That the School Board recognize 31 students who earned first place wins at the Future Health Professionals, formerly known as Health Occupations Students of America (HOSA), statewide leadership conference.

Background Summary:

With roots dating back to 1957, Future Health Professionals today is the largest national career and technical organization for students interested in health and medical science careers. Competitive events are held at statewide leadership conferences to recognize the competencies developed by students in health science and biomedical science class instruction; related job training; and HOSA activities. At Virginia’s statewide leadership conference, VBCPS students earned first place wins in multiple categories.

Background Summary:

Educators Rising is a network of teachers and administrators who join for one specific reason: to support the path of high school students who are interested in the teaching profession. The network organizes state and national competitions for aspiring teachers to not only demonstrate their knowledge, skill and leadership, but also to stretch their creativity, commitment and professionalism. Virginia Beach City Public Schools students earned first place wins in nine categories.

That the School Board recognize four Virginia Beach City Public School students who won first place honors in the ProStart State Competition.

Background Summary:

ProStart is a program developed by the National Restaurant Association to foster the passion of students who are interested in the culinary industry. The organization sponsors a statewide competition to showcase students’ talents and creativity by asking them to apply what they learned in authentic environments. Tallwood High School four-member student team submitted a proposal for the next hot restaurant concept and presented it to a panel of industry judges. They also quickly solved challenges restaurant managers face on a daily basis such as clients requesting substitutions of menu items.

Regular School Board Meeting MINUTES TUESDAY, April 18, 2017

INFORMAL MEETING

1. Convene School Board Workshop: The School Board convened in the einstein.lab at 4:32 p.m. In addition to Superintendent Spence, all School Board members were present with the exception of Ms. Melnyk who arrived during the closed meeting at 5:36 p.m.; and Ms. McLeod who was absent from the meeting due to a work-related event.

A. School Board Administrative Matters and Reports: Chairwoman Anderson reported because several School Board members have advised of conflicts on the scheduled Retreat dates of July 10 and 11, 2017, an adjustment will be brought forward at the May 2 meeting for the School Board to take action to change the Retreat/Meeting date to July 17 and 18, 2017. In reviewing the current meeting agenda, she noted a closed meeting will be held after the workshop; advised a revision to the Personnel Report was placed on the dais for approval; and announced the addition of a resolution recognizing Virginia Student Voter Registration Week to be proposed during Adoption of the Agenda for approval as part of the Consent Agenda. Other announcements included a reminder of the May 1 Virginia School Boards Association (VSBA) Tidewater Regional Forum to be held in Surry; and accolades by those who attended the Family Life Program held earlier in the day. Discussion concluded at 4:36 p.m.

B. Instructional Technology Update: Amy E. Cashwell, Ed.D., Chief Academic Officer, presented an update on instructional technology as it relates to the Transformational Learning experience for students presented at the April 2 workshop. She explained the process in determining the strategic deployment of devices based on readiness and budget to provide timely supports, the rationale for the use of the Chromebook as the

preferred device, and the goals to provide seamless access and connectivity. Also reported were plans to garner information from the Transformational Learning site to design a targeted professional learning plan. Instructional Technology Specialists and students from select Anchor Schools reported on what they have been doing around student disposition for Transformational Learning, and students presented their perspective on what it’s like to work in that environment. Discussion concluded at 5:31 p.m.

2. Closed Meeting: Vice Chair Edwards made a motion, seconded by Ms. Manning, that the SchoolBoard recess into a closed meeting pursuant to the exemptions from open meetings allowed bySection 2.2-3711, Part A, Paragraphs 1, 2 and 7 of the Code of Virginia, 1950, as amended for thefollowing purposes:

A. Personnel Matters: Discussion of or consideration of interviews of prospective candidatesfor employment, assignment, appointment, promotion, performance, demotion, salaries,disciplining, or resignation of specific public officers, appointees, or employees, pursuantto Section 2.2-3711, (A) (1); namely to discuss setting a date and time for a hearing on thepetition to revoke license of a teacher;

B. Student Matters: Discussion or consideration of admission or disciplinary matters orany other matters that would involve the disclosure of information contained in ascholastic record concerning any student of any Virginia public institution of highereducation or any state school system, pursuant to Section 2.2-3711, (A) (2); namely todiscuss status of a special education case; and

C. Legal Matters: Consultation with legal counsel and briefings by staff members orconsultants pertaining to actual or probable litigation where such consultation orbriefing in an open meeting would adversely affect the negotiating or litigating postureof the Board or consultation with legal counsel employed or retained by the Boardregarding specific legal matters requiring the provision of legal advice by such counsel,pursuant to Section 2.2-3711 (A) (7); namely to discuss status of a zoning case.

The motion passed (ayes 9, nays 0; Melnyk had not yet arrived), and the School Board entered into a closed meeting at 5:34 p.m. prior to Ms. Melnyk’s arrival at 5:36 p.m. Individuals present for discussion: School Board members with the exception of Ms. McLeod who was absent from the meeting; Superintendent Spence; Marc A. Bergin, Chief of Staff; School Board’s Legal Counsel, Kamala H. Lannetti, Deputy City Attorney; and Dianne P. Alexander, Clerk of the School Board. The School Board reconvened in an open meeting at 5:46 p.m.

Certification of Closed Meeting: Vice Chair Edwards made a motion, seconded by Ms. Melnyk, that the School Board certifies that to the best of each member's knowledge, only public

business matters lawfully exempted from open meeting requirements by Virginia law were discussed in the closed meeting to which this certification applies, and only such public business matters as were identified in the motion by which the closed meeting was convened were heard, discussed, or considered. The motion passed (ayes 10, nays 0).

3. School Board Recess: The School Board recessed at 5:47 p.m. to reconvene in the School BoardRoom at 6:00 p.m. for the formal meeting.

4. Call to Order and Roll Call: Chairwoman Anderson called the formal meeting to order at 6:00p.m. In addition to Superintendent Spence, all School Board members were present with theexception of Ms. McLeod who Chairwoman Anderson announced was absent due to a work-related event.

A. VHSL State Vault Champion: The School Board recognized Kellam High School studentEmily Ware for being named Virginia High School League (VHSL) Group 6A GymnasticsVault Champion.

B. VHSL Basketball Player of the Year: Landstown High School sophomore Michael Christmaswas recognized by the School Board for being named the Group 6A Basketball Player ofthe Year by the VHSL.

C. Virtual Enterprises International First Place Winners: Students in the AdvancedTechnology Center’s Advanced Web Design class were recognized by the School Board forwinning several first place awards in the Virtual Enterprise (VE) International Mid-AtlanticRegion’s Annual Business Plan Defense and Trade Show.

D. Government Finance Officers Association Award: The School Board recognized theDepartment of Budget and Finance for receiving the Government Finance OfficersAssociation’s (GFOA) Certificate of Achievement for Excellence in Financial ReportingAward for the Comprehensive Annual Financial Report (CAFR) for the 2016 fiscal year.

7. Superintendent’s Report: Prior to presenting his report, Superintendent Spence announced alldivision comprehensive high schools, with the exception of Landstown, earned the gold level2017 National Council of Excellence Award from the Association of Student Councils (NASC) whichrecognizes student councils for their records of leadership, service and activities that improve theschool and community. It was noted although Landstown did not apply, it has received the awardthe past three years. Superintendent Spence’s report recognized April as National VolunteerMonth, marking a time to celebrate the countless hours volunteers contribute to the division insupport of the social, emotional and academic growth of students. Lawanda Johnson, a volunteer

at College Park Elementary School, was featured as the newest member of the Compass Keepers Club1, for her commitment not only to the school, but also for her commitment to engaging others.

McDonald, that the School Board approve minutes from their April 4, 2017 regular meeting as presented. The motion passed (ayes 10, nays 0).

10. Adoption of the Agenda: Prior to a motion, Chairwoman Anderson announced the addition of a Resolution Recognizing Virginia High School Voter Registration Week to Consent as Item 11E. Ms. Felton then made a motion, seconded by Mr. McDonald, that the School Board adopt the agenda as adjusted. The motion passed (ayes 10, nays 0).

11. Consent Agenda: After Chairwoman Anderson’s review of items presented as part of the Consent Agenda, Ms. Melnyk made a motion, seconded by Ms. Riggs, that the School Board approve the Consent Agenda as reviewed. The motion passed (ayes 10, nays 0), and the following items were approved as part of the Consent Agenda: A. Carl D. Perkins Local Plan for Career and Technical Education budget for 2017-18 grant

funds totaling $799,399 B. Religious Exemption Case Number RE-16-18 C. Policy Review Committee Recommendations as follows:

1. Policy 3-23 Sales / Exchange / Disposal of Property related to the disposal of surplus personal property revised to allow for the sale of items through a third party service for a fair market value, and to provide for donations to an affiliated group for public purposes

WHEREAS, the mission of the Virginia Beach City Public Schools, in partnership with the entire community, is to empower every student to become a life-long learner who is a responsible, productive, and engaged citizen within the global community; and

WHEREAS, the right to vote is an important civil liberty that helps contribute to the health of the American political system as well as to the people who participate in it; and

WHEREAS, voter registration for high school students who are 18, or will turn 18 before an election, should be accessible and convenient for all students; and

WHEREAS, educators play an important role in the development of their students as productive, active citizens, and participation in the electoral process is one of the earliest introductions students can have to becoming involved citizens; and

WHEREAS, Virginia Secretaries of Administration and Education have worked with the Department of Elections and the Department of Education, as well as other interested parties, to conduct voter registration outreach to high school students across the Commonwealth; and

WHEREAS, Governor Terence R. McAuliffe’s proclamation dated March 23, 2017, recognizes April 23-29, 2017, as the second annual Virginia High School Student Registration Week in which teachers and students are encouraged to hold registration drives at their schools so that high school students throughout the Commonwealth who are qualified to register will have a convenient opportunity to do so; and

WHEREAS, nearly 2,500 qualified 17-year-olds registered to vote during the first annual Virginia High School Student Voter Registration Week, and 52,806 18-year-olds voted in the 2016 Presidential Election; and

WHEREAS, Virginians can apply to register to vote at the Department of Motor Vehicles, a voter registration drive, or their local general registrar’s office by filling out a paper application and mailing it to their local registration office, or by completing the online form on the Department of Elections’ website; and

WHEREAS, voting is a fundamental part of our democracy and ensures that everyone’s voice is heard.

13. Information Introducing the State School Quality Reports and VBCPS Campus Compass: Donald E. Robertson, Jr., Ph.D., Chief Strategy and Innovation Officer, provided information on the Virginia Department of Education School Quality Profiles (SQP’s), and redesigned Virginia Beach City Public Schools (VBCPS) annual school report cards now known as the Campus Compass. A review of the old Virginia Department of Education (VDOE) School Performance Report Card was provided along with the background and display of the redesign to include an overview of the state snapshot, local division snapshot, and school snapshot. Also introduced was the redesign of the VBCPS annual school report cards retitled the Campus Compass aligned more directly to the division’s strategic plan -Compass to 2020 – and with the division’s Navigational Markers that are used to monitor progress.

14. Standing Committee Reports: Ms. Weems reminded the School Board of the Southeastern Cooperative Education Program (SECEP) spring plant sale being held at the Renaissance Academy on April 21.

That the School Board approve a resolution recognizing Asian/Pacific American Heritage Month.

Background Summary:

In 1978, a joint congressional resolution established Asian/Pacific American Heritage Week. The first 10 days of

May were chosen to coincide with two important milestones in Asian/Pacific American history: the arrival in the

United States of the first Japanese immigrants (May 7, 1843) and contributions of Chinese workers to the building

of the transcontinental railroad, completed May 10, 1869. On October 5, 1978, President Jimmy Carter signed the

Joint Resolution designating the annual celebration. Twelve years later, President George H. W. Bush signed an

extension making the week-long celebration into a month-long celebration. In 1992, Congress expanded the

observation to a month-long celebration.

During the month of May, the cultural traditions of Americans whose ancestry, native languages, and the unique

experiences of more than 56 ethnic groups who speak more than 100 languages are honored.

This year’s theme is “Unite Our Voices by Speaking Together”. The theme this year provides a single focus for all

Asian American Pacific Islanders to unite by speaking together. With this theme, we can improve representation by

communicating the benefits and importance of diversity. It encourages the various communities to join together to

overcome misconceptions and stereotypes about the vibrant and diverse Asian American Pacific Islander’s community.

The Asian American Pacific Islander’s experience varies greatly and all groups must join together to communicate

individual experiences.

In a Nation that derives so much of its strength from cultures and races, Asian American Pacific Islanders are a

thriving force in our country and our community.

The recognition of diversity promotes unity in our school division as well as supports the School Board’s strategic

plan.

In our desire to encourage unity in the Virginia Beach City Public Schools, we hereby recognize this important event

which will take place the month of May 2017.

WHEREAS, one of our nation’s greatest strengths is its vast diversity which enables Americans

mosaic of races, ethnicities, and religious groups; and

WHEREAS, it is imperative for the good of our nation that schools continue to build awareness

and understanding of the contributions made by Asian & Pacific Islander Americans; and

WHEREAS, through the study of these contributions, all students may find role models whose

participation, commitment, and achievement embody the American spirit and ideals; and

That the School Board approve the proposed FY 2017/18 General Fees Schedule including the rates for student fees for optional/ancillary services or activities, student meal prices, and tuition rates for nonresident students. Background Summary: FY 2017/18 Student Fees School divisions may charge student fees approved by their local school boards pursuant to the provisions of 8 VAC 20-720-80 Student Fees and Charges. The attached fee schedule lists the current and recommended rates for student fees that are subject to school board approval. Fee adjustments or new fees for the 2017-18 school year are shown in red. • Student Meal Prices: The increase in student paid lunch price is to comply with the Hunger-Free Kids Act’s required

adjustments to the weighted average price for paid lunches. Pursuant to provisions in federal legislation effective July 1, 2011, school divisions are required to increase the price of paid meals until the paid meal price plus the federal reimbursement for a paid meal is equal to the federal reimbursement for a free meal. Paid Lunch meal price increase is the only meal price increase recommended for FY 2017/18.

FY 2017/18 Nonresident Student Tuition Fees School Board Policy 3-22 Tuition Fees requires the Superintendent to recommend to the School Board “the tuition fees to be charged nonresident students based on the per capita cost of operations for the preceding session on the elementary level and the secondary level.” Subsequently, per Policy 3-22, “the School Board shall then fix and determine the amount of tuition fees to be charged.”

The attached fee schedule includes the proposed tuition fees for school year 2017-18 as based on the per capita cost of operations for the preceding session on the elementary and secondary levels. The School Board adopted the fiscal year 2016/17 fee schedule with no increase to nonresident VBCPS employees’ tuition rates at any level.

The numbers of students for whom tuition has been collected for various reasons during the current school year FY 2016/17 are as follows:

• Nonresident VBCPS Employees: The children of nonresident VBCPS employees may attend VBCPS schools on a tuition

basis provided classroom space is available. Twenty-nine (29) employees are paying tuition for 30 nonresident students (20 K-5, & 10 secondary).

• Other Nonresidents: There are 12 nonresident students whose parents are paying tuition for various reasons (i.e., custody issues, housing matters, address verification, interstate placement, etc.).

• F-1 International Students: Two (2) students have attended or are attending VBCPS high schools this year on F-1 visas. For reference, School Board Regulation 5-10.3 International Students (in compliance with the “Illegal Immigration Reform and Immigrant Responsibility Act of 1996”) requires students attending public schools on F-1 visas to reimburse public secondary schools for the full, unsubsidized per capita cost of education.

BUSINESS AND NONINSTRUCTIONAL OPERATIONS

Competitive Negotiations/Awards: Procurement of Professional Architectural and Engineering Services A. Generally It shall be the policy of the School Board of the City of Virginia Beach to announce projects, select consultants and negotiate agreements for architectural and engineering services on the basis of demonstrated competence and qualification for services required and at fair and reasonable fees in conformity with the Virginia Public Procurement Act. B. Definition Architectural or engineering services are those professional consulting services associated with research, development, design and construction, alteration, or repair of real property, as well as incidental services that members of these professions and those in their employ may logically or justifiably perform including, but not limited to, studies, investigations, surveys, evaluations, consultations, planning, programming, conceptual designs, plans and specifications, cost estimates, inspections, and other related services. C. RegistrationAnnouncement of projects Architects and engineers are encouraged to submit statements of current qualifications and performance data for registration and reference purposes. The federal government standard form 254 and standard form 255 may be included in this data. These statements will be kept on file by the school board in the Office of Facilities Planning and ConstructionServices and used as a basis for preliminary selection. The Sschool Bboard may announce projects which require architectural or engineering services to qualified firms on file with the Sschool Bboard by publicizing descriptions periodically in applicable media resources or other appropriate meansnewspapers, by posting announcements of projects on a bulletin board, or any other methods to publicize the need for consulting services. Factors to be considered for selection purposes shall be communicated in the project announcement. D. Administrative Review: Expressions of Interest After expressions of interest are received, Aa review shall be conducted by staff designated by the Executive Director of Facilities Services of all firms responding to determine those firms best qualified for the services desired shall be conducted by the appropriate staff designated by the Executive Director of Facilities Services Planning and Construction as the Superintendent's designee. A minimum of three firms shall be selected for interview from among those responding or on file. The firms selected to be interviewed shall be submitted to the superintendent for approval by the Director of Facilities Planning and Construction. E. Composition of Interview Committee for Selection Purposes The interview, for selection purposes, shall be performed by school staff employees to include five (5) individuals. The staff employees shall consist of the Ssuperintendent's designee who will not be a member of the Office of Facilities Services, the Executive Director of Facilities Services Planning and Construction, the Staff Architect and two individuals designated by the Executive Director of Facilities ServicesPlanning and Construction.

F. Factors to be considered. Factors to be considered for selection purposes are as follows: 1. The expressed desire of the firm to perform the services. 2. Professional qualifications of the staff or design team to be assigned to this project. 3. The extent of specialized experience of the firm in the type of work required. 4. The capacity of the firm to accomplish the work in the required time. 5. The degree of familiarity of the firm and the particular project requirements. 6. Past performance of the firm on similar projects in general and school board projects in particular. 7. Experience and qualification of any consultants to be used by the architect and engineer. 8. Current work volume that will effectaffect the ability to complete the work in the required time frame. 9. Evidence of cost control effectiveness. 10. Familiarity with sustainability practices. GF. Negotiations Negotiations of the agreement shall be initiated with the number-one ranked firm only, and shall be conducted by the Ssuperintendent or his designee and support staff, when appropriate. Should satisfactory terms fail to be reached, negotiations with that firm shall be terminated and initiated with a second, then subsequent ranked firms, until a satisfactory agreement is reached. Negotiations shall be based on a definitive scope of work and period of performance with attendant manpower, material, and service estimates. Established fee schedules or curves shall be used for comparative purposes only, and not as a basis of justification of any proposed fee. HG. Award After an agreement has been negotiated, and upon approval of the division Ssuperintendent or designee, the selected firm shall be recommended to the School Board of the City of Virginia Beach for final approval. The recommendation shall include summary interview and performance evaluation results. Architectural and engineering agreements shall be executed by the division Ssuperintendent or a designee. IH. Performance Evaluation Upon completion of the project, an evaluation of the performance of the architectural and engineering firm may be placed on file to indicate excellence or deficiencies in the service rendered. This information shall be maintained on file for reference purposes in future project awards. Further, it shall be open for review by the subject firm who may tender any observance felt to be appropriate as a matter of record in such files. JI. Exclusions

Contract Execution Policy fFor Capital Improvement Program (CIP) Projects

A. Generally

This Policy establishes a uniform procedure for the review, approval and execution of School Board contracts and contract change orders for Capital Improvement Program (CIP) Projects by officers and employees of the School Board. As used herein, the phrase "School Board contract" means any contract or agreement to which the School Board or School DivisionAdministration is a named party, or to which any authorized school officer or employee enters into on behalf of the School Board or School DivisionAdministration. For execution of contracts which do not involve CIP projects refer to School Board Policy 3-89 "General Contract Execution Policy."

B. Applicability

This Policy shall be applicable only to School Board construction or architectural/engineering (A/E) contracts for CIP projects entered into with any person. For purposes of this Policy, "person" shall be deemed to include any individual, or any corporation, partnership, firm, organization or other group or association of persons acting as a unit. Notwithstanding the above, this Policy shall not be applicable to: 1a) routine contracts of employment budgeted by the School Board and authorized by the Chief Human Resources Officer; 2b) contracts entered into by the Superintendent, with the approval of the School Board Chairman, in response to an emergency provided that the contract does not exceed $300,000, and further provided that the Superintendent documents, in writing, that an emergency exists and that delay in executing the contract will be detrimental to the interests of the School Division; or 3c) contracts covered by School Board Policy 3-89, General Contract Execution Policy.

C. Contract Review and Approval

1. Content

Every contract shall be reviewed by the Executive Director of the Office of Facilities Services Planning & Construction (Director, FSPC) or his/her duly authorized designee. Every contract shall also be signed (or initialed) "approved as to content" by such individual or his/her designee. When an individual signs (or initials) a contract "approved as to content," the individual is representing that he or she: ai) has read the contract;, bii) agrees with the terms and conditions contained therein; : and iiic) is satisfied that the terms and conditions of the contract accurately reflect the agreement that was reached between the parties thereto.

2. Fiscal Note

Every contract shall have a fiscal note attached thereto in a form prescribed by the Office of Business Services. The fiscal note, which must be prepared by the Office of the Office of Facilities Services Planning & Construction, shall provide an estimate of the "total cost to complete" the project, including the contract base cost, and shall compare the "total cost to complete" to the project budget. A copy of the fiscal note shall be provided to the Office of Business Services at the time the contract is prepared. If the contract does not involve the expenditure of funds, the Executive Director, Faclities Services PC or his/her authorized designee, shall indicate "N/A" (not applicable) on the fiscal note and sign or initialshall place his/her signature or initials adjacent thereto.

3. Availability of Funds

Every contract exceeding $30,000 shall be signed or initialed "approved as to availability of funds" by the Director of the Office of Business Services or his/her duly authorized designee. Every contract of $30,000 or less shall be initialed "approved as to availability of funds" by the individual in charge of the department, office or other agency from which the contract originated. If it is determined by the Office of Business Services that there are insufficient funds available to approve the contract, the contract shall be referred back to the Office of the Office of Facilities Services Planning & Construction for a determination as to whether the Office of Facilities Services Planning & Construction desires to request a transfer of the necessary funds for the contract to be approved and executed. If the office decides to request such a transfer, the request shall be forwarded to the Office of Budget Development for appropriate action.

4. Legal Sufficiency

A/E contracts exceeding $30,000 and construction contracts exceeding $50,000 shall be forwarded to legal counsel for review as to legal sufficiency once they have: ai) been "approved as to content;"; bii) had the required fiscal note placed thereon; and c iii) been "approved as to availability of funds."

When legal counsel signs (or initials) a contract as being "legally sufficient," legal counselhe or she is only certifying that the contract complies with all applicable laws, policies and regulations, contains all necessary contractual provisions, and is legally enforceable. Legal counsel is not indicating his/her approval of the contents of the contract or the purposes for which the contract is being entered into.

5. School Board Approval

Prior to contract execution, all A/E proposals exceeding $50,000 and construction bids exceeding $100,000 shall be submitted to the School Board for approval. The following information shall be included with the School Board Agenda item:

a. A/E Proposals

The name of the A/E firm selected, the name of the project, the proposed contract amount and the design budget.

b. Construction Bids

The name of the lowest responsive and responsible bidder, the name of the project along with a description, the proposed contract amount, the construction budget and a summary of the bid results.

D. Contract Execution

Once a contract has gone through the above-stated review and approval process, it shall be forwarded to the Superintendent for final execution:

1. The Superintendent or his/her duly authorized designee shall execute all contracts on behalf of the School Board. In that regard, the Superintendent may delegate in writing the authority to execute contracts on a "contract-by-contract" basis or may establish a written list of the types of contracts that specific designees shall have the authority to execute on an ongoing basis until such time as the delegation is amended or revoked.

2. Notwithstanding any provision herein to the contrary, the Superintendent or his/her designee is not authorized to execute any contract which contains a clause, paragraph or provision ("Provision") designed to "indemnify" or "hold harmless" the provider of goods or services for liability due to negligence or an intentional act of the provider in the performance of the contract. If a contract contains such a Provision, and the service provider will not agree to remove the Provision from the contract, the Superintendent, his/her designee or the purchasing agent shall forward the contract to legal counsel for final resolution.

3. Notwithstanding any provision herein to the contrary, the Superintendent or his/her designee is not authorized to execute any contract which contains a clause, paragraph, or provision ("Provision") agreeing or authorizing either party to submit any dispute arising from the contract or the performance thereof to any alternative dispute resolution procedure, including, but not limited to, arbitration and mediation. If a contract contains such a Provision, and the service provider will not agree to remove the Provision from the contract, the Superintendent, his/her designee or the purchasing agent shall forward the contract to legal counsel for final resolution.

Upon advice and approval of the School Board's legal counsel, the Executive Director, Office of Facilities Services PC may agree to submit any contractual dispute to nonbinding alternative dispute resolution procedures, including, but not limited to arbitration and mediation.

E. Contract Change Order Review and Approval

1. Content

Every change order shall also be signed (or initialed) "approved as to content" by such individual or his/her designee. When an individual signs (or initials) a change order "approved as to content," the individual is representing that he or she: ai) has read the change order; bii) agrees with the terms and conditions contained therein; and ciii) is satisfied that the terms and conditions of the change order accurately reflect the agreement that was reached between the parties thereto.

However, any proposed contract change order on a fixed-price contract for an amount more than twenty-five percent of the contract amount or $50,000, whichever is greatergreater, requires advance written approval by the School Board. Contract change orders may not exceed the appropriated funds for the project.

2. Fiscal Note

Every contract change order shall have a fiscal note attached thereto in a form prescribed by the Office of Business Services. The fiscal note, which must be prepared by the Office of the Office of Facilities Services Planning & Construction, shall provide the cost of the change order and the revised contract amount and shall compare the revised contract amount to the project budget. A copy of the fiscal note shall be provided to the Office of Business Services at the time the contract change order is prepared.

3. Availability of Funds

Every contract change order shall be signed or initialed "approved as to availability of funds" by the Director of the Office of Business Services or his/her duly authorized designee.

If it is determined by the Office of Business Services that there are insufficient funds available to approve the change order, the change order shall be referred back to the Office of the Office of Facilities Services Planning & Construction for a determination as to whether or not the Office of Facilities ServicesPlanning & Construction desires to request a transfer of the necessary funds for the change order to be approved and executed. If the Office of the Office of Facilities Services Planning & Construction decides to request such a transfer, the request shall be forwarded to the Office of Budget Development for appropriate action.

Every contract change order shall be executed by either the Chief Operations Officer, Division ServicesExecutive Director of the Office of Facilities Services or, if unavailable, then by the Chief Operations Officer or the Chief Financial Officer.

F. Compliance with School Board Policies and Regulations

The provisions of this Policy supplement, but do not supersede, other applicable School Board policies and regulations. Therefore, any contract or contract change order that is negotiated, awarded and executed pursuant to this Policy shall comply with any other applicable policies and regulations.

G. Failure to Follow Contract Execution Policy

Any individual purporting to execute contracts who executes a contract or change order on behalf of the School Board without the requisite School Board authority in accordance with this Ppolicy may be held personally liable for any or all of the obligations imposed on the School Board by such contract or change order.

Policy 5-14

STUDENTS

School Attendance AreasZones

A. Generally

Upon the recommendation of the Superintendent, the School Board shall designate school attendance areaszones.

The School Board recognizes that only through effective long-range planning for enrollment can the School Division be adequately prepared to meet the needs of its current and future student population. In order to assure such planning, the School Board establishes procedures which require annual review and recommendations from thea Building Utilization Committee regarding enrollment trends and their impact on School Ddivision facilities and which will assure adequate opportunity for community reaction prior to any redistricting decision by the School Board.

B. Projections

The School Division Ddemographer, under the supervision of the Superintendent, shall:

1. Produce by November 1December 15 of each year, annual updates on the 65-year enrollment projections for the School Division which take into consideration the following:

a. Figures from the latest school census;

b.a. School registration figures;

c.b. Review of forthcoming changes in planning and zoning;

d.c. Review of current and planned community land development and housing projects; and

e.d. Latest available birth data.

2. Coordinate enrollment data, facilities planning, transportation impact and formation of recommendations for review by the Superintendent and the School Board.

C. Process

1. Building Utilization Committee

The Superintendent shall create a Building Utilization Committee, (hereinafter “BUC”) with no more than seven (7) members. The School Division Demographer shall chair theis BUCCommittee. In addition to the Demographer the BUCis Committee shall include a representative from School Leadership, and two or three representatives of the School Board. The Council of Civic Organizations and the PTA Council shall also be invited to name one

member each to serve as members of the BUCuilding Utilization Ccommittee.

2. Review of Projections

Between November 1 and March 15 of each year, the BUCBuilding Utilization Committee, chaired by the Demographer, shall analyze the updated 65-year enrollment projections to determine the impact, if any, of changes in enrollment projections on optimal building utilization and report to the School Board any recommendations. The BUCuilding Utilization Committee shall propose consider a plan for redistricting when building utilization at any school building differs from the optimum building utilization level by exceeding the level by ten (10) percent or by falling below the level by ten (10) percent.

3. Formulation of Redistricting Recommendations

The BUCCommittee will receive, at the onset of its discussions, a proposed redistricting plan developed by the Demographer, which may include a recommendation for no action, to provide a basis from which to move forward in making recommendations. The BUCCommittee shall consider the proposed plan in light of the factors set forth below. While each of the factors must be considered and discussed, it may be impractical to reconcile each factor in the recommendations which will ultimately be presented to the School Board.

a. a. Optimal utilization of space:

1. b. 1) The desire to keep areas commonly known as subdivisions or neighborhoods together;

2. c. 2) The need to develop long term solutions that support limiting redistricting of individual students to one time at each level (i.e. once at elementary, once at middle and once at high school), except in cases of student change in residence;

3. d. 3) Construction considerations (documented new subdivision construction and scheduled school renovation/construction projects);

4. e. 4) The desire to reduce or eliminate the number of middle and high schools with divided feeder patterns if at all possible;

5. f. 5) Transportation considerations (non-transportation zones, hazards, redirection of the number of students riding a bus and reducing the length of bus rides);

6. g. 6) The costs associated with the various options considered;

7. h. 7) The impact of enrollment changes upon course h offerings/subject offerings, equipment needs, building modifications, etc.; and

8. i. 8) The desire is to redistrict as few schools and students as possible.

The BUCCommittee's recommendations will be incorporated into the final redistricting plan prepared by the School Division Demographer.

4.3. Community Input

Before the BUCCommittee's proposed redistricting plan is presented to the School Board for information, the School Division Demographer shall present the proposed plan to the community at one or more community meetings in each area affected by the proposed plan (e.g. a possible single boundary change affecting three schools could be handled by one meeting), where members of the community will have an opportunity to review the plan, to comment on its merit and make suggestions for its improvement.

The BUCuilding Utilization Committee shall consider public comment prior to presentation of the proposed redistricting plan to the School Board.

D. School Board Action

The BUCuilding Utilization Committee shall prepare a final report no later than March 15 of each year. The final report will include the redistricting plan developed by the BUCCommittee, outlining the advantages and disadvantages of the plan. The report will be presented by the chair, or designee, of the BUCCommittee to the School Board for information at a meeting no later than the second School Board meeting in March.

Prior to taking action on the BUCCommittee’s proposed redistricting plan, the School Board must hold a public hearing not less than ten days after reasonable notice to the public in a newspaper of general circulation if the redistricting of school boundaries affects fifteen percent or more of the pupils in the average daily membership in the affected school. Such public hearing may be held on the same day as the School Board meeting at which action on the plan is taken as long as the hearing is held before action is taken.

E. Definitions

1. Optimum Building Utilization: the division-wide building utilization, considering optimum capacity, adjusted at the site level, for the average two-year historical growth or decline in membership from September 30 to March 31.

2. Building Utilization: the actual percentage use of optimum program capacity, factoring in the number of inaccessible first seats by grade level.

3. Optimum Capacity: 90% of the program capacity of the school building reported, used for planning purposes due to fluctuations in class sizes throughout the school year.

3.4. Program Capacity: the maximum capacity of the school building for a particular school year and particular student population, taking into account the number of first seats in the building (without counting portables currently on site) updated annually.

4.5. First seat: an instructional space within the physical plant of the a school building in which students receive core and primary instruction. Self-contained special education classrooms are also considered to be first seats.

F. Attendance Area Zone CriteriaExceptions

The Superintendent shall ensure that students attend the schools that serve the attendance zone of their home residence as established by the School Board. The Superintendent shall develop proceduresa mechanism to verify that students attend their assigned actual attendance areaszones for students. A student needing an exception to attendance zones in order to attend a school may request an out-of-zone transfers. Criteria for out-zone transfers may be found under School Board Regulation 5-14.1. Additionally, the Superintendent or designee shall ensure that no school which exceeds its optimum building utilization by ten or more percent receives out-of-zone students unless approved by the Superintendent or his/her designee under established regulations.

1. 1. The Superintendent shall ensure that students attend the schools that serve their attendance area as established by the School Board, except An individual student may apply for an out-of-zone transfers in the instance where; (a1) redistricting decisions affect an individual student more than one time at a school level (i.e. at the elementary school level at the middle school level or at the high school level);, or except (b2) in cases of a student change in residence. Additionally, the Superintendent or designee shall ensure that no school which exceeds its optimum building utilization by ten or more percent receives out-of-zone students unless approved by the Superintendent or his/her designee under established regulations. The Superintendent shall develop a mechanism to verify actual attendance areas for students.

2. Children of School Board employees will be allowed to attend the school to which such parent or guardian reports or is their primary assignment pending approval of the school principal and such enrollment will be exempt from the school’s optimum building utilization by ten (10) percent or more requirement. Employees who live out of the City of Virginia Beach will be required to pay tuition according to the provisions set forth in School Board Regulation 5-10.1.

3. A student may be transferred out-of-zone when the student’s presence in the school poses a significant disruption to the educational environment or to the safety of students or staff at the school. Upon recommendation of the Director of Student Leadership, the Department of School LeadershipAssistant Superintendent may review the student’s placement and make a decision to transfer the student to another school or an alternative educational setting. Transportation to the designated out-of-zone school may be provided. The adult student or the minor student’s parent/legal guardians may appeal the Department of School Leadership’s Assistant Superintendent’s decision to the Superintendent within five (5) calendar days of notification. The Superintendent or designee will review the matter and make a final, written, unappealable decision. Any such placement will be for the current school year. Such transfers are exempt from the optimum building utilization level as stated in section F-1 of this Policy.

G. Last Year Options

Upon the establishment of new attendance zones by the School Board, rising fifth, eighth and twelfth graders shall be permitted to continue in their previously assigned

INSTRUCTION

Driver Education

Driver education will be made available to all eligible students according to the Code of Virginiaprovisions of Virginia law and Virginia Board of Education regulations.

Students under age eighteen (18) will not receive a driver's license unless they meet the coniditiions set forth in applicable law and regulation. provisions of § 46.2-334 of the Code of Virginia as cited in the legal reference to this policy.

The School Board may establish fees for the behind-the-wheel phase of the instructional program.

INSTRUCTION

Title I Program

A. Generally In Title I schools, supplemental instruction shall be offered to students demonstrating the greatest academic need as determined by multiple criteria.

B. Title I - Equivalency/Comparability To assure that state and local services are provided in Title I schools at least equivalent to such services in non-Title I schools, these policies will be observed by in the Sschool Ddivision.

1. Salary Scales The division-wide salary scales will be applicable to all staff whether assigned to Title I or non-Title I schools.

2. Assignment of Teachers, Administrators and Auxiliary Personnel Assignment of teachers, administrators and auxiliary personnel will be made in such a way to assure that the numbers of students per staff person in Title I schools shall be equivalent to the average number of students per staff person in relevant comparison schools (i.e., non-Title I or other Title I schools). Any variance greater than the 10% allowed in equivalency computation will result in appropriate action to achieve the allowable ratio.

3. Curriculum Materials and Instructional Supplies Curriculum materials and instructional supplies will be provided to schools with the same grade spans on a per pupil cost factor to assure that all studentschildren have access to the same level of state and local resources regardless of whether they attend a Title I or non-Title I school.

C. Title I - Parental Involvement 1. Parents/legal guardians of the studentschildren being served by Title I shall have the opportunity to participate in the planning, design and implementation of the project. The goals of parental/legal guardian involvement include the following:

2. Parents/legal guardians of Title I Sstudents will be provided with information about the following components of the program. All materials will be sent home in readable format and in a native language if possible. Information will include:

8. b. Instructional goals for the studentchild;.

9. c. Progress of the child;.

10. d. Strategies, materials, and training for providing help at home to work with the student child to improve the studentchild’s achievement;.

11. e. Opportunities for volunteer assistance to teachers/studentschildren;.

12. f. Curriculum measurements for academic achievement, special activities, parental f. involvement procedures and other information that is helpful to parents/legal guardians; .

13. g. VirginiaState Standards of Learning which can be accessed through the school division website at www.vbschools.com.;

14. h. Notification of meetings and other activities that encourage parental involvement. (See Sschool Ddivision website at www.vbschools.com);

15. i. Assistance to parents/legal guardians in understanding assessments and how to monitor their studentchild’s progress.

16. j. Materials and training to help parents/legal guardians work with their studentschildren;.

17. k. Efforts to educate all stakeholders in the value of good home-school communication;.

18. l. Coordination of parental involvement programs with other fFederally funded programs.

INSTRUCTION

Summer School

A. Generally

Summer school programs may be operated under the direction of the Superintendent. Summer schools shall be designed to: enrich the education of students; who so desire, ;to provide remediation to students in areas of need;, and to permit students to earn credits needed for graduation or promotion.

The Ssummer Sschool program shall be equal in quality to that offered during the regular school term. A standard credit for students taking a summer school courses for the first time shall be based upon a minimum of 140 clock hours of instruction. Credit for students repeating a course shall be based upon a minimum of 70 clock hours of instruction. A verified credit for summer school courses shall be based upon a minimum of 70 clock hours for those repeating a course or 140 clock hours of instruction for first time course takers, and the achievement by the student of a passing score on the end-of-course Standards of Learning test for that course.

Virginia Board of Education requirements for an accredited summer school shall be met.

B. Fees

Summer school programs shall be financed by fees as determined by the School Board.

MOTION: That the Board adopt a motion to recess into a closed meeting pursuant to the exemptions from open meetings allowed by Section 2.2-3711, Part A, Paragraphs 1 & 7 of the Code of Virginia, 1950, as amended, for

A. Personnel Matters: Discussion of or consideration of interviews of prospective candidates for employment, assignment, appointment, promotion, performance, demotion, salaries, disciplining, or resignation of specific public officers, appointees, or employees, pursuant to Section 2.2-3711, (A) (1); namely to

1. hold a hearing on the Petition to Revoke Collegiate Professional Teaching License for a former teacher; and

2. to make a determination on the Petition to Revoke Collegiate Professional Teaching License for a former teacher.

B. Legal Matters: Consultation with legal counsel and briefings by staff members or consultants pertaining to actual or probable litigation where such consultation or briefing in an open meeting would adversely affect the negotiating or litigating posture of the Board or consultation with legal counsel employed or retained by the Board regarding specific legal matters requiring the provision of legal advice by such counsel, pursuant to Section 2.2-3711 (A) (7); namely to discuss procedures for a hearing on Petition to Revoke Collegiate Professional Teaching License for a former teacher.

WHEREAS, the School Board of the City of Virginia Beach has convened a closed meeting on this date pursuant to an affirmative recorded vote and in accordance with the provisions of the Virginia Freedom of Information Act; and

WHEREAS, Section 2.2-3712 (D) of the Code of Virginia requires a certification by this School Board that such closed meeting was conducted in conformity with Virginia law.
