produce life-giving oxygen, and provide habitat for

wildlife, and

WHEREAS: trees are a renewable resource giving us paper, wood for our homes, fuel for our fires and beautify

our community, and

WHEREAS: trees in our city increase property values, enhance the economic vitality of business areas, and

beautify our community, and

WHEREAS: trees, wherever they are planted, are a source of joy and spiritual renewal.

NOW, THEREFORE, I, Rod Koch, Mayor of the City of South Sioux, Nebraska, do hereby proclaim April 27th,

2018 as

ARBOR DAY in the City of South Sioux City, and urge all citizens to celebrate Arbor Day, and to support efforts to protect our

trees and woodlands, and

ORDINANCE 2018 - 3 AN ORDINANCE OF THE CITY OF SOUTH SIOUX CITY, DAKOTA COUNTY, NEBRASKA, AMENDING SECTION 34-41 OF THE SOUTH SIOUX CITY MUNICIPAL CODE AS IT RELATES TO EMERGENCY SERVICES; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING A TIME WHEN THIS ORDINANCE SHALL BE IN FULL FORCE AND EFFECT.

BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF SOUTH

SIOUX CITY, NEBRASKA:

SECTION 1. SECTION AMENDED. Section 34-41, Suspension of alarm user permits, of the Code of Ordinances of the City of South Sioux City, Nebraska, is repealed and the following adopted in lieu thereof:

Sec. 34-41. – Violations of False Alarms.

The following limits are established for each alarm system:

1) Upon receipt of the second false alarm within a calendar year, a warning notice shall be issued by the Fire Department to the alarmed user business monitoring the system. Upon any additional false alarms within the calendar year, a response report shall be filed with the alarm user within ten days of the false alarm.

2) Upon receipt of the third false alarm within a calendar year, the alarm user shall be subject to the following fees to be paid to the City Clerk of the City of South Sioux City within ten days after notice that it is due:

R112.1 General is repealed in its entirety and replaced with the following:

R112.1 General. In order to hear and decide appeals of orders, decisions or determinations made by the building official relative to the application and interpretation of this code, there shall be and is hereby created a board of appeals. The South Sioux City Rental Inspection Board shall serve as the Board of Appeals for this code. The board shall render all decisions and findings in writing to the appellant with a duplicate copy to the building official.

R302.5.1 Opening protection. Openings from a private garage directly into a room used for sleeping purposes shall not be permitted. R403.1 Footings General. All footings shall have at least two #4 reinforcement bars parallel with footings and shall be continuous around all corners. Reinforcement bars shall be held in place with proper chairs or other means so as to not displace the reinforcement bars during the placement of concrete. All wooden grade stakes shall be removed from footing during the placement of concrete.

R403.1.1 Minimum Size is repealed in its entirety and replaced with the following:

R403.1.1 Minimum size. Minimum sizes for concrete and masonry footings shall be as set forth in Table R403.1 and Figure R403.1(1). The footing width, W, shall be based on the load-bearing value of the soil in accordance with Table R401.4.1. Spread footings shall be at least 8 inches in thickness, T. Footing projections, P, shall be at least 2 inches (51 mm) and shall not exceed the thickness of the footing. The size of footings supporting piers and columns shall be based on the tributary load and allowable soil pressure in accordance with Table R401.4.1. Footings for wood foundations shall be in accordance with the details set forth in Section R403.2, and Figures R403.1(2) and R403.1(3).

R501.3 Fire protection and all subsections are repealed. SECTION 4. CHAPTER REPEALED. Chapter 11, Energy Efficiency is repealed and replaced with the 2009 International Energy Conservation Code. SECTION 5. CHAPTER AMENDED. Chapter 25, Plumbing Administration all references in Chapter 25 using the word “shall” are to be changed to “may” in regards to mandatory testing. SECTION 6. SECTION AMENDED. Section 18-222, Additional Standards, of the Code of Ordinances of the City of South Sioux City, Nebraska is amended by adopting the International Building Code, 2012 Edition. SCHOOL RESOURCE OFFICER

MEMORANDUM OF UNDERSTANDING

Between the South Sioux City, Nebraska Police Department

and South Sioux City Community Schools

Purpose

The purpose of this Memorandum of Understanding (“MOU”) is to set forth guidelines to ensure

that the South Sioux City, Nebraska Police Department (“PD”) and the South Sioux City

Community Schools (the “District”) have a shared understanding of the School Resource Officer

(“SRO”) program and the parties’ roles in maintaining safe schools, improving school climate,

and supporting educational opportunities for all students.

Mission, Goal, and Objectives

Schools in the District are meant to be places where students can learn from their mistakes in

order to grow into healthy, productive adults.

The parties recognize and support the need for safe schools and a safe learning environment for

our youth. In furtherance of that goal, PD shall provide an SRO as provided in this MOU. The

SRO will be covered by the PD Union contract. The SRO shall work in partnership with school

officials.

Except as specifically noted, this MOU does not limit the ability, authority or operations of the

PD or District. This MOU does not alter any party’s existing duties under local, state, or federal

laws.

Goals and objectives are designed to develop and enhance rapport between youth, police

officers, school administrators and parents. Goals and objectives include:

Friendly contact between PD and the youth in the City of South Sioux City.

Assistance and information sharing concerning problems and issues affecting the District

and its school employees and students.

Education of children regarding the role of laws, courts, and law enforcement officers in

society.

Investigation of cases involving juveniles and use of effective alternatives to court

whenever possible.

Prevention of crime or delinquent behavior by juveniles within the SRO’s areas of

assignment.

Effective problem solving and liaison with neighborhoods surrounding the schools.

Roles and Responsibilities

PD

PD’s role within the school environment is to help foster a positive school climate by

demonstrating respect for the rights of District school employees and students and

protecting the safety of the school environment.

The PD will provide the SRO any required police equipment, including but not limited to

radios and motorized vehicles to the SRO.

District

It is the role of teachers and other educators to administer school discipline in a way that

supports personal growth and learning opportunities for all of the District’s students. It is

further the goal of the District and PD that school discipline be administered in such a

way as to keep students within the classroom setting to the greatest extent practicable.

The District will provide a private office, office furnishings, telephone, and a computer to

the SRO for SRO use in each school building the District places the SRO (“Schools”).

SRO

The SRO is not a school teacher, school administrator, or school counselor. The SRO

may assist teachers with classroom presentations on relative topics when requested and

able. The SRO may be used in a guest speaker capacity and may assist the District in

working with families, individual students and other school employees with counseling

and guidance efforts when requested and appropriate.

The SRO is encouraged to work extracurricular activities as requested by the school

administrator. It is recognized by all parties that these assignments provide further

opportunities for crime prevention and crime detection as well as providing the

opportunity to interact with the students in a more casual manner. All after-hours work,

including any work by the SRO at extracurricular activities, shall be approved by the

SRO’s assigned PD Supervisor in advance and will be consistent with the PD Union

Contract, if applicable.

The parties recognize that the SRO has the authority to investigate criminal cases

involving youth and is expected to maintain order through the enforcement of local, state,

and federal laws. SRO may be involved in school discipline, when it pertains to

preventing a disruption that would, if ignored, place students, faculty and school

employees at risk of harm.

The parties recognize that the SRO is expected to attend all training, meetings and

appointments assigned by the PD. Some of these will conflict with SRO availability

during normal school hours. These conflicts will be minimized as much as possible but

the potential exists that such requirements will take precedence over school presence.

The SRO shall strive to keep the school principal or District designee informed about

his/her absences and/or activities as appropriate on a need to know basis.

The SRO will conduct himself/herself in such a manner that the SRO could be considered

a role model or mentor for students.

Involvement of PD in a School-Based Incident

Wherever possible, school-based incidents shall be addressed through the use of non-punitive

interventions that improve school safety and academic performance (e.g., restorative justice, peer

mediation, counseling services, etc.), and not through harsh, exclusionary measures or justice

system intervention.

1. “Involvement” in a school-based incident by PD/SRO includes any action beyond

data collection and may include:

opening of a case file

conducting an investigation

being called to, or arriving at, a school campus

questioning and/or searching of any students or school personnel; as long as it

adheres to current State of Nebraska Statutes

issuance of tickets/citations

conducting arrests and/or making referrals to the juvenile justice system.

2. Notwithstanding the foregoing, SRO primary involvement in a school-based incident

should be limited to incidents of felony or misdemeanor conduct posing a threat of injury to any

individual within the school community. The SRO may be involved in any matter, if requested,

that involves violation of State or federal Law.

3. The purpose of SRO involvement in school-based incidents is to assist the District in

maintaining safe schools and to provide a law enforcement resource should an incidents take

place within any of the District’s schools. It is not the SRO’s role to enforce school discipline or

to punish students. The SRO is not to be used as a tool of intimidation. The SRO may educate

students about the legal consequences of the students’ behavior.

4. Examples of school-based infractions that shall be handled by school officials without

SRO involvement include (but are not limited to): disorderly conduct, disruptive or disrespectful

behaviors, tardiness, verbal arguing, minor property damage, consensual sexual activity ( age

appropriate), etc. SRO may be involved in school-based infractions as a support member to the

school employees.

5. Examples of behavior that may warrant SRO or PD involvement include (but are not

limited to): possessing or using weapons, selling drugs or alcohol, physical assaults involving

injuries or weapons, and sexual assaults, statutory offensives, child abuse cases and/or

allegations, and disturbing the peace.

6. SRO or PD involvement in school absenteeism shall consist of assisting the school

with student/parent home visits. PD may, upon request of District, conduct an investigation into

Nebraska State Statute violations that pertains to student absenteeism (i.e. truancy or contributing

to the delinquency of a minor). If requested, the SRO may do a home visit in order to locate and

determine why a student is not in school. SRO will assist District in the location of parents in

order to have the child taken to school or picked up from school. SRO is not responsible for

picking students up for school or driving students’ home after school.

Procedure for SRO Involvement in a School-Based Infraction

Unless in an emergency situation, the decision to involve the SRO in any school-based

incident should be made by a Principal, Assistant Principal, Dean of Students or other

District designee.

Any member of the school community may notify the PD, the SRO, principal or District

designee of student conduct believed to poses a serious and immediate threat of injury to

an individual within the school community.

It is recommended that the principal or District designee attempt to de-escalate the

situation wherever possible prior to calling or otherwise involving the SRO in the school-

based infraction. However, if the principal or District designee feels that the SRO’s

presence is needed, based on past experience with a student, the principal or District

designee may contact the SRO for assistance prior to attempting to de-escalating a

situation.

Procedures Concerning PD / SRO Conduct in Schools

Absent an emergency situation, a school principal or District designee shall be consulted

prior to the arrest or detention of a student.

When the SRO or PD has taken a student into custody, the SRO or PD shall notify a

school principal or District designee, who will notify the student’s parent or guardian.

The PD shall take immediate steps to notify the parent, guardian, or responsible relative

of the minor that the minor is in custody and the place where he or she is being held

When a student has been taken into custody as a victim of suspected child abuse, the

principal shall provide the PD with the address and telephone number of the student’s

parent or guardian. If the PD has a reasonable belief that the minor would be endangered

by a disclosure of the place where the minor is being held or that the disclosure would

cause the custody of the minor to be disturbed, the PD may refuse to disclose the place

where the minor is being held for a period not to exceed twenty-four hours. The PD shall,

however, inform the parent, guardian, or responsible relative whether the child requires

and is receiving medical or other treatment.

PD may conduct a search of a student’s person or possessions, only where there is

probable cause to believe the student committed or is committing a felony/misdemeanor

offense and the offense at issue poses the threat of injury to an individual within the

school community and/or the security of the School or District. The SRO may conduct a

search of student upon arrest. The SRO and PD must follow local, state, and federal law

when conducting a search of any person, person’s possession or property. PD is not to

perform a search of a person or possessions for a school policy violation that is not also a

criminal violation.

Absent an emergency situation, a principal or District designee should be consulted

before PD conducts a search on a student’s person, possessions, or locker.

PD shall not request that school officials conduct a search of a student’s person,

possessions, or locker in order to evade the probable cause standard.

SRO interviews of students that may result in criminal consequences shall be reserved for

criminal activity. Advance notice of such questioning should be given to a principal or

District designee and should be conducted in the presence of a parent or guardian and/or

with a parent or guardian’s consent.

Strip searches of students by PD or the SRO are prohibited.

Prior to, or at the time of arrival at a school campus, the SRO should be notified by the

principal or designee of any students involved in a criminal matter or who possess

disabilities and who therefore may require special treatment or accommodations by PD or

the SRO.

Physical Restraint

Physical restraints may be used when it is believed that less intrusive measures of

restraint have failed or when the SRO believes that the lesser restraints may result in the

serious or immediate injury to a student, school employee, self or the community.

Physical restraints (handcuffs, Tasers, Mace, pepper spray, or other physical and

chemical restraints) shall be used for conduct that poses a threat to an individual within

the school community and /or the security of the school.

Transparency, Accountability, and Training

Any school employee who fails to follow the protocol established above, resulting in the

unnecessary involvement of the SRO or PD, may be subject to corrective action. This

corrective action will be conducted by school administration. The SRO will not have any

involvement in school employee discipline.

The District, PD and the SRO may maintain records (including PD Incident or Event

numbers) of school-based incident resulting in PD / SRO involvement disaggregated by

description of the incident, names of school officials involved, manner in which PD was

notified, searches/questioning of students, tickets, citations, or summonses issued, arrests

made, filing of delinquency petitions, referrals to a probation officer, and other referrals

to the juvenile justice system. PD involvement is defined as an arrest or citation issued

by PD.

Each record described above may also include information on any suspension, expulsion,

disciplinary transfer, or other disciplinary consequence imposed on the student. School

records may reflect school discipline. PD record shall consist of an Incident Report and /

or Event Report.

PD and the SRO shall be trained on their role within the District’s schools and on the

rights afforded to students. Further, they shall be trained on topics including, but not

limited to, child and adolescent development and psychology, cultural competence,

special accommodations for students with disabilities, and practices proven to improve

school climate. Such trainings shall continue on an annual basis. This training may be

formal or informal. Expenses for training will be agreed on by the District and PD on a

case by case scenario.

Complaint System

PD shall create a user-friendly system for students, parents, school employees, or other

individuals to lodge complaints against the SRO. Such complaints must be given in

written form and include a brief description of why the complaint is being issued.

The complaint system must provide for independent investigation of any and all

allegations as well as swift and comprehensive redress.

Parents must be able to lodge complaints in their native language.

Complainants shall receive written or oral notification within thirty (30) days of the

resolution of complaints or written notification of the need for additional time to resolve

the complaint including concrete and specific actions taken to work toward resolution of

the complaint.

Where allegations of serious abuse are pending against a PD officer, including the SRO

that officer may not be further deployed to respond to any school-based infraction.

Where allegations of serious abuse against a PD officer, including the SRO, are

substantiated, that officer must be permanently suspended from any assignment relating

to a school-based infraction.

Effective Date This Memorandum of Understanding is effective _______ ___, 2018, and shall remain in effect

through _______ ___, 201_ unless renewed by agreement of both parties or terminated as provided

herein.

Termination of Agreement

Either party may terminate this agreement upon sixty (60) days written notice to the other party.

Termination of this agreement may be completed prior to 60 days if all parties agree.

Modification; Entire Agreement of Parties Expressed

No modification of this Agreement shall be valid or binding unless the modification is in writing,

duly dated and signed by both parties.
