  • Students AR 5132(a) STUDENT DRESS AND GROOMING In cooperation with teachers, students, parents/guardians, the principal or designee shall establish school rules governing student dress and grooming which are consistent with law, board policy, and administrative regulations. These school dress codes shall be regularly reviewed. (cf. 0420 - School Plans/Site Councils) It is the intent of the Board of Education that students be dressed and groomed in a manner which will not interfere with or detract from a school environment conducive to academic learning or study, disrupt or threaten to disrupt the educational or instructional process, or create or present an unnecessary or unreasonable risk of injury or harm to any student. It shall be the policy of the Chino Valley Unified School District to enforce the requirements of Title 5, Section 302, of the California Administrative Code which provides: "A student who goes to school without proper attention having been given to personal cleanliness or neatness of dress, may be sent home to be properly prepared for school, or shall be required to prepare himself/herself for the school room before entering." Guidelines for Student Dress and Grooming at School and at School Activities 1. Student dress and/or grooming which disrupts or threatens to disrupt the

    instructional process, or which creates an unnecessary or unreasonable risk of injury or harm to any student is prohibited.

    2. Student dress and grooming shall be appropriate to the activity levels and types

    that can reasonably be expected to occur during the school day. 3. Each school shall allow students to wear sun-protective clothing, including but

    not limited to, hats as approved by the principal, for outdoor use during the school day. (Education Code 35183.5)

  • AR 5132(b) STUDENTS DRESS AND GROOMING (cont.) Specific Minimum Dress and Groom Standards for Grades K-6 1. Shoes must be worn at all times. Sandals must have heel straps. Thongs, thong-

    type, or backless shoes or sandals are not permitted. Platform shoes above 2 inches are not permitted. Roller shoes are not permitted.

    2. Clothes shall be sufficient to conceal undergarments at all times. See-through or

    fish-net fabrics, halter tops, off-the-shoulder or low-cut tops, bare midriffs and skirts or shorts shorter than mid-thigh are prohibited.

    3. Hats, caps and other head coverings shall not be worn indoors unless they are

    worn for religious or medical reasons. 4. Clothing, jewelry and personal items (backpacks, fanny packs, gym bags, water

    bottles etc.) shall be free of writing, pictures or any other insignia which are crude, vulgar, profane or sexually suggestive, which bear drug, alcohol or tobacco company advertising, promotions and likenesses, or which advocate racial, ethnic or religious prejudice.

    5. Nail polish may be worn. 6. Make-up is not permitted. 7. Jewelry which creates a health or safety hazard is not permitted. 8. Clothes and belts must be the appropriate size and length when worn. 9. Hair shall be clean and neatly groomed. Colored hair (such as blue, orange,

    green, etc.) is not permitted. 10. College logo apparel is permitted as designated by school’s policy.

  • AR 5132(c) STUDENTS DRESS AND GROOMING (cont.) Specific Minimum Dress and Grooming Standards for Grades 7-12 1. Shoes must be worn. 2. Absence of undergarments is not permitted. 3. Clothing which allows undergarments to be visually observed is not permitted. 4. Bare midriffs are not permitted. 5. Halter, tube or strapless tops are not permitted. 6. Bathing suits are not permitted as outer wear (except when in use for a P.E.

    activity or athletic activity). 7. Clothing, jewelry and personal items (backpacks, fanny packs, gym bags, water

    bottles etc.) shall be free of writing, pictures or any other insignia which are crude, vulgar, profane or sexually suggestive, which bear drug, alcohol or tobacco company advertising, promotions and likenesses, or which advocate racial, ethnic or religious prejudice.

    8. Clothing or grooming that is obscene or defamatory, or that so incites students to

    create a clear and present danger of the commission of unlawful acts on school premises, or the violation of school regulations, or the substantial disruption of the orderly operation of the school is not permitted.

    9. Jewelry which creates a health or safety hazard is not permitted. 10. Gang-related and/or obscene/profane/vulgar tattoos must be covered at all times. 11. Accessories which advocate or cause disruption on campus and/or other acts of

    violence or may be used as weapons are not permitted. 12. Approved hats may be worn during outside activities for sun protection.

    Coaches and teachers may impose more stringent dress requirements to accommodate the special needs of certain sports and/or classes. (cf. 3260 - Fees and Charges)

  • AR 5132(d) STUDENTS DRESS AND GROOMING (cont.) No grade of a student participating in a physical education class shall be adversely affected if the student does not wear standardized physical education apparel because of circumstances beyond the student's control. (Education Code 49066) (cf. 5121 - Grades/Evaluation of Student Achievement) The principal, staff, students and parent/guardians at each school may establish reasonable dress and grooming regulations for times when students are engaged in extracurricular or other special school activities. Extracurricular/Cocurricular Activities The principal, staff, students, and parents/guardians at each school may establish reasonable dress and grooming regulations for times when students are engaged in extracurricular or other special school activities. Gang-Related Apparel At individual schools that have a dress code prohibiting gang-related apparel at school or school activities, the principal, staff and parents/guardians participating in the development of the school safety plan shall define "gang-related apparel" and shall limit this definition to apparel that reasonably could be determined to threaten the health and safety of the school environment if it were worn or displayed on a school campus. (Education Code 32282) Each school site that prohibits gang-related apparel must include the prohibition in their school safety plan and must submit it to the board for approval. The Board shall approve the plan upon determining that it is necessary to protect the health and safety of the school’s students. (cf. 0450 – Comprehensive Safety Plan) (cf. 5136 – Gangs) Because gang-related symbols are constantly changing, definitions of gang-related apparel shall be reviewed at least once each semester and updated whenever related information is received.

  • AR 5132(e) STUDENTS DRESS AND GROOMING (cont.) Determination of Violation 1. Dress or grooming by a student which violates the District guidelines but is not

    expressly delineated within District or school site regulations shall be considered and reviewed by the site administrator in charge. The site administrator shall make a determination of whether the dress or grooming matter at issue violates District policy and, if so, shall undertake appropriate action to immediately bring about the student's compliance with the District guidelines including, but not limited to, contacting the student's parents/guardians and seeking the cooperation and assistance of the parents/guardians.

    2. Upon first violation of the District dress and grooming regulation, the student will

    be warned. Parents/guardians will be contacted and asked to bring appropriate attire to the school or the student may be sent home to comply with the dress and grooming regulation. The student and parent/guardian will be notified that if there is a second violation of the district dress and grooming regulation, the student will be suspended from school for 1 to 3 days depending on the student discipline record. If there is a third violation, progressive discipline will be followed.

    Partial Invalidity In the event a court of law makes a final determination that any term or provision of the District's Student Dress and Grooming policy or regulation is invalid or unenforceable, all remaining terms and provisions shall remain in full force and effect. The principal, in cooperation with parents/guardians, teachers, staff and student shall establish, review and revise school rules governing dress and grooming. In no case shall school dress and grooming rules be less restrictive than district dress and grooming policies nor shall they supersede the provisions of this policy or the law. Uniforms School standards may include voluntary or required uniforms. In the absence of a specific site policy on uniforms, a student may voluntarily wear a uniform which conforms to district and site dress and grooming standards with the approval of the principal or designee. Students who participate in a nationally recognized youth organization (example: Scouts) shall be allowed to wear organization uniforms on days when the organization has a scheduled meeting.

  • AR 5132(f) STUDENTS DRESS AND GROOMING (cont.) A voluntary uniform policy may be established at a school site at any time. A voluntary uniform policy is one in which school wide standardized dress and/or grooming guidelines are established as an option for those students who wish to wear a uniform, but there is no requirement that students wear a uniform. Before establishing a voluntary uniform, the principal shall notify the parents/guardians in writing of the proposed policy. This notice shall include the following statement "this is a voluntary uniform policy. While students are encouraged to wear the school uniform, they are not required to do so." The principal shall seek input from staff and parents/guardians of the individual school in selection of the specific uniform to be worn. Establishing a Required Uniform Policy In schools where a school wide uniform is required, the principal, staff and parents/guardians of the individual school shall jointly select the specific uniform to be worn. (Education Code 35183) 1. When a principal determines that there is sufficient interest in establishing a

    required uniform policy, he/she shall conduct an informational meeting for the purpose of explaining the district policy and Education Code related to a required uniform policy. A notice of the meeting shall be sent to parents/guardians at least seven school days prior to the date of the meeting. Such meeting may only take place once each year.

    2. A required uniform policy shall be adopted upon receiving a majority of votes in

    favor of such a policy on the ballots returned to the school. Parents/guardians shall be entitled to one vote per parent/guardian. Each site staff member shall be given one vote. Each ballot shall include the following information: a. The colors and styles of uniforms being considered b. Estimated cost of purchasing the uniform c. Compliance measures to be used in enforcing the policy d. The effective date of the policy

    Each ballot shall also include the following statement: "Should the required uniform policy be adopted, Education Code 94116 stipulates that parents/guardians may still exempt their children from the requirement to wear a school uniform. District policy requires that a request for exemption be made by the parent, in person, on a form provided by the school."

  • AR 5132(g) STUDENTS DRESS AND GROOMING (cont.) 3. It is the responsibility of the principal and the school staff to ensure that the

    election is fair and to adequately communicate to parents/guardians information regarding school uniforms, including: a. Styles and colors of uniforms b. Lists of vendors where uniforms may be purchased c. Compliance measures to be employed in enforcing the policy d. Measures to facilitate the recycling of uniforms e. The availability of financial assistance f. The district and school site minimum dress and grooming standards g. The right and procedures for parents/guardians to have their children

    exempted from a required school uniform policy 4. Notification of a required uniform policy must be given to parents/guardians at

    least six months prior to implementation. (Education Code 35183) 5. The principal or designee shall also repeat this notification at the end of the

    school year so that parents/guardians are reminded before school clothes are likely to be purchased.

    No student shall be penalized academically or otherwise discriminated against nor denied attendance at school if the student's parent/guardian choose not to have the student comply with a school voluntary or required uniform policy. The principal shall communicate to all teachers, noon supervisors and other staff the names of students who are exempt from a required uniform policy. Each school may develop incentives and positive reinforcement measures to encourage full compliance with a voluntary or required uniform policy. Disciplinary action may be taken to encourage compliance with a school required uniform policy (except toward students exempted by the parents/guardians as provided for by this policy). Prior to initiating any disciplinary action against a student for not complying with a required uniform policy, the student or the principal or designee shall conference with the student's parent/guardian to solicit parental cooperation and support. However, no student shall be suspended from school, or from class, or receive a lowered academic grade as a result of not complying with a school uniform.

  • AR 5132(h) STUDENTS DRESS AND GROOMING (cont.) The Superintendent or designee shall establish criteria for determining student eligibility for financial assistance when purchasing uniforms. The principal shall identify a source for any needed financial assistance. No student shall be considered noncompliant with the policy when: 1. Noncompliance is due to financial hardship 2. A student wears a button, armband or other accouterment to exercise the right to

    freedom of expression as provided for in Education Code 48907 (see BP 5145.2 unless the symbol is related to gangs as stipulated in BP 5136) or is in violation of student dress and grooming standards (as stipulated in AR 5132.

    3. A student wears the uniform of a nationally recognized youth organization

    (example: Scouts) on regular meeting days 4. The wearing of a uniform violates a student's sincerely held religious beliefs 5. A student has on file with the school a "request for exemption from the student

    uniform requirement" signed by a parent/guardian in the presence of a school employee

    Schools requiring students to wear uniforms shall evaluate the uniform policy on an annual basis to determine the effectiveness of the policy and to consider appropriate modifications.     BACKGROUND By state law, the Citizens’ Oversight Committee, established to oversee expenditures of bond funds from the Measure M bond passed in 2002, must consist of at least seven (7) members and must include:

    • One member who is active in a business organization representing the business community located within the school district

    • One member who is active in a senior citizens’ organization • One member who is a parent or guardian of a child enrolled in the school district • One member who is a parent or guardian of a child enrolled in the school district

    and active in a parent-teacher organization • One member who is active in a bona fide taxpayers’ organization

UNIT MEMBERS ================================================================== BACKGROUND The present Collective Bargaining Agreement between the Chino Valley Unified School District and the Associated Chino Teachers (A.C.T.) was ratified without negotiated changes that were necessary to the following provisions of the contract: Appendix B- Miscellaneous: “When opening a new school, unit members may have three (3) days of substitute pay ($90.00 per day) for additional services to be rendered as assigned by the principal.” Appendix C- Substitute Rate: “The daily rate for unit members substituting while off contract, and during summer months shall be $115.00.” With the increases to the certificated substitute schedule, it is necessary to reflect proportionate changes to the provisions that apply within the A.C.T. contract. This will increase a unit members substitute pay from $90.00 to $125.00 when an A.C.T. member is opening a new school and an increase from $115.00 to $150.00 per day when substituting while off contract and during summer months. This was reviewed with A.C.T. Approval of this item supports the goals identified within the District’s Strategic Plan. RECOMMENDATION It is recommended the Board of Education approve an increase in substitute pay for A.C.T. unit members.

    BOARD MEMBERS AND SUPERINTENDENT Sylvia Orozco thanked Brenda Dunkle for accurately reporting issues; acknowledged the individuals involved in after school programs; asked Dr. Enfield for a status for online grades (Dr. Enfield responded that October 24 is the expected date); and thanked the Richard Gird Educational Hall of Fame Committee members for volunteering their time to ensure that District history is not lost. Charles Dickie thanked Carissa Ramirez for her words of wisdom and thanked the youngsters from Chino HS who stood in solidarity to express their views; thanked Brenda Dunkle for her dedication and all that she does; thanked Todd Hancock for his words and tribute to his father; and encouraged people to vote on November 4.

    Andrew Cruz congratulated Brenda Dunkle; thanked Don Lugo HS principal Ms. Cabrera, Mr. Bunselmeier, staff, and parents for their work on the Conquistador Classic; said Chino Youth Boxing Club’s gym received a face lift throughout the facility, and noted that there is a young boxer, age 15, who has the potential to go to the Olympics; attended the parent nights regarding the Common Core; said that the number one priority is being emboldened to parents, and that it is important to put across the information in a more understandable format and we need to do a better job at presenting information to our community; stated that he believes, throughout his years of teaching, that what we do not get in public schools is discipline and reminders of the working of consciousness, and that we need to alert youths about the workings of consciousness and listen to the voice of consciousness tying into the divine spirit, the quiet place of the most high; and closed with Zachariah 4:6. Irene Hernandez-Blair followed up on Mr. Cruz’s comment on the parent Common Core information nights and asked that feedback/”how we did” cards be provided to parents in the future; highlighted her Dickson ES superstars spirit wear; reflected on the time when she first met Brenda Dunkle at a Dickson ES event when her son was in kindergarten, and that she appreciates the wonderful pictures she shares with the community about our students; spoke about the original purpose of the AVID program, which was created to serve the underserved and the neediest whose parents have traditionally not continued to college, and students who may be the first in their families to attend college; said that the AVID program funding is not being cut but rather that it needs to remain true to its original purpose, the way it was intended; said there have been some sites who serve the underserved and there are those sites that serve students whose parents attended college and are highly educated; discussions will continue regarding the blending of the student populations who are being served, and said that we can think of other programs for college bound students; spoke about the process associated with the Board agenda distribution and how she reviews it; explained why it is difficult to respond to emails regarding concerns on an agenda item if she receives questions the day before or day of the meeting; said that it is National School Lunch Week and that 29 million children throughout our nation receive free lunch at public schools; acknowledged parents who have expressed concerns over the lunch program meals, and encouraged them to speak to their school principals because it is a legitimate concern; thanked all employees who play a role in ensuring that students get a proper meal; said that it is Breast Cancer Awareness Month and Pregnancy and Infant Loss Awareness Month; said Bark for Life is having an event at Boys Republic for cancer awareness; said the City of Chino is hosting a “Meet the Chiefs” event on October 18 at the Chino Police Headquarters so residents can say goodbye to Chief Miles Pruitt and hello to newly-promoted Chief Karen Comstock, who is a product of CVUSD, and said she is grateful to Chief Pruitt because he really believes in serving; and thanked everyone for staying at the meeting. Superintendent Joseph said that parent nights on Common Core State Standards and Smarter Balanced State Assessments have taken place; said parent engagement on the Local Control Accountability Plan are scheduled for October 23: one at 9:00 a.m. and the second at 6:00 p.m. at Ramona JHS in English and Spanish; said this will be the sixth year that parent information nights on cyber issues and drugs with the first scheduled for

    President Na acknowledged students from Chino HS’s Christian Club and a player on the girls’ soccer team; commented on Carissa Ramirez’s statements; reflected on Todd Hancock’s comment regarding the honor it is to be a teacher; said he attended the funeral services for Lana Christianson, who passed away at age 49 after undergoing 174 chemotherapy treatments; said that her love for her children continued to her last days; and read The Calling from Roger Fields.

    BETWEEN FUNDS OF THE SCHOOL DISTRICT ================================================================== BACKGROUND For the past several years, the State has deferred the apportionment of a significant amount of K-12 funds to the subsequent fiscal years. When the State defers apportionment payments to the District, it results in a mismatch between receipt of projected revenues and ongoing expenditures, and could cause a shortage of cash. Interfund borrowing is a form of borrowing on a temporary basis between other available funds of the District. Education Code 42603 specifies that the governing board of any school district may direct funds to be temporarily transferred to another fund or account of the District. Interfund borrowing must be repaid in the same fiscal year, or the following year, if borrowing takes place within 120 days of fiscal year end. Approval of this item supports the goals identified within the District’s Strategic Plan.     Resolution to Authorize Temporary Borrowing Between Funds of the School District

    WHEREAS, the San Bernardino County Treasurer does not have authority to honor warrants drawn on school district funds with insufficient cash balances in the absence of an approved borrowing arrangement with the District;

    WHEREAS, the Board of Education of any school district may direct that moneys held in any fund or account may be temporarily transferred to another fund or account of the District for payment of obligations as authorized by Education Code 42603;

    WHEREAS, actual interfund transfers shall be accounted for as temporary loans between funds and shall not be available for appropriation or be considered income to the borrowing fund or account; and

    WHEREAS, amounts transferred shall be repaid either in the same fiscal year, or in the following fiscal year if the transfer takes place within the final 120 calendar days of a fiscal year.

    NOW THEREFORE, BE IT RESOLVED:

    1. The Board of Education of the Chino Valley Unified School District hereby authorizes, for fiscal year 2014/2015, temporary transfers between the following funds and authorizes the San Bernardino County Treasurer to honor warrants drawn on those funds, regardless of their cash balances, provided the aggregate cash balance of all those funds is positive: All funds.

    2. The Board of Education of the Chino Valley Unified School District hereby authorizes the Superintendent or his designee to approve any actual interfund transfers processed between the above-mentioned funds and requires that any actual transfer of funds pursuant to this resolution be ratified by the Board as soon as practicable.

    =================================================================== BACKGROUND In an effort to cultivate 21st Century learning and ensure our students thrive in today’s world, the District would like to establish partnership with Kaiser Permanente to offer Magnolia JHS students an opportunity to participate in the Kaiser Permanente Hippocrates Circle Program (HCP). The HCP was established in 2000, as a proactive, physician-run mentoring program for underprivileged middle-school students. The goal of the HCP program is to encourage minority students and their parents to set academic goals and to inspire them to believe that they too can have a career in medicine. This program provides a road map, tools, and encouragement to assist the parents and students who may decide to choose the pathway of a medical career.     communities and diverse backgrounds the awareness that having a career as a physician is possible

    for them. Through the collaborative efforts of the local school districts, medical schools, and the

    physicians from the Southern California Permanente Medical Group and Kaiser Permanente

    sponsorship, the HCP will strive to strengthen the self-esteem of young people and empower them

    to pursue their goals to become physicians. The selected individuals enrolled in the HCP will have

    several opportunities in their fellowship to interact with practicing physicians.
