THE UNIVERSITY OF JOHANNESBURG PRESENTS: “ North, South and in-between: Fairness, transparency and emerging themes in insurance” FRIDAY, 19 AUGUST 2016 The most recent emphasis on transparency in insurance and pressure on financial services providers to transact in a way that is fair increasingly emphasises the duties of financial services providers. In South Africa, it has become apparent from recent decisions that it is often those who sell insurance who have to perform their duties in a way that is transparent and fair. Insurance companies on the other hand still conduct their business in very much the same way they always have. The question therefore remains whether there is not perhaps an imbalance between the duties pertaining to transparency and fairness that rest on brokers and advisors and those that rest on insurers. This is just one of the many difficulties in modern-day insurance law. This one-day conference aims to canvass a number of issues, namely: Commission structures and the influence of these on miss-selling. Challenges posed to the international re-insurance market. What does the recent shift to fairness mean for consumers and insurance companies? Will the emphasis on fairness change the way in which insurers conduct their business? How does new legislation aim to incorporate principles of fairness? Is transparency a value that is embedded in current and proposed insurance legislation? The role of default legal rules in insurance The keynote speaker for this conference is Dr. Souichirou Kozuka, Professor of Law from the Gakushuin University in Japan. Other speakers will be selected from abstracts. These may be forwarded to Prof Daleen Millard ([email protected]) and Prof Birgit Kuschke ([email protected]) before 13 May 2016. Speakers will be notified of the acceptance of their abstracts by 16 May 2016. The early bird registration fee for speakers and delegates is R1 200 and this is payable by 30 May 2016 by the latest. The fee for registrations after 30 May is R1 800 per delegate. Details of payment methods will be communicated in due course. Registration fees include coffee, tea, lunch, a cocktail function and a cultural excursion. The venue in either Pretoria or Johannesburg (depending on number of delegates) will be confirmed during June. The conference organisers, Daleen Millard and Birgit Kuschke, are professors in insurance law and co-authors of the South African Monograph on Insurance law in the International Encyclopedia of Laws and members of the International Insurance Law Association (AIDA) and its South African Chapter.
