Transfers
BUNDLE REQUIREMENTS The DMV workweek is Monday Through Sunday. All bundles are due to SambaSafety the following Wednesday by 5pm. Bundles must include the paperwork for all transactions from the previous week. Bundles must be sent to SambaSafety using a tracking delivery method such as FedEx, or DHL, and carry a unique tracking number.

DAILY BUNDLE REPORT ASSEMBLY 1. Print a daily Bundle Report on plain copy paper as your cover sheet for the day’s work. Remember-
one bundle equals one day’s transactions.2. DMV file copies must be printed on DMV file copy paper.3. Include all transactions processed in CA EVR for the day with the same bundle report printed for that
day.4. Assemble each bundle and all associated documents in the same order as shown on the bundle
report cover page5. Verify that all required documents are audited and included, before sending the Bundle Reports to
ADR.6. Copy the bundle for DMV record retention.7. Bundles must be secured with paper or binder clips. No staples or tape on any documents. CA DMV
does not accept paperwork with staples or tape.8. Bundle each day separately with the bundle report cover page on top and attach the days
corresponding transactions behind the bundle cover sheet (attach with paper or binder clips).9. Keep Bundle Reports in a secure, locked location in your office until ready to send all your week’s
work.

TRANSFERS Order of Documents
Each transaction requires the documents to be assembled as listed below:
1. DMV File Copy printed on DMV Paper
NOTE: For Set RDF, only include DMV File Copy2. Title (ORIGINAL TITLE ONLY) or Application for Duplicate Title (REG 227)
3. Vehicle Report or Current Registration Card
• Required for Filing for Duplicate Title (REG 227)
4. Statement of Error or Erasure/Statement to Record Ownership (REG 101)
• Required if errors or corrections are made on title
• Clarifies ownership for multiple transfers
5. Vehicle Vessel Transfer/Bill of Sale (REG 262) (ORIGINAL ONLY)
• Required for processing an Application for Duplicate Title (REG 227)
• Required for correcting title odometer statement errors
6. Statement of Facts (REG 256)
Section A: Required when transferring a vehicle as a gift or family transfer as Use Tax
Exemption
Section B: Required for a SMOG exemption

Section C: Required for processing a Transfer Only (Non Op)
7. SMOG Certificate – For smog information visit: dmv.ca.gov and search “Smog Rules”
8. Any other supporting documents, for example:
• Non Resident Military – REG 5045
• Indian Reservation – REG 256A Section C
• Special Transportation Vehicle Exemptions – REG 345
• Gross Vehicle Weight Declarations – REG 4008
• Dealer Report of Sale (Dealer Transactions Only)
Corporate to Corporate or LLC Transfers
• If the vehicle owner is a corporation – a copy of the Board of Director’s Resolution authorizing the
change. 1 copy may be accepted for a fleet.
• Need to bring in the titles – the owner’s new name must be printed in the new owner section of
the back of the title – a signature is NOT required.
• If there is a Legal Owner – the name and address must be printed on the back of the title.
Gifts from or to a Corporation or Partnership
An applicant who gives or acquires a vehicle/vessel as a gift to or from a corporation or partnership must pay use tax or submit a BOE 111 or a BOE 111B.

USE TAX AND RECLASS CODES Family Exemption:
Transfer between a parent, child, grandparent, grandchild, spouse, domestic partner, or minor siblings. No value required and must be free of liens. (Requires REG 256 family box checked).
Exempt from Use Tax and Reclass:
Addition or deletion of a family member; spouse, domestic partner, parent [s], son/daughter, grandparents, grandchildren. No value required and must be free of liens (Requires REG 256 Addition/Deletion box checked).
Gift Transfer:
Transfer between two individuals with no money involved. Value required and must be free of liens. A gift is NOT a trade or transfer of contracts or other valuable consideration. (Requires REG 256 gift box checked and value listed or value and word gift in purchase price on 9B back of title).
Dealer Transfer:
Transfer with a dealer number (sold through a dealership) and is exempt from sales tax (they pay on a state quarterly return). Requires dealer to be added to your account with the DMV. Please submit your request through EVR under Account Maintenance and select Dealers.
Lessor to Lessee Transfer:
Transfer from a leased vehicle to the lessee as the registered owner. Sales tax is collected by the leasing company. No sales tax is due, and a value is not required.
Use Tax – No Reclass: Sales tax is due, and a value is required.
• Transfer from a leased vehicle to the lessee as the registered owner. Sales tax is NOT collectedby the leasing company.
• Any transfer where money exchanges hands and one of the registered owners remain on the titleas the new registered owner.
Use Tax and Reclass: Sales tax is due, and a value is required.
• Transfer from the registered owner to another registered owner and monies exchanges hands.
• Including vehicles traded between individuals, transfers of contracts or other valuableconsideration.

CRITICAL ERRORS Requests for Voids on Critical errors shall be done immediately! If the critical error is identified before 4:30 pm on the day it was keyed, please submit a request to void your transaction. We will work with DMV to have the transaction voided. If we cannot get the transaction voided, or if it is after hours or on the weekend please fax all documents to:(916)-852-8010.
A critical error is defined as: 1. Wrong Registered Owner2. Missing a Registered Owner3. Missing the Lienholder4. Keying the wrong Lienholder5. Keying a Lienholder when there should be none6. Transferred the wrong vehicle
All other keying errors are not critical errors. These errors can be corrected by retrieving the title from your client and sending it to SambaSafety with a REG 256 Statement of Facts, Section G, describing the error and the correction needed. Once you have all the required documents to make the correction, send them in a separate envelope with your bundles. Label the envelope: Error Correction
SIMPLE TRANSFER A transfer between 2 people where one person receives money for the vehicle and another person gets the title and vehicle. A trade of 2 vehicles would be considered a transfer. On the transfer tab make sure, to select "Use Tax and Reclass" and have the correct purchase price or value of the vehicle.

Effective Jan 1, 2021 odometer is required for vehicles less than 20 model years beginning with the model year 2010. The odometer compliance area must be filled out and signed by both the seller and the purchaser. Make sure this is the mileage you key into the system.
The registered owner(s) must sign lines 1A and/or 1B to release their interest. Remember 2 signatures are required

MULTIPLE TRANSFER A multiple transfer is when a vehicle is sold more than once (other than dealer to dealer) without a new title being issued.
• The name, address, and signature for all buyers on the California Certificate of Title. However, asigned Vehicle/Vessel Transfer and Reassignment Form (REG 262) and the printed name of allbuyers on the Certificate of Title may be accepted in lieu of the written signature of previousbuyers on the title.
Important: The current buyer(s) to whom ownership of the vehicle is beingtransferred must sign the Certificate of Title.
• The fees due. A transfer fee is due for each buyer. However, only the last transfer is subject to atransfer penalty. Use tax paid by a previous buyer cannot be used for any fees due for asubsequent buyer.
• Identify the chain of ownership by writing “I,” “II,” etc., in front of each buyer’s name on the titleand the REG 262.

Backside of Certificate of Title – Multiple Transfer
Effective January 1, 2021 odometer disclosure is required for a vehicle ownership transfer for vehicles less than 20 model years old beginning with the model year 2010 and newer. The information keyed into the system will be based on the final buyer, in this scenario it would be buyer III. Remember Reg 262's must always be originals, they can be ordered under controlled items in the EVR system.

vehicles more than 20 model years old beginning with the model year 2009 do not require Reg 262's for a multiple transfer. Use a Reg 101 statement to record ownership to record additional owners that do not fit on the back of the title. Remember the final buyer must sign somewhere on the back of the title.

DEALER TRANSFER California dealers and lessor-retailers have 30 days from the date of sale to submit on the Report of Sale–Used Vehicle (REG 51) form the transfer application and fees for used vehicle without penalties (CVC §9553(c)(1)) and/or administrative service fee (ASF). This includes nonresident vehicles and vehicles on which the registration expired while in dealer inventory.
Note: This does not apply to vehicles with penalties due or accrued prior to the date of sale to the dealer or lessor-retailer (CVC§9553(c)(2)). Penalties continue to accrue unless the fees and penalties due are posted by the dealer.
In addition to the procedures listed in the Basic Transfer Requirements, the following must be submitted:
• The dealer’s endorsement on the California Certificate of Title• The dealer’s Report of Sale–Used Vehicle (REG 51) form
Each dealer’s name and a countersignature or initials must be entered for dealer reassignments on the title. When there is insufficient room for all dealer transfers in the dealer reassignment section, a Vehicle/Vessel Transfer and Reassignment Form (REG 262) is required. The dealer name and number should be included on the REG 262.
A REG 51 is not required to register a vehicle taken in trade by the dealership.

COMPANY SIGNATURES Company and/or Business Names—The endorsement for a company or business name, including a leasing company, must include the company/business name and an authorized representative’s countersignature or initials. The DMV does not require proof that the person is an authorized representative of the company/business.
Countersignatures—A signature or initials only as the countersignature for a company or business on any document is acceptable. DMV does not require proof that the person is an authorized representative of the company/business.

REPO TITLE A repossession is a vehicle that the bank takes back from the registered owner for nonpayment of their loan. The bank will resale the vehicle using the form Reg 119. California titled vehicles will be processed as a transfer in the EVR system. Navigate to the registration tab and key the repossession date in the field "repossession date". This will charge the appropriate repossession fee to your client. Remember only the lien holder can fill out the repossession form. They will sign on the title for the registered owner using the Word "repo".

ERRORS ON TITLE In the event you make a mistake filling out the title, a Reg 101 is used to correct the mistake. The Reg 101 cannot be used to correct a mileage error (Reg 262). The Reg 101 has 2 purposes; to record errors and to record ownership. To correct an error, we would use the Single line though the mistake and write the correct information on the title next to it. The title has a number next to each line for required information (except for the odometer) list the line number on the Reg 101 and state what the mistake was and the corrected information. If there is not room on the title use a Reg 101 "statement to record owner" to list the correct information.

TRANSFER LEGAL OWNER Transfer legal owner is when a registered owner wants to remove the lien on their vehicle, add a lien to their vehicle or change the lien on their vehicle. The only information filled out on the title is section 2 on the front of the title (lien holder release) and sections 11, 12 and 13 for the new lien holder. The registered owner does not release their ownership on lines 1A and/or 1B and they do not fill out the back of the title as the new owner, this area is for when there is a change of registered owner only.
To remove the lien:
• Lien holder signs off on front of title line 2 (title front)• Registered owner writes the word "none" on line 11 (title back) and initials it
To add a lien:
• Registered owner signs line 2• Registered owner fills out the new lien holder information on lines 11, 12 and 13 and initials it
Changing from 1 lien holder to another lien holder:
• Lien holder signs off on front of title line 2• Registered owner fills out the new lien holder information on lines 11, 12 and 13 and initials it

PERSONALIZED PLATES Personalized plate function is located on the New Owner tabs
Click on the Personalized Plate Information + to open the functionality.
It will expand so you can enter the plate information you are assigning to the vehicle.
