One person signed up for public comment (Mr. Tolbert) explaining that the WV DOH
Route 51/Summit Point Road proposals do not adequately address the construction
impacts to residents in the west end of Charles Town nor the overall impacts to the
traffic patterns outside Charles Town, in the western and southwestern areas of
Jefferson County.
IV. REPORTS
A. Ward Reports
Ward #1 - Ms. Ricketts reported the following:
• Attended her first Street and Personnel Committee meetings.
• Attended the Jefferson County Planning Commission meeting, where she
learned about a new 51-house development (Milton's Landing) planned for
Summit Point Road, just outside City limits. She expressed concerns that the
development plans do not include sidewalks and that the Commission seemed
unaware of the proposals for improving WV Rt51/ Summit Point Road.
• Spent time at Evitts Run Park to see how the Let's Play Mobile Van was
working.
• Toured the Charles Town Utility Board’s (CTUB) water and sewer treatment
facilities and thanked Kristen Stolipher (CTUB Manager) for hosting the tour.
• That the FY2022 Congressional Appropriation Bill includes earmarks for the
Augustine Sidewalk Project, Happy Retreat and the Liberty Street Stormwater
Management project, as well as the Downtown Charles Town Revive Initiative.
• That July is Disability Pride Awareness Month.
Ward #1 - Mr. Kratovil reported that he attended the Street Committee meeting and
the Charles Town Farmer's Market.
Ward #2 - Mr. Hynes reported the following:
• Attended the Finance and Ordinance Committee meetings.
• Toured the Charles Town Utility Board’s (CTUB) water and sewer treatment
facilities. He also thanked Kristen Stolipher (CTUB Manager) for taking time
from her busy schedule to host the tour.
• Attended Farmer Market and the Grand Opening of Fuzzy Dog Bookstore.
• That he is registered to attend the West Virginia Municipal League's annual
conference in August.

Ward #3 - Ms. Philabaum reported the following:
• Attended the Personnel and Ordinance Committee meetings.
• Toured the Charles Town Utility Board’s (CTUB) water and sewer treatment
facilities.
• Attended the Farmers Market, the Grand Opening of Fuzzy Dog Bookstore,
and the Charles Town Library’s outdoor story time – who has partnered with
the Presbyterian Church for this initiative.
• Ortegas and Bushel and Peck are now open for indoor dining/shopping.
• This Friday, July 23rd is the Friday Night Live event in downtown Charles
Town where there will be live music and shops will stay open later.
• The multi-day meal packs will be available for pick-up at Washington High
School between 8:00 a.m. - 9:30 a.m. on Tuesday, July 20th.
Ward #3 - Ms. Petti reported the following:
• Attended the Finance and Ordinance Committee meetings.
• That the Charles Town Ghost Tours will begin a tour on Friday, July 23rd at
8:00 p.m. to benefit the Animal Welfare Society.
• The Potomac Audubon Society will be holding a virtual Weed Warrior training
on Tuesday, July 27th from 6:30-8:30 p.m.; more information can be found
on their website.
• Ms. Petti also commended the Shenandoah Garden Club for their work at
Evitts Run Park in partnership with the City of Charles Town.
Ward #4 - Ms. Twyford reported the following:
• Attended the Ordinance Committee and Board of Education meetings.
• Attended the Farmers Market, the Grand Opening of Fuzzy Dog Bookstore,
and visited the Devil's Due Distillery, located in the Burr Business Park.
Ward #4 - Mr. George reported the following:
• Attended or listened in to the Ordinance, Street, Finance, Personnel, and
Historic Landmarks Commission (HLC) meetings. HLC approved Fuzzy Dog’s
door modification request.
• That he walked the route of the proposed George Street sidewalk from the
Police Station towards the downtown and didn’t identify any major obstacles
to establishing a sidewalk along that route.
• That Christmas in July event will be held on Saturday, July 24th from 11 a.m.
to 3:00 p.m. in downtown Charles Town.

• Mr. George reviewed some notes from the meetings he attended, which
included: some audio difficulties, public comment at Committee meetings,
and identifying “call in” participants in Zoom meetings.
B. Mayor's Report
Mayor Trainor reported the following:
• Attended the Finance, Street, Personnel, and Ordinance Committee meetings.
• Attended Charles Town Utility Board meeting.
• Met with the Berkeley County Housing Authority in Martinsburg; following-up
on some action items of Homelessness Committee Report.
• Met with the Crosswinds Homeowners Association (HOA) property manager to
discuss City code enforcement.
• That the Board of Parks and Recreation, Building Commission, and Historic
Landmarks Commission are seeking applicants to fill vacant positions. Notices
will be advertised in the Jefferson Spirit newspaper starting Wednesday July
21st; applications are due to the City by August 13, 2021.
C. Committee Reports
1. 4919: Finance Committee Report for July 7, 2021, Meeting
Mayor Trainor reported that the Finance Committee recommends that the 35%
sidewalk drawing be forwarded to the Street Committee and to schedule a public
hearing to solicit public comment concerning the sidewalk proposal. He also
reported that the City is currently seeking a waiver from the WV Department of
Transportation – Division of Highways for the placement of a permanent sign in
the State Route right of away for the Municipal Building at 661 S. George Street.
Mayor Trainor reported that the WV 457 Retirement Plus Program, will be
included as an agenda item in a future Personnel Committee meeting.
2. 4932: Street Committee Report for July 8, 2021
Ms. Philabaum reported that the Street Committee selected her as Chairman.
The Street Committee agreed to conduct a thorough review of the Sidewalk
Improvement Program and make recommendations for possible revisions after
the Council's strategic planning meeting in October. They also reviewed the
Pavement Condition Assessment Report. There are no recommendations for the
Council at this time.
The Street Committee agreed that meetings will be held at City Hall on the
second Thursday of the month at 6:00 p.m.

3. 4933: Personnel Committee Report for July 12, 2021
Mr. George reported that the Personnel Committee selected him as Chairman.
The Personnel Committee reviewed the following:
Payment of Employment Benefits; Leave without Pay; Parental Leave; Leave
Payout; and Sick Leave Donation Program Guidelines. The Personnel Committee
has no recommendations on these topics for the Council at this time.
The Personnel Committee also discussed Charles Town Police Department (CTPD)
staffing levels. The Personnel Committee directed staff to research the
availability of an independent contractor to conduct a CTPD staffing study to
determine adequate and optimal staffing levels for the CTPD.
The Personnel Committee agreed that meetings will be held the second Monday
of each month at 5:00 p.m. via Zoom.
4. 4935: Ordinance Committee Report for July 15, 2021
Ms. Twyford reported that the Ordinance Committee selected her as Chairman.
The Ordinance Committee reviewed the Curbside Pickup Program initiative
(Article 365 – Parking) and Urban Deer guidelines (Article 1102.05(a)). The
Ordinance Committee has no recommendations on these topics for Council at this
time.
The Ordinance Committee agreed that meetings will be held on the third
Thursday of the month at 6:00 p.m., possibly via Zoom.
D. City Manager's Report
1. 4936: City Manager Report for July 19, 2021
Mr. Hennessy reported that the Charles Town Utility Board is researching a
ground water well that will serve as a backup water source for customers.
He also reported that an engineering study is being done by Gwin, Dobson and
Foreman Engineers on several pending water and sewer projects; the results of
the study will be reported to the Council.
E. Police Chief's Report
Chief Kutcher reviewed the June 2021 Charles Town Police Statistics report with the
Council. He also reported that the CTPD is continuing their recruiting efforts to
address personnel shortages.
V. UNFINISHED BUSINESS
1. 4928: Strategic Planning Session - October 9, 2021 - Preliminary Agenda
Mr. Hennessy reviewed the agenda that was created at the planning session
for the upcoming strategic planning meeting on October 9, 2021. He reported

that there will be a pre-session briefing scheduled and that council members
with any other agenda topics recommendations should contact him.
VI. NEW BUSINESS
1. 4929: Tree Board - WV Division of Forestry Demonstration Grant
Mr. Tanner Haid reported that the Tree Board was contacted by Dr. Campany
of Shepherds University asking for permission to plant 10-15 trees in 2022
throughout Charles Town to study tree physiology and stress responses. Mr.
Haid is seeking Council support for this research project by allowing Dr.
Campany to move forward with grant funding applications and proposed
planting locations.
Mayor Trainor asked if there was any objection for the Tree Board to move
forward with this project. Hearing none he declared the request approved.
2. 4927: Ward 2 Council Vacancy - Applications and Next Steps
The City has received three applications for the Ward 2 Council Member
vacancy. After discussion it was decided that 30-minute interviews will take
place on August 2nd before the regular scheduled Council meeting. The
Council will decide whether or not to vote on the nominees at the August 2nd
regular Council meeting or to delay the decision until the August 16th Regular
Council meeting.
3. 4930: WV Alcohol Beverage Control Administration (ABCA) Waiver
Mr. Hennessy reported that a Jefferson County catering company is seeking a
waiver to the open container ordinance that will permit them to sell alcohol at
a private indoor event within the city limits. The City has issued these
waivers in the past and the City Manager is asking for Council to grant City
staff the authority to issue this type of waiver in the future without taking a
Council vote on each request.
Mr. Hynes moved to grant City staff the ability to issue waivers of this type in
the future without taking a Council vote on each request. Mr. George
seconded the motion and it passed unanimously.

privilege. Mr. Hynes seconded the motion and Mayor Trainor declared the

MEMORANDUM TO THE MAYOR AND CITY COUNCIL FROM: Daryl Hennessy, City Manager SUBJECT: City Manager’s Report DATE: August 2, 2021 ADMINISTRATION AND OPERATIONS Shentel Communications. Representatives from Shentel have been meeting with city staff to review their right-of-way permit applications and begin planning for the installation of new, 1-gigabyte fiber optic cable and internet lines throughout the city. In 2020, Shentel signed a new franchise agreement with the city to operate as a new provider in the municipality. Shentel is finalizing agreements with Potomac Edison to install the lines on poles where available. They will install fiber optic lines underground elsewhere in the community where other utilities are already buried. The city expects to see advance crews in the community in mid-August to prep for the field work. Contractors are expected to be in the field to begin installing the lines in late August/early September. At present, Shentel is estimating it will finish its work in the community by January 2022. COMMUNITY AND ECONOMIC DEVELOPMENT 114 W. Liberty Street Sale. The sale of the old police department building on Liberty Street is nearly complete. A new survey has been completed, which reflects the lot line changes needed to accommodate the buyer without adversely affecting the adjacent municipal parking lot. The closing has been set for August 4, 2021. The buyer has proposed to convert the property to a new delicatessen. PUBLIC SERVICE/MAINTENANCE AND UTILITIES WV-51 Feasibility Study. Representatives from HEPMPO, Carpenter Marty, and I visited Charleston on July 28, 2021 to meet with Secretary White, Deputy Commissioner Wriston, and other members of the Department of Transportation (DOT) staff. The purpose of the meeting was to review the WV-51 feasibility study that was completed in May 2021 and encourage DOT to advance the project to the next stage of environmental review. I confirmed that the community has not coalesced around a preferred option for improving traffic flow and safety through the Martin Luther King Boulevard and Summit Point Road corridors but did express the importance of making safety and traffic improvements in the area. DOT has agreed to advance the project to the environmental stage of review and consider an additional option for traffic that includes stubbing off MLK Boulevard at the railroad tracks and routing all traffic through a connector street to W. Washington Street.

Charles Town Utility Board. The CTUB Directors met on July 28, 2021 for a regular meeting that included updates from Gwin, Dobson, and Foreman Engineers (GD&F) on various projects, including a high-level analysis of the options for serving customers of Shenandoah Junction Public Sewer (SJPS). The WV Public Service Commission (PSC) has determined that SJPS is a distressed utility that cannot continue to operate in its current capacity. Moreover, the SJPS is still under a WV Department of Environmental Protection Consent Order that will require substantial wastewater plant upgrades that it may not be able to afford. The PSC has advised CTUB to work with SJPS to determine a path forward. Absent a mutual agreement, the PSC could direct CTUB to take over this distressed utility. Attached is a report from GD&F on the physical condition of SJPS. If the city were required to assume the assets of the utility, it is estimated to cost approximately $1.4 million to connect the SJPS customers to the CTUB system. There is another $400,000 in costs that should be borne by the current owner to decommission the plant. The cost to connect these customers to the CTUB system is not something that the existing 187 customers on the SJPS system could afford. Funding the improvements could have an impact on CTUB customer rates. Adding the SJPS as a CTUB resale customer is much more affordable at an estimated $30,000, but that action alone is not likely to satisfy the PSC. I will provide more details on this developing situation as they are known. Attachment

Dear Mayor and Charles Town City Council:
I write seeking an appointment to the recently vacated Ward 2 Council seat for the Charles Town City Council.
I moved to Charles Town in February of 2011, in the neighborhood of Huntfield. I moved here looking for a
simpler life where my focus could be on my faith, my family and my community that the hustle and bustle of
a larger metropolitan area just didn’t afford. I wanted to be a part of a true community and in moving here, I
finally found that. Charles Town is a true “hometown”, with so many wonderfu l and diverse people of all
walks of life. Finally, a home where we work side by side in true community fashion. Once here I knew I
needed to get involved to help my now “Hometown”.
I have volunteered in several ways over these past 10 plus years, from the Cold Weather shelter to being on
Boards and committees. Recently I was on CTUB as a Board Member and Treasurer before joining the Council
in June of 2020 and currently serve as President of the Old Opera House Theater Company here in Charles
Town. In all of this I found a calling to help even further by working to get on the Council. The opportunity
presented itself in May of 2020 when there was another vacant seat to be appointed, I applied, and was
humbled by the vote of the Council at that time appointing me to this seat.
In this past year since being on the Council I have had the pleasure of serving in several ways for the City by
working on the Ordinance Committee, Charter Review Committee and the Personal Committee. We as a
Council have accomplished a lot this past year moving forward in many areas in helping Charles Town, but
there is so much more to get done!
I unfortunately lost my bid for re-election to my seat, but with the encouragement of the 45% of the voters
who did support me in this election and a strong desire to continue the great work that the Mayor and
Council had started and look to begin work on during the next few years, I decided to seek this open seat. I
hope that you will consider my application.
If considered, I look forward to working alongside the rest of you, improving on the great work already done
and to get even more accomplished. Having worked very hard on updating our Charter, I would like to
continue to work on this through to completion, also to review, update and as needed removing or adding to
our city ordinances to improve the life of our citizens, and continued work on our Finances to get the much -
needed infrastructure improvements so that all of Charles Town can be connected to our historic downtown

FREQUENTLY ASKED QUESTIONS ABOUT WEST VIRGINIA’S NEW FIREWORKS LAW
When will it be legal to purchase and use consumer fireworks in West Virginia?
On June 1, 2016, West Virginians will be able to purchase and use consumer fireworks in The Great State of West Virginia. – defined – “Consumer fireworks” means small fireworks devices that are designed to produce visible effects by combustion that are required to comply with the construction, chemical composition and labeling regulations promulgated by the United States Consumer Product Safety Commission under 16 C.F.R. Parts 1500 and 1507 (2014), and that are listed in APA Standard 87-1. Consumer fireworks do not include sparkling devices, novelties, toy caps or model rockets.
West Virginians can already purchase hand-held and ground-based sparkling devices, such as hand-sparklers and fountains. These have been legal in West Virginia since 2006.
What types of consumer fireworks will be legal in West Virginia on June 1?
Consumer products that will be legal to purchase and use in West Virginia on June 1, 2016, include:

Missile-Type Rockets
Helicopter and Aerial Spinners
Roman Candles

§103-4-11. Prohibited Conduct. 11.1. A person may not intentionally ignite, discharge or use consumer fireworks on public or private property without the express permission of the owner to do so. 11.2. A person may not intentionally ignite or discharge any consumer fireworks or sparkling devices within or throw the same from a motor vehicle or building. 11.3. A person may not intentionally ignite or discharge any consumer fireworks or sparkling devices into or at a motor vehicle or building, or at any person or group of people. 11.4. A person may not intentionally ignite or discharge any consumer fireworks or sparkling device while the person: 11.4.a. Is under the influence of alcohol; 11.4.b. Is under the influence of any controlled substance; 11.4.c. Is under the influence of any other drug; 11.4.d. Is under the combined influence of alcohol and any controlled substance or any other drug. 11.4.e. A person who is less than eighteen years of age may not purchase, nor offer for sale, consumer fireworks. 11.4.f. A person who is less than sixteen years of age may not purchase, nor offer for sale, sparker or novelty devices. 11.5. The provisions of this section shall be effective June 1, 2016. 11.6. No retailer may knowingly sell or offer for sale fireworks to any person who: 11.6.a. Is under the influence of alcohol. 11.6.b. Is under the influence of any controlled substance. 11.6.c. Is under the influence of any other drug. 11.6.d. Is under the combined influence of alcohol and any controlled substance or any other drug. 11.6.e. Is less than eighteen (18) years of age.
You should also check with your local city governments as there may be certain areas where consumer fireworks are not permitted.
Where can I purchase consumer fireworks in West Virginia?
On June 1, 2016, West Virginians will be able to purchase consumer fireworks at any location that is properly licensed by The West Virginia State Fire Marshal. A retailer shall post the certificate/license in a conspicuous place at the location of the business. It shall be posted within five feet (5’) from any public entrance to any temporary or permanent structure.

What safety tips should West Virginians follow when using consumer fireworks, sparklers and/or sparkling devices?
According to the American Pyrotechnics Association, safety tips include:
Store fireworks in a cool, dry place Always read and follow the directions on the label Always have an adult present when handling fireworks Never give fireworks to young children, even sparklers! Use fireworks outdoors in a safe, non-wooden area Have a working garden hose or bucket of water handy Keep everyone a safe distance away from fireworks Light only one firework at a time Never re-ignite a firework that doesn’t light the first time or one that has finished its display Never carry fireworks in your pocket Don’t throw fireworks at another person Keep pets indoors and away from fireworks Never shoot fireworks in metal or glass containers Keep spectators at a safe distance Always wear safety glasses when igniting fireworks

School Resource Officer Agreement

RESOLUTION
A Resolution to Provide for the Adoption, Approval, and Implementation of an Intergovernmental Agreement Regarding a Prevention Resource Officer
WHEREAS, the City of Charles Town (City) and the Jefferson County Board of Education (JCBOE) wish to renew a partnership that was started in 2018 to provide a fully equipped and trained member of the City’s police department as a Prevention Resource Officer at Washington High School; and WHEREAS, the City and JCBOE share the same goals and objectives with regard to the Prevention Resource Officer including, but not limited to, performing law enforcement functions within the school setting, identifying and preventing delinquent student behavior, including substance abuse, and fostering a better understanding for students of the law enforcement function, concepts, and structure of law; and WHEREAS, the JCBOE agrees to reimburse the City $60,000 to cover the costs of this position for one year, some of which may be offset by grant funds that both parties agree to mutually pursue during the school year. NOW, THEREFORE BE IT RESOLVED, the City affirms its commitment to providing a Prevention Resource Officer to the JCBOE for Washington High School during the coming school year; and LET IT BE FURTHER RESOLVED, the City agrees to enter into an intergovernmental agreement with the JCBOE regarding a Prevention Resource Officer Agreement, a copy of which is attached hereto and is made a part of this Resolution as if repeated verbatim herein. Re: Amendments to Rules and Regulations of the Police Civil Service Commission
All,
The Police Civil Service Commission of the City of Charles Town (the “PCSC”) is pleased to submit the
enclosed amended Rules and Regulations of the PCSC, in both redline and clean versions, for
consideration and approval by both the City’s Mayor and City Council.
The Commission prescribed the enclosed amended Rules and Regulations by vote on July 20, 2021. The
effect of the amendments is to:
(i) Revise Section 4.03, and related provisions, to provide the PCSC flexibility in certifying
names of eligible applicants for original appointment. Said revisions are made as a result of
recent revisions to WV Code Section 8-14-15;
(ii) Revise various provisions to provide the PCSC greater flexibility in conducting the
hiring process, including the provision of notice of openings, the preparation and/or procurement
of tests, the grading of tests, and the scaling of test scores.
(iii) Revise Sections 6.04 and 6.05 pertaining to promotions to simplify those sections and
make them more consistent with provisions pertaining to original appointment;
(iv) Add a new Section 10.02(b)(1) to provide the PCSC flexibility to reduce the average
minimum score required on competitive written examinations when circumstances require; and
(v) Make various minor and technical corrections and clarifications.
In order for the amended Rules and Regulations to become effective, they must be approved both by the
