Broward Metropolitan Planning Organization February 11, 2016 Meeting

REQUESTED ACTION:

MOTION TO APPROVE Amendments to the Rules of the Broward MPO WHY THIS ACTION IS NECESSARY:

Action on the above item is needed to complete the expansion of the MPO voting membership and to update other related items within the Rules. THIS ACTION ADDRESSES:

Strategic Direction Education/Development Goal 2: Strengthen Board Decision-making Capacities. SUMMARY EXPLANATION/BACKGROUND:

On April 9, 2015, the Broward MPO Board approved moving forward on a Third Amendment to

the Interlocal Agreement, allowing for the expansion of the MPO voting membership from 19 to 25 voting members. The proposed Third Amendment was then forwarded to the respective Parties/Member Governments to the Interlocal Agreement to adopt and execute. The MPO is currently in the process of obtaining the final signatures of the required Parties. Once the signatures are obtained, the Third Amendment to the Interlocal Agreement will be recorded in the Public Records of Broward County.

In order to complete the expansion of the MPO’s voting membership, the Rules of the Broward MPO must be amended to incorporate the changes to the voting structure. In addition to these changes, MPO staff is proposing related changes and updates to advisory committee structures and other housekeeping items. Attachment 1 contains the proposed amendments to the Rules of the Broward MPO in a strikethrough and underline version. Attachment 2 contains the proposed amendments to the Rules of the Broward MPO in a clean version.

The expanded MPO Board voting structure will go into effect once the Third Amendment to the Interlocal Agreement is recorded and the amendments to the Rules are approved. MPO staff and General Counsel will provide an update on the recording of the Interlocal Agreement at the February 11, 2016 meeting.

MPO staff recommends approval of the Amendments to the Rules of the Broward MPO.

REQUESTED ACTION:

PUBLIC MEETING and MOTION TO APPROVE Amendments to Commitment 2040, the Broward MPO’s 2040 Long Range Transportation Plan (LRTP) ***Roll Call Vote Required*** WHY THIS ACTION IS NECESSARY:

As per federal requirements, adding, deleting or major changes to existing projects, funding or language within an adopted LRTP’s Cost Feasible Plan require amendments to that Plan. THIS ACTION ADDRESSES:

Strategic Direction Multimodal Improvements Goal 1: Establish Vision for Multimodal Systems. TECHNICAL COORDINATING COMMITTEE (TCC) AND COMMUNITY INVOLVEMENT ROUNDTABLE (CIR) RECOMMENDATIONS: The TCC and CIR recommend the Broward MPO approve the amendments to the 2040 LRTP. SUMMARY EXPLANATION/BACKGROUND: On December 11, 2014, the Broward MPO adopted its 2040 LRTP, known as Commitment 2040.

Since the adoption, several changes are needed to the Plan.

The Town of Southwest Ranches has requested two amendments to the 2040 LRTP in order to: 1) remove the SW 188th Avenue extension project between 63rd Street and Sheridan Street and 2) modify the SW 184th Avenue project between Griffin Road and Sheridan Street from a four-lane roadway to a two-lane roadway. Currently, the Plan includes the roadway extension for SW 188th Avenue funded within the 2026-2030 time period and the construction of SW 184th Avenue as a four-lane roadway funded within the 2031-2040 time period. Attachment 1 is the required formal request from the Town of Southwest Ranches which includes a letter from the Town Administrator and two resolutions adopted by their town council requesting the two LRTP amendments.

As part of the Federal Certification of the Broward MPO last year, the Federal review team identified three (3) corrective actions which require modifications/amendments to the MPO’s LRTP. Attachment 2 provides an excerpt from the Federal Certification Report describing these corrective actions. Noteworthy Practices and other Recommendations by the Federal review team also are provided in the attachment for information.

Attachment 3 is the Commitment 2040 excerpt pages for the changes made to the Cost Feasible 2040 LRTP to address the amendments described above. 6

Per federal regulations, a public review and comment period is provided. Opportunities for the public to speak were provided at the January 27, 2016 meetings of the Technical Coordinating Committee (TCC) and the Community Involvement Roundtable (CIR) and will be provided at the February 11, 2016 MPO Board meeting. To view the public notice for these meetings, please see Attachment 4. At the time of the agenda mailing, the MPO has received comments regarding the Southwest Ranches amendment. See Attachment 5.

MPO staff recommends approval of the amendments to the Broward MPO’s 2040 LRTP. MPO staff will be available to address questions and comments at the meeting.

REQUESTED ACTION:

DISCUSSION AND MOTION(S) Regarding Local Surtax Options to Fund Transportation and Infrastructure Needs WHY THIS ACTION IS NECESSARY: Discussion and direction from the Board is needed in order for MPO and partner agency staff to move forward in pursuit of an appropriate surtax option. THIS ACTION ADDRESSES: Strategic Direction Revenue/Funding Goal 1: Increase Funding for Transportation Improvements. Objective 1: Develop a local option tax plan. SUMMARY EXPLANATION/BACKGROUND: Funding transportation and infrastructure has become increasingly difficult. The Federal Highway

Trust Fund, financed primarily by a tax on gasoline, is receiving less money annually based on a dated funding mechanism. If the Broward region is to have the means to further develop its transportation system and provide the necessary infrastructure to sustain its current residents and seasonal population, as well as attract business, it will need to look locally for future funding.

Much discussion has occurred at MPO meetings regarding funding shortfalls and discretionary sales surtax options to better serve the residents of Broward. To this end a Local Surtax Subcommittee was created for Board members to discuss and examine the surtax options more closely. Two discretionary sales surtaxes are available to Broward to fill the transportation funding gap: the Charter County and Regional Transportation System Surtax and the Local Government Infrastructure Surtax. A Local Funding Options Fact Sheet, provided in Attachment 1, explains the differences between the two options. On February 4, 2016, MPO staff presented a Compromise Transportation Surtax Option to the Local Surtax Subcommittee for consideration. After much discussion, the Local Surtax Subcommittee motioned to approve the Compromise concept to be considered by the MPO Board at their February 11, 2016 meeting. Attachment 2 provides information regarding the Compromise Transportation Surtax Option.

Unified Planning Work Program (UPWP) FY 2016/17 - FY 2017/18: Request for Input from Municipalities and Transportation Operating Agencies This item provided for information only. No action is required. SUMMARY EXPLANATION/BACKGROUND:

The Broward MPO’s Unified Planning Work Program (UPWP) describes the transportation planning activities and studies to be performed by MPO staff, its consultants and partner agencies (when applicable). Federal regulations require the development of a UPWP in metropolitan areas as part of the transportation planning process. The regulations require MPOs to work in cooperation with FDOT, transportation operating agencies and local partners to develop the Program.

The FY 2016/17 – FY 2017/18 UPWP covers two years starting on July 1, 2016 and ending on June 30, 2018. Development of the FY 2016/17 – FY 2017/18 UPWP begins by requesting input regarding activities, subjects, and/or studies that need to be included in the upcoming two-year UPWP. Please see the Attachment for more information on this request. Partner agencies anticipating the use of federal funds to conduct major planning studies should include these study efforts in the MPO’s UPWP.

The current UPWP is available online at www.browardmpo.org/programs/unified-planning-work-program to provide guidance on the types of transportation planning projects included in the UPWP. Please send your requests to Michael Ronskavitz. The contact information is provided below. A Draft FY 2016/17 – FY 2017/18 UPWP will be available in late February or early March 2016.

Broward MPO staff will be at the meeting to answer questions and receive comments.
