I. INTRODUCTION

I. Introduction:

1.1. General Introduction on the project:

1. The project's objective is to upgrade and expand the IlOkV, 22kV, and 35kV

rural distribution network in rural areas that have quick increased load demand, in

order to improve the capacity of rural distribution network and meet the electricity load

growth demand as well as ensure power supply.

The project investment is aimed to (a) restore, improve and expand the power system

of Dak Lak province to meet the energy demand for the social and economic development up

to 2010; (b) increase the fidelity and the quality of the power network, reduce power loss on

power network; (c) increase power purchase effect.

The Rural Distribution Project (RD) in Dak Lak includes: (i) Build the IlOkV power

network and IlOkV substation implemented by EVNCPC.

Main issues on Rural Distribution network includes:

.The load demand in rural area increase from 13%-14% on an average and does not

meet the social-economic development and production of the rural areas .

• The level of power used in daily life and production is increasing; the overload of

power network and distribution substations is very common. Meanwhile, the demand of

stable and safe power supply in the rural areas also rises but the quality of power supply is

still insufficient.

• Investment capital source is limited.

2. The Rural Distribution Project, Dak Lak province:

In order for the social and economic development of Dak Lak province to reach the

average GDP improvement of 10.8%/year in the period of 2006-2010 and 13%-14%/year in

the period of 2011-1015, with the load demand of 374.714 million kWh in 2005, 813 million

kWh in 2010 and 1,302.089 million kWh in 2015, Dak Lak province decided to join the Rural

Distribution Project with a belief that the implementation of the project will meet the load

demand for the area, enhance reliability in power supply and reduce power loss. Thus, this

will improve the efficiciency in power business in Dak Lak province in particular and for

power sector in general.

The Rural Distribution Project in Dak Lak province includes 3 main parts:

~ Expand 01 110kV feeder at Ea Kar llOkV substation.

- Build the Ea Kar-Krong Pak 110 kV line of27.576 km long.

- Build new Krong Pak llOkV substation with the capacity of2x40MV A.

1.2. Legal framework on ethnic minority

Ethnic minority development plan is built on OP 4.10 instruction about ethnic minority

ofWB and the state's policies of ethnic minority.

1.2.1. Legal system of the Socialist Republic of Vietnam.

According to Clause 5, Constitution of the Socialist Republic of Vietnam (1992), it is stated

that: "The Socialist Republic of Vietnam is a united government with all ethnic groups living

in the country. The Government issues the policy of fairness, united and mutual support

between the ethnic groups; all activities of discrimination and division within the country

should be banned. All ethnics have· the right to use their own language and written language

to retain their national characters, they have the right to promote their customs, traditions and

their beautiful cultures. The Government applies the policy of comprehensive development to

gradually enhance the mental and spiritual living standard of the ethnic minority people.

According to Clause 94, constitution of the Socialist republic of Vietnam (1992), it is

stated that ''the Committee of ethnic minority has the right to propose and set plan to the

related issues to the national assembly and to supervise and control the implementation of

national policies as well as development programs on various aspects such as education and

health care.

The participation of the Ethnic minority assembly and the Committee of mountainous

and ethnic minority in the Government together with many programs of social-economic

development, natural resources development in mountainous and remote areas is the evidence

of the united policy on fairness and anti~racial discrimination for the ethnic minority people,

with the promises to enhance the living standard of the ethnic minority people being carried

out by Vietnamese Government.

According to the Vietnamese Government, the ethnic minority people have the

following characteristics:

- Have deep knowledge and permanent resident on ancestors' land, have strong

attachment to natural resources.

- Be self-recognized and be recognized by the surrounding members based on different

cultures.

- Use different languages from the national language

- Have traditional and permanent legal system and society.

- Have self-sufficient production.

1.2.2. WB's OP 4.10 policy on ethnic minority:

The objective of the ethnic minority framework is to ensure the development schedule,

encourage them to develop their human dignity, human right and culture, help them to gain

appropriate cultural, social and economic advantages. The WB's OP 4.10 on the ethnic

minority states clearly that the proposed strategy for the available issues should link to the

issues of ethnic minority and should base on the announced participation of the ethnic

minority people themselves. Hence, it is very important to define the priority order in the

local area through direct community participation and consultation together with the

knowledge of the ethnic minority people on the project approach and immediate use of

experienced experts for any project that has impact on the ethnic minority people and their

rights for the natural and economic resources.

The legal framework of the Vietnamese Government related to the ethnic minority

people has the same content as the WB's OP 4.10 policy on the ethnic minority people.

1.3. The Ede ethnic minority group in the project area:

According to the statistics, the total population in Dak Lak province is approximately

1.728 million people, including 44 ethnic groups, among which the ethnic minorities account

for 31.97% of the total population in the whole province (about 97,893 HHs - 540,365

people), the permanent ethnic minorities here such as Ede, Jarai, M'Nong, etc account for

59.6% of the ethnic minorities, the rest are Nung (11.5%), Tay (9.3%), Coho, X'Tieng,

Xodang, etc. The project area only affects the Ede people and a few Tay, Nung, Dao ones.

The Ede lives mainly on planting crops. Their main grains are oryza sativa rice and

cassava. They use simple cultivation tools, mainly large knives for tree cut, bush clearance,

soil excavation and also, there is a stick to make hole when spreading seeds. The breeding of

cows, pigs, dogs and poultry develops. Men are professional in weaving Vietnamese basket

(gui) and basket; women are good at weaving loin-cloth, skirt and shirt for the family.

Hunting, gathering, fishing are other sub-economic activities that have considerable

contribution to their lives.

The production of a majority of Ede people follows a scheming arrangement of the

local authority. They have low intellectual level and many backward customs.

Despite of their different language, culture, customs and lifestyle, in general, they live

in harmony with the Kinh people.

Their children study in the same schools as Kinh children. They also join cultural

activities and share available economic chances and public benefits.

The majority of old ethnic minorities are illiterate.

Besides, some ethnic minorities with different customs migrate here, but in general,

their daily life is the same as Kinh people.

II. Basic information

11.1. Social assessment

Dak Lak: province is in the central highland area of Vietnam. In the last decade, thanks

to the transfer of economic structure and the national technical scientific development, Dak

Lak province generally has rapid economic growth: GDP rises 10.8% on the average, among

which industry accounts for 22-23%, forestry and agriculture: 5-6%, services and

commerce:21-22%. GDP per capita reaches 17 million VND.

The ethnic minority in Dak: Lak province in general and the Ede in particular

gain benefits from the country development and their living condition is raising considerably.

However, they are still inferior to Kinh people due to many reasons such as the closing

traditional economic and social system, the dependence on the exhausted natural resources,

lower education, more members in a family and the low economic starting point. Therefore,

the ethnic minority should be paid attention to so as to ensure that they are treated fairly and

the benefits from the project implementation they gain are equivalent to their own economic

and social structure. Besides, in the project area, there are some affected Nung and Dao HHs.

These HHs are not native people. They move from another regions and buy Ede's land for

cultivating, planting and breeding.

According to the investigation results, the ethnic minorities in affected communes still

live in groups, forming separate hamlets. In some communes, they live with Kinh people.

Their economy is still self-sufficient. They themselves retain their own economic-social­

cultural features.

Alternatively, the harmony with other ethnic minority groups and the Kinh people in

the project area is a popular trend in the project communes. Hence, the ethnic minorities in

the project areas gain many benefits such as developing the socio-economic awareness,

improving skills and workmanship in production.

II.I.I. System of land use right:

According to the Land law of Vietnam, the ethnic minority farmers have the

equivalent rights to the local Kinh people, they also have cultivated land and are granted with

permanent land use right certificate. The ethnic minorities of the affected communes are also

granted with agricultural land as others. Their average area of wet rice is the equivalent to that

of Kinh people. Besides, they also have fields and fields on the mountains due to burnt-over

and inheritance from their ancestors to plant industrial trees and crops. Despite of the vast

land area here, many HHs still have limited investment skill that leads to the limited

agricultural development, causing difficulties for the local people (including Ede people) to

gain income.

11.1.2. Production.

All the communes that have ethnic minorities are agricultural ones. The ethnic

minorities and the Kinh people here live mainly on cropping, breeding and planting industrial

trees.

The local crops include wet rice and dry rice, corn, cassava and some vegetables. Fruit

trees are mainly durians. tongans, avocados, etc.

Industrial trees are coffee, pepper, rubber.

Traditional castle in these communes are buffaloes, pigs, cows and pOUltry. However,

the breeding still develops in small scales in ethnic minority groups.

II.!J. Living standard and living conditions.

The communes in the area that have affected ethnic minorities currently have good

traffic roads and cart ways that run through the area of the communes of the project and have

roads that lead to the commune centers. All communes have primary schools, secondary

schools, kindergartens, cultural houses, radio stations and clinics. However, many communes

do not have gathering markets. The people's income is based mainly on agriculture. Average

income: 7,049,180 people/year or 5870432 VND/person/month.

Living conditions of affected HHs:

* 100% HHs get water from driven wells and drilled wells.

* 100 % HHs have TV and other electrical appliances.

Table 2-3 provides some data on the living conditions of the ethnic minorities in the 05

affected communes

II.IA. Culture-Education:

Based on the general situation in Vietnam and Dak Lak province, the ethnic minorities

have preferential policies in the education system, including free school fee and advantages in

the university entrance exam. However, the percentage of illiterate adults is still very high in

comparison to the number of ethnic minorities in Dak: Lak: province in general and in affected

communes in particular. According to the investigation results, the illiterate percentage of the

communes in the project area is still very high, mainly on the elderly. Most of the ethnic

minority children can go to schools. The local education system is in good condition and near

the community.

Currently, the majority of Ede living in affected communes wears their traditional

costumes and speaks their language. Some Ede youngsters can speak Kinh language as they

go to Kinh schools, only a few elder people cannot speak this language.

In the society of the ethnic minorities, the hamlet leader or the village patriarch plays

an important role in the spiritual aspect of the whole society. They have full respect from the

villagers. They are the mental consultants, the peacemakers, and the ones who make decisions

for everything in the commune. People ask for their opinions when building houses, holding

wedding ceremonies or other family business. Therefore, in order to follow the Government

policies, the development programs and other obligations, the authority and other

organization have to cooperate and exchange information with the village patriarchs of the

ethnic minority groups.

11.2. Project impacts:

According to the selected investigation results, 05 communes in the project ofDak Lak

province have affected ethnic minorities due to temporary or permanent land loss and assets

loss.

On average, the number of affected ethnic minorities of 07 communes accounts for

50% of the total affected HHs. The average number of people of each ethnic minority HH

(6.6 people/HH) is much larger than that of the Kinh (5.2 people/HH). According to the

selected study result, in affected communes, the affected ethnic minorities are Ede and a few

ofNung, Dao.

11.2.1. Land loss and impacts on resettlement

The RD Project in Dak Lak province does not cause serious and long-lasting impacts

on the resettlement plan of the ethnic minorities. The project only affects a few Ede ethnic

minority groups in 05 communes ofEa Kar and Krong Pak district ofDak Lak province.

The table 4-1 and table 4-2 show brief data on land loss and impacts on ethnic

minorities. Details about project impacts on ethnic minorities are in Annex 1 to Annex 6. In

total, there are 42 ethnic minority HHs (244 people) suffering from the project due to

temporary and permanent land loss, assets loss together with land loss.

Out of the total land-holding area of 683,369 m2 of the ethnic minority people, only

184,633 m2 is permanently and temporarily affected due to the construction of power

network. 01 HH with breeding facilities in ROW will be assisted on removal out of ROW in

the area of this HH's land. Therefore, there is no impact on their life and production. No

ethnic minority HH is seriously affected by resettlement or loss of business places.

All ethnic minorities HHs have permanent land use right for affected land. There are

42 ethnic minority HHs that has loss of trees/crops (mainly vegetable, manioc, fruit tree and

long-term trees. The project has no impact on spiritual land or sensitive areas.

11.2.2. Positive impacts of the project:

Continuing the poverty reduction program, Vietnamese government is seeking for the

international support. The Distribution Efficiency Project (DEP) in Dak Lak province is

financed by WB with an aim to improve the living standard in the rural area, among which

are the poorest communes, by providing basic infrastructure and power supply. These are the

supportive factors for economic and social activities in the project area.

According to the feedback results and group discussion, both the ethnic minority

people and Kinh people support the project investment, even when they lose cultivated land.

In their opinion, the increasing power source will bring them a lot of advantages, and bring

about positive impacts on their daily life and economic conditions rather than causing

negative impacts (which actually are very little).

11.3. Public consultation and participation

During project preparation, some discussion and community consultation were carried

out with the local authority and the ethnic minority people in 05 communes of affected ethnic

minority people. In the community of the ethnic minority people, the commune leaders and

village patriarchs gain the most respect and play an important role in consultation for the

people. They are invited to the meetings to be provided with information about the project,

resettlement plan and the EMDP. The consultants presented the information about expected

position of the project and about the resettlement plan. Those who attend the meeting are

asked to raise their ideas about the potential harms of the project to propose solutions and

development plan. The local authority, among which many are ethnic minority people,

eagerly participated in the data collection process about potential harms of the project for the

ethnic minority people.

The ethnic minority people in 05 affected communes all support the project. The local

authority and the local people eagerly participate in the discussion about demand, difficulties

and requests towards the project in order to make use of and improve the benefits brought

about by the project to increase the income level and enhance the economic-cultural-social

life. The people who are asked for opinions show their wish to participate in the private work

such as construction and providing building materials. The ethnic minority people are mainly

asked for opinions in improving the current agricultural production. The feedback of the

ethnic minority people and local authority are put in the contents of this development plan.

Through the consultation of the local authorities and ethnic minority peoples in the affected

areas, the people have following feedback about possible adversed impacts of the project:

• Electric shocks and accidents during construction;

• Life of people in the area are interfered by the construction and workers;

• During construction, it is requested to maintain natural environment, ecological

environment and traditions of the ethnic groups;

• Measures to collect garbish are needed and the layout must be returned to locality

upon completion.

• Measures for safe use of electric power must be provided to ethnic groups.

All these feedbacks and measures are included in this EMDP. Consultation activities will

be maintained during project implementation. The draft and final version of this plan will

be disclosed in accordance with guidance of the WB.

11.4. The Ethnic Minority Development Plan (EMDP)

As the project is implemented in the area crowded with ethnic minority people, the

resettlement should be limited to the minimum.· Also, negative impacts on ethnic minority

people should be avoided during project design, implementing methods and implementing

schedule. However, land loss is stilI unavoidable. Actually, the construction of power

network only has individual impact at a low level. Most of the impacts on land of the ethnic

minorities are inconsiderable and temporary. Some HHs will lose land permanently due to the

construction of power tower and substations. However, this accounts for a very low

percentage in comparison to the area of land-holding area, no HH loses more than 10% area.

The project's items do not pose serious impacts on cultural aspects of the affected ethnic

minority HHs, and do not affect much on the economic and social aspects of the whole

community. Based on the possible impacts of the project, we shall have measures and

development activities as mentioned below. These are built up based on the following

policies:

+ The project development should respect human dignity, human rights and ethnic

cultural features.

+ The ethnic minorities do not have to suffer from negative impacts during project

development.

+ The ethnic minorities can have adequate economic and social advantages.

IL4.l. Information disclosure of the project:

The information disclosure about resettlement was, is and will be carried out as a part

of the RP for affected people, including the ethnic minority people. However, to avoid

potential language barrier and to ensure the respect towards the ethnic minority people, the

information campaign of the project, if necessary, can be carried out in the language of the

ethnic minority people. The ethnic minority people should be announced widely about the

EMDP. To carry out this activity, the resettlement brochure and other advertising documents

for the ethnic minority people will be put in the places that are appropriate to their daily life

and their culture. The information disclosure about the project for the ethnic minority people

will be carried out at the same time of the RP progress/schedule in the general information

campaign about resettlement plan. Consultants, NPMU staves and construction units should

cooperate with the related communes to complete the mission. All expenses are borne by the

power sector.

11.4.2. Power safety guidance:

Most of the people in the project area are supplied with power from the local power

network. However, to ensure power safety, if necessary, guidance for ethnic minority people

should be carried out. For efficient guidance, NPMU of Central Power Corporation should

cooperate with the communes to define the demand in power safety training and guidance for

the ethnic minority HHs. The power safety training includes:

shock. These leaflets will be provided for all families in the project area.

- Power safety guidance and first-aid of electrical shock at every commune for the

local people and primary and secondary students.

The budget for this activity is provided by t.':le power sector.

11.4.3. Job assistance related to the project:

Serious affected ethnic minority people will have the priority to be recruited for the

jobs related to the project.

Step 1: NPMU (EVNCPC) can require the contractors to recruit the serious affected

people to the positions related to the project.

Step 2: The local authority will investigate the job demand of serious affected people

and inform NPMU (after the completion of Detail Measurement Survey)

Step 3: Contractor recruits serious affected people during implementation.

NPMU, local monitoring agency and the commune organizations will supervise the

recruitment of the local people.

II.4.4. Solutions

1. The implementation period should be after crop harvest (with appropriate

implementation schedule)

2. Set up regulations of road safety during implementation.

3. Set up warning signs in dangerous area.

4. In the contract of contractors, there should be necessary clauses to limit the impact

during construction. In these clauses. NPMU should point out: If the contractor does any

harm to the assets of the ethnic minority people, they should compensate in accordance with

equivalent value.

5. Strictly and clearly monitor the EMDP implementation.

III. Organization and implementation

The details about the organization and implementation of the project is stated In

Section 7

In order to thoroughly implement the EMDP, EVNCPC and NPMU can cooperate or

work independently to:

- Make up the appropriate number of people to carry out the project items.

- Hire professional experts for EMDP

- Set up at-site office for thorough work performance

- Periodically supervise through inside and outside monitoring organization.

- Ensure clarification during implementation through the information campaign.

- Ensure that the leaders of the ethnic minority people can participate in RP and EMDP

preparation steps.

IV. Supervision and appraisal:

The supervision of EMDP implementation is a part of the implementation of RP. The

RP describes the general plan to supervise the RP implementation.

During project, the independent monitoring organization recruited by the NPMU will

supervise and appraise independently the progress reports on RP and EMDP implementation

by NPMU, conduct interview of representatives of farmers of ethnic groups and evaluate the

EMDP implementation and capability of the people involved in EMDP implementation.

The independent monitoring organization (IMO) recruited by the NPMU requires

professional staves that have knowledge in sociology or anthropology_ The IMOs should

check and assess the report of RP and EMDP implementation schedule of NPMU and

EVNCPC; review the information in the Rural and mountainous development department in

Dak Lak province, agricultural encouragement center, Dak Lak industry and trade

department; interview farmer representatives of the ethnic minority people, displaced person;

preview the local development criteria in the communes of ethnic minority people; assess the

implementation ofEMDP and the ability of the EMDP participants.

V. Cost estimate:

- Some parts of EMDP have cost estimate in the resettlement expenses of RP

(compensation and resettlement expenses).

- To save money, pes, NPMUs and related branches to RP and EMDP should combine

meetings with the training programs.

Information from the Social impact assessment and the meetings with ethnic minority

groups will be used in designing the project, implementation schedule and implementation

methodologies for sub-projects and cost estimate for necessary work, including:

a. Proposal to change the line route, position and implementation methods and

implementation schedule for subprojects to meet the demand and priority. of the ethnic

minority groups:

Community participation and consultation are carried out during the pre-designed

period of the line route, tower position and prior consideration for the ethnic minority people

in the project area.

The implementation schedule avoids the harvest period. Although the required

implementation period of the project is 18 months, the workers work 02 shifts/day so that the

implementation can begin right after the harvest and complete before the next crops.

However, temporary negative impacts for crops will be compensated at market price.

b. Notice the sensitive cultural, spiritual or ecological zones that needed to be put into

consideration during design and implementation

The sensitive zone should be carefully put into consideration during pre-design period.

However, these sensitive zones are not in ROW.

c. Develop informative program, and educational program for the ethnic minority

community in the affected area about power safety, healthcare and social issues.

d. Land acquisition and compensation: Wherever there is land acquisition, the people

rights are ensured not to be encroached and they will be compensated in an appropriate way

to their culture. Compensation will base on the resettlement plan for project displaced

persons. The leaders of ethnic minority community will a~sist the community participation

and consultation and compensation.

*Land compensation will be at replacement price as defined in RP. However, it should

be noted that 42 ethnic minority HHs have certificate for land use right in comparison to their

total land-holding area.

* Representatives of affected ethnic minority people of each commune in the project

area should always be available in the ethnic community.

* The ethnic minority people can get the administrative structure, appealing structure

as well as other monitoring structures as stated in the RP.

area during sub-project implementation and maintenance. Serious affected HHs

will be assisted in agriculture, job changing and work. In agricultural assistance, if

the land being reclaimed is in the financed areas ofWB, the areas of ethnic

minorities should be in priority order.

Training guidance

The ethnic minority people in the affected area will be provided with power safety

guidance. Leaders of this community will be included in the training of social assessment,

resettlement and supervision of implementing the ethnic minority development plan.

Gender assistance

Special community participation and consultation is carried out for women, especially

female family leaders such as agricultural development, agricultural encouragement, or

fertilization, etc.

The RD Project in Oak Lak province is invested by EVNCPC (financed by WB) with

an aim to reduce power loss and increase the power supply to every household in Oak Lak

province. The project is under the management ofNPMU of EVNCPC.

+ EVNCPC (financed by WB with Government approval): Build llOkV line and

llOkV substation.

All HHs, organization and individual that lose land and assets such as houses,

construction,trees, crops temporarily or permanently due to the construction of project items

(line, tower foundation, substation), or due to their location in safety zone (ROW) of the

power network.

2/ Who delineate the affected area and affected assets?

+ NPMU (EVNCPC) and the district and commune People's committee will delineate

the affected area and the affected HHs based on the map of line route and substation. After

that, they will carry on preliminary supervision and then detailed supervision, point out the

rights of affected HHs before project implementation.

+ Affected areas are located in power safety corridor, which is defined by a distance of

4 m between the outermost cable to the ones on two sides (Decree 106/20051ND -CP dated

August 17th 2005)

3/ Types of impact

+ Permanent impact: land, houses, construction and trees (more than 4 m tall) in safety

corridor of the line route/tower foundation and substations.

+ Temporary impact: trees, crops and other assets affected during construction

4/ Will the land in ROW be taken for the project?

No. However, only use the land for crops under 3 m tall and re-use residential land for

usage limitation.

5/ Who will be compensated, who won't be compensated?

+ All HHs, organization, individuals whose assets (land, houses, construction, trees

and crops) are affected by the construction and those who can provide evidence of land use

right and the right of using their assets before the deadline (May 17th 2011) will be

compensated and assisted.

+ Those who acquire land or construction after deadline will not be compensated. The

owners have to remove their assets themselves.

6/ Compensation price:

+ The compensation price is made by the Dak Lak People's committee based on the

local market price.

+ All affected people will be compensated with reduced expenditures-actual market

price at the time of resettlement, and the purchasing expenses (if any) - for affected assets,

with no depreciation or material reduction.

+ Affected land will be compensated by the same type of land, or in cash.

71 For affected houses:

+ Technical methodologies will ensure that no house will be removed. However, if

required, the following steps should be carried on:

+ In case the affected parts of the house/construction do not affect the remaining ones

of it, the compensation will be paid for the affected part together with the home repair costs.

+ In case the affected parts of the house/construction affect the remaining ones of it,

and these remaining parts are damaged, the whole house/construction will be compensated.

8/ When will the affected people receive compensation and move out?

+ The resettled people should be compensated with land, houses, construction, trees,

and crops at least 03 months before handing over the land for the project.

+ Those whose houses are partly or fully affected and have to build another houses on

the remaining land area will be compensated for affected land, houses, construction, trees,

crops at least 2 months before handing over the land for the project.

+ Those who have affected trees and crops will be compensated at least 1 month

before implementation.

9/ For those who have to resettle, do they have any other right besides being

compensated?

Serious affected HHs (lose more than 10% of land area) will receive development

assistance stated in RP and EMDP

10/ Do the affected people have to move out or suffer from site clearance after

receiving a part of compensation and allowance?

Affected people must hand over the land or carry on site clearance when receiving

enough compensation or other rights.

ll1When receiving compensation, will affected people be asked by the compensation

department to donate a sum of money for an organization?

No one has the right to take back the compensation and other rights of the affected

people.

121 Who will announce the affected people about the compensation schedule, land

acquisition, site clearance and related information?

NPMU, commune People's committee are responsible for the announcement to

affected people about the RP, compensation policy and resettlement plan, rights of affected

people, compensation schedule, land acquisition schedule, site clearance and implementation.

131 In case the affected people do not agree on the detailed survey results, where can

they complain to?

+ The commune People's committee

+ In case the affected people disagree with the solution of the commune people's

committee, they can complain to the district people's committee and NPMU. The complaint

and grievance should be solved in 15 days.

+ In case the affected people do not agree on the solutions of the district people's

committee, the complaint and grievance will be solved by the court.

The complaining people do not have to pay administrative expenditure at different

levels.

141 Who monitor the compensation process?

An in-house unit ofNPMU will internally monitor the RP

An independent organization is hired by NPMU to externally monitor the RP and

EMDP

151 Responsibilities of affected people:

+ Participate in all meetings that have related contents and read related information.

+ Prepare related documents such as Certificate of land use right, Vietnamese

registration system, certificate of other assets.

+ Read and understand thoroughly the declaration form of social economic survey,

DMS, asset inventory, resettlement and compensation commitment, and participate in all

activities.
