My boyfriend and I lived together for over two years, had two kids, then broke up and now I want to get sole custody and guardianship. What’s the difference between custody and guardianship?If you and your spouse were never married, you will be applying for a court order under the provincial Family Law Act (FLA). Under the FLA there is no such thing as custody. That term is now only reserved for married spouses who apply under the Divorce Act in Supreme Court. Under the FLA you and your boyfriend, because you lived together with the children, are both presumed to be guardians. As the guardians of the children, you are presumed to share all parental responsibilities for your children unless you agree or the court otherwise orders. Section 41 of the FLA outlines a list of 12 broad parental responsibilities such as, deciding where the children will live, who the children will associate with, what extracurricular activities they will participate in, and their religious and cultural upbringing. You and your spouse can share all of the parental responsibilities in consultation with one another, divide them up between you or one of you can have them all. If you cannot agree on how the parental responsibilities will be shared, you can apply to the court and have a Judge decide.

Ultramarathoning the worldCouple ultraruns for health, adventure, and the sheer sport of it

Some couples like to run together for exercise.

Others will tackle a marathon or two together. Jacqueline Windh and Dave Gilbert of Port Alberni take their mutual love of running to the extreme: they are ultramarathoners.

An ultramarathon is any race longer than a marathon, which is 42.2 kilometres (26 miles). Ultra distances start at 50 kilometres, and there are standards of 50 miles (80 kms), 100 kms, 100 miles and even 200 miles, says Windh.

Windh and Gilbert have competed and participated in ultraruns around the world.

“Ultrarunning is one of the fastest-growing sports in North America right now,” says Windh.

She and Gilbert, both 50, love the sport for the personal achievement as well as the adventure

tourism aspect. “There are some places you can only get to on foot. Through my international ultramarathon races I have experienced places and people that almost no other

tourist would be able to even get to,” she says.

“For example, being immersed in the Costa Rican jungle, alone on a red mud trail with all of those jungle sounds above you, for hours…that is the real

jungle experience and it’s a feeling that no one on a bus tour or boat tour to the jungle could ever get.”

Another experience has stayed with her, from the third day of a five-day race she participated in

Himalaya. The run started high on a ridge line that serves as the border between Nepal and India, with views of Mount Everest. The trail descended along steep rocky trails for hours, down into the valley, emerging at

last in a remote jungle village.

“It was great interacting with the women in these villages, and the kids,” she says. “The locals here only see foreigners one day a year, the day the racers run through their village.

“That day was one of the best days of my life.”

Windh got into ultramarathoning “in a strange way,” she says. A writer and photographer, she started reporting on endurance races in 2005.

“I realized I’d get much better photos if I could run down the trails a way, instead of just hanging out at transition areas or aid stations and getting photos of runners on the roadside or in a parking lot,” she relates.

“So I started training, and it grew from there. I worked up and ran my first marathon in 2007, when I was 43.”

Marathons are typically run on roads, which Windh says is “kind of boring running, as well as hard on your joints. So it was a natural move for me to get into ultramarathons, which are nearly always run on trails.”

Gilbert grew up in the Alberni Valley and has been running and mountain biking its trails since he was a teenager. He used to race Ironman triathlons (which combine swimming, cycling and running). “When we got together, just over three years ago, I got him off the road and onto the trails,” says Windh.

transition for him because he already had the endurance and strength—he is faster than me.”

Earlier this month Windh returned from Patagonia, in South America, where she completed a 70K race in 19 hours, winning her 50-plus age group and placing in the top half overall.

The couple completed their first 50-miler at Sun Mountain, Wash., on the May long weekend in 12:02 hours. “I had problems with both my knee and my Achilles tendon which slowed me down so we walked the final 20K,” she said.

They don’t normally participate in back-to-back races so close together because their bodies need the down time.

“We probably do two or three ultramarathon races

a year, plus maybe a couple of marathons or half-marathons,” says Windh. “But we also go to ultramarathon runs that are not races. A few years ago, we ran up to Della Falls and Love Lake and back in a day. Last July I ran the Juan de Fuca Trail (47 kms) in a day, solo,” she says.

“Next month we plan to run the whole West

Coast Trail, 75 kms, in a day.”

Windh and Gilbert are avid trail runners and advocates for the trail system in the Alberni Valley. They can often be found running, hiking or walking the local trails for recreation, exercise or training. Gilbert is a board member for Vancouver Island Spine Trail

Association (VISTA) and they both plan to attend the opening of the latest phase for the Inlet Trail on May 24.

“We have the best trails—a pretty much unlimited network, if you count all the connections via the logging roads,” says Windh. “Many ultrarunners are at a disadvantage because they don’t have hills to train on where they live, but that is definitely not a problem here. And our trails are just so beautiful—Dave and I and the dog are on trails like Rogers Creek and the Inlet Trail several times a week.

“Our popular running blog, www.daveandjackierun.wordpress.com, profiles Port Alberni’s trails as well as our international adventures, and has an ever-growing international

readership—11,000 views last year and increasing,” says Windh.

The couple will share a slideshow and stories about their ultramarathoning adventures on Tuesday, May 26 from 7–9 p.m. at Char’s Landing in Port Alberni.

Their slideshow will feature photos from races they have done all over the world: Himalayas, Costa Rica, Patagonia, Guadeloupe, British Columbia and Washington State.

“We will also talk about some of the crazy things you experience while running such long races—ranging from intense pain to exhilaration to hallucinations,” she says.

“Hopefully we can be an inspiration to people.”

For the love of the game: baseball captures hearts

I met my husband 20 years ago through a mutual friend who played

on his baseball team.“Tell him Shippy

says hi,” Ken James said after suggesting I look up his teammate at my new place of employment. “Maybe he’ll introduce you to some people.”

I thought that was a good idea and after a few days on the job I e-mailed Paul Welbourne, also

known as “Nuke” to Ken and the rest of their team. Even though he worked in a different building than I did, we arranged to meet for coffee at the end of the day.

At the time Paul was a pitcher in a competitive men’s league with the Vancouver Pharaohs. He also played softball with a group of work pals I met after our coffee.

We became fast friends and I soon learned how passionate his family was for the sport. His nieces and nephews played in T-Ball and little league, his sisters played when they were younger, and his father played for many years—and by the time I met him he was a provincial commissioner of Babe Ruth Baseball.

Since then Gord Welbourne has been honoured by the

Coquitlam Sports Hall of Fame and the Babe Ruth Hall of Fame for his 45 years of service for the North American association.

Even Grandpa Charlie was a ball player and heavily involved in growing the sport in Burnaby before and after the Second World War.

But now the only one in the Welbourne clan who plays ball regularly is our 11-year-old daughter, Daisy. Without any coaxing from us, she felt it was her destiny and joined the Westside Outlaws in the Westside Minor Fastball Association three years ago.

Initially she wasn’t always focused and it wouldn’t be unusual to see her doing cartwheels in the outfield. But in the lastyear she’s suddenly become more serious about the sport.

Imagine this: One day you develop a sharp back pain. Like most you wait a bit to

see if things get worse or improve. You might research for possible answers or ask family or friend advice.

With no change you see your doctor. Your friends and family check back with you, asking how they can help you to manage.

Now imagine this: One day, you wake up and realize that emotionally, you’ve been feeling different. You’re not sure what it is, but you and others notice you’re acting differently. You are not yourself.

Two months later,

the feelings are getting worse, but you still haven’t asked for help. You think this can’t be serious, it’s all in your head, get over it. You reason that it’s your personality, age or stress. Things you try on your own don’t help. Or you suspect what it could be. So you keep it to yourself and just try to get by day to day, hoping it will change.

According to the Canadian Mental Health Association (2015), about one in five people—more than six and a half million Canadians—experience a mental illness or substance use problem in their lifetime. Unfortunately, 60 per cent of people with a mental health problem or illness don’t ask for help. They feel

ashamed, scared and stigmatized.

Stigma occurs when people experience negative attitudes or stereotypes because others have judged their behaviours and conclude them to be abnormally “different”. In fact, most people living with mental illness say that the stigma they experience is worse than the symptoms of their illness they feel.

Stigma is why we treat our mental health so differently from our physical health.

In 2010, Michael Inzlicht of the University of Toronto

reported on a study called “Negative Stereotypes Stick with You”. He concluded “even after a person

leaves a situation where they faced negative stereo-types, the effects of coping with

that situation remain. People are more likely to be aggressive after they’ve faced prejudice in a given situation. They are more likely to exhibit a lack of self-control. They have trouble making good, rational decisions. And they are more likely to over-indulge on unhealthy foods.”

A “Catch 22” for any person trying to make positive change…..the very behaviours people are trying to manage are the very behaviours that are being triggered by everyday people around them.

Everyday people seem to need to engage in ‘armchair diagnosis’ with physical conditions but more commonly, with mental conditions. Trained by the school of daytime TV medical shows and with limited knowledge, people feel free to make judgments about another’s health status on the basis of a few behaviours.

People seem to think they are qualified to practice psychiatry/psychology/counselling because

they know and are comfortable with the use of diagnostic terms. This is without even understanding what those terms truly mean, or how they marginalize people, pathologize perfectly normal behaviour and offensively force people out of conversations.

The fact is, many people with mental illness walk around unnoticed and undetected. Someone with bipolar disorder can have a high-energy day and it’s not mania. It’s just a good mood, one like other people have and the result of things going well.

Sometimes people with depression have down days that aren’t about biochemistry, have everything to do with stuff going

sideways and being a grump. People without mental illness do things that are weird. Children don’t talk to their parents; people get snappish, or sad. None of these things are evidence of mental illness. They’re evidence of being human, because this is what it is like to be alive.

People can, and do, recover from mental illness/difficulties. The earlier people get help, the better the outcome. So if you or someone you know appears to be having difficulty with their well-being, speak with a doctor (GP), medical health professional or a therapist/counsellor.

on getting better. As a result of her improvements, as well as those of all her teammates, the games have become more interesting to watch.

The most exciting one I’ve witnessed personally happened at a recent tournament in Summerland when her team was down 12 runs in the last inning of the finals.

We didn’t think there was much of a chance they’d win a medal at that point, but after Daisy’s friend, Sammi, shut down their opponents with her superb pitching, and the entire team came together to make an incredible comeback with a bunch of runs, they unexpectedly had a chance to win.

It was one of those nail-biting experiences

I’ll never forget. With two outs, and the bases loaded it was Daisy’s turn up at bat.

Standing on the sidelines I felt increasingly stressed as each pitch was thrown. It felt like slow motion to me as I tried to telepathically send her a message to relax, have fun and go for it. Finally, the decisive moment that would determine a win or loss for the Outlaws was upon us.

With two strikes and three balls, my

daughter stood at home plate ready for the last pitch. As the girls and the coach cheered her on, affectionately calling her “Crazy”, my friend’s dad yelled “Here’s your chance to be a hero.”

I held my breath, the ball was thrown, and Daisy swung at it with everything she had, plowing it straight down the middle to the outfield, as the girls on base ran

into home, winning the game. It was tremendously exciting and one of those timesI wish a video camera had been rolling.

It was also one of those moments that has Daisy feeling her family’s passion for baseball even more than she already did.
