Ms. Brown: This is to confirm our conversation this morning wherein I told you that pursuant to AS 15.13.076(2): “A contribution to a group may be received only by the group’s campaign treasurer or a deputy treasurer”

During that conversation you asked whether or not you, not being a treasurer or deputy treasurer, could legally receive name, address, occupation, employer and credit card information from a contributor and then pass that information on to a treasurer or deputy treasurer for the transaction to be processed. I have been unable to find a clear answer to that question. Neither the statute nor the regulations define the word “receive” for purposes of who may receive contributions. There appear to be reasonable arguments on both sides of the issue.

Thus, if you were to accept the contributor information you asked about; it might be considered an illegal receipt of contributions. If someone filed a complaint, APOC staff would investigate, make a recommendation to the Commission; and the Commission would decide how to interpret the statute given the facts of the case.

You may, however, request an advisory opinion concerning this issue. In that case, staff would make a recommendation to the Commission, and the Commission would issue an Advisory Opinion that you could rely on to guide your actions.
